Abstract

Buying and selling transactions at Pasar Raya Sangkumpal Bonang are carried out with ethics that are not commendable by the seller to the prospective buyer so that the validity of the sale and purchase needs to be reviewed. The method used to solve the problem in this study is a type of field research with a case study approach to the ethics of the seller of Toko X Pasar Raya Sangkumpal Bonang Padangsidimpuan, the data sources in this study are primary and secondary data sources. Primary data sources consist of interviews with sellers and buyers. Meanwhile, secondary data sources refer to journals and books that are relevant to the researcher's discussion. Based on these problems, researchers will analyze using the theory of Islamic business ethics. based on the results of the study that the practice of transactions carried out by sellers and buyers is null and void because there is an element of coercion carried out by the seller.

Abstract

Along with the increasing number of publications in the field of digital zakat, it is necessary to study and research related to zakat management to obtain general concepts that are used as policy standards by zakat management practitioners and national zakat regulators that aim to provide knowledge about zakat management in an easy, flexible, transparent and right on target manner. This study is field research that observes actual events in society and aims to describe the state or status of a phenomenon using empirical legal research methods and an interdisciplinary approach, namely sociological and ethnographic studies. The results of this study state that the correct distribution of zakat requires an understanding of its fiqh, which is based on the arguments contained in shari'a texts that are explored through a linguistic approach (al-qowâid al-lughawiyyah) as well as an objective shari'a approach (maqâshid asy-syarî'ah). In addition, collecting zakat funds by national amil zakat agencies and institutions in Indonesia must be by the times and technology as an alternative that will make it easier for muzakkī's to meet their needs.

Abstract

The role of the state in the economic growth of society can never be ignored. There is a strategic role of the state to regulate wealth nationally, to distribute wealth to all those in need. Something most people don't realize. Sheikh al-Islam Ibn Taimiyah in addition to producing works in the field of economics. His thoughts came to examine the fundamental role of the state in the economy. Ibn Taimiyah seemed to formulate the relationship between the state and the practice of sharia economics, the position of the state became closer in supervising the practice of muamalah. Based on the description above, this paper discusses Ibn Taimiyah's economic thought, in terms of its rationalization, to the strategic steps found.

Abstract

Abstract

The current development, instant culture, and efficient dos in every activity of business, need to use the standaard contract. It is believed that businessmen make the standard exoneratie clause unilaterally and the consumer don’t have choices for doing negotiation or bergaining position, when make transactions. For example; the eksemsi clause, the determination of the interest clause, the entire immediate payment clause of financial lease, the forbidding returned item clause of buying, the risky clause, the delayed clause in transportation, the clause of forbidding brought food in karaoke business. Based on the desctiption, this article will explore The Validity Of Clauses Of The Standaard Contract In The Perspective Of Islamic Law. This article explores the fundamental of the legal agreement, the legal culture of Indonesia, and the fundamental of the Islamic law agreement. This article rediscovers that the fundamental of the Islamic law agreement is the ibahah fundamental, the free fundamental, the consented fundamental, the pact fundamental, the balance fundamental, the beneficial fundamental, the honest fundamental, and the fair fundamental. This article stresses that the standaard contract is ably, because corresponding to the ibahah fundamental and the free fundamental. But the clauses weren’t corresponding to the free fundamental, the consented fundamental, the balance fundamental, the beneficial fundamental, the honest fundamental, and the fair fundamental. Consequently, the validity of the clauses isn’t fulfilled. Perkembangan zaman, budaya instan dan upaya efisiensi dalam setiap kegiatan bisnis, mengharuskan untuk penggunaan perjanjian baku. Umumnya perusahaan membuat klausula eksonerasi perjanjian baku secara sepihak dan pihak konsumen tidak memiliki kesempatan untuk melakukan negosiasi atau tawar menawar ketika melakukan transaksi. Sebagai contohnya; klausula eksemsi, klausula penetapan bunga, klausula pembayaran seluruh seketika dalam sewa beli, klausula barang tak boleh dikembalikan dalam jual beli, klausula risiko (cacat dalam leasing dan kehilangan dalam jasa parkir), klausul penundaan jadwal di bidang transportasi, dan klausula larangan membawa makanan dalam usaha karaoke. Berdasarkan uraian tersebut, tulisan ini akan membahas keabsahan klausul eksemsi pada perjanjian baku dalam perspektif hukum Islam. Tulisan ini mengkaji asas-asas hukum perjanjian konvensional, budaya hukum Indonesia, dan asas-asas perjanjian dalam hukum Islam. Tulisan ini menemukan bahwa asas perjanjian hukum Islam meliputi; asas ibahah, asas kebebasan, asas konsensualisme, asas janji mengikat, asas keseimbangan, asas kemaslahatan, asas amanah, dan asas keadilan. Tulisan ini menegaskan bahwa pada dasarnya perjanjian baku boleh, sebab sesuai dengan asas ibahah dan asas kebebasan. Namun klausul eksemsi tidak sesuai dengan asas kebebasan, asas konsensualisme, asas keseimbangan, asas kemaslahatan, asas amanah dan asas keadilan. Sehingga dapat dinilai bahwa keabsahan klausula eksemsi tidak terpenuhi.

Abstract

The practice of digital-based work contracts is experiencing rapid development, one form of business that uses digital-based work contracts, namely Mediapreuner, an example of a fairly large Mediapreuner business model in Indonesia, namely the Pikiran Rakyat Media Network (PRMN). The reality found on the ground, digital work contracts have been carried out massively, even by business networks that are national in scale. This seems to reconstruct the work contract culture that has been widely practiced by business people, starting from the MoU process. This then encourages researchers to carry out an in-depth observation process to dissect the engagement scheme, clauses in the contract, as well as the factors that influence business people to trust each other in digital work contracts. The practice of digital contracts of work at PRMN is an agreement in the form of cooperation between 3 parties. Strong reasons that encourage parties to be able to organize and maintain digital employment contracts are the parties' trust and track record of income.

Abstract

Cryptocurrencies experienced a huge surge whose value reached more than US $ 191 million or Rp. 2.7 trillion. Interestingly, almost all types of cryptocurrencies do not have an underlying asset as a common underlying asset in ordinary investments. Bitcoin and Ethereum claims that its underlying asset is the coin miner charges from the amount of hardware and electricity used in the transaction. Tether and USDC claim that their underlying assets are in US dollars. This article examines Islamic law regarding the underlying assets in the form of coin mining fees and US Dollars. The questions that arise are, how is the study of Islamic law regarding the underlying asset in the form of coin mining fees and US Dollars? Furthermore, the ideal pattern of a cryptocurrency scheme that includes assets in the form of tangible goods refers to manafiul a’yan? This research uses the gate of legal philosophy approach, looks at the business scheme in terms of values and principles and then provides legal conclusions based on that assessment. From the research conducted, first, the underlying asset of coin mining costs cannot be said to be an underlying asset that is truly economically useful for coin owners, except for the technology access costs which are clearly experienced by all technologies. Second, the underlying asset in the form of US Dollars has clearer benefits, but this is contrary to Islamic law. Third, for the underlying asset in the form of tangible goods, ownership must always be included in every coin purchased.

Abstract

This study explores the philosophical values and human rights implications within the Bajapuik tradition, a distinct matrimonial practice of the Padang Pariaman tribe in Sumatra. Explores the philosophical values of the unique amalgamation of local wisdom and Islamic law as an example of integrating cultural heritage with religious principles in marriage. As qualitative descriptive field research, data were gathered from interviews and documentation from a diverse group of informants, including religious leaders, traditional leaders, community leaders, and the people of Padang Pariaman. By utilising a sociological approach, the study examines the social realities of the Bajapuik tradition, mainly focusing on its dowry practice, particularly the maslahah (general welfare) concept. Contrary to typical dowry practices, in the Bajapuik tradition, the bride’s family provides the dowry to the groom, symbolising respect and equality rather than economic burdens. This study highlights that the Bajapuik tradition is not merely a transactional stage in the marriage process but a more profound expression of community bonds and shared values. The findings emphasise the strong philosophical values of mutual respect and companionship inherent in the Bajapuik tradition, demonstrating its alignment with Islamic law and human rights values. This research reveals how the Minangkabau’s adherence to religious and local wisdom significantly reinforces human rights within traditional practices. Furthermore, the study examines the extent to which the Bajapuik tradition achieves the objectives of maslahah in marriage. The results show that the Bajapuik tradition supports general welfare (maslahah) by strengthening social bonds, upholding the dignity of women, and ensuring justice and equality in marital relationships, offering a new perspective rarely explored in previous studies.

Abstract

This study examines the integration of Islamic humanitarian values and modern ulama thoughts in shaping child protection policies in Indonesia. Grounded in Islamic values, including insights from Qur’anic injunctions and prophetic traditions, it highlights the parental responsibilities of safeguarding children's education, health, and overall well-being. Fathers are assigned the duty of providing sustenance, while mothers are entrusted with the primary role of nurturing and caring for their children, as emphasized by scholars such as Wahbah az-Zuhaili and Sayyid Sabiq. The findings illustrate how these principles align with Indonesia's cultural and social contexts, offering a comprehensive framework for addressing child labor and exploitation. The study presents actionable recommendations, including strengthening legal frameworks rooted in Islamic humanitarian values, empowering families through education on children’s rights, and fostering collaboration among policymakers, religious leaders, and civil society. By integrating Islamic values with contemporary challenges, this article contributes novel perspectives to the discourse on child protection, proposing culturally relevant and ethically grounded solutions. These insights aim to guide the development of effective, child-centered policies that uphold both humanitarian and Islamic ideals

Abstract

This research aims to explore the optimization of PNAs for asset protection by integrating the principles of maqashid sharia, which emphasize the protection of religion, life, intellect, progeny, and wealth. The high divorce rates in Indonesia, mainly due to online gambling, highlight the vulnerability of asset protection at the beginning of marriage and underscore the importance of prenuptial agreements (PNAs). This research uses a qualitative approach with normative juridical analysis methods. Secondary data was obtained through critical analysis of related literature, including the Indonesian Marriage Law, previous academic studies, and other legal documents related to the PNA. The descriptive-analytical method is used to evaluate the effectiveness of PNA in protecting assets based on maqasid sharia principles. The main question addressed is how PNAs can be effectively utilized to safeguard personal assets and reduce conflicts within marriage. This study critically analyzes Law No. 16/2019 Indonesian Marriage Law and suggests improvements to enhance the effectiveness of PNAs. The analysis reveals that detailed provisions on the content of PNAs, simplification of the legalization process, mandatory legal consultation, and enhanced public education are essential for optimizing asset protection. The findings underscore the necessity of PNAs in providing legal certainty, promoting justice, and ensuring the welfare of both parties in marriage, aligning with the maqashid sharia principles. This research contributes to the existing literature by offering a new perspective on applying Maqashid sharia in PNAs and provides practical guidelines for drafting effective and Sharia-compliant PNAs.
