Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum konsumen perbankan oleh Otoritas Jasa Keuangan menurut hukum positif dan untuk menganalisis peran Ototritas Jasa Keuangan dalam memberikan perlindungan hukum kepada konsumen menurut hukum positif. Penelitian ini merupakan penelitian hukum normatif. Hasil penelitian menunjukkan Pertama perlindungan hukum konsumen perbankan oleh Otoritas Jasa Keuangan yang diatur dalam Undang-Undang No.8 Tahun 1999 tentang Perlindungan Konsumen, Undang-Undang No.3 Tahun 2004 tentang Perubahan atas Undang-Undang Nomor 23 Tahun 1999 tentang Bank Indonesia, Undang-Undang No.21 Tahun 2011 Tentang Otoritas Jasa Keuangan, Peraturan Otoritas Jasa Keuangan No.1/POJK.07/2013, Peraturan Otoritas Jasa Keuangan No.1/POJK.07/ 2014, serta dalam Surat Edaran Otoritas Jasa Keuangan No.2/SEOJK.07 /2014. Kesemua Aturan tersebut memberikan perlindungan hukum konsumen perbankan tentang pemenuhan hak-haknya serta dalam usaha memberikan perlindungannya secara preventif maupun represif. Kedua, Masih lemahnya norma hukum yang mengatur tugas pengawasan oleh Otoritas Jasa keuangan yang dapat dilihat pada Pasal 8 Undang-Undang No. 21 Tahun 2011 Tentang Otoritas Jasa Keuangan, yang menjabarkan kewenangan tugas pengaturan Otoritas Jasa Keuangan, sedangkan pada Pasal 9 menjabarkan kewenangan Otoritas Jasa Keuangan dalam  melaksanakan tugas pengawasan, akan tetapi dalam pasal tersebut terdapat kekaburan norma antara tugas pengawasan dan pengaturan.

Abstract

Stressing toward civil servant discipline in the era of reformation and autonomy by government is a positive response to achieve a world class governance of Indonesia government. Based on the view,  it can be formulated problem as follows as: How is the regulation of civil servant discipline in the laws in Indonesia? How is the procedure of civil servant disciple sanction in Indonesia? This research is a normative law research with using law,  conceptual,  and case approach. From the research can be concluded as follows as: (1) Law norm formulation in article 3 number 11 of government regulation number 53 year 2010 about coming work obligation and obey to the work hour and its description are a vague law norm formulation,  not clear,  not complete and hard to apply and give more dispensation to the high rank official to do more interpretations in the execution. (2) The membership structure of personnel Board (Bapek) based on the government regulation number 53 year 2010 contains of minister and high rank official who has a lot of work to do,  and need much cares,  energies,  times are potential to hinder the Bapek meetings and legality of Bapek decree. (3) Law norm formulation in the head regulation of personnel state board number 21 year 2010 on enclosure of character E about discipline law conveyance number 7 is a vague law norm formulation and not clear.Keywords: Civil Servant Discipline,  Personnel law.

Abstract

Sebelum berlaku Undang-Undang Administrasi Pemerintahan (UUAP), gugatan-gugatan advokasi publik seperti class action apalagi actio popularis (citizen law suit) sulit untuk diajukan di Peradilan Tata Usaha Negara (Peratun). Namun, seiring dengan perluasan kewenangan Peratun untuk menguji tindakan faktual pemerintah serta perluasan kriteria objek sengketa di Peratun. Kajian ini disusun secara yuridis normatif dan hasil kajian menunjukan bahwa gugatan-gugatan advokasi publik terbuka lebar peluangnya untuk dapat diajukan dan dijadikan salah satu alternatif model gugatan di Peratun. Perluasan kewenangan Peratun membuka akses keadilan publik dalam perkara-perkara kepentingan publik.

Abstract

According to article 17 (2) of the Constitution of Republic of Indonesia: “ministries are appointed and dismissed by President”, the appointment of a minister is president’s authority. Based on this article, the appointment of a vice ministry then will be a part of president’s authority as well. Hence, it is necessary to stress that the appointment of vise minister is not contrary to the constitution. In relation with the legal stand of vise minister, article explanation 10 of Law No 30 of 2008 stipulates: “vise minister is career official and not cabinet member”. In its decision, constitutional court considers that such article explanation is not conformed to the article 9 (1) of Law No 30 of 2008, because the latest article explains that the ministerial structure consists of:  minister, leading assistance i.e., general secretary, the primary task executor, i.e. general directory, inspector, i.e. general inspektorat, back-up task i.e. central and local agent as well as the primary task executor at local level and, or, abroad by deputy in accordance with the regulations. If the vise minister appointed as a career official then he/she no longer has any position, and that’s not conformed to the ministerial structure, that is also incompatible with article 9 of Law No 39 of 2008. This fact brings about the legal uncertainty and it’s contradicted to article 28D (1) of the Constitution of Republic of Indonesia.  According to constitutional court decision No. 79/PUU-IX/2011, its fulfills a part of the pleader’s request on judicial review to article 10 Law No 39 of 2008 on state ministries by nullifying the explanation of the such article because it contrasts to the constitution and hasn’t any legal force. In its decision, constitution court also instructs president to amend the old presidential decision in order that it’s conformed to executive authority and does not bring about legal uncertainty.Keywords: The Vice Minister’s , Legal Standing, Constitutional Court Decision

Abstract

Mengacu pada Undang-Undang Nomor 11 tahun 2012 Tentang Sistem Peradilan Pidana Anak dan Peraturan Pemerintah Republik Indonesia Nomor 65 tahun 2012 Tentang Pedoman Pelaksanaan Diversi dan Penanganan Anak Yang Belum Berumur 12 (dua belas) Tahun. Dalam penerapan Diversi terhadap anak yang berkonflik dengan hukum penyidik menggunakan konsep restorative justisce dengan melibatkan pelaku dan korban serta pehak terkait denga prinsip kepentingan terbaik terhadap anak. Pada tingkat penyidikan anak yang menjadi pelaku tindak pidana penyidik dalam waktu 1x24 jam penyidik wajib meminta pertimbangan kepada Pembimbing Kemasyarakatan Bapas dan Pekerja Sosial profesional  untuk melakukan pendampingan saat pemeriksaan sampai dengan  penerapan diversi. Penyidik wajib mengupayakan Diversi dalam waktu 7 (tujuh) hari setelah dilakukan penyidikan. Kesepakatan Diversi Pada tahap penyidik dapat berbentuk perdamaian dengan atau tanpa ganti kerugian, menyerahkan kembali kepada orang tua, keikutsertaan dalam pendidikan atau pelatihan di lembaga pendidikan dan pelayanan kemasyarakatan. Pada tingkat penyidikan apabila berhasil dilakukan Diversi penyidik menyerahakan hasil kesepakat Diversi ke pengadilan Negeri untuk untuk dikelurkan penetapan Diversi. Kata Kunci: Penyidik, Diversi, Anak Yang Berkonflik Dengan Hukum

Abstract

This thesis entitled force executorial administrative court ruling and the implications in practice, discusses the mechanism of execution of the decision of the Administrative Court, the obstacles in the process of execution of the decision of the Administrative Court and the efforts that are made to the administrative court ruling that is not carried by the official / TUN Agency . This type of research is normative and assisted legal research / materials reinforced with empirical law in order to simplify and refine the analysis . The approach used is legislation approach , conceptual approach , approach cases , comparative approach . So that research results can be drawn that the mechanism of execution of court decisions TUN namely : Decision inkracht , after 60 working days the defendant did not perform its obligations , the decision has no legal force again and turns 90 working days of the obligation is not performed , the plaintiff filed a petition to the President of the Court order the court ordered defendant to implement the decision of the court , the defendant is not willing to implement the decision inkracht forceful measures imposed in the form of payment of a sum of money and forced or administrative sanctions and announced in local print media by him, since non-compliance of the court and the chairman shall submit to the President as the highest authority for TUN ordered officials to implement the court’s decision . So there was a bottleneck in the execution of the ruling Justice TUN namely : Verdict Amar , execution barriers TUN official verdict is due to the position of Regional Chief Political Officer , execution barriers TUN official verdict caused the accused are officials who received the delegation of authority false , barriers of understanding TUN officials the State ‘s theory of law and AAUPB , technical barriers , barriers juridical ; Barriers related to legal principles , barriers in terms of the limited authority of judges , Barriers due to changes in the system of regional autonomy , Barriers due to noncompliance TUN officials and effort to do the administrative court ruling are not carried by the official / TUN Agency as criminal Attempts by the police to file a criminal report with the basic law 216 of the Criminal Code and civil efforts filed a lawsuit in state court using Article 1365 of the Civil Code as the basis for a lawsuit .Keywords : executorial power , Mechanisms , Barriers and Efforts .

Abstract

Tujuan dilakukannya penelitian ini adalah menawarkan bentuk pola komunikasi pada situasi konflik dalam urusan sengketa tanah adat pada masyarakat Cek Bocek Salesek Reen Sury di Kabupaten Sumbawa. Penelitian ini menggunakan pendekatan konstruktif dengan metode penelitian kualitatif. Metode pengumpulan data dilakukan dengan wawancara mendalam (indepth interview) dan observasi partisipan (overt-participant)guna mendapatkan data yang akurat dari informansesuai dengan kebutuhan dan pada situasi orang-orang yang diteliti mengetahui kehadiran peneliti dalam bentuk interaksi dan percakapan (conversation).(Kriyantono, 2014, h. 111). Di Desa Lawin Kabupaten Sumbawa terdapat kelompok masyarakat adat Cek Bocek Salesek Reen Sury hidup secara turun temurun sejak tahun 1512 yang menggantungkan hidupnya dengan Hutan Dodo. Di wilayah Hutan Dodo terdapat tanah konsesi petambangan PT. Newmont Nusa Tenggara seluas 1. 127, 134 Ha berdasarkan dokumen Kontrak Karya (KK) yang ditandatangani pada tanggal 2 Desember 1986 melalui persetujuan Presiden Republik Indonesia nomor: B.43/Pres/II/1986. Dalam kontrak karya tersebut, seluas 10.331 Ha berada di wilayah adat masyarakat Cek Bocek Selesek Ren Sury sehingga terjadi perebutan hak atas tanah di wilayah tersebut (Gunawan dkk. 2011). Hasil penelitian menunjukkan terdapat tiga konflik yang melibatkan masyarakat adat Cek Bocek Salesek Reen Sury dengan satu objek pertanahan. Pertama, konflik masyarakat adat dengan PT. Newmont Nusa Tenggara. Kedua, konflik masyarakat adat dengan Pemerintah Daerah Kabupaten Sumbawa dan ketiga, konflik masyarakat adat dengan Lembaga Adat Tana’ Samawa (LATS). Kuatnya dominasi Pemerintah Daerah dan hadirnya Lembaga Adat Tana Samawa (LATS) melalui PERDA No. 9 Tahun 2015 semakin mempersulit eksistensi dan keberadaan masyarakat adat lainnya di Kabupaten Sumbawa termasuk masyarakat adat Cek Bocek Salesek Reen Sury. Berdasarkan hasil analisis komunikasi, situasi konflik semacam ini membutuhkan pola komunikasi negosiasi intermediaries untuk menentukan langkah komunikasi yang efektif pada masyarakat adat Cek Bocek Salesek Reen Sury di Kabupaten Sumbawa.

Abstract

Now, many consumer who report bed business practices that lost consumer are sued back by businessman. These we can see in the case Dewi Prita Mulyasari, Fery Kuntoro, Fifi Tanang and so on. The accident made a traumatic to consumer who report. It is the problem in consumer protection in Indonesia. That why, this writing try to study implication of law because there is no macanism of law protection to reporter consumer and how to make a rule which give guaranty protection of law to reporter consumer. Purpose of this research is to give a solution in dilemma revenge action from businessman and to encourage honest and responsible business practice atmosfer. This research is normative research with statute approach, conceptual approach and comapartive approach. Implication of nothing rule in national act concerning to protection of law for reporter consumer is businessman can sue consumer with aspersion, inconsistent protection of law for consumer and created much cosumer crime. Thus, construction of law which give protection of law for reporte consumer from aspersion is nomativly there is rule which give imunity for reporter lost consumer from aspersion until there is judgment decision. Abstract

The constitution has clearly provided legal protection toward rights of citizen. Constitutionalism regime contains the idea of power restriction and secures civil rights through constitution. Nevertheless, some places in which agrarian conflicts occur, the ignorance of civil rights seem to be prominent. People living in the forest area of register 45 Mesuji Lampung is the picture of people who, for more than twelve years, are missing their constitutional rights. Local government does not recognize them as resident just because they occupy forest area which its management is delegated to private party. The critical legal studies perspective is constantly examining legal performance with the authority behind the law and the power within a community. Critical legal theory is focusing on the importance of a legal study which not only criticizes the substance of rule but also takes the whole aspect of social life and law into account.  Keywords: Agrarian Conflict, Ignorance, Constitutional Rights, Citizen.

Abstract

Tujuan penelitian ini untuk melakukan kajian dan analisis terhadap kedudukan dan kekuatan hukum akta pengakuan hutang sebagai dasar perlihan saham Perseroan Terbatas; dan melakukan analisis terhadap perlindungan hukum bagi pemegang saham minoritas dalam peralihan saham dengan akta pengakuan utang.  Metode penelitian yang dipergunakan adalah penelitian normative dengan pendekatan perundang undangan (statute approach) dan pendekatan kasus (case approach).  Akta pengakuan utang yang dibuat oleh dan dihadapan notaries tidak dapat dijadikan dasar untuk   pengalihan saham suatu Perseroan Terbatas. Pengalihan saham haruslah mengacu pada mekanisme hukum yang diatur dalam UU No.40 Tahun 2007 tentang Perseroan Terbatas yaitu pasal 56 dan 60. Meskipun dalam Undang Undang No.40 Tahun 2007   tentang Perseroan Terbatas  tidak secara tegas memberikan perlindungan hukum terhapap pemilik saham minoritas dalam pengambilan keputusan peralihan saham , namun  dalam praktik pemegang saham minoritas  harus tetap diundang  dalam RUPS  untuk didengar pendapatnya.  Pengabaian terhadap kehadiran pemegang saham minoritas dalam RUPS dapat berdampak bahwa RUPS tersebut menjadi tidak sah dan dapat dibatalkan di Pengadilan.  Ini menunjukkan bahwa ekseistensi pemegang saham minoritas sangatt dilindungi dan dihormati.Kata Kunci :  peralihan saham, pengakuan utang
