Abstract

Polygamous marriage in Indonesia can be carried out by fulfilling the requirements stipulated in the legislation. However, if these requirements are not met, the marriage can be annulled. The Surabaya High Court Decision No. 343/Pdt.G/2023/PTA.Sby is one such decision regarding a lawsuit for the annulment of a marriage filed by the first wife against her husband's polygamous marriage with the second wife, which was conducted without the consent of the lawful first wife. The decision stated that the lawsuit could not be accepted because the marriage proposed for annulment had already been dissolved due to death. This study aims to understand the basis for the lawsuit to annul the second marriage and the legal consequences on the status of the second marriage from the perspective of the Marriage Law and Civil Procedure Law. The author conducted this research using a normative juridical approach with a descriptive-analytical research specification. Data collection techniques were carried out through literature studies that gathered primary, secondary, and tertiary legal materials. The data analysis method was conducted through a normative qualitative method to address the legal issues in this study. Based on the research results, it can be concluded that the basis for the lawsuit to annul the second (polygamous) marriage did not meet the marriage requirements stipulated in Article 3 paragraph (2) of the Marriage Law, which states that a person engaging in polygamy must have the consent of the parties concerned. Furthermore, the legal consequence of the Surabaya High Court Decision No. 343/Pdt.G/2023/PTA.Sby, which stated that the lawsuit could not be accepted because the marriage had been dissolved due to death, is that the second marriage existed (was valid) along with its legal consequences.

Abstract

Undang-Undang Nomor 16 Tahun 2019 Perubahan Atas Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan (UU Perkawinan) merupakan sebuah sumber hukum perkawinan di Indonesia. Tujuan dari penulisan ini adalah untuk mendapatkan gambaran perkawinan terhadap praktik perkawinan masyarakat di Kampung Urug Kabupaten Bogor dikaitkan dengan Undang-Undang Perkawinan. Untuk memperoleh mengenai keselerasan dan kesesuaian hukum menurut UU Perkawinan dan hukum adat terhadap praktik perkawinan masyarakat di Kampung Urug Kabupaten Bogor. Berdasarkan hasil penelitian mengenai praktik pelaksanaan perkawinan masyarakat Kampung Urug Kabupaten Bogor adalah telah sesuai dengan syarat sah perkawinan menurut UU Perkawinan. Untuk adanya suatu hal yang dilakukan secara adat tetap tidak dapat dikesampingkan atau tetap harus dilakukan dan dilaksanakan karena keyakinan masyarakat terhadap para leluhurnya masih cukup besar, namun hal-hal tersebut tidak berlawanan dengan UU Perkawinan.

Abstract

This article discusses the issue of the legal validity of marriage contract in the case dowry is paid by a third party.  Legal analysis will be performed on the legal principles and regulations found in The Law Number 1 Year 1974 on Marriage, The Compilation of Islamic Law and sources in Islamic Law .  One important finding is does not forbid the payment of dowry by a third party and that this practice does not affect the validity of the marriage contract.

Abstract

In the context of marriage law in Indonesia, divorce brings a number of legal consequences, one of which is the division of joint property. This situation becomes more complex when the couple does not have a marriage agreement and when the wife carries out her husband's obligations in earning a living. Examples of cases like this are contained in Supreme Court Decision Number 266/K/AG/2010 and Supreme Court Decision Number 1636/K/Pdt/2018. This research aims to explain the legal provisions and legal consequences of divorce on the distribution of joint assets between couples without a marriage agreement and wives who carry out their husband's obligations based on the perspective of marriage law and Islamic law. This research uses a normative juridical approach with analytical descriptive research specifications. Data collection techniques were carried out through literature study and interviews. The data analysis method used is qualitative juridical. The research results show that in resolving the implementation of the division of joint assets in marriage in Indonesia, legal practitioners can be guided by the Marriage Law and the Civil Code as the legal basis for resolving the division of marital assets. This is in accordance with Article 37 of the Marriage Law which states that in the event of a divorce, joint property is regulated according to respective laws. However, if there is a case where the wife carries out her husband's obligations in terms of earning a living, it will be returned in accordance with the Judge's decision based on consideration of supporting evidence and the portion of each party's contribution to the joint assets collected.

Abstract

Marriage is sacred, involving various things, namely the parties concerned, religion and beliefs, even relating to living law and national law. Based on Islamic law, the legal requirements of marriage, namely the pillars of marriage, must be fulfilled. One aspect of the pillars of marriage is that there must have a marriage guardian, but there are parents who are not willing to become marriage guardians because khitbah is not carried out. This study aims to examine how the legal position of marriage that is not approved by parents because khitbah is not carried out. This research method is normative legal research, where secondary data is used, namely legal materials in the form of related laws and regulations, as well as Islamic law. As a result, khitbah is not an aspect that determines whether a marriage is valid or not. Marriage is considered valid if the prospective bride and groom follow the provisions of the pillars of marriage.

Abstract

Manusia terlahir sebagai laki-laki atau perempuan, namun ada kondisi tertentu disebut ambiguous genitalia atau khuntsa, di mana status kelamin tidak jelas. Ulama Fiqih membagi khuntsa menjadi dua jenis: Khuntsa Musykil, yang sulit ditentukan jenis kelaminnya meskipun dengan berbagai cara, dan Khuntsa Ghairu Musykil, yang status kelaminnya masih dapat diketahui. Ketidakjelasan ini berdampak hukum, terutama dalam menentukan hak waris. Penelitian menggunakan metode yuridis normatif dengan pendekatan deskriptif-analitis melalui studi pustaka dan lapangan. Analisis data dilakukan secara yuridis kualitatif. Hasil penelitian menunjukkan bahwa hak dan kewajiban ahli waris khuntsa mengikuti kecondongan jenis kelaminnya. Fatwa MUI No. 2 Tahun 1980 dan No. 3/MUNAS-VII/2010 mendukung operasi kelamin bagi khuntsa untuk mempertegas identitas kelamin. Pembagian waris khuntsa yang telah melakukan operasi penyesuaian kelamin dan memperoleh kejelasan status kelamin mengikuti ketentuan QS. An-Nisa ayat 11 dan Pasal 176 KHI. Jika status kelamin tetap diragukan, Mazhab Syafi’i mengusulkan pemberian bagian terkecil dengan menyimpan sisanya, sementara Mazhab Maliki menawarkan pembagian dengan dua kemungkinan yang dihitung dan dibagi dua. Pendekatan ini memastikan hak waris dapat diberikan tanpa menunda pembagian, meskipun status kelamin belum sepenuhnya jelas.

Abstract

The legal system currently in force in Indonesia prohibits the practice of interfaith marriages. The Constitutional Court has twice rejected requests for judicial review regarding interfaith marriages; the Indonesian Ulema Council also firmly stated that interfaith marriages are considered haram and illegitimate. However, in its practice, a lot of interfaith couples are able to get married through the assistance of an institution called Indonesian Conference on Religion and Peace (ICRP). Thus, this research aims to examine and determine the legality of interfaith marriages. This research uses a normative juridical approach with an analytical descriptive method. The results of this research show that the Marriage Law views interfaith marriages as illegitimate even though they have been registered at the Civil Registry Office and have obtained an Excerpt of Marriage Certificate, while the Islamic Law views interfaith marriages as haram and illegitimate.

Abstract

Mixed marriages between Indonesian citizens (WNI) and foreign nationals (WNA) often give rise to legal issues, particularly in divorce cases involving the division of marital property. A key challenge arises from the restriction on land ownership for foreign nationals under the Basic Agrarian Law. This study examines Decision Number 146/Pdt.G/2021/PA.Dps, in which an Indonesian wife was accused of extortion against her foreign husband in the context of a mixed marriage divorce. Using a normative juridical method and a descriptive-analytical approach, the study finds that the wife’s act of withholding her husband’s documents does not constitute extortion, but rather a form of self-protection due to the husband's failure to provide financial support. The findings emphasize that the division of marital assets in mixed marriages must consider the provisions of the Marriage Law, the Compilation of Islamic Law for Muslim couples, and the Basic Agrarian Law, especially regarding land ownership by foreign nationals. Therefore, resolving property disputes in mixed marriages requires a careful legal approach to ensure compliance with applicable laws.

Abstract

The phenomenon of transsexuality and sex change is still something that is considered taboo or should not be done by Indonesian society, the reason is because our country upholds religious values, traditions and eastern values adopted by society. Keep in mind that not everyone is born with normal conditions. There are some people who experience gender ambiguity or in medical terms called ambiguous genetalia or sex ambiguity and Islamic jurisprudence studies, this group of people is referred to as khunsa or double gender. The results of this study show that Law Number 23 of 2006 concerning Population Administration opens up opportunities for sex change by submitting a sex change application to the court so that the event can be recorded at the relevant agency. Judging from Islamic law, Islamic law also allows sex change if done for someone suffering from multiple gender conditions (khuntsa) as a form of treatment as stipulated in Fatwa No. 03/MUNASVIII/MUI/2010.
