Abstract

The phenomenon of the high number of foreign workers (TKA), which is increasing every year in Indonesia, especially in the Central Sulawesi region, of course, means that the supervisory function carried out by the Central Sulawesi Province Manpower and Transmigration Service will be increasingly strict. However, since the existence of the Job Creation Law, employment agencies have changed the supervisory function of TKA. The research aims to analyze the role of the employment service in carrying out the supervisory function of foreign workers entering the Central Sulawesi region after the existence of the Job Creation Law. The research method used in this research is Normative Juridical research, which will examine the role of the employment department's supervisory function from changed aspects of the Job Creation Law. To examine how the law should apply. where based on cases in the field, researchs try to analyze facts and also applicable legislation. The research results show that the supervisory function of the Manpower Service after the existence of the Job Creation Law still provides a mandate similar to the Manpower Law. However, in its implementation, as an institution appointed by the state that has the task and function of issuing IMTA (Permits to Employ Foreign Workers), it has now been revoked by the Job Creation Law. The regulations regarding foreign workers after enacting the Job Creation Law underwent significant changes. Keywords: Employment Service; Supervisory Function; Job Creation Law

Abstract

Minimarket di daerah-daerah yang menyediakan kebutuhan sehari-hari masyarakat dapatmenjadi solusi untuk memenuhi kebutuhan-kebutuhan tersebut karena letak minimarket yang biasanya strategis serta produk yang dijual biasanya lengkap dan memudahkan konsumen untuk mencari produk yang diinginkan. Adapun contoh minimarket yang beroperasi di Indonesia adalah Alfamart. Alfamart merupakan minimarket yang menyediakan kebutuhan sehari-hari bagi masyarakat. Perlindungan hukum terhadap konsumen terkait ketidakjujuran karyawan pada struk belanja Alfamart di Kota Makassar menunjukkan bahwa perlindungan hukum yang dilakukan adalah dengan penyelesaian mediasi oleh BPSK atau di luar pengadilan hal ini ditempuh karena ada itikad baik dari pelaku usaha dengan meminta maaf secara langsung kepada konsumen, serta konsumen memilih menyelesaikan masalahnya melalui luar pengadilan karena menganggap bahwa jalur tersebut lebih memudahkan terlebih lagi konsumen belum sepenuhnya memahami hak-haknya yang telah diatur oleh UUPK sesuai dengan Nomor 8 tahun 1999 tentang Perlindungan Konsumen dalam pasal 4 (b). Serta Pertanggungjawaban karyawan terkait ketidakjujuran pada struk belanja Alfamart di Kota Makassar menunjukkan bahwa pertanggung jawaban yang diberikan adalah diselesaikan dengan cara musyawarah antara pihak Alfamart dan konsumen yang dirugikan, dan Alfamart selaku pelaku usaha memberi permohonon maaf kepada konsumen yang telah dirugikan haknya yang di atur dalam UUPK.

Abstract

Penelitian ini bertujuan untuk menganalisis kebijakan hukum pidana dalam pertanggungjawaban pidana oleh korporasi di Indonesia, dan untuk menganalisis penerapan sanksi pidana terhadap korporasi yang melakukan tindak pidana korupsi dalam hukum positif di Indonesia. Penelitian ini merupakan jenis penelitian yuridis normatif, dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Sedangkan untuk metode analisis data yang digunakan adalah metode deskriptif, metode evaluatif, dan metode Argumentatif. Hasil dari penelitian ini menerangkan bahwa kebijakan hukum pidana dalam pertanggungjawaban pidana oleh korporasi di Indonesia lahir dari adanya perbuatan melawan hukum a criminal act (actus reus) dan terpunihinya unsur kesalahan a criminal intent (mens rea) sehingga dari segi objektif terhadap perbuatan yang dinyatakan sebagai tindak pidana yang berlaku dan secara subjektif kepada korporasi sebagai pelaku tindak pidana yang memenuhi persyaratan untuk dapat dikenai pidana karena perbuatannya. Serta penerapan sanksi pidana terhadap korporasi yang melakukan tindak pidana korupsi dalam hukum positif di Indonesia diatur dalam ketentuan Pasal 2 dan Pasal 20 UU No. 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi, yang memberikan pemahaman bahwa pertanggungjawaban pengganti dapat diterapkan jika masih dalam kewenangan pimpinan korporasi serta mengatur penerapan pidana pokok hanya dapat diganti dengan pidana denda serta pidana tambahan 1/3. Abstract

Abstract The implementation of the civil servant mutation policy in the context of the needs of regional government organizations in Gowa Regency is a strategic action carried out by the regional government to transfer employees according to the needs of certain units or departments. Thus, the goal to be achieved is to increase the efficiency and effectiveness of public services by placing employees in positions that suit their abilities and competencies. The research used is field research. This research uses qualitative analysis, intending to provide a systematic description of a phenomenon, symptoms and conditions that occur as well as explaining precisely the conditions that are related to the variables studied. The resulting data shows that the civil servant mutation process must be enforced with strong legal protection, which ensures that all stages of mutation take place fairly, openly and in accordance with applicable regulations. Legal protection for civil servants who experience transfers by the regional government in Gowa Regency includes several important aspects, such as: 1) Principle of Legal Certainty; 2) Transparent Procedures; 3) Consultation and Clarification; 4) Protection from Discrimination and 5) Appeal Mechanism. Abstract

Research Objective: This study examines the Territorial Principle within Islamic Criminal Law, focusing on jurisdictional boundaries and enforcement of Islamic punishments for non-Muslims under Islamic governance. Research Methodology: The research employs literature review methodology, analyzing primary and secondary sources addressing territorial jurisdiction in Islamic legal traditions and examining contemporary implementation case studies. Results: The research identifies divergent jurisprudential positions: Imām Abū Ḥanīfah restricts enforcement to Muslim territories with discretionary authority granted elsewhere, while Imām Malik, al-Syafi'ī, and Imām Ahmad advocate universal application emphasizing individual responsibility over geographical boundaries. Findings and Implications: Implementation of territorial principles in regions like Aceh reveals jurisdictional conflicts between local Islamic law and national legal frameworks, creating inconsistencies that challenge legal coherence within pluralistic governance structures. Conclusion: Diverse interpretations of territorial jurisdiction create practical challenges in contemporary legal systems. Achieving legal harmony requires balancing local religious-legal autonomy with national legal coherence. Contribution: This research provides systematic analysis of territorial jurisdiction principles in Islamic criminal law and their contemporary applications, enhancing understanding of how classical Islamic legal principles operate within modern governance structures. Limitations: The study relies exclusively on literature review methodology without empirical data collection. The research primarily examines theoretical jurisprudential positions rather than comprehensive case studies across multiple jurisdictions. Suggestions: Future research should explore comparative legal mechanisms navigating jurisdictional tensions between religious and secular systems. Abstract

Research Objective: This study investigates the significant abandonment of Islamic Criminal Law by examining its adaptability to contemporary contexts. It seeks to challenge the assumption that this legal framework is separate from modern legal systems through a historical analysis of Islamic jurisprudential influences on global punishment frameworks. Research Methodology: Employing a normative legal framework, the research adopts both conceptual and comparative approaches, specifically analyzing theft punishments within Islamic criminal law, Indonesian positive law, and Iranian positive law. Results: The comparative analysis reveals that, although all three legal systems share a common objective of deterrence, they employ distinct methodologies for punishment: Indonesian law predominantly utilizes imprisonment, Islamic law prescribes hand-cutting as a form of deterrent, and Iranian law implements a graduated system that ranges from finger-cutting to imprisonment. Findings and Implications: This research demonstrates that, despite the methodological differences in punishment approaches, each legal system bases its sentencing decisions on contextual factors, including the nature of the crime, the offender's background, and specific circumstances. Conclusion:  While these legal systems share a fundamental goal of deterrence, they reflect different philosophical frameworks and cultural contexts. This underscores the idea that Islamic Criminal Law can be interpreted in a contextual manner, despite its distinctive punishment methods. Contribution: This study enriches jurisprudential discourse by challenging misconceptions regarding the contemporary relevance of Islamic Criminal Law. Limitations: The study's emphasis on a single category of offense restricts a comprehensive analysis of broader criminal law approaches. Suggestions: Future research should expand comparative analyses to encompass additional legal systems and a wider range of offenses

Abstract

Research Objective: This study seeks to identify the key components of an Islamic identity as derived from the Qur'an, aimed at fostering the development and preservation of Muslim youth.  Research Method: The study utilized an inductive approach, analyzing the Qur'an to extract components of Islamic identity pertinent to youth development. Results: The findings reveal that Islamic identity is defined by its core belief system, a unified connection to a global ummah, and a profound influence on both the private and public lives of Muslims. Findings and Implications: The identified components specifically address significant threats that Muslim youth encounter in their efforts to preserve their Islamic identity, including peer pressure, assimilation, materialism, corrupt desires, religious doubt, societal disconnection from religion,  and Islamophobia. These components serve as vital anchors for establishing and maintaining the faith of young Muslims.  Conclusion: Understanding and developing an Islamic identity is essential for Muslim youth to uphold their faith, particularly during challenging times.  Contribution: This research enhances our understanding of how an Islamic identity, rooted in Qur'anic teachings, can assist Muslim youth in navigating contemporary challenges to their faith and identity within diverse social contexts. Limitations and Suggestions: While the abstract highlights potential ramifications of failing to preserve Islamic identity, such as loss of trust and engagement in oppression and sin, it does not explicitly address the research limitations or offer specific suggestions for further inquiry in this area.

Abstract

Research Objectives: This study explores electronic sex, or "e-sex," among couples, focusing on its various forms, types, motivations, justifications from the participants, and the associated risks. Research Method: The research utilizes a descriptive, analytical, and deductive approach to examine this contemporary phenomenon within the framework of Sharia law. Results: The study concludes that the practice of electronic sex between spouses is fundamentally prohibited due to the inherent dangers and ethical issues that contradict the core objectives of Sharia. Findings and Implications: The findings suggest that permission for such practices is granted only in specific cases and under strict supervision. This implies that exceptions can be made, but they must adhere to strict parameters. Conclusion: The primary purpose of marriage in Sharia law is to foster deep enjoyment between spouses. However, contemporary practices like electronic sex generally violate Sharia principles unless strictly controlled under necessary conditions. Contribution: This research enhances Sharia jurisprudence by examining new forms of marital relationships that have emerged during the contemporary information revolution, thereby providing legal guidance on issues previously unaddressed within Islamic law. Limitations and Suggestions: The study acknowledges that failure to adhere to the required controls necessitates consideration of the alternative solutions proposed. It also suggests further exploration of these alternatives and their implementation within a Sharia-compliant framework.

Abstract

  Research Objective: The study aims to provide a comprehensive overview of Islamic legal perspectives on zakat for savings and to clarify the requirements and conditions under which zakat should be paid on savings and interest earned from bank deposits. Research Methodology: The study employs the Uṣūl al-Fiqh methodology, utilizing comparative techniques through literature reviews and analysis of current societal trends, examining both classical Islamic jurisprudence and contemporary interpretations. Results: The research findings reveal that zakat must be paid on bank savings if they meet established criteria in zakat regulations. Regarding interest earned on savings, zakat should be paid according to the views of scholars who permit accepting interest. Findings and Implications: The study provides comprehensive analysis offering valuable insights into zakat obligations on savings and interest, serving as guidance for Muslims seeking to adhere to Islamic law in their financial practices. Conclusion: The research concludes that specific Islamic legal requirements exist for paying zakat on both savings and interest earnings, with different scholarly perspectives influencing their application. Modern banking practices can be reconciled with traditional zakat obligations through careful jurisprudential analysis. Contribution: The study bridges classical Islamic jurisprudence with contemporary interpretations regarding zakat obligations on modern banking practices. This research fills a critical gap by offering practical guidance for contemporary Muslim financial conduct while maintaining scholarly rigor in Islamic legal analysis. Limitations: The research primarily relies on existing literature without empirical analysis of actual zakat practices among contemporary Muslims. focus may limit practical applicability across diverse socio-economic contexts. Suggestions: Future research should incorporate empirical studies examining zakat payment behaviors among Muslim savers and investors. Comparative cross-cultural analysis would enhance understanding of how different Islamic societies interpret zakat obligations on modern financial instruments.

Abstract

Research Objective: This study examines law enforcement measures against rupiah bill mutilation by Bank Indonesia's Malang office, analyzing legal frameworks and enforcement strategies. Research Method: The study employs an empirical juridical approach with a sociological emphasis on law. Data were collected through interviews, document analysis, and a literature review. Results: Bank Indonesia Malang implements public education, awareness initiatives, formal warnings, and inter-agency collaboration to address currency mutilation. Findings and Implications: Currency mutilation violates Law No. 7/2011 on Currency and Islamic law principles. Offenders face imprisonment, fines, and other sanctions reflecting the economic significance of currency protection. Conclusion: Indonesia maintains a comprehensive legal framework against currency mutilation. Bank Indonesia Malang actively enforces these regulations through preventive and punitive measures within national and Islamic legal structures. Contribution: This research documents practical enforcement strategies, examines regulatory implementation at regional levels, highlights Islamic legal principles, and provides a reference for comparative studies. Limitations and Suggestions: Geographic focus on Malang limits generalization. Future research should compare multiple regions, measure awareness campaign effectiveness, explore technological solutions, examine cross-jurisdictional enforcement, and assess public compliance with currency protection regulations.
