Air merupakan aspek penting bagi setiap makhluk hidup tak terkecuali dengan manusia. Di Indonesia, upaya untuk menjaga sumber daya air telah diatur dalam UU No. 17 Tahun 2019 (UU SDA) yang diubah beberapa kali terakhir dengan UU No. 32 Tahun 2024 tentang Perubahan atas Undang-Undang Nomor 5 Tahun 1990 tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya. UU SDA masih belum optimal dalam mengatur mengenai beneficiary pays principle (BPP). BPP merupakan salah satu prinsip dalam pengelolaan sumber daya air di mana pemanfaat sumber daya air diwajibkan membayar sejumlah uang sebagai bentuk kompensasi atas pemanfaatan sumber daya air. Penelitian ini bertujuan untuk merekonstruksi pengaturan BPP dalam UU SDA. Penelitian ini merupakan penelitian hukum normatif dengan mengedepankan pendekatan konseptual, perundang-undangan, dan perbandingan dengan negara lain. Temuan dari penelitian ini yaitu bahwa BPP masih dirumuskan secara terbatas dan secara parsial dalam UU SDA. Simpulan dari penelitian ini yaitu perlu revisi terhadap UU SDA dan PP SDA supaya aspek BPP dapat dituangkan dalam UU SDA dan PP SDA secara optimal sebagai upaya untuk melindungi lingkungan dan menjaga kelestarian sumber daya air.

Pendidikan penyadaran kekerasan dan pelecehan seksual penting dilakukan di lingkungan sekolah. Hal ini bertujuan untuk membuat lingkungan sekolah menjadi kondusif dalam kegiatan pembelajaran. Hal ini khususnya upaya penyadaran kekerasan dan pelecehan seksual di lingkungan sekolah melalui pelajaran Pendidikan Agama Islam. Penelitian ini bertujuan menegaskan urgensi penyampaian materi penyadaran kekerasan dan pelecehan seksual di lingkungan sekolah dalam pelajaran Pendidikan Agama Islam, khususnya dengan pengoptimalan nilai anti kekerasan dalam moderasi beragama. Penelitian ini menggunakan metode kualitatif dengan mengedepankan observasi serta analisis terhadap rujukan pustaka terkait kekerasan seksual di lingkungan sekolah. Hasil penelitian menegaskan bahwa moderasi beragama dan urgensi penyadaran kekerasan seksual di lingkungan sekolah perlu dilakukan karena salah satu spirit dari moderasi beragama adalah anti kekerasan dan hal ini relevan untuk menjadikan mata pelajaran Pendidikan Agama Islam sebagai salah satu orientasi dalam memberikan pendidikan sekaligus penyadaran terhadap kekerasan dan pelecehan seksual di sekolah. Selain itu, pemahaman dan penyadaran pencegahan kekerasan dan pelecehan seksual di sekolah, khususnya di SMPN 1 Kalitidu dapat dilakukan melalui: penguatan nilai anti kekerasan dalam moderasi beragama sebagai salah satu orientasi pemahaman Pendidikan Agama Islam kepada peserta didik, penyadaran kekerasan dan pelecehan seksual di sekolah dengan menyisipkan beberapa materi yang relevan dalam pelajaran Pendidikan Agama Islam, mengedepankan pendekatan kontekstual, serta mengoptimalkan peran media sosial maupun perangkat digital lainnya dengan mengajak siswa untuk belajar serta bijak bersosial media.

Post-general election reconciliation takes place to prevent polarisation and ongoing conflict after the general election in Indonesia. This research analyses and formulates post-2024 election reconciliation as a constitutional convention that must be implemented to maintain national unity and support progressive legal culture practices. The progressive legal culture refers to the character and culture of Indonesian society, emphasising the family dimension and noble values in society. This research is normative legal research, prioritising conceptual and statutory approaches. The research results confirm that constitutional conventions, as unwritten laws that must be obeyed, should fulfil several characteristics: repeated constitutional acts, substantially based on political ethics and constitutional morality, and having ethical binding force. When recognised as a constitutional convention, post-election reconciliation should serve as a moral and ethical framework that guides political actors and society in maintaining unity. The implication of post-election reconciliation as a constitutional convention is that it has ethical validity and must be implemented; however, if such reconciliation is not observed, it cannot be fair for the judicial institution. This research recommends the institutionalisation of post-election reconciliation as a constitutional convention, ensuring that Indonesia's legal culture prioritises morality and minimises societal divisions, safeguarding national unity and preventing social disintegration.

The Biak Customary Law Community in Papua has unique customary rights, particularly with regard to water aspects. The recognition and protection of the Biak Customary Law Community encounters problems when it is compared to the spaceport in Papua which is in the territory of the Biak Customary Law Community. Apart from that, from a juridical perspective, there is also a legal vacuum regarding regulations related to the Biak Customary Law Community, especially in Biak Numfor Regency. The legal issues analyzed in this study are related to the legal vacuum regarding the recognition and protection of the customary rights of the Biak Customary Law Community. This research is a normative legal research that focuses on the analysis of legal issues in the form of a legal void in the recognition and protection of the Biak Customary Law Community by using a concept and statutory approach. The results of the study confirm that the legal implication of the existence of a regulatory legal vacuum regarding the recognition and protection of the Biak Indigenous People, Papua, namely customary rights, traditions and local wisdom has the potential to no longer be enforceable due to the existence of a spaceport project in Biak. Future arrangements related to efforts to recognize and protect the Biak Customary Law Community, especially in terms of their customary rights, namely through the establishment of a Regional Regulation of the Biak Numfor Regency related to the Biak Customary Law Community, Papua and at the national level need to ratify the Indigenous Law Community Bill. Abstract: The problem related to the development of cybercrime in Indonesia is that there are several cybercrime developments in Indonesia that have not been regulated in statutory regulations, giving rise to a legal vacuum. Apart from that, the spread of regulations regarding cybercrime in various laws and regulations in Indonesia also has the potential to cause disharmony regarding regulations regarding cybercrime. This research aims to analyze and promote the need for legislation regarding cybercrime in a centralized and integrated manner using the omnibus law method from a progressive legal perspective. This research is normative legal research which prioritizes conceptual and statutory approaches. The research results show that the urgency of forming a centralized and integrated cybercrime law is intended to overcome various legal gaps related to cybercrime in Indonesia. Efforts to form cyber crime laws in a centralized and integrated manner using the omnibus law method viewed from a progressive legal perspective are intended to accommodate the legal needs of society because by referring to a progressive legal perspective the law exists to facilitate various human developments and needs. Apart from that, optimizing the omnibus law method in forming cyber crime laws in a centralized and integrated manner to create laws that are effective, efficient and useful for society.

Constitutional changes are part of the political and legal dynamics of a country. Changes to the constitution aim to meet the legal demands and needs of the community so that they are clearly and firmly regulated in the constitution. This paper is oriented towards the idea of a formal review of constitutional changes in Indonesia. This research is a normative legal research. The approach used in this research is a conceptual approach, a comparative approach, and a statutory approach. The primary legal materials in this study include the text of the 1945 Constitution of the Republic of Indonesia, constitutional texts in various countries and the Constitutional Court Decision No. 91/PUU-XVIII/2020. Secondary legal materials include: books, journal articles, and websites related to the constitution and constitutional law. Non-legal materials include legal dictionaries. The results of the study indicate that a formal review of constitutional changes is needed as an effort to maintain the supremacy of the constitution, including also placing the court's function as guardians of the law and the constitution in dealing with the determination of non-legal aspects in constitutional changes

The expansion of the authority of acting regional heads following the enactment of Circular Letter (SE) Number 821/5492/SJ actually raises legal issues. The legal issues include the legal certainty of the Circular Letter, which is a policy regulation and not externally binding, and is in conflict with statutory regulations. This research focuses on the legal implications of the authority of acting regional heads to dismiss and transfer ASN based on legal products in the form of SE, where the authority of acting regional heads is based on Law No. 10 of 2016. This research is a normative legal study that emphasizes a conceptual and legislative approach. Research findings indicate that the existence of Circular Letter (SE) Number 821/5492/SJ, which expands the authority of acting regional heads, has implications that create legal uncertainty. The recommendation from this research is that amendments to Law Number 23 of 2014 are necessary to clearly regulate the authority of acting regional heads.

The constitutive or first-to-use system in trademark registration in Indonesia actually creates problems, particularly in failing to meet substantive justice aspects in trademark registration. This is because the constitutive or first-to-use system only provides protection for registered trademarks. This research aims to analyze and reconstruct a trademark registration system that accommodates the General Principles of Good Governance (AUPB). This study provides a novel perspective by integrating the General Principles of Good Governance (AUPB) with Indonesia's trademark registration system, offering a unique approach to enhance substantive justice in trademark law. The research highlights the need for reform in the Indonesian trademark registration process, which can guide policymakers and legal practitioners in improving the accuracy and fairness of trademark protection, thereby reducing disputes and enhancing the protection of intellectual property rights. This research is normative legal research using statutory, conceptual, and philosophical approaches. The research results confirm that the "first to file" system in trademark registration in Indonesia has undermined substantive justice because it only provides legal protection when a trademark has been registered. The urgency to make AUPB a guideline in the trademark registration process is oriented so that the DJKI trademark registration process can prioritize aspects of accuracy and prudence. Reconstructing a trademark registration system model that embodies substantive justice can be done by not applying the constitutive system absolutely but rather relatively by accommodating developments in trademark registration practices. This application needs to be combined with the general principles of good governance to create a fair and effective system in protecting trademark rights and realizing substantive justice.

The principle of lex sportiva as the main principle in sports law has not yet been regulated in Law No. 11 of 2022 on Sports. The lack of regulation of the lex sportiva principle results in the suboptimal application of the lex sportiva principle in Indonesian sports law. This research aims to analyze the position of the lex sportiva principle in Indonesian sports law and its relevance to the national legal system. This research is a normative legal study that emphasizes a legislative and conceptual approach. The results of this study indicate that sports law, as a new field in legal science, is based on the principle of lex sportiva, which is related to independence, autonomy, and harmonization with the national legal system. The recommendations offered in this study include the need for a revision of Law No. 11 of 2022 on Sports Law by emphasizing the position of the lex sportiva principle in Indonesian sports law, as well as the need for an understanding of the lex sportiva principle in the organization of sports, including making the lex sportiva principle a part of legal considerations for judges in the Supreme Court and the Constitutional Court when adjudicating disputes related to sports aspects.

Background: Women's representation in Indonesia's Village Consultative Bodies (BPD) is essential for gender equality and inclusive governance. However, unclear regulations, socio-cultural barriers, and weak enforcement hinder progress. Gap: Legal ambiguities and inconsistent practices limit effective participation and gender-responsive decision-making. Aim: This study explores the legal uncertainties affecting women's representation in BPDs and their broader impacts. Results: Findings highlight unclear legislation, gaps between national and regional regulations, and insufficient enforcement, compounded by cultural biases, reducing women’s motivation and participation. Novelty: The study provides a unique analysis of legal and socio-cultural challenges, offering actionable reform strategies. Implications: Clearer regulations and empowerment programs can improve representation, fostering equitable governance and sustainable development. Highlights: Legal ambiguities in regulations hinder women’s effective participation in BPDs. Socio-cultural biases significantly reduce opportunities for gender-responsive governance.
