Abstract

The difference perspectives about endowment among fuqaha is closely related to the respective concept of property (mal). The difference is about property in terms of what can be used as endowments. Do the waqf objects do not move, or move. Then can the objects moves such as money be a property that can be endowments. What is the formulation of the problem are What is meant by money waqf according to Sayyid Sabiq and Law No. 41 of 2004? Why is there a difference between the money waqf law of Sayyid Sabiq and Law No. 41 of 2004? What is the relevance of money waqf in Indonesia by using the rupiah currenlcny?This thesis research is library research. The method used is a qualitative method with a normative - juridical approach. The goals to be achieved with qualitative analysis are to explain a situation, or to analyze the validity of money waqf according to Law No. 41 of 2004 and the invalidity of money endowments according to the views of Sayyid Sabiq. In data analysis, the writer uses descriptive analysis method.The results of the discussion show that according to Sayyid Sabiq the waqf of legal money is invalid. According to him, if someone who will represent something that shows the waqf, it must be on condition that there is the possibility of benefiting from the goods being represented, with the item itself still in existence (baqau ‘ainihi). The legal reason for Sayyid Sabiq who argues that the endowment of illegitimate money is because the money endowments cannot be fixed (baqau ‘ainihi) when used to buy things such as candles, food, and perfume. The opinion of Sayyid Sabiq who considers the invalidity of money waqf is not relevant to the waqf regulations that apply in Indonesia. Because based on the legislation that applies waqf is not enough only with immovable objects but also includes moving objects such as money. This can be accessed from the types of endowments in Indonesia based on Law Number 41 of 2004 concerning Waqf and Government Regulation Number 42 of 2006 concerning the implementation of Law Number 41 of 2004 concerning Waqf, even though the currency in Indonesia uses the Rupiah is still dependent on foreign currency so it is feared that in the coming years there will be inflation, therefore every nominal represented by waqf there must be reserves in the form of gold, because gold tends to be stable and even the selling  price

Abstract

The State of the Republic of Indonesia is a legal state (rechstaat) where the principle of state law is to ensure the certainty, order and protection of the law aimed at obtaining the truth and not being a state based on power (machtstaat) or where power is subject to law. The development of the law in the life of the society requires legal certainty on the legal relationship of individuals and subjects of law. Law is one of the means that everybody needs to fill their lives, especially in the economic system that enters the era of globalization. The need is manifested in the form of clear legal products and has legal certainty and strict law enforcement action of law enforcement officials. The public's need for legal products as a written evidence tool in a courtesy proof resulted in every public lawsuit involving the parties to be included in a letter of law. If a particular article is made so as to be a means of proof, then the letter or article is called the act is a special writing made to be written evidence. The act as a written evidence tool in certain cases is a powerful evidence tool for parties bound thereto. It is clear that the authentic deed in society is a widespread public need in civil law as regulated by the KUHPerdata, especially on the need for written proof.

Abstract

AbstrakPerkawinan merupakan ikatan suci antara laki-laki dan perempuan untuk membangun keluarga bahagia, harmonis, sejahtera, unggul, dan berkualitas yang turut berkontribusi dalam mewujudkan program pembangunan keluarga nasional seutuhnya. Namun temuan empirik menunjukan, masih terdapat institusi keluarga yang belum mengoptimalkan tujuan perkawinan. Hal itu disebabkan oleh faktor ketidaksiapan usia perkawinan baik dari aspek fisik, psikis, maupun spiritual. Penelitian ini menerapkan metode pengambilan hukum istihsan terhadap tradisi perkawinan usia dini yang langsung mengalami kehamilan. Jenis Penelitian ini termasuk yuridis kualitatif. Teknik pengumpulan data dilakukan melalui studi kepustakaan dan eksplorasi data primer-sekunder yang kemudian dianalisa. Para ulama berbeda pendapat mengenai hukum menunda kehamilan: mubah, mubah muqayad, makruh, dan haram. Secara normatif praktik menunda kehamilan masih belum sampai pada tahapan hukum yang mewajibkan. Dengan mengkaji data temuan, ternyata praktik kehamilan perkawinan usia dini berimplikasi negatif (madharat) baik bagi dirinya, keluarga, masyarakat, bahkan bangsa. Kehamilan tersebut dapat menghambat pembangunan keluarga berkualitas. Atas dasar analisa metode istihsan dengan mempertimbangkan prinsip al-mashlahatu al-khas dan al-mashlahatu al-am dan kaidah daf’ul mafaasid muqadamu ala jalbi al-mashaali, maka hukum menunda kehamilan pada perkawinan usia dini adalah wajib. Kata Kunci: Analisa, Hukum, Perkawinan, Istihsan, dan Keluarga. Abstract Marriage is holy bond between boy and girl to build a happy family, harmonious, prosperous, superior, and quality who participated contribute in realize the program full national family development. However findings a empirical shows, still there is a family institution which has not optimized the purpose of marriage. This is caused by factors unpreparedness of marriage age both from physical aspects, psychic, and spiritual. This research applies retrieval method istishan law towards early marriage traditions who immediately experience pregnancy. This type of research includes juridical qualitative. Data collection technique conducted through literature studies and secondary primary data exploration which is then analyzed. The theologian has a different opinion regarding the law of delay pregnancy: mubah, mubah muqayad, makruh, and forbidden. Normatively practice delaying pregnancy still not arrived at the stage obligatory law. By reviewing findings data, evidently practice of pregnancy marriage early age have negative implication (madharat) good for him, family, society, even the nation. The pregnancy can inhibit quality family development. On the basis of istishan method analysis taking into account the principle al-mashlahatu al-khas and almashlahatu al-am and kaidah daf’ul mafaasid muqadamu ala jalbi al-mashaali, then the law delays pregnancy in early marriage is mandatory.Keywords : Analysis, Law, Marriage, Istishan, and Family

Abstract

AbstrakPerkembangan teknologi berdampak bagi aspek kehidupan ekonomi masyarakat. Munculnya finansial teknologi berbasis syaeiah memberikan kemudahan untuk mendapatkan dana yang diinginkan dengan waktu yang singkat dan mudah prosesnyaPenelitian ini akan menganalisis tentang kedudukan hukum ekonomi Islam di Indonesia dan apakah dasar  hukumnya serta perkembangan fintech syariah dalam perekonomian Indonesia. Metode penelitian yang digunakan adalah Yuridis Normatif dengan spesifikasi penelitian deskriptif analitis. Hasil penelian menunjukkan bahwa perkembangan hukum ekonomi Islam pada dasarnya sejajar dengan hukum ekonomi konvensional lainya. Ketika menggunakan layanan fintech syariah memiliki kemudahan yaitu antara penerima pinjaman atau pembiayaan tidak perlu bertatap muka langsung dan kebutuhan finanssial lebih mudah terpenuhi serta sebagaimana umat muslimyaitu melakukan kegiatan keuangan bersadasarkan syariah Islam. Kata kunci : Perkembangan, Ekonomi Islam, fintech syariah.

Abstract

Pelaksanaan pengelolaan wakaf saat ini dilakukan dengan inovasi baru oleh nadzir untuk lebih bermanfaat dan produktif. Salah satu pengelolaan wakaf yang demikian dilakukan oleh yayasan Pondok Pesantren Assalafiyah di Desa Luwungragi. Nadzir wakafnya mencoba mengembangkan tanah wakaf sebagai sarana untuk mengembangkan pondok pesantrennya untuk mencapai kesejahteraan pondok pesantren. Metode yang digunakan dalam penelitian ini adalah kualitatif dimana sifat penelitiannya deskriptif analisis. Teknik pengumpulan data dilakukan dengan cara observasi, wawancara (interview), dan studi dokumentasi. Dari hasil penelitiannya pengelolaan wakaf di Pondok Pesantren Assalafiyah menurut syariat Islam sudah sesuai dimana pada prinsip syariat harta wakaf tidak boleh dijual, diwariskan dan dihibahkan. Prinsip tersebut telah dilakukan pada Pondok Pesantren Assalafiyah dan dikelola dengan baik. Pendayagunaan tanah wakafnya sudah dimanfaatkan dengan baik sesuai dengan ikrar wakaf dimana tanah wakafnya didayagunakan untuk sawah sehingga lebih produktif dan berkontribusi maksimal untuk pengembangan pesantren. Kata Kunci: Pengelolaan, Pendayagunaan Tanah Wakaf, Produktif, dan Assalafiyah ABSTRACT The implementation of “wakaf” management nowdays involves new innovation by “nadzir” to make it more useful and productive. One of the management of “wakaf” is applied by Assalafiyah Islamic Boarding School in Luwungragi Village. The “nadzir” of “wakaf” attempts to improve “tanah wakaf” as medium to improve the quality of the Islamic Boarding School to achieve its prosperity. The method involved in this research is qualitative concerning on descriptive analysis. The technique to gather data involves observation, interview, and documentation. The result of the research shows that the management of “wakaf” at Assalafiyah Islamic Boarding School according to the principle of “Syariat wakaf” that “harta wakaf” is not allowed to be sold, to be inherited, and to be given. The principle has implemented at Assalafiyah Islamic Boarding School and it is managed well. The utilization of “tanah wakaf” is applied well and it is appropriate to “ikrar wakaf” between “wakaf” and “nadzir” that is “tanah wakaf” is used to be rice field so it is more productive and contributes maximally to the improvement of the Islamic Boarding School. Keywords: The management, The utilization of “tanah wakaf”, Productive, “Assalafiyah”.

Abstract

Freedom of expression is one part of human rights. In Indonesia as a country of law and democracy, the right of expression has been set in the constitution. Article 28 letter G of the Constitution of the Republic of Indonesia Year 1945 states that the State protects the freedom of the press and freedom of expression. But freedom of the press in conveying information to the public contrary to the legal interest in ensuring the protection of children's rights. Children's right to protection and guarantee of media coverage that guarantees the confidentiality of information of children when dealing with the law, the presentation of news about the child should be better and benefit, the information presented should protect children. When the children read the information in the electronic or print media, so your child can easily understand the information. Law No. 40 of 1999 concerning the Press indepeneden produce a state agency called the Press Council, the Press Council should control the news related to the rights of children, which is accessed by the whole society. The role of the Press Council in protecting the rights of children is to supervise and control the news about the child, the Press Council puts journalist organizations as partners in the enforcement of the code of conduct. Moreover, sanctions on journalists who violate the code of conduct can only be given by an organization of journalists and press companies. Journalist organizations can follow up the assessment and recommendation of the Press Council against unethical reporting.

Abstract

Hukum Islam (fiqh)  adalah salah satu produk hukum yang diambil dari nash-nash al-Qur’an yang bersifat dhanni (interpretable) melalui metodologi istinbathhokum (ushul fiqh) dari dalil-dalil terperinci  berkaitan dengan perbuatan mukallaf yang diambil dari al-Qur’an dan al-Hadits. Perkembangan hukum tentu diiringi dan disesuaikan dengan illat hukumnya baik ada atau tidak adanya illat hokum tersebut, hal ini tentu menimbulkan “konspirasi politik” hukum Islam sebut saja misalnya dengan dikodifikasinya buku Kompilasi Hukum Islam (KHI) tidak menutup kemungkinan muatan politik praktis bersentuhan di dalamnya.Terbitnya buku Kompilasi Hukum Islam yang diramu dari berbagai kitab fiqh melalui tahapan-tahapan peraturan pemerintah sangat dibutuhkan bagi kemaslahatan masyarakatmuslim di Indonesia.Nash-nash hukum syara’ yang kemudian menjadi syariat hukum Islam baik yang berkaitan dengan kemashlahatan manusia tidak terlepas dari kebutuhan pokok (dharuri), kebutuhan sekunder (hajiyyah) dan kebutuhan pelengkap (tahshiniyyah). Kata Kunci : Konspirasi, kemaslahatan, syariat dan nash ABSTRACT Islamic law (fiqh) is one of the legal products taken from the Qur'anic texts which are dhanni (interpretable) through the istinbathhokum (ushul fiqh) methodology of detailed arguments relating to mukallaf actions taken from the Qur ' an and al-Hadith. Legal development is certainly accompanied and adapted to the illat of the law, whether or not there is a legal illat, this certainly raises the "political conspiracy" of Islamic law, for example, with the codification of the Compilation of Islamic Law (KHI) does not rule out the possibility of practical political content in it. The publication of the book Compilation of Islamic Law which is mixed from various books of fiqh through the stages of government regulation is needed for the benefit of the Muslim community in Indonesia. Syara law texts' which later became sharia law both related to human welfare are inseparable from basic needs (dharuri ), secondary needs (hajiyyah) and complementary needs (tahshiniyyah). Keywords : Conspiracy, benefit, Shari'a and texts

Abstract

Ulama sepakat bahwa seorang saksi harus beragama Islam. Syarat yang sama, khususnya pada akad nikah, juga diadopsi peraturan perundangan Indonesia. Tetapi, dalam kenyataannya, tak jarang seorang yang non-muslim jadi saksi pada perkawinan muslim dengan muslim, baik pada akad nikah, rujuk dan terutama sekali dalam penyelesaian perkara perceraian di Pengadilan. Hal itulah yang jadi masalah penelitian ini; bagaimana status non-muslim sebagai saksi dalam perkawinan menurut hukum Islam.Tujuan penelitian ini adalah untuk mengetahui kedudukan saksi non-muslim dalam perkawinan menurut hukum Islam. Untuk mencapai tujuan itu dipakai metode kualitatif dengan pendekatan studi kepustakaan (library riset). Sumber penelitian terdiri atas bahan-bahan hukum primer dan bahan-bahan hukum sekunder. Bahan sumber primer berupa kitab-kitab fikih dari empat mazhab Ahli Sunnah. Sementara bahan-bahan hukum penelitian ini adalah buku teks yang berisi prinsip-prinsip dasar ilmu hukum dan pandangan-pandangan sarjana dan ahli hukum Islam. Anlisa terhadap temuan penelitian dilakukan dengan mengggunakan metode berfikir deduktif dan induktif.Dari bahasan yang dilakukan dapat disimpulkan: berdasarkan surat al-Nisa' (4) ayat 141 dan sabda Nabi Saw bahwa “Tidak dibolehkan kesaksian pemeluk satu agama terhadap pemeluk agama lain, kecuali umat Islam”, maka hukum Islam tidak memandang sah akad nikah, talak dan rujuk dengan saksi non-muslim. Abstract

AbstrakArtikel ilmiah ini membuktikan bahwa hukum wanita karir dalam Islam dengan merujuk kepada pendapat para ulama dan fuqaha sangat beragam. Pandangan bahwa wanita tidak boleh berkarir di luar rumah secara totalitas dibantah dalam artikel ini. Wanita lebih utama di rumah memang benar, namun bukan berarti berkarir bagi wanita di luar rumah itu tidak boleh. Islam mengatur secara gamblang dan jelas bagaimana seharusnya wanita yang ingin berkarir. Berkarir di luar rumah juga pernah dilakukan oleh para wanita di zaman Nabi Muhammad Saw, termasuk istri-istri beliau dan para shahabiyyah (sahabat dari kalangan perempuan). Kajian ini mengajak para pembaca terutama para laki-laki untuk lebih arif dalam memandang wanita karir. Selain itu,  agar para wanita karir paham akan hukum Islam dalam berkarir sehingga tidak melewati batas-batas yang telah ditetapkan dalam Islam.AbtractThis scientific article proving that legal career women in Islam by referring to the opinion of the scholars and jurists are very diverse.The view that women should not be a career outside the home in totality is contradicted with the conclusion this article.Women better at home it is true, but it does not mean a career for women outside the home it should not be. Islam set in stark and clear how should women who want a career. A career outside the home has also been done by women at the time of the Prophet Muhammad's wives, including she and his shahabiyyah.This study invites readers especially the males to be more discerning in looking at career women. Abstract

The nature of law rests on the idea of justice and moral strength. Justice and injustice according to a law will be measured and judged by a morality that refers to human dignity. Judges participate in the formation of law, not objectively like the law created by legislators, but judges apply abstract text of the law to concrete legal events. This paper discusses the role of judges in ensuring legal certainty and justice in society, especially in handling criminal cases. This study uses a normative and philosophical analysis of the application of the principle of judicial independence in the resolution of criminal cases in the Indonesian criminal justice system. This paper concludes that judges as the spearhead of the enforcement of justice need to have the same perception about the application of the principle of judicial independence in carrying out criminal offenses. It is hoped that the uniformity of mindset in applying these rules from judges throughout Indonesia is no longer the case with the disparity in the conviction, which results in public dissatisfaction with the judge's decision.
