Abstract

This research is entitled “The Legal Status of Copyright Certificate as Loan Collateral (A Comparative Study between Indonesia and Singapore)”, aiming to analyze and compare the legal regulation and protection of copyright certificates as loan collateral in Indonesia and Singapore. This study employs a normative juridical method with statutory and comparative approaches. The findings reveal that both Indonesia and Singapore recognize copyright as a viable collateral object. However, Singapore has established a more structured system through the Copyright Act 2021, the IP Financing Scheme, and the Intellectual Property Office of Singapore (IPOS), which facilitates the monetization of copyright with standardized valuation methods. In contrast, Indonesia, despite having a legal basis through the Copyright Law, Fiduciary Law, and Government Regulation No. 24 of 2022, still faces practical barriers such as the absence of a dedicated financing scheme, lack of standardized valuation, and minimal involvement from financial institutions. Therefore, legal and policy reforms are needed in Indonesia to strengthen copyright as an economic asset that can be effectively used as loan collateral.

Abstract

This study examines the trademark dispute between PT Tatalogam Lestari (owner of the "KASO" mark) and Tedi Hartono (registrant of the "kasomax" mark), adjudicated by the Commercial Court of Central Jakarta (Decision No. 115/Pdt.Sus-Merek/2022). The dispute arose from alleged violations of the first-to-file principle, distinctiveness, and bad faith in trademark registration. Indonesia adopts a first-to-file system under Law No. 20 of 2016 concerning Trademarks and Geographical Indications, granting exclusive rights to the first registrant. This case demonstrates that registering marks similar to existing trademarks may cause consumer confusion and unfair competition.The study aims to analyze the court’s legal considerations in the ruling and the application of trademark principles in dispute resolution. A normative juridical approach was employed, utilizing primary legal sources (statutes, court decisions) and secondary materials (literature, journals).Findings indicate the Commercial Court annulled the registration of "kasomax" due to its fundamental similarity to the "KASO" mark and bad-faith registration. The ruling reinforces the first-to-file principle and provides legal certainty for registered trademark owners. The implications suggest the need for stronger substantive examination by the Directorate General of Intellectual Property (DGIP) and public awareness campaigns to prevent infringing registrations.

Abstract

The emergence of AI-generated illustrations challenges copyright frameworks globally. This normative study compares Indonesia's static Copyright Law with Sweden's progressive EU-aligned system. While both jurisdictions deny copyright to purely AI-created works due to unmet originality requirements, Sweden's sophisticated approach through neighboring rights and AI Sweden's R&D initiatives demonstrates greater adaptability. Indonesia's rigid human authorship mandate under Article 1(2) UUHC 28/2014 risks technological irrelevance. The analysis recommends Indonesia establish specialized AI governance mechanisms and adopt tiered protection for human-AI collaborations, emulating Sweden's balanced approach under the EU AI Act. Strategic alignment with WIPO standards could bridge the growing regulatory gap while preserving creator rights. The findings highlight the urgent need for developing nations to modernize intellectual property systems in response to disruptive technologies. Sweden's dual strategy of legislative harmonization and research investment offers a replicable model for jurisdictions facing similar AI challenges. This comparative analysis contributes to global discourse on copyright adaptation in the age of generative AI.

Abstract

This study discusses the comparison of the legal force of the Vote Counting Information System (Situng) in the 2019 Election and the Recapitulation Information System (Sirekap) in the 2024 Election and its implications for presidential and vice presidential candidate pairs. The main issues raised are unclear regulations, technical errors in data input, and the legal force of Situng and Sirekap in resolving election disputes. This study uses a normative legal method with a statute approach, case study approach, comparative approach, and conceptual approach. The results of the study show that neither Situng nor Sirekap have binding legal force on the final election results, but Sirekap has a stronger position because it can be used as supporting evidence if the C Result form is not available. However, both information systems are considered unable to fully realize the principles of justice, legal certainty, benefit, transparency, and accountability. And the implications are that the constitutional rights of presidential and vice presidential candidate pairs can be ignored, and public trust in the election results becomes vulnerable. Abstract

This article examines violations related to trademarks in the metaverse, which are reviewed from the perspective of intellectual property rights and examines the law enforcement that is applied in the metaverse itself in the event of a trademark violation that is claimed by another person who is not the owner of the rights to the trademark. The type of research used is normative juridical, in which the discussion of this research prioritizes the study of the application of positive legal norms or legal principles applied in Indonesia and approaches through related laws and regulations. The study in this research is an analysis of the first-to-file principle in registering trademarks used in the metaverse and studying the classification of trademarks so that they can be registered in the metaverse so that other people do not use these trademarks. Based on the study in the discussion in this study, it is concluded that the legal protection of trademarks in the metaverse, seen from the perspective of intellectual property rights, still needs to be under the provisions of the applicable laws and regulations. This is marked by the many legal cases against trademark violations in the metaverse itself because trademarks registered in the real world will not automatically be registered in the metaverse unless the rights owner or company registers their trademark through a trademark registration service application on the metaverse.

Abstract

Trademark registration is very important for businesses so that the trademark that has been built is not imitated by others, but in reality, the registration of trademarks in the Directorate General of Intellectual Property does not rule out the possibility of disputes caused by the registration of trademarks that have similarities with other trademarks or even have similarities in meaning with previously registered trademarks. This research discusses the application of the doctrine of foreign equivalents associated with trademark registration in Indonesia which aims to be a solution when there is a dispute in the trademark registration process. The research method used is normative legal research using legal materials relevant to trademark registration in Indonesia. The results showed that the concept of the doctrine of foreign equivalents is done by translating a trademark or service mark into English before the mark is registered. It is intended that the registered trademark can be identified whether the trademark is a generic trademark or included in the words of public property or there is a resemblance to a previously registered trademark. In addition, the doctrine of foreign equivalents has not been applied in Indonesia, it can be proven by the existence of two different court decisions related to trademark registration associated with the concept of foreign doctrine.

Abstract

Along with globalization, intellectual property has become a valuable asset that requires solid legal protection in various countries in an effort to improve the economy, including the legal protection of trademarks. This article analyses the legal protection of trademarks by comparing the legal arrangements between Indonesia and South Korea. Normative legal research is used to explore issues related to trademarks by using a statute approach and comparative approach and secondary data as the primary data. The results of the research and discussion show that trademark protection in Indonesia and South Korea have many similarities in terms of registration procedures, duration of protection, and dispute resolution mechanisms. However, there are differences in aspects such as statutory arrangements, management bodies, sanctions for violations, and some technical details of trademark registration between the two countries. The conclusion of this study is that the legal protection system between Indonesia and South Korea apply first to the file system. However, South Korea technically still recognizes the existence of a trademark that is used but has not been registered and can be protected by the provisions of business competition legislation. At the same time, in Indonesia, the opportunity has yet to be regulated at all because all trademarks must go through registration first to obtain legal protection as stipulated in the Trademark Act and Geographical Indications.

Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana pertimbangan hukum hakim dan akibat hukum berdasarkan putusan nomor 18 pk/pdt.sus-hki/2023 tentang sengketa merek antara boncabe dan bon nori. Penelitian ini dilakukan dengan menggunakan metode penelitian hukum normatif, adapun pendekatan yang digunakan dalam penelitian adalah pendekatan perundang-undangan dengan menelaah peraturan atau regulasi yang berkaitan dengan isu hukum dan pendekatan kasus .Jenis data dalam penelitian ini adalah data sekunder dengan menggunakan teknik pengumpulan data studi dokumentasi dan penelitian ini menggunakan analisis yang bersifat kualitatif. Hasil dalam penelitian ini menunjukan bahwa dalam pertimbangan hukumnya hakim mempertimbangkan 3 masalah yaitu boncabe merupakan merek terkenal, bon nori memiliki persamaan pada pokoknya dengan boncabe dan pendaftaran merek bon nori dilakukan dengan itikad tidak baik. Adapun akibat hukum dari adanya putusan nomor 18 pk/pdt.sus-hki/2023 merek dagang bon nori dicoret dari daftar umum merek, menghentikan produksi merek bon nori, melakukan penarikan terhadap produk bon nori yang telah diedarkan di perdagangan maupun promosi bon nori yang dilakukan di tv atau media sosial dan dapat dituntut ke ranah pidana jika tidak melaksanakan hasil putusan.

Abstract

The phenomenon of a single candidate and the blank column in the 2024 Banyumas Regional Election raises debates about democratic legitimacy and legal certainty in Indonesia’s electoral system. This study employs a juridical-empirical method with a descriptive qualitative approach, combining literature review and interviews with Banyumas KPU commissioners to analyze the legal status of the blank column under Law No. 10 of 2016 and Constitutional Court Decision No. 100/PUU-XIII/2015, as well as to assess the legal responsibility of the Election Commission (KPU) in upholding democratic principles and popular sovereignty. The findings indicate that the blank column has constitutional legitimacy as a substantive democratic instrument that allows citizens to reject a single candidate. Empirically, the Banyumas KPU implemented the election process in accordance with the LUBER JURDIL principles, despite challenges such as regulatory gaps, unclear campaign rules for the blank column, and low levels of political literacy. Voter turnout reached 65,42%, with 40,56% voting for the blank column, reflecting growing political awareness and public criticism of elite dominance and weak party cadre regeneration. This study recommends regulatory reforms for single-candidate elections, strengthened political education, and optimization of political party roles in presenting competitive candidates to ensure a more substantive and equitable local democracy.
