Abstract

Gender's existence today is strongly influenced in every aspect of human life. One of them is the application of gender in customary inheritance law in Baumata Village, Taebenu District, Kupang Regency. This type of research is empirical research conducted in Baumata Village, Taebenu District, Kupang Regency and the data source used is primary data. Primary data is data obtained directly from the research location through direct interviews with respondents. Based on the results of this study is that the Baumata village community still maintains the position of inheritance rights, namely boys are still more dominant in getting inheritance rights but not to get the inheritance rights. The timor community in baumata village still maintains the inheritance rights distribution system because it still adheres to patrilineal culture.

Abstract

Land is one of the most needed investments from time to time. The demand for land is starting to show with the increasingly rapid human growth, while the land for land is not increasing. In de facto, there are still tribal lands in NTT, but the power of indigenous peoples over tribal lands is no longer fully because what was previously considered as shared land, as a result of the individualization process has changed to individual ownership, this is partly because there are no regulations governing the existence of indigenous peoples and customary land or customary land. The lack of protection for indigenous peoples in Kupang Regency not only means that it has not been recognized by the state but also causes the existence and wealth of indigenous peoples, including customary lands, to be vulnerable to various interests both from within the indigenous peoples themselves and pressure from outsiders. This Community Service activity aims to explain in detail the existence of customary land in Kupang Regency, how important and urgent it is to provide protection for customary law communities and what kind of protection mechanism from the state is considered appropriate to the current characteristics of the Kupang Regency customary law community. The method used in this activity is lecture and question and answer. The results of the activity showed that the community was very enthusiastic about hearing and listening carefully to the explanations presented by the resource persons so that interesting discussions ensued. Through this activity, the community also gains new knowledge related to the existence of customary land. From the results of this activity it can also be concluded that the implementation of the activity in general went well because of the collaboration with various parties in the target location, namely the Kuimasi Village Office, Fatuleu District, Kupang Regency and also the target community (participants namely village officials, community leaders and the community ) in Kuimasi Village, Fatuleu Sub-district, Kupang Regency really hopes for further socialization in the field of law.

Abstract

Land in the juridical sense is the surface of the earth, land rights are rights to a certain portion of the earth's surface, which is limited, has two dimensions with length and width. No human being or any group of people can be separated from land. Land can be used for development, both in infrastructure such as roads, irrigation, telecommunications and in the fields of agriculture, animal husbandry, mining, housing so that currently land has very high economic value. This will of course trigger land disputes. One of the factors that causes land disputes is the large number of lands owned by residents who do not yet have land certificates, and also in the process of issuing land certificates, the principle of caution in examining juridical and technical data is not implemented properly. Based on the background above, the problem formulation is put forward as follows: (1) Has the Nagekeo Regency Land Office in issuing land title certificates paid attention to the precautionary principle? (2) Does the land title certificate issued provide legal certainty and act as strong evidence? This research was carried out at the Nagekeo District Land Office. This research is empirical legal research, which is carried out by looking at the realities that exist in field practice. Based on the results of the research that has been carried out, it was found that: (1) To find out the application of the precautionary principle in issuing land title certificates, it can be seen from the land services provided by the Nagekeo Regency Land Office, which refers to the Regulation of the Head of the National Land Agency of the Republic of Indonesia Number 1 of 2010 concerning Service Standards and Land Regulation. The procedure for issuing activity certificates includes checking juridical data and checking technical data. (2) The land title certificate issued guarantees legal certainty and is strong evidence but is not the only evidence so that the certificate issued can still be challenged.

Abstract

The aim of this research is to find out the concepts of entitled authority and acting authority in civil law as well as the relevance and implications of regulating entitled authority and acting authority in civil law practice. The type of research used by the author is Normative Law research, the type of data used in this research is qualitative data. The data used in research is based on the relevance of the source data, namely primary and secondary data. The results of this research are that the results of the research show that Rightful Authority is defined as the authority of an individual or a legal entity to carry out a legal act in a community's social life which is considered valid because it constitutes his or her essence as a human being or individual or as a legal entity while the Authority to Act is defined as Special authority. The special authority referred to is authority that only applies to certain people and for certain legal actions, whereas the relevance and implications show that there is no relevance in regulating the authority to have rights and the authority to act in civil law. This is shown by cases that frequently occur. for example, early marriage.

Abstract

An endorsement cooperation agreement (Endorsement Agreement) is a collaboration or contract entered into by two parties via social media. This collaboration is not like other agreements, namely written, but all forms of agreement are made via social media based on the principle of freedom of contract. So that in its implementation, defaults often occur by one party or two parties. The purpose of this research is to find out how the Endorsment Agreement between Kopi Papa Ganteng and Instagram Celebrities is implemented and how to resolve disputes regarding default on the Endorsement Agreement between Kopi Papa Ganteng and Instagram Celebrities. The research method used is an empirical legal research method where researchers obtain data directly from the field and obtain information regarding research studies from Kopi Papa Ganteng and Instagram celebrities in Kupang City. Data collection techniques are by means of interviews and literature studies in the form of books, laws and regulations and other materials related to the problem being studied. The results of this research show that: First, the implementation of the Agreement between Kopi Papa Ganteng and Instagram Celebrities meets the requirements for the validity of the agreement in Article 1320 of the Civil Code where: there is an agreement between the parties, according to those who made it, there is a certain thing and there is a lawful cause. Kopi Papa Ganteng will contact celebgrams via social media, to endorse several Kopi Papa Ganteng drink products individually. If the celebrity agrees, the endorser provides a price list to Kopi Papa Ganteng. Then, after approval, the endorsement fee payment transaction process occurs, which in this case is 50% and will be paid off after being posted by the celebgram. Second, dispute resolution for celebgrams and Kopi Papa Ganteng regarding non-compliance with the Endorsment Agreement is carried out through amicable settlement without reporting to the authorities. And all disputes were resolved thoroughly by Kopi Papa Ganteng and celebgram. Out-of-court dispute resolution is regulated in Law of the Republic of Indonesia no. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution.

Abstract

The price difference between the price tag and the cashier's price that occurs at Suba Suka Store is a form of violation of consumer rights, so that legal certainty is needed to protect the rights and obligations of consumers and business actors. The formulation of this research problem are: (a) How is legal protection for consumers who experience price differences between price tags and cashier's prices according to Law Number 8 of 1999 concerning Consumer Protection? (b) What is the responsibility of business actors regarding price differences between price tags and cashier's prices experienced by consumers at Suba Suka Store, Kupang City? The objectives of this research are: (a) To determine the legal protection for consumers who experience price differences based on Law Number 8 of 1999 concerning Consumer Protection; and (b) To determine the form of responsibility of business actors in handling the problem of price differences at Suba Suka Store in Kupang City. The results showed that (a) Legal protection for consumers who experience price differences is clearly regulated, but in its implementation based on existing provisions, it has not been carried out properly because there has been no complaint to be resolved directly by the authorized party, namely BPSK at the NTT Provincial Disperindag, so that when consumers file a complaint (b) the form of responsibility of the Suba Suka Store is to provide prices according to what is found by the store, the rest is the right of consumers to decide to continue or cancel the transaction. The conclusions in this paper are: (a) The legal protection provided has not been implemented properly because it has never been resolved by the authorized party, either directly or indirectly (b) errors in the price tag and cashier's price are things that need to be paid attention to again by the Suba Suka Store to become their full responsibility to solve the problem of price differences that occur. The author's suggestions (a) it is necessary to increase supervision and provide socialization about consumer protection (b) every business actor pays more attention to replacing price tags (c) consumers are expected to be smarter and increase awareness when they realize their rights are being violated (d) to further researchers so that they can continue this research to support this thesis.

Abstract

The purpose of writing This For understand the review of Islamic law regarding the practice of buying and selling breast milk (ASI) in Ujung Pandang District, Makassar City. The theoretical benefit of this research is that it is hoped that this research can provide a useful contribution to the development of knowledge regarding the buying and selling of breast milk in society and the attitude of the government and religious figures towards the practice of buying and selling breast milk (ASI) in handling it and practically, it is hoped that this research can help provide ideas for the community and readers regarding the buying and selling of breast milk from the perspective of Islamic law. The research method is empirical juridical research. The results of this research show (1) An overview of Islamic law regarding the practice of buying and selling breast milk (ASI) in Makassar City, especially in Ujung Pandang District, namely that it should not allow buying and selling breast milk (ASI), because there are many disadvantages (damage/danger). Because the buying and selling of breast milk (ASI) which is carried out through the Indonesian Association of Breastfeeding Mothers (AIMI) does not have recorded data so the source of breast milk (ASI) is not clear between the sellers and buyers of breast milk (ASI). (2) Factors that influence the practice of buying and selling breast milk are as follows: 1. Economic factors, where the perpetrators of buying and selling breast milk (ASI) are breastfeeding mothers who are still young and some of them are not able to produce breast milk. (ASI) is good, where the perpetrators of buying and selling breast milk (ASI), especially respondents who sell breast milk (ASI), experience financial shortages, so they choose to sell breast milk (ASI) through the Indonesian Breastfeeding Mothers Association (AIMI). 2 the religious factor, which is due to a lack of education and support from the family so that many perpetrators of buying and selling breast milk (ASI) do not really understand the importance of religious knowledge in carrying out the practice of buying and selling breast milk (ASI). Conclusions of Writer are: (1) Overview Islamic law regarding practice sell buy breast milk (ASI) in Makassar City, especially in Ujung Pandang District , namely should No allow exists sell buy breast milk (ASI), because Lots harm ( damage / danger ). Suggestions from Writer are: (1) It is better not to breastfeed (ASI). bought and sold in a way illegal nor free. (2) Necessary exists supervision morestrict from institution government nor non- governmental institutions local about practice sell buy breast milk (ASI) so you don't happen.

Abstract

This research was conducted at the Baun weekly market. The background to this research is markets that should provide quality, clean and halal food, however carrying out trade in animal meat that does not comply with sales standards. The problem studied is animal husbandry procedures in selecting livestock for farming slaughter at the baun market and the role of supervisor and responsibilities of the district livestock service Kupang, the role of breeders in terms of consumer protection regarding the sale of animal meat (Cow and Pork) at the baun market. This research uses empirical methods or methods with data obtained from direct interviews in the field. 1) Procedures for cattle breeders and pigs to be slaughtered according to procedures and supervised directly by the livestock service Kupang Regency and the quality of the meat produced is safe and high quality at the Baun market. 2) Supervision of animals and animal meat (beef and pork) is carried out by veterinarians, breeders, Kupang district livestock service, BPOM, health service, (LPPOM MUI), (BPKN), (LSPK), market foremen, and sub-district/district governments.

Abstract

Public services today are additional needs whose role is very important in society because they can relieve the community and help national development which aims to realize a just and prosperous society in the era of economic democracy. However, public services are indeed loaded with various problems, what's more, the range itself is very wide, covering both the profit and non-profit sectors. One of the means of shipping goods that can be used is PT Pos Indonesia. Atambua Branch Post Office is one of the branches of PT Pos Indonesia which operates for the Belu Regency area, East Nusa Tenggara Province. The formulation of the problems in this study are (1) How is the responsibility given by PT. Pos Indonesia Atambua Branch for the delivery of lost or damaged goods? (2) How are the obstacles to the implementation of the responsibility for lost or damaged goods provided by PT. Pos Indonesia Atambua Branch? The type of research used by the author is Empirical Legal research, the type of data used in this research is qualitative data. The data used in the research based on the relevance of the source data, namely primary and secondary data. The results of the study suggest that: (1) Liability for lost shipments by PT Pos Indonesia Atambua Branch, namely by providing compensation of 1 (one) x shipping costs and plus one time compensation guarantee that has been included in the proof of delivery receipt. If the shipment is damaged but part of the shipment can still be functioned, PT Pos Indonesia Atambua Branch provides compensation of 1 (one) x shipping costs and plus half x the cost of the guarantee of compensation that has been included in the proof of delivery receipt, but if it is totally damaged and loses its function, it will be given compensation of 1 (one) x shipping costs and add 1 (one) x the cost of compensation that has been included in the proof of delivery receipt. (2) The inhibiting factors are the lack of communication between PT Pos Indonesia and service users, negligence from PT Pos Indonesia Atambua Branch (Courier) which still often closes communication with the Foreman related to these problems.

Abstract

Kesulitan UMKM untuk mendapatkan sumber pembiayaan dari bank bukan semata-mata terbatasnya jaminan yang bisa disediakan oleh UMKM tetapi bisa juga bersumber dari pemahaman dan anggapan yang sering berlebihan dari sebagian besar lembaga perbankan bahwa melayani usaha kecil mengandung resiko tinggi serta melayani usaha kecil yang jumlahnya banyak sangat merepotkan dan meningkatkan biaya transaksi. Penelitian ini merupakan penelitian hukum empiris, yaitu dilakukan dengan melihat kenyataan yang ada dalam praktik lapangan. Pendekatan ini dikenal juga dengan pendekatan secara sosiologis yang dilakukan secara langsung ke lapangan. Data dianalisis secara deskriptif-kualitatif. Berdasarkan hasil penelitian yang telah dilakukan, diperoleh bahwa: (1) Kedudukan penjamin dalam pemberian kredit bagi UMKM pada Bank TLM Kupang, yakni: Penjaminan kredit dapat menjadi jembatan bagi mereka yang layak usaha namun belum layak mendapatkan kredit. Kedudukan penjaminan kredit disini sangat diharapkan dapat memberikan pemberian kredit kepada UMKM secara sehat, dikarenakan adanyakendala dalam tidak tersedianya kecukupan agunan yang memadai. Penjamin berfungsi sebagai penguatan agunan sehingga dapat melindungi kreditur dari risiko kredit macet. (2) Syarat yang harus dipenuhi seseorang untuk menjadi seorang penjamin dalam pemberian kredit usaha mikro, kecil dan menengah (UMKM) pada Bank TLM Kupang, antara lain: (a) Memeriksa permohonan kredit yang merupakan langkah awal yang dilakukan oleh seorang nasabah sebelum melakukan kredit pada bank. (b) Menganalisa kredit atau mengkaji kelayakan dari suatu permohonan kredit. Tujuannya yaitu untuk memperoleh keyakinan, apakah permohonan kredit mempunyai kemampuan dan kemauan memenuhi kewajibannya mengembalikan pinjaman. (c) Adanya persetujuan kredit yang akan dilakukan sebelum melakukan pencairan kredit. (d) Pencairan kredit apabila seluruh prosedur pemberian kredit sudah dilakukan. Saran dari penulis ialah diharapkan dalam pelaksanaan pemberian kredit bank bagi UMKM, bank pelaksana yang telah ditunjuk oleh pemerintah agar dapat melayani dengan baik UMKM yang telah bermohon untuk mendapatkan kredit agar dapat mengembangkan usaha sehingga dapat menyerap tenaga kerja.
