Abstract

This research includes library research with a normative research approach because it examines laws and regulations related to patent regulations in the United States. Patent rights in the United States are regulated in the America Invents Act (AIA) of 2011 and Article 154a (1) and (2) Title 35 of the United State Code America (USCA), especially the Contents And Term Of Patent Section; Provisional Rights. Based on these provisions, the Meta Party (Facebook) filed an objection to the patent ownership owned by Voxer. However, the Texas Court's decision stated that Facebook must pay around US $ 174 million or around Rp. 2.6 trillion to Voxer for alleged patent infringement.

Abstract

Sexual violence is an act of coercion by the perpetrator on his victim. Children as victims suffer mental loss that is disturbed and has excessive fear. this violence occurs in the private sphere (family), even though the family sphere is always considered as a safe place for children. Based on this, it can be drawn what are the factors that cause the occurrence of rape against children in the family sphere (incest) and how efforts in the protection of the law against children as incest victims according to the perspective of Viktimology. This research method uses normative research , the purpose of this research is to find out the factors that cause sexual violence in children and also to know what efforts can be given in child protection. The result  of  the discussion  that the causative factor consists of  two  factors, namely the external and internal factors. Factors of close relationship between victims and perpetrators can be the cause of sexual violence. As for environmental factors that are not good can be one of the other factors. Therefore, it is necessary to protect the child so that the child receives his rights and what the child needs. In Law No. 23 of 2002 on Child Protection has regulated the rights of children.

Abstract

The development of digital technology has brought significant transformation to business practices while simultaneously generating new potential disputes that require adaptive resolution mechanisms. In Indonesia, the emergence of the electronic litigation system (e-court) offers a formal court-based solution, while non-litigation mechanisms based on Online Dispute Resolution (ODR) provide a more flexible, fast, and efficient alternative. However, these two mechanisms still operate partially without a clear integration framework, raising questions about the effectiveness of digital business dispute resolution. This article addresses two research problems: (1) how the development and implementation of e-court and ODR in resolving digital business disputes in Indonesia have evolved, and (2) what harmonization model can be established to create a more comprehensive, efficient, and just dispute resolution mechanism. The findings show that e-court has provided legal certainty and formal legitimacy but remains limited to time-consuming litigation processes. Conversely, ODR meets the needs of efficiency and speed but faces challenges in regulation and the acceptability of decisions. The discussion highlights the importance of a harmonization model that integrates the strengths of e-court in terms of legal formality with the flexibility of ODR in non-litigation processes. Harmonization can be pursued through the establishment of regulations recognizing ODR as part of the judicial system, strengthening digital infrastructure, and enhancing legal literacy among disputing parties. Thus, harmonizing these two mechanisms is expected to address the challenges of digital business dispute resolution in the era of technological transformation.

Abstract

This study aims to analyze the implementation of Pancasila values within the Corporate Social Responsibility (CSR) programs of PT Telkom Pekalongan, particularly those oriented toward environmental sustainability. The research is grounded in the urgency of integrating corporate social responsibility with the foundational philosophy of the state, which emphasizes a balanced interplay among social, economic, and environmental dimensions in sustainable development. Employing a qualitative method with a case study approach, the study seeks to obtain an in-depth and contextual understanding of the phenomenon. Data were collected through in-depth interviews, field observations, and documentation analysis of the company’s CSR initiatives. The findings demonstrate that the value of Divinity is reflected in the ethical commitment to environmental preservation, the value of Humanity is manifested in efforts to enhance public awareness of a healthy environment, the value of Unity is realized through multi-stakeholder collaboration, the value of Democracy is evidenced by community participation in planning and implementation processes, and the value of Social Justice is embodied in the equitable and sustainable distribution of program benefits. These findings affirm that the internalization of Pancasila values in CSR policies functions not merely as normative legitimacy but also as an effective institutional strategy for strengthening corporate sustainability governance and contributing substantively to sustainable development.

Abstract

Penelitian ini bertujuan untuk menganalisis keterwakilan perempuan dalam Kelembagaan Adat Dayak di Kota Palangka Raya dalam perspektif hak sipil dan politik serta prinsip non-diskriminasi. Latar belakang penelitian didasarkan pada fakta empiris bahwa seluruh Damang Kepala Adat di Kalimantan Tengah berjenis kelamin laki-laki, meskipun Peraturan Daerah Nomor 16 Tahun 2008 tidak secara eksplisit membatasi berdasarkan jenis kelamin. Penelitian ini menggunakan pendekatan yuridis empiris dengan teknik wawancara mendalam terhadap 12 informan (Damang, mantir adat, tokoh perempuan adat, dan akademisi), observasi partisipatif, serta analisis dokumen normatif. Data dianalisis melalui analisis tematik dengan triangulasi sumber. Hasil penelitian menunjukkan bahwa norma patriarki struktural membatasi representasi perempuan secara substantif. Dalam perspektif teori representasi politik Pitkin, keterlibatan perempuan masih bersifat deskriptif dan belum mencapai representasi substantif. Secara normatif, praktik tersebut berpotensi bertentangan dengan Pasal 28I UUD 1945 dan prinsip CEDAW mengenai penghapusan diskriminasi terhadap perempuan. Kontribusi penelitian ini terletak pada integrasi analisis pluralisme hukum dan teori patriarki dalam konteks kelembagaan adat Dayak serta rekomendasi ius constituendum untuk reformasi regulasi daerah.

Abstract

This study examines the urgency of reconstructing the principles governing legislative drafting in Indonesia in light of the Constitutional Court’s formal review of the Job Creation Law, particularly concerning the omnibus law model. The research addresses two central issues: (1) the implications of the Constitutional Court’s formal review decision for the legislative drafting process; and (2) whether the principles stipulated in Article 5 of Law No. 12 of 2011 on Law-Making are adequate to ensure legal certainty within Indonesia’s dynamic legislative framework. This research employs a normative juridical method, utilizing statutory and conceptual approaches, and is analyzed through a prescriptive legal framework. The findings indicate that the high frequency of judicial review, the phenomena of overregulation, regulatory overlap, and normative disharmony reflect the absence of anticipatory and responsive dimensions in the legislative process. The Constitutional Court’s decision, including the presence of dissenting opinions, underscores the necessity of more adaptive procedural standards capable of responding to evolving legal and societal demands. This study proposes the reconstruction of Article 5 of Law No. 12 of 2011 by incorporating anticipatory and responsive principles as normative instruments to enhance legislative quality and strengthen legal certainty. The scholarly contribution of this research lies in the conceptual formulation of integrating anticipatory and responsive principles into the framework of national legal development.

Abstract

The implementation of Public Information Disclosure (Keterbukaan Informasi Publik/KIP) and public participation in the formulation of the Regional Spatial Plan (RTRW) of West Kalimantan Province for 2024–2044 continues to face structural and procedural challenges. Although Law Number 14 of 2008 on Public Information Disclosure guarantees the right of access to information, the practice of drafting the RTRW reveals a significant gap between legal norms and their empirical implementation. This study employs an empirical legal method with a socio-legal approach, conducted from January to August 2024, involving 18 informants comprising local government officials, members of the Regional House of Representatives (DPRD), academics, and representatives of civil society. Data were collected through in-depth interviews, document analysis, and participatory observation, and were examined using Arnstein’s Ladder of Citizen Participation as an analytical framework. The findings demonstrate that proactive disclosure of strategic documents, particularly the Strategic Environmental Assessment (KLHS) and the draft Regional Regulation (Raperda), remains inadequate through official governmental channels. Public participation mechanisms tend to be procedural and formalistic, falling short of the principles of public information disclosure, Free, Prior and Informed Consent (FPIC), and meaningful participation. Previous studies have not specifically examined the implementation of public information disclosure in the formulation of regional spatial planning regulations using Arnstein’s participatory framework, thereby leaving an empirical gap at the subnational level. The novelty of this research lies in integrating normative analysis of public information law with an empirical assessment grounded in participation theory to determine the actual degree of participation. Formally, participation reaches the level of consultation (tokenism), yet substantively it descends into therapy or manipulation (non-participation). These findings underscore the urgency of restructuring spatial governance to ensure substantive transparency and participatory legitimacy in regional policymaking.
