Abstract

Upaya Pemerintah dalam melakukan pemindahan Ibu Kota Negara dari Jakarta ke Kalimantan Timur diwujudkan dalam Undang-Undang Nomor 3 Tahun 2022 tentang Ibu Kota Negara, sehingga menimbulkan polemik di masyarakat, ada yang Pro dan ada yang Kontra. Tujuan Pemerintah melakukan pemindahan Ibu Kota Negara adalah dalam rangka percepatan pembangunan yang lebih baik. Pada era pemerintahan Presiden Soekarno wacana pemindahan Ibu Kota Negara sudah ada sampai saat ini kembali ditegaskan oleh Presiden Jokowi. Presiden menyampaikan pemindahan Ibu Kota Negara dari Provinsi DKI Jakarta ke Provinsi Kalimantan Timur pada tanggal 26 Agustus 2019. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Penelitian hukum normatif mempunyai makna suatu penelitian hukum yang dikonsepsikan sebagai apa yang ditulis dalam peraturan perundang-undangan atau konsepsi dari kaidah atau norma yang menjadi patokan dalam berperilaku di masyarakat terhadap apa yang seharusnya dilakukan. Sedangkan pendekatan yang digunakan adalah pendekatan perundang-undangan (statute approach), dengan mengkaji Undang-Undang No. 3 Tahun 2022 tentang Ibu Kota Negara. Hasil Penelitian Ini menunjukkan bahwa Pemindahan Ibu Kota Negara ke Kalimantan Timur membutuhkan upaya yang sangat besar dari pemerintah dalam mewujudkannya, dan pasti akan berpengaruh pada lembaga-lembaga negara, kantor lembaga negara ini pastinya ikut berpindah pada Ibu Kota Negara baru. Diundangkannya UU IKN dinilai cacat formil sebab tidak melibatkan partisipasi masyarakat sebagaimana yang dimuat dalam Pasal 27 ayat (1) dan Pasal 28C ayat (2) UUD Tahun 1945 sehingga dinilai tidak menghiraukan prinsip kedaulatan rakyat. The Government’s efforts to move the National Capital from Jakarta to East Kalimantan are manifested in Law Number 3 of 2022 concerning the National Capital, which has caused polemics in society, some are Pro and some are Con. The Government’s goal in moving the National Capital is to accelerate better development. During the era of President Soekarno’s administration, the discourse on moving the National Capital has existed until now, it has been reaffirmed by President Jokowi. The President conveyed the transfer of the National Capital from DKI Jakarta Province to East Kalimantan Province on August 26, 2019. The method used in this study is normative legal research. Normative legal research has the meaning of legal research that is conceptualized as what is written in laws and regulations or the conception of rules or norms that are the benchmark for behaving in society regarding what should be done. While the approach used is the statute approach, by examining Law No. 3 of 2022 concerning the National Capital. The results of this study show that the relocation of the National Capital to East Kalimantan requires a great deal of effort from the government to realize it, and will certainly affect state institutions, the offices of these state institutions will certainly move to the new National Capital. The enactment of the IKN Law is considered formally flawed because it does not involve public participation as stated in Article 27 paragraph (1) and Article 28C paragraph (2) of the 1945 Constitution, so it is considered to ignore the principle of people’s sovereignty.

Abstract

Keberadaan fungsi hukum tidak lain adalah untuk dapat dijadikan sebuah sarana bagi berbagai pembaruan yang dibutuhkan oleh masyarakat khususnya dalam suatu pembangunan nasional. Konstitusi sebagai acuan hukum tertinggi menjadi sebuah poros utama dalam proses pembangunan nasional sehingga diperlukan tatanan pengaturan yang selalu dapat menjawab tantangan pembaruan di dalam masyarakat. Konstitusi dapat dikatakan sebagai suatu tonggak bagi suatu negara dalam penyelenggaraan berbangsa dan bernegara. Dalam penulisan ini akan dibahas perbandingan perkembangan konstitusi di Indonesia sejak awal kemerdekaan hingga saat ini untuk kemudian dijadikan sebagai pedoman dalam merekontruksi hukum agar bisa menghadapi setiap perubahan yang terjadi didalam masyarakat kedepannya. Metode penulisan yang digunakan adalah melalui pendekatan perbandingan dan pendekatan secara historis. Pendahuluan kepentingan bersama daripada kepentingan golongan haruslah diutamakan agar dapat memberikan tunjangan perubahan yang signifikan bagi kemajuan masyarakat secara keseluruhan untuk dapat mencapai tujuan dari pembangunan nasional yang dibungkus secara apik dalam sebuah Konstitusi. The existence of function of law is none other than to be used as a means for various reforms needed by society, especially in national development. The constitution as the highest legal reference becomes a main axis in the national development process so a regulatory order is needed that can always answer the challenges of reform in society. The constitution can be said as a milestone for a country in the administration of the nation and state. In this paper, we will discuss a comparison of the development of the constitution in Indonesia since the beginning of independence until now to be used as a guide in reconstructing law so that it can deal with any changes that occur in society in the future. The writing method used is a comparative and historical approach. The introduction of common interests rather than group interests must be prioritized to provide significant change allowances for the progress of society as a whole to be able to achieve the goals of national development which are neatly wrapped in a Constitution.

Abstract

Untuk mencegah jangan sampai terjadi kekosongan jabatan kepala daerah akibat berakhir masa jabatan tahun 2022 dan tahun 2023. Maka diangkat seorang Penjabat guna mengisi kekosongan jabatan dimaksud. Namun persoalannya penjabat yang diangkat bukan berasal dari kalangan sipil melainkan dari kalangan militer. Metode penelitian yang digunakan adalah yuridis-normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual untuk menganalisis permasalahan yang menjadi fokus penelitian. Hasil penelitian menyimpulkan bahwa Pengangkatan prajurit TNI aktif dalam menduduki jabatan sipil semestinya tidak boleh terjadi. Sebab sangat mungkin menyebabkan terjadi penyalahgunaan kekuasaan dengan mencampuradukkan kepentingan militer dan kepentingan sipil dalam birokrasi pemerintahan sehingga berpontensi menciptakan konflik kepentingan. Selain itu, bagi prajurit TNI yang telah mengundurkan diri atau pensiun, tidak serta-merta boleh diangkat sebagai penjabat kepala daerah. Melainkan yang bersangkutan harus terlebih dahulu mengikuti seleksi atau diangkat menduduki Jabatan Pimpinan Tinggi, kategori Madya atau Pratama. Setelah itu, barulah yang bersangkutan dapat diangkat sebagai Penjabat Kepala Daerah. To prevent a vacancy in the position of regional head due to the end of the term of office in 2022 and 2023, an Acting Officer will be appointed to fill the vacancy in the position in question. However, the problem is that the officials appointed do not come from civilian circles but from military circles. The research method used is juridical-normative using a statutory approach and a conceptual approach to analyze the problems that are the focus of the research. The results of the research concluded that the appointment of active TNI soldiers to civilian positions should not have occurred. Because it is very likely to cause abuse of power by mixing military interests and civilian interests in the government bureaucracy, thereby potentially creating a conflict of interest. Apart from that, TNI soldiers who have resigned or retired cannot immediately be appointed as acting regional heads. However, the person concerned must first take part in a selection or be appointed to a High Leadership Position, Middle or Primary category. After that, the person concerned can be appointed as Acting Regional Head.

Abstract

Pembentukan BUMDes diharapkan dapat menjadi penggerak ekonomi lokal didasarkan dari kebutuhan, potensi, dan kapasitas desa, untuk dapat meningkatkan kesejahteraaan masyarakat. Pasal 87 angka (1) UU No. 6 Tahun 2014 tentang Desa mengamanatkan bahwasanya setiap desa dapat mendirikan BUMDes namun berdasarkan pantauan hasil di lapangan bahwa hingga saat ini Pemerintah Desa Kemantren belum mendirikan BUMDes karena adanya beberapa kendala. Penelitian ini bertujuan mengkaji implementasi pengaturan mengenai BUMDes ditinjau dari UU No. 6 Tahun 2014 tentang Desa di Desa Kemantren Kecamatan Tulangan Kabupaten Sidoarjo serta untuk mengetahui faktor-faktor yang menjadi kendala dalam pembentukan BUMDes ditinjau dari UU No. 6 Tahun 2014 tentang Desa di Desa Kemantren Kecamatan Tulangan Kabupaten Sidoarjo sesuai asas hukum rekognisi dan asas hukum subsidiaritas. Metode penelitian yang digunakan adalah penelitian hukum empiris dengan pendekatan kualitatif. Pengumpulan data dilakukan dengan cara wawancara, kepustakaan/dokumen dan observasi. Kendala yang dihadapi Pemerintah Desa Kemantren dalam mendirikan BUMDes meliputi kurangnya pemahaman Pemerintah Desa Kemantren tentang BUMDes, terkendala dana dan biaya, kurangnya ide-ide pada Pemerintah Desa Kemantren dalam mengolah potensi desa, Pemerintah Desa Kemantren belum menemukan sumber daya manusia yang dirasa mampu dalam mengolah BUMDes. The formation of Village-owned Enterprises (BUMDes) was expected to be a local economic driver based on village needs, potential and capacity, to improve community welfare. Article 87 number (1) of Act No. 6 of 2014 on Villages mandates that every village can establish a BUMDes, but based on monitoring results in the field, to date the Kemantren Village Government has not established a BUMDes due to several obstacles. This research aims to examine the implementation of regulations regarding BUMDes in terms of Law No. 6 of 2014 concerning Villages in Kemantren Village, Tulangan District, Sidoarjo Regency and to determine the factors that are obstacles in the formation of BUMDes in terms of Act No. 6 of 2014 on Villages in Kemantren Village, Tulangan District. Sidoarjo Regency is in accordance with the legal principle of recognition and the legal principle of subsidiarity. The research method used is empirical legal research with a qualitative approach. Data collection was carried out by means of interviews, literature/documents and observation. Obstacles faced by the Kemantren Village Government in establishing BUMDes include the Kemantren Village Government’s lack of understanding about BUMDes, constraints on funds and costs, the Kemantren Village Government’s lack of ideas in processing village potential, the Kemantren Village Government has not yet found human resources that it feels are capable of developing BUMDes.

Abstract

Maraknya konten live streaming dimana pemilik akun menampilkan seorang nenek/lansia yang mengguyurkan air ke badan apabila seseorang penonton memberikan gift/hadiah berupa koin yang mana koin tersebut dapat di tukarkan menjadi uang tindakan yang dilakukan oleh pemilik akun merupakan kategori tindak pidana eksploitasi dimana seseorang dijadikan objek suatu hal untuk mendapatkan keuntungan. Perlunya tindakan tegas terhadap para pelaku tindakan ekploitasi terhadap lansia melalui sosial media, sehingga menimbulkan efek jera bagi pelaku eksploitasi online. Penelitian ini menggunakan metode normatif dengan bahan dasar hukum primer yaitu peraturan perundang-undangan dan bahan hukum sekunder yaitu buku, jurnal, dan artikel ilmiah tentang hukum. Dalam mengkaji permasalahan ini menggunakan metode penelitian normatif untuk menemukan ratio legis dari peraturan yang berlaku di Indonesia dengan permasalahan yang terjadi, dengan menggunakan pendekatan perundang-undangan, konseptual dan kasus, dapat ditemukannya penyelesaian masalah. Hasil dari penelitian ini adalah perlunya pembaharuan aturan hukum mengenai tindak pidana eksploitasi yang dilakukan melalui online, karena aturan yang ada saat ini kurang relevan lagi dengan perkembangan teknologi yang semakin pesat. The rise of live streaming content where the account owner displays a grandmother/elderly pouring water on the body if a viewer gives a gift/prize in the form of coins which can be exchanged for money, the action taken by the account owner is a category of criminal exploitation where a person is made an object of something to gain profit. There is a need for strict action against perpetrators of exploitation of the elderly through social media, so as to create a deterrent effect for perpetrators of online exploitation. This study uses a normative method with primary legal materials, namely laws and regulations and secondary legal materials, namely books, journals, and scientific articles on law. In examining this problem, a normative research method is used to find the ratio legis of the regulations in force in Indonesia with the problems that occur, using a statutory, conceptual and case approach, a solution to the problem can be found. The results of this study are the need to renew the legal regulations regarding criminal acts of exploitation carried out online, because the current regulations are no longer relevant to the increasingly rapid development of technology.

Abstract

Ketersediaan lahan untuk investasi memang penting, namun tujuan dari investasi itu sendiri adalah untuk mensejahterakan masyarakat. Sebagian besar tanah dimiliki oeh perorangan atau sekelompok orang yang juga memiliki kepentingan tersendiri atas tanah tersebut. Adanya berbagai kepentingan yang seakan saling bertentangan satu sama lain berkaitan dengan masaah pertanahan dalam investasi menyebabkan proses pengadaan tanah untuk investasi menjadi berlarut-larut. Untuk itu, Bank Tanah dalam melaksanakan pengadaan tanah juga harus memperhatikan kesejahteraan masyarakat yang merupakan pemilik tanah dengan cara melibatkan masyarakat dalam proses pengadaan tanah melalui konsultasi publik sebagai bentuk perlindungan hukum. Berdasarkan latar belakang, diuraikan rumusan masalah Bagaimanakah karakteristik pengadaan tanah oleh Bank Tanah untuk investasi, dan Bagaimanakah pelaksanaan konsultasi publik sebagai bentuk perlindungan hukum bagi masyarakat terkait pengadaan tanah oleh Bank Tanah untuk investasi. Sedangkan bentuk dari penelitian ini merupakan penelitian yuridis normatif atau penelitian hukum kepustakaan dengan cara meneliti bahan pustaka yang ada, baik bahan hukum primer maupun bahan hukum sekunder dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual untuk kemudian dikategorikan dan dianalisis. The availability of land for investment is indeed important, but the aim of the investment itself is to improve the welfare of the community. Most of the land is owned by individuals or groups of people who also have their own interests in the land. The existence of various interests that seem to conflict with each other regarding land issues in investment causes the process of procuring land for investment to be protracted. For this reason, the Land Bank in carrying out land acquisition must also pay attention to the welfare of the community who own the land by involving the community in the land acquisition process through public consultation as a form of legal protection. Based on the background, the problem formulation describes what are the characteristics of land acquisition by the Land Bank for investment, and how is the implementation of public consultation as a form of legal protection for the community regarding land acquisition by the Land Bank for investment. Meanwhile, the form of this research is normative juridical research or library law research by examining existing library materials, both primary legal materials and secondary legal materials using a statutory approach and a conceptual approach to then be categorized and analyzed.

Abstract

The high rate of toll road construction aims to smooth traffic in developed areas and enhance the equitable distribution of development outcomes. One of the toll road constructions targeted to be operational in 2024 is the Yogyakarta-Bawen toll road. The construction of this toll road is considered important because Yogyakarta plays a role as a hub for economic development in southern Java. The issue that becomes important when constructing a toll road is the mechanism for acquiring land owned by residents to be converted into a road. This raises issues regarding the mechanism for land acquisition for public purposes on Sultanate land, which has distinct characteristics compared to privately owned land. In this study, a comparison will be made regarding the regulation of land acquisition for public interest in Law No. 2 of 2012 as amended by Law No. 6 of 2023 with the Regional Regulation No. 1 of 2017. Additionally, the study will examine how the mechanism of land acquisition for public interest on Sultanate land in the construction of the Yogyakarta-Bawen toll road. This research employs an empirical juridical research type with a statutory approach, a conceptual approach, and a case approach. The research results indicate that there are differences in the provisions regarding land acquisition for public purposes in Law No. 2 of 2012 compared to DIY Regional Regulation No. 1 of 2017.

Abstract

The purpose of this research is to determine the position of this foreign concept in the Indonesian legal system, specifically criminal procedural law, and to examine the existence of the amicus curiae concept in the settlement of case number 798/Pid.B/2022/PN Jkt.Sel while linking its existence in the case with the principle of res judicata pro veritate habetur, which is inherent in every decision product of an institution with the authority to adjudicate. This research was conducted in a normative juridical manner using literature or secondary data and an analytical method in the form of in-depth analysis that produces sentences according to the rules or is called qualitative. The selection of this title focuses on the position of amicus curiae itself in Indonesian criminal justice and its role in the judge’s legal considerations that result in a decision in a particular case. More or less it was found that the position of this concept is not explicitly regulated in any regulations in Indonesia, but its existence can still be found because in fact there are several regulations that indicate this concept can be used. The existence of this concept in the settlement of cases resulting in court decisions remains within the principle of res judicata pro veritate habetur, which means that it is not appropriate to doubt the decision even though it is known that there is a contribution from amicus curiae who do not have a clear position.

Abstract

Exhibitionism is a deviant sexual fantasy by showing one’s genitals to other people. This behavior certainly violates the norms of decency and norms which causes unrest and disturbs the peace in the community. Therefore, legal norms must be enforced in order to maintain order and peace and provide legal certainty in social life. Talking about criminal acts cannot be separated from discussing the punishment of the perpetrators of the criminal acts themselves. It can be said that criminal impositions must pay attention to the purpose of punishment which is identical to the punishment that applies for violating a legal rule. In Decision Number 23/Pid.B/2022/PN Wat the defendant admitted to making videos/photos of himself that contained pornography. During the investigation process, the defendant was examined by a psychologist with the results of the examination showing that the defendant suffered from exhibitionism. The panel sentenced the defendant to 10 months imprisonment and a fine of Rp. 250,000,000.

The supply and demand for digital era commodity assets is related to the development of commodity markets. Investing in cryptocurrencies is very attractive as an alternative investment opportunity that has the potential to gain huge profits in a fairly short time. The research approach in this study is a normative legal research method using a statutory and regulatory approach and a contextual approach.
