Abstract

This study explores women's contributions to addressing environmental issues through a thematic analysis of QS. Al-A'raf: 56 and QS. An-Nisa': 32. Environmental issues are not only considered damage to nature, but also moral and spiritual problems arising from exploitative mindsets. Through a literature review and analysis of Quranic texts, this study finds that the concept of khalifah in Islam is inclusive and does not distinguish between men and women, so that both genders have equal responsibility in preserving the sustainability of the earth. QS. Al-A'raf: 56 emphasises the ethics of prohibiting environmental destruction as a form of piety towards Allah, while QS. An-Nisa': 32 recognises women's equal rights and contributions in all aspects of life, including environmental management. Women play an important role through concrete actions at the family and community levels, such as waste management, planting crops, educating the younger generation about environmental values, and actively participating in cleanliness campaigns through social media platforms. This study concludes that the principles in the Quran provide a strong basis for recognising and strengthening the role of women as agents of change in environmental conservation efforts. Further research is recommended to be based on empirical data and to integrate the Quranic perspective into structured and sustainable environmental programmes with the active involvement of women.

Abstract

This study explicitly addresses the research question of whether Islam universally prohibits women’s leadership or permits it within a maqāṣid al-syarī‘ah framework through an integrative bayānī, burhānī, and ‘irfānī approach. The research employs a qualitative library-based method by analyzing Qur’anic exegesis, hadith, classical and contemporary fiqh literature, and recent academic scholarship. The findings demonstrate that key texts, particularly QS. al-Nisā’ [4]:34 and related hadith, are context-bound rather than universally prohibitive, while rational and empirical analysis confirms that leadership legitimacy is determined by competence, justice, and public welfare rather than gender. Furthermore, the ‘irfānī approach emphasizes leadership as a moral and spiritual trust grounded in integrity and piety. The study concludes that women’s leadership is compatible with Islamic principles insofar as it fulfills the objectives of maqāṣid al-syarī‘ah, including justice, human dignity, and social welfare. Abstract

Abstract

Abstract

Classical Islamic jurisprudence establishes financial support (nafkah) as an absolute obligation for husbands, which serves as the foundation for traditional inheritance distribution. However, contemporary Muslim family dynamics are increasingly defined by role reversals, where wives often become the primary breadwinners, creating tension between textual legal norms and the reality of substantive justice. This study aims to analyze the juridical implications of these role reversals on a wife's inheritance status by reinterpreting the principles of qiwāmah and maqāṣid al-syarī‘ah. Utilizing a normative-contextual legal research method, this study finds that shifts in economic roles necessitate a re-conceptualization of inheritance proportions—one no longer based solely on gender, but on the distribution of actual economic burdens. The urgency of this discussion lies in the need for Islamic law to remain relevant in resolving contemporary family disputes. The findings contribute theoretically to the development of Ahwal al-Syakhshiyyah and provide practical guidelines for religious courts in upholding substantive justice in family asset distribution.

Abstract

This study examines the fulfillment of children's rights in Indonesian Migrant Worker families in Lelong Village, Central Praya District, from the perspective of maqasid al-shari'ah, focusing on the rights to livelihood (nafkah), education, and custody (hadhanah). Using a qualitative case study approach, data were obtained through in-depth interviews, observation, and documentation with five PMI families. The findings show that the fulfillment of children's rights is partial and varies across families. The right to livelihood is fulfilled but fluctuates depending on the continuity of remittances. The right to education is formally fulfilled but faces obstacles in academic supervision. The right to custody is functionally fulfilled by substitute caregivers but lacks optimal emotional closeness. From the maqasid al-shari'ah perspective, the fulfillment of children's rights in PMI families has not yet fully realized the ideal objectives of shari'ah, particularly in protecting the soul (hifz al-nafs), intellect (hifz al-'aql), and lineage (hifz al-nasl). This study also reveals the gender dimension, where female caregivers (mothers, grandmothers, or other female relatives) bear a double burden in substitute caregiving while also managing the household economy.
