Redaksi menerima tulisan yang berupa hasil kajian yang berasal dari penelitian hukum dalam berbagai bidang ilmu hukum yang belum pernah dipublikasikan serta orisinal. Visa is a written letter that has an element of legality used when one visits another country. In 2016 the President of the Republic of Indonesia issued a Presidential Regulation regarding Visa-Free Visit. Presidential Decree Number 21 Year 2016 concerning Visa-Free Visit (BVK) provides an opportunity for 169 countries to freely visit the territory of the Republic of Indonesia without a visa. With this provision, it creates dualism in a social environment. On one hand, this provision is beneficial in increasing the tourism economy, and on the other hand, the growth of the risk of criminalization by foreigners is increasing. This study aims to provide a solution to the problem in legal provisions to prevent and control the traffic of foreigners to Indonesia after the enactment of the BVK and how to sanction citizens who abuse the visa-free visit permit. This study uses normative legal research methods. The results of this study indicate that the rules that determine the supervision and implementation of the rules systematically against foreigners who abuse BVK are specified in Law Number 6 Year 2011, Regulation of the Ministry of Law and Human Affairs (Permenkumham) Number 17 Year 2016, and Regulation of the Ministry of Domestic Affairs (Permendagri) Number 49 Year 2010. In addition, for foreigners who are caught having committed violations, the government can provide administrative sanctions up to criminal sanctions and deportation. From the perspective of the ius constituendum, the provisions regarding BVK need to carry out legal reconstruction to determine specific sanctions against foreigners who commit violations. Besides, there is a need for provisions regarding the system for providing BVK to foreigners in detail so that it is right on target. Visa merupakan sesuatu surat tertulis yang memilki unsur legalitas yang digunakan dalam kegiatan kunjungan menuju negara lain. Pada tahun 2016 Presiden Republik Indonesia mengeluarkan Peraturan Presiden mengenai bebas visa kunjungan. Perpres Nomor 21 Tahun 2016 tentang Bebas Visa Kunjungan (BVK) memberikan kesempatan bagi 169 negara untuk bebas berkunjung ke wilayah Republik Indonesia tanpa visa. Ketentuan tersebut menimbulkan dualisme dalam suatu lingkungan sosial. Di satu sisi, ketentuan ini menguntungkan dalam peningkatan ekonomi pariwisata, dan di sisi lain pertumbuhan resiko kriminalisasi oleh orang asing kian bertambah. Kajian ini bertujuan memberikan suatu jawaban dari permasalahan dalam ketentuan hukum untuk mencegah dan mengendalikan lalu lintas orang asing ke Indonesia pasca berlakunya BVK dan bagaimana sanksi kepada warga yang menyalahgunakan izin bebas visa kunjungan. Kajian ini menggunakan metode penelitian hukum normatif (normative legal research). Hasil penelitian ini menunjukkan bahwa aturan-aturan yang menentukan mengenai pengawasan dan berjalannya aturan secara sistematis terhadap orang asing yang menyalahgunakan BVK ditentukan dalam Undang-Undang Nomor 6 Tahun 2011, Permenkumham Nomor 17 Tahun 2016, dan Permendagri Nomor 49 Tahun 2010. Selain itu bagi orang asing yang tertangkap telah melakukan pelanggaran, pemerintah dapat memberikan sanksi administratif sampai sanksi pidana dan deportasi. Dari prespektif ius constituendum ketentuan mengenai BVK perlu dilakukan rekonstruksi hukum guna menentukan sanksi secara khusus terhadap warga asing yang melakukan pelanggaran. Selain itu, perlu adanya ketentuan mengenai sistem pemberian BVK kepada orang asing secara mendetail agar tepat sasaran.

Reclamation based on the revitalization of Benoa Bay-Bali which is regulated in Presidential Decree No. 51 of 2014 has the goal of increasing competitiveness in the field of tourism destinations. However, many Balinese people reject the reclamation of Benoa Bay-Bali because the Benoa Bay area is a conservation area. With various objections from the Balinese people, KEPMEN KP No: 46/ KEPMEN-KP/2019 was issued regarding the management of the maritime cultural protection area of ??Benoa Bay-Bali by appointing the Bali Provincial Government as the manager. This study aims to examine policies regarding the maritime conservation area of ??Benoa Bay-Bali managed by the Provincial Government of Bali, as well as the determination of the Benoa Bay-Bali maritime conservation area to function effectively in the framework of environmental preservation. Using sociolegal research with a statutory approach and a case approach. The result of the research is that there is no further regulation regarding the Bali Provincial Regulation regarding the management of the Benoa Bay maritime conservation area, so that there is a norm vacuum. It is hoped that the determination of the Benoa Bay maritime conservation area to be able to effectively provide a positive impact in environmental maintenance activities, in which to ensure its wise use and increase the quality of its value and diversity.

Covernote issued by the Notary for the acceleration of credit disbursement. The problem is the legal position of the covernote issued by the Notary in the disbursement process carried out by the Bank and how the credit disbursement process by the Bank is based on the covernote. The research objective is to find out and explain the concept of the legal position of the covernote in terms of implementing credit disbursements by. This study uses an empirical juridical research method, with a prescriptive analytical approach. The discussion obtained is the legal position of the covernote, namely only in the process of credit realization carried out by the Bank, the legal force of the covernote is not binding on the covernote, only a certificate in process, and not a single article states or interprets the notary's authority to issue a covernote, in the process of credit disbursement The problem that occurs is that the HT certificate settlement has not been completed while the credit has been disbursed based on the covernote, and another problem is the occurrence of congestion in credit payments which causes the debtor to default and the bank experiences a loss. Covernote dikeluarkan oleh Notaris untuk percepatan pencairan kredit. Permasalahanya adalah kedudukan hukum daripada covernote yang diterbitkan oleh Notaris di dalam proses pencairan yang dilakukan oleh Bank serta bagaimana proses pencairan kredit oleh Bank berdasarkan covernote. Tujuan penelitian mengetahui dan menjelaskan konsep dari kedudukan hokum covernote dalam hal pelaksaan pencairan kredit oleh. Penelitian ini menggunakan metode penelitian yuridis empiris, dengan melakukan pendekatan preskriptif analitis. pembahasan yang diperoleh adalah kedudukan hukum covernote yakni hanya dalam proses realisasi kredit yang dilakukan oleh Bank, kekuatan hukum covernote tidaklah bersifat mengikat melainkan covernote hanya sebatas surat keterangan yang masih dalam proses, dan tidak ada pasal yang menyatakan atau menafsirkan kewenangan dari Notaris untuk menerbitkan covernote, dalam proses pencairan kredit masalah yang terjadi adalah penyelesaian sertifikat HT tak kunjung selesai dalam keadaan kredit telah dicairan berdasarkan covernote, dan permasalahan yang lain adalah terjadinya kemacetan dalam pembayaran kredit sehingga menyebabkan debitur melakukan wanprestasi dan pihak bank mengalami kerugian.

The idea of village head dispute resolution through the Special Judicial Institution began with anxiety over Law 6 of 2014 concerning Villages, Government Regulation number 6 of 2014 concerning Implementation of Village Laws, and Minister of Home Affairs Regulation No. 112 of 2014 concerning Guidelines for Election of Village Heads, which has not yet regulated the village head election supervisory institutions and dispute resolution institutions for village head elections. The institutions that are required to complete based on these rules are Regents with a period of 30 days. Regents are political positions which also have many political interests. The existence of this decision had an impact on one of the candidates for the village head. The current practices for resolving disputes over village head elections through the District Court and the State Administrative Court. The purpose of this study to create a concept for regional special judiciary institutions in resolving regional election disputes in Indonesia. This research using a normative juridical approach with a statute approach, history approach and conceptual approach. The results of the study show that by establishing a special independent judicial institution based on local wisdom by prioritizing the principle of kinship and consensus building. The main task of the institution is to assist the regional head in providing alternative legal services, to serve and protect the rights of the parties in seeking truth and justice, and to settle according to a predetermined time, to try to examine and decide on cases of village head election disputes.

The purpose of this paper is to examine the customary law sanctions that are threatened against perpetrators of sexual violence against children, for example in the people of Tenganan Village, Karangasem-Bali, which are Balinese customary law communities who still adhere to their traditions in the era of modernization and globalization that is developing in Bali. Whether the customary sanctions for perpetrators of sexual violence against children in Tenganan Village, Karangasem-Bali are in accordance with the principle of fulfilling children's rights. This research is a type of normative legal research or what is often called doctrinal research. The approach used in this research is the Legislative Approach, the Conceptual Approach and the Comparative Approach. The result of this paper is that customary sanctions against sexual violence against children that occur in Tenganan Village do not position children as victims of sexual violence. On the other hand, children are placed in a position to participate as perpetrators. The customary sanctions do not provide legal protection and fulfillment of children's rights for child victims of sexual violence. Penelitian ini bertujuan untuk mengkaji sanksi hukum adat yang diancamkan kepada pelaku kekerasan seksual terhadap anak, contohnya pada masyarakat Desa Tenganan, Karangasem-Bali yang merupakan masyarakat hukum adat Bali yang masih memegang teguh tradisinya di era modernisasi dan globalisasi yang berkembang di Bali. Apakah sanksi adat bagi pelaku kekerasan seksual terhadap anak di Desa Tenganan, Karangasem-Bali telah sesuai dengan prinsip pemenuhan hak anak.Penelitian ini merupakan jenis penelitian hukum normative yang menggunakan tiga jenis pendekatanantara lain pendekatan Perundang-undangan, Pedekatan Konseptual dan Pendekatan Perbandingan. Berdasarkan hasil penelitian diketahui bahwa sanksi adat terhadap kekerasan seksual terhadap anak yang terjadi di Desa Tenganan tidak memposisikan anak sebagai korban kekerasan seksual. Sebaliknya anak ditempatkan pada posisi turut serta sebagai pelaku. Dalam sanksi adat tersebut tidak memberikan perlindungan hukum dan pemenuhan hak anak bagi anak korban kekerasan seksual.

This research is about the role of the Prosecutor as an executor in executing the assets of the convicts of corruption, to recover the State financial losses from corruption. Besides that, this research aims to know about the returning of State financial losses through the payment of replacement money. Corruption is an extraordinary crime, veiled and endanger national stability and security and inhibiting Indonesian economic development. This research is a normative legal research with primary, secondary and tertiary legal material supported by data. This research is using statutory, case, and comparative approaches. The legal basis used in this research are Law No. 31 of 1999 in conjunction with Law No. 20 of 2001, Law No. 16 of 2004 and Law No. 8 of 1981 (Indonesian Criminal Procedural Code). The corruption has become systematic and the scope enters into all aspect of life, start with the lower level with State Officers and law enforcers becomes the dominant actors. In imposing the sanction, The Judges are not only charge imprisonment but also charge additional fines and/or penalties to returning the State financial losses and ask the convicts of corruption to pay the replacement money to the State. The problem arises in this research related to the execution of the verdict about returning State financial losses which are the assets of the convicted person is already in the third party hands or have been depleted, dual population administration, the length of the judicial process, the convicted person prefers to take the subsidiary criminal charge and the hollow of norm regarding technical execution for the Prosecutors so that the execution cannot be carried out.

PPAT's authority in making a land sale and purchase deeds must take into account the provisions of Article 22 PP No. 37 of 1998 that: the PPAT deed must be read/enforced to the party in the presence of at least two witnesses before being signed immediately by the parties, witnesses and PPAT. In practice, in the decision of the Ungaran District Court No.80 / Pdt.G / 2015 / PN.Unr, the PPAT land sale and purchase certificate was never signed by the landowner and in the decision of the Tanjung Karang District Court No.35 / Pdt.G / 2015 / PN. Tjk, the legal owner of the land certificate for joint assets does not have the wife's consent letter that is entitled to the land sale and purchase certificate. On this basis, the related parties submitted a cancellation of the issuance of the land sale and purchase certificate, so that the agreement was null and void. The purpose of this research is to analyze the responsibilities of PPAT, how to protect the law for landowners as a result of the issuance of the PPAT land sale and purchase certificate. This type of research is normative juridical with an inviting approach and a case approach. The source of legal material used is secondary data which is analyzed qualitatively and comes from deductive. The research results reveal that whether the legal protection for landowners in the PPAT land sale and purchase deed is null and void by a court decision has provided protection and legal certainty. Kewenangan PPAT dalam membuat akta jual beli tanah harus memperhatikan ketentuan Pasal 22 PP No. 37 Tahun 1998 bahwa : akta PPAT harus dibacakan/dijelaskan kepada para pihak dengan dihadiri oleh sekurang-kurangnya dua orang saksi sebelum ditandatangani seketika itu juga oleh para pihak, saksi-saksi dan PPAT. Prakteknya dalam putusan Pengadilan Negeri Ungaran No.80/Pdt.G/2015/PN.Unr, akta jual beli tanah PPAT tidak pernah ditandatangani oleh pemilik tanah dan dalam putusan Pengadilan Negeri Tanjung Karang No.35/Pdt.G/2015/PN.Tjk, pemilik sah sertifikat tanah atas harta bersama tidak terdapat surat persetujuan istri yang berhak dalam akta jual beli tanah. Atas dasar tersebut, para pihak terkait mengajukan pembatalan atas lahirnya akta jual beli tanah, agar perjanjian tersebut batal demi hukum. Tujuan penelitian ini adalah untuk menganalisis bagaimana tanggung jawab PPAT, bagaimana perlindungan hukum bagi pemilik tanah akibat dari lahirnya akta jual beli tanah PPAT. Jenis penelitian yang digunakan bersifat yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Sumber bahan hukum yang digunakan adalah data sekunder yang dianalisis secara kualitatif dan ditarik kesimpulan secara deduktif. Hasil penelitian mengungkapkan bahwa apakah perlindungan hukum bagi pemilik tanah dalam akta jual beli tanah PPAT yang batal demi hukum oleh putusan pengadilan sudah memberikan perlindungan dan kepastian hukum.

This study aims to analyze the policy underwriting organization arrangements in insurance companies in Indonesia and the absence of a policy guarantor institution at insurance companies in Indonesia. The method used in research related to the regulation of policy insurance institutions in insurance companies in Indonesia uses normative juridical legal research. This study uses a statutory approach or statute approach to analyze legal issues in this study. Sources of legal materials in this study consist of primary legal materials, secondary legal materials, and also tertiary legal materials. The results of this study found that the insurance company has not regulated the policy guarantor in Indonesia in positive law in Indonesia even though it has been mandated in Law Number 40 of 2014 concerning Insurance. The absence of regulations regarding policy underwriters in insurance companies in Indonesia has resulted in public distrust of insurance companies, so it is necessary to regulate policies related to insurance companies in insurance companies in Indonesia. Penelitian ini bertujuan untuk menganalisis pengaturan lembaga penjamin polis pada perusahaan asuransi di Indonesia serta tidak adanya lembaga penjamin polis pada perusahaan asuransi di Indonesia. Metode yang digunakan dalam penelitian terkait pengaturan lembaga penjamin polis pada perusahaan asuransi di Indonesia ini menggunakan jenis penelitian hukum yuridis normatif. Penelitian ini menggunakan pendekatan perundang-undangan atau statute approach untuk menganalisis isu hukum dalam penelitian ini. Sumber bahan hukum dalam penelitian ini terdiri dari bahan hukum primer, bahan hukum sekunder, dan juga bahan hukum tersier. Hasil dari penelitian ini menemukan bahwa belum diaturnya lembaga penjamin polis pada perusahaan asuransi di Indonesia dalam hukum positif di Indonesia walaupun telah diamanatkan dalam Undang-Undang Nomor 40 tahun 2014 tentang Perasuransian. Tidak adanya pengaturan terkait lembaga penjamin polis pada perusahaan asuransi di Indonesia mengakibatkan ketidakpercayaan masyarakat terhadap perusahaan asuransi, sehingga perlu pengaturan terkait lembaga penjamin polis pada perusahaan asuransi di Indonesia.

The purpose of writing this journal is to find out how to regulate smell in trademark law in Indonesia and to find out how to regulate smell in trademark law in Indonesia in the future. The research method used in this journal is the normative legal research method, namely research by describing a problem which is then discussed using legal theories in accordance with statutory regulations. Research results show that trademark law in Indonesia in the future needs to regulate smell as a trademark because Indonesia is a member of the WTO-TRIPs which requires adjustments of national law to the agreement. In order to protect smell, Indonesia needs to pay attention to the policies of several countries in brand protection as stated in the brand definition. In addition, the need for regulation of smell is to help provide protection for inventors and speakers who have sacrificed their energy, time, and mind to produce the work, where the work is an original work. Tujuan dari penulisan jurnal ini adalah untuk mengetahui bagaimana pengaturan tentang smell dalam hukum merek di Indonesia dan untuk mengetahui bagaiamana pengaturan tentang smell dalam hukum merek di Indonesia pada masa mendatang.Metode penelitian yang digunakan dalam jurnal ini yaitu metode penelitian hukum normatif, yakni penelitian dengan memaparkan suatu permasalahan yang selanjutnya dibahas dengan menggunakan teori-teori hukum yang sesuai dengan peraturan perundang-undangan.Hasil Penelitian menunjukkan bahwa hukum merek di Indonesia pada masa mendatang perlu mengatur smell sebagai merek karena Indonesia tergabung dalam anggota WTO-TRIPs yang mengharuskan penyesuaian hukum nasionalnya terhadap perjanjian tersebut. Agar dapat melindungi smell, Indonesia perlu memperhatikan kebijakan beberapa negara dalam perlindungan merek yang tertuang dalam definisi merek. Selain itu perlunya pengaturan terhadap smell adalah untuk membantu memberikan perlindungan bagi penemu dan pencitpa yang telah mengorbankan tenaga, waktu, serta pikirannya untuk menghasilkan karya tersebut, dimana karya tersebut adalah karya orisinil.

Abstract General welfare is the ideals of the Indonesian people as referred to in the 1945 Constitution of the Republic of Indonesia and one of the elements that must be realized by the government. One of the efforts to improve the quality of health both individuals and community groups by means of health services. The rapid advancement of technology has a positive and a negative impact, especially in the health sector. In addition to increasingly advanced tools, there are also online health services through the internet or online media which are often called Telemedicine. This study aims to analyze the juridical basis for doctors who perform online health services and physician responsibilities when negligent in the practice of health services to patients through telemedicine. Normative legal research is a type of research used. Approach to the concept and laws used. The technique of tracing legal materials uses document study techniques. The results showed that the legal basis for telemedicine was Article 42 by not forgetting the Good faith principle as the basis for its implementation. In the case of negligence the doctor in telemedicine responsible is the organizer of the system, explicitly stated in Article 15 of the ITE Law. Abstrak Kesejahteraan umum merupakan cita-cita bangsa Indonesia sebagaimana dimaksud dalam Undang-Undang Dasar Negara Republik Indonesia 1945 dan salah satu unsur yang harus diwujudkan oleh pemerintah. Salah satu upaya untuk meningkatkan kualitas kesehatan baik perorangan maupun kelompok masyarakat dengan cara pelayanan kesehatan. Kemajuan ilmu teknologi yang kian pesat memberikan dampak yang positif dan juga dampak negatif khususnya pada bidang kesehatan. Selain dengan alat-alat yang semakin maju terdapat juga pelayanan kesehatan secara online melalui internet atau media online yang sering disebut Telemedis. Penelitian ini bertujuan menganalisis landasan yuridis bagi dokter yang melakukan pelayanan kesehatan online dan tanggung jawab dokter apabila lalai dalam praktik pelayanan kesehatan terhadap pasien melalui telemedicine. Penelitian hukum normatif merupakan jenis penelitian yang digunakan. Pendekatan dengan kosnep dan perundang-undangan yang digunakan. Teknik penelusuran bahan hukum menggunakan teknik studi dokumen. Hasil penelitian menunjukkan dasar hukum pelayanan kesehatan secara telemedicine ialah Pasal 42 dengan tidak melupakan Asas Itikad Baik sebagai dasar dalam pelaksaannya. Dalam hal kelalain dokter dalam telemedicine yang bertanggung jawab adalah penyelenggara sistem, secara eksplisit dinyatakan dalam Pasal 15 UU ITE.
