Abstract

This study aims to provide clarity regarding the law on the implementation of the sacrificial arisan in the view of Islamic law. This research uses a qualitative approach with library research methods and descriptive analysis. The results of this study indicate that the opinion of the majority of scholars regarding the law of sacrificial worship is that sacrifice is not obligatory but is sunnah for those who can afford it. For people who are less able but have a great desire to get closer to Allah through the performance of sacrificial services, there is nothing wrong with following the arisan method which includes elements of debt and credit. With a note if there is a guarantee of the ability to pay it. The implementation of the sacrificial arisan which is carried out by some members of the community is legally permissible or permissible because it fulfills the terms and pillars of the contract. The implementation of the qurban gathering is a new problem in muamalah which did not exist before at the time of the prophets and companions and has not been mentioned in the Qur'an or hadith, so it is returned to the original law of a problem. It is permissible as long as there is no reason to forbid it. The qurban gathering carried out by some people has fulfilled the principles of muamamalah, namely the principle of mutual consent between all parties. In carrying out this sacrificial arisan, it brings many benefits to people who are less fortunate but have a great desire to carry out sacrificial worship in order to draw closer to Allah. Another benefit that is also found in the implementation of this sacrificial arisan is that it can be a means to get closer to Allah and to establish friendship between all members of the arisan group. Given the many benefits derived from the implementation of the sacrificial arisan.

Abstract

Kelurahan Malunda is one of the areas affected by an earthquake measuring 6.2 on the Richter scale in West Sulawesi. Disaster survivors who survive in refugee camps are very vulnerable to post-disaster trauma, which is why the Humanitarian Community Service Program of STIBA Makassar aims to carry out the three principles of higher education by taking on the role of service and humanity in the Malunda area. The method of implementing the program begins by identifying the needs of the people in the affected areas using SOAR analysis which then results in several programs including social service, teaching the Koran with the dirosa method, Muslim taklim, memorizing the Koran for teenagers and a religious child festival. The results of the implementation of this program have had quite a positive effect on the community in dealing with post-earthquake psychological stress, as well as making a significant contribution to the quality of volunteer personnel in helping affected communities in the Malunda village.

This research aims to find out a general overview of women's participation in political parties and how Islam views the role of women in the realm of practical politics. This research uses qualitative research, which focuses more on aspects of in-depth understanding, and uses library research methods with a normative juridical legal approach. The strongest opinion was the opinion of the majority of ulama who decided that women were not allowed to participate in practical politics. This is based on the strength of the arguments, in addition to the fact that there are no other arguments that contradict these arguments, as well as targeted criticism of the arguments that both allow and cancel their arguments with these arguments.

Abstract

This research aims to determine the position of non-Muslims as witnesses in judicial jurisprudence reviews, as well as the validity of non-Muslim testimony in judicial jurisprudence reviews. This research uses library research, which focuses on the study of manuscripts and texts, using a normative approach and a conceptual approach. The results of the research are as follows: first, the position of non-Muslims as witnesses in judicial jurisprudence, namely, the jurists are of the opinion that non-Muslim witnesses cannot be used as witnesses because the witnesses are not people who meet the requirements. The reason the jurists do not justify the presence of non-Muslim witnesses is because of religious differences and a non-Muslim is not a just person and is often characterized as wicked. Non-Muslims are also considered not to be from groups that are pleased with Muslims. Meanwhile, according to Islamic law, the testimony of non-Muslims cannot be used as a witness because testimony is a matter of power, whereas non-Muslims are not people who have power over Muslims. However, due to differences of opinion among the ulama regarding the testimony of non-Muslims, there are a minority of ulama who accept the testimony of non-Muslims on the grounds of emergency, namely making a will while traveling. Second, the validity of non-Muslim testimony in judicial jurisprudence, namely Imam Syafi'i and Imam Malik are of the opinion that non-Muslims cannot be witnesses against Muslims and their testimony is not accepted absolutely. Meanwhile, Imam Hanafi and Imam Ibn Hanbal allow the testimony of non-Muslims against Muslims in testamentary cases while on pilgrimage. Ibnu Qayyim al-Jauziyah stated that the rejection of non-Muslim witnesses must be reviewed in the era of globalization where currently people live together, non-Muslim testimony can be accepted in emergency matters that are desired, both in travel and residence situations.

Abstract

This research aims to find out how the legality of the mudarabah system based on Law No. 21 of 2008 and how the implementation of mudarabah contracts in property investment. To get answers to the above problems, the author uses descriptive qualitative research (library research), which focuses on manuscript and text studies using normative, juridical and historical approach methods with deductive data analysis. The results show that legally, the mudarabah system has been regulated in Law No. 21 of 2008 through Articles 19 and 20 related to the collection and distribution of funds by Islamic banks. However, the implementation of mudarabah contracts in property investment has not fully complied with the provisions of the law, especially in the aspects of profit-sharing transparency (Article 21 letter b), risk monitoring (Article 26), and dispute resolution mechanisms (Article 55). This finding theoretically confirms the strength of the Islamic Banking Law in distinguishing partnership-based contracts from the conventional interest-based system. Practically, the implementation of mudarabah contracts in accordance with sharia principles can increase customer trust and loyalty, while non-compliant implementation has the potential to reduce the credibility of Islamic financial institutions.

Abstract

Background: In the face of rapidly changing global dynamics and the increasing challenges related to moral and ethical values, education plays a critical role in fostering intellectual and moral integrity. Islamic Religious Education (PAI) has long been responsible for instilling Islamic values in the younger generation, yet traditional methods often fail to address the practical application of these values in daily life. Purpose: This study explores the TAPE (Instill, Observe, Practice, Evaluate) learning model in PAI education, which integrates theory and practice to promote both intellectual and moral development. The TAPE model consists of four interconnected stages designed to facilitate students' understanding of Islamic values while fostering active engagement, social skills, and self-reflection. Method: A qualitative approach with a descriptive case study design was adopted for this research, involving both field and library research. Data collection included interviews, observations, and document analysis. Result: The study examines how the TAPE model enhances students' ability to internalize Islamic values, such as honesty, responsibility, and compassion, while also developing essential life skills. Findings suggest that the TAPE model not only promotes intellectual learning but also shapes students' character and encourages the application of Islamic values in their daily lives. Conclusion: The research concludes that the TAPE model is crucial in developing a generation that is both knowledgeable and morally grounded, ready to contribute positively to society. The study underscores the importance of adopting innovative pedagogical approaches like TAPE to address the challenges posed by globalization and moral integrity in modern Islamic education.
