Abstract

Premarital pregnancy continues to drive adolescent marriage in Indonesia where religious, customary, and state norms intersect. This study examines how marriages following premarital pregnancy are governed in North Halmahera and identifies the conditions under which negotiated compromises protect or harm young families. Using a qualitative case study, we conducted in-depth interviews with clerics, customary leaders, officials, adolescents, and parents, observed community proceedings, and analyzed local documents; thematic and cross-case analysis with triangulation and reflexivity ensured credibility and ethical safeguards. Cases cluster among adolescents aged fifteen to nineteen with incomplete schooling and financial strain, and decision windows compress rapidly once pregnancy becomes known. Proximal and structural drivers include gaps in sexuality education, limited parent–child communication, peer and media influence, low practical religious literacy, and poverty. Three honor-restoring mechanisms recur: swift marriage, customary acknowledgment through penebusan, and judicial dispensation. Outcomes diverge: when safeguards for consent, psychosocial readiness, maternal and child health, continued education, and civil documentation are embedded, reintegration improves; when compromises focus on ritual display alone, risks accumulate and legal identity gaps persist. The analysis refines legal pluralism in practice by showing how maqasid- and maslaha-oriented reasoning legitimates harm-reduction pathways and explains subdistrict variation by leader networks and administrative capacity. The study offers a micro-process model and recommends locally coherent sexuality education, culturally anchored premarital counseling, integrated referral systems, clear documentation routes, and measured use of dispensation.

Abstract

Artikel ini membahas tentang urgensi pengaruh rotasi dan revolusi Bumi dalam menentukan waktu shalat. Perjelanan harian matahari menjadi sebuah indikator dalam menentuakan awal dan akhir waktu shalat dalam keseharian yang dikonversi dalam bentuk formulasi salah satunya melalui deklinasi matahari. Dalam perkembangan berikutnya dikatakan bahwa peredaran matahari tidaklah tetap. Unsur diklinasi matahari secara global sudah diperhitungkan sehingga dapat menghasilkan jadwal waktu Shalat dari hari ke hari yangmengalami perubahan sesuai dengan posisi matahari tersebut. Dari hasil penelitian diketahui bahwa posisi rotasi dan revolusi Bumi dinilai sangat urgensi dalam formulasi penentuan awal waktu shalat.

Abstract

AbstrakTulisan ini mengkaji tentang dinamika penentuan awal bulan ramadhan dan syawal pada masyarakat eksklusif  dengan mendeskripsikan metode Hisab dan rukyat yang digunakan jamaah an-Nadzir dan Naksabandiyah di kabupaten Gowa. Tujuannya untuk mengungkap pengaruh imam pada pengambilan keputusan dalam menggambarkan besarnya pengaruh tanda-tanda alam sebagai objek terhadap pengambilan keputusan penetapan dalam menetapkan awal ramadhan dan Syawal pada jamaah an-Nadzir dan Naksabandiyah di kabupaten Gowa. Penentuan awal bulan kamariyah terkhusus pada pelakasanaan ibadah (puasa dan idul fitri dan idul adha) dengan menggunakan hisab memiliki kedudukan yang benar secara teoritik, sedangkan dengan menggunakan hisab akan menguatkan  hisab secara empirik. Olehnya diperlukan integrasi kedua metode tersebut agar memberikan keyakinan yang haq/ilmiah kepada ummat.

Abstract

The effect of human error on the accuracy of the qibla direction of mosques and graves in Gowa regency aims to determine the percentage accuracy of the qibla direction of mosques and graves in Gowa district; To find out the causative factors so that the direction of the qibla of mosques and graves is less accurate so that we can find out the percentage of the influence of Human Error on the accuracy of the direction of Qibla and graves in Gowa Regency This study used a qualitative descriptive method and chose locations in mosques and cemeteries. The population in this study includes places of worship and burial places for Muslims in Gowa district. 1,174 mosques spread over 18 sub-districts. mosque and cemetery data samples represent the highlands, the capital of Gowa Regency, and the lowlands. Data collection methods include: participatory observation, in-depth interviews and documentation. The analysis method used is content analysis. Causes of human error Inadequate knowledge, lack of education and training, lack of imagination about the future, dependence on other parties, ignorance, negligence, and carelessness, lack of ability to communicate.Keywords: Qibla direction, human error, mosque and cemetery

Abstract

This article examines the reconstruction of legal discovery methodology in Islamic legal philosophy through a comparative analysis of three classical approaches: Bayani theory, ta‘lil, and istislahi, in response to legal challenges in the contemporary context. The impetus for this research stems from the increasing complexity of modern legal problems such as human rights, digital technology, and ecological justice, which demand a more dynamic methodology of istinb?? al-?ukm, while still being grounded in the authority of revelation. This research uses a qualitative library research method with an Islamic legal hermeneutics approach and descriptive-comparative analysis, which allows for an in-depth study of classical texts and modern literature. . The results of the study show: (1) Bayani theory, which emphasizes text (nash), maintains the continuity of sharia, but needs reinterpretation to be relevant to modern problems; (2) Ta'lil theory, with a focus on rationalization and identification of 'illat (legal reasons), allows for contextual ijtihad, but is prone to subjectivity without a strict methodology; (3) The istislahi theory, which is based on maslahah and maq??id al-shar?‘ah, has proven to be the most adaptive to contemporary issues, although it requires normative boundaries so as not to deviate from the principles of sharia. This research essentially affirms the urgency of reconstructing an integrative methodology for legal discovery, combining the strengths of Bayani, ta‘lil, and istislahi within a comprehensive epistemological framework. This integrative model gives rise to textual, rational, and beneficial Islamic law, responding to the needs of global society without losing the authenticity of revelation. The results of this analysis contribute to the development of Islamic legal philosophy by offering a relevant, dynamic, and socially just paradigm of legal discovery.
