Abstract

This article aims to uncover the views of Islamic law as a universal rule does not only discuss the relationship between humans and God but also the relationship between humans and other humans. The order of life in society as part of the interaction between humans creates various problems. Land becomes an object of economic driving for humans and the state whose users cannot be separated from politics and law, as well as having a function to create life together. The research method used is field research and is qualitative and comparative. Sources of data used in this study come from primary and secondary data. The result of this research is that the purpose of this land acquisition is for the public interest. In Islamic law, land acquisition for public purposes is included in one of the objectives of Islamic law (maqashid syariah). Islamic law teaches to help each other in terms of goodness, by having joint ownership of objects that have been held, the soul is calm because the needs have been provided. An object that is used as a public facility is a valuable asset so that the procurement process also uses a well-ordered system.

Abstract

This paper aims to find out the views of Islamic law and positive law on rape by the biological father and to find out the views of Islamic law and positive law on the Sungguminasa District Court Decision. The type of research used is field research or commonly referred to as Qualitative Field Research. Descriptive Qualitative Field Research is a type that describes a research as qualitative about the object being discussed in accordance with the reality that exists in society. This study uses data collection methods by Observation, Interview and Documentation. The results of this study indicate that in the view of Islam there are differences of opinion in giving punishment for fathers who rape their biological children. The first opinion states that the law is stoning, because the perpetrator is seen as a muhsan adulterer. The second opinion states that the punishment is ta‟zir, that is, the degree and type of punishment is left to the ijtihad decision of the authorities and the application of material criminal law to the crime of sexual intercourse with children in the case of decision number: 327/Pid.Sus/2020/PN. Sgm has been appropriate because has fulfilled the elements contained in 81 paragraphs (1) and (3) of Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection.

Abstract

The concept of Indonesian fiqh is an idea that is characteristic of the implementation of Islamic law in Indonesia which is in accordance with the character and nuances of Indonesian society. The emergence of the concept of Indonesian fiqh cannot be separated from the ideas of important figures who contributed ideas to Islamic law in Indonesia. This research is library research carried out by collecting and reviewing various literature related to the concept of Indonesian fiqh which was initiated by several important figures and their ideas. The data analysis technique uses qualitative descriptive analysis through analysis of the thoughts of influential figures in grounding Indonesian fiqh. The results of the research show that Hazairin's thoughts on Indonesian fiqh gave birth to the concept of the Indonesian school of thought or the Syafi'i plus Indonesia school which was projected by including Islamic law in the national legal system. Then Munawir Syadzali with the concept of humanitarian ijtihad through the positivization of Islamic law. Several of the proposals and methodologies that have been initiated have the same ideals, namely wanting a new fiqh format that is in accordance with social realities in Indonesia.

Abstract

The logic of harm in Islamic Law plays a central role in balancing benefit (benefit) and harm (loss). The principle of lā ḍarara wa lā ḍirāra is an important basis for establishing legal policies that aim to avoid all forms of harm to individuals and society. In the context of Islamic legal philosophy, the logic of harm reflects ethical principles aimed at maintaining human welfare and preventing loss. This article examines the logic of harm as a philosophical framework in determining Islamic law and its application in various aspects of modern life. The research method used is a qualitative research approach with analytical descriptive methods. The approach used by researchers in solving existing problems is normative and theoretical. This research explores the importance of the logic of harm in Islamic Law, especially in maintaining a balance between benefits and harms in various aspects of life. With the principle "lā ḍarar wa lā ḍirār", Islamic Law not only functions as a system of rigid rules, but also a dynamic tool that continues to be relevant amidst current developments. In modern applications, the logic of harm has proven effective in addressing contemporary challenges in health, economics, and the environment.

Abstract

The main problem in this research is domestic violence in the contemporary era and the legal consequences it causes. In law enforcement, the implementation of investigations basically does not differentiate between the victim and whether the victim must be a wife or husband because in the law it is not called a wife, it is clearly someone who is in the household, be it wife, children, parents, servants or other people. which is under supervision. The availability of sufficient evidence for proof is something that makes things difficult for victims. Forms of domestic violence are not only physical violence, but also sexual and mental violence such as verbal abuse, insults and mental terror if the victim leaves or reports the incident, as well as threats of being killed. As a result, domestic violence victims not only suffer physical injuries but also mental injuries. In this research, normative legal research or library research methods are used. In this normative legal research, library materials are basic data which in research science is classified as secondary data. Secondary data has a very broad scope, including personal letters, legal materials, legal journals, theses, dissertations, views of legal experts or fikhi (doctrine) scholars, diaries, legal books, legal dictionaries, jurisprudence down to official documents issued by the government. The results of this research are that domestic violence occurs due to several factors including economic factors, jealousy, gender inequality, differences in principles, alcohol, promiscuity, lack of good communication, but according to researchers, domestic violence occurs mainly due to lack of education. morals and weak faith in related parties resulting in a lack of implementation of religious values ​​in married life and are easily propagated.

Abstract

In several regions in Indonesia, there are many criminal cases of abuse of alcoholic beverages, but on the other hand, in many regions, they provide legalization for alcoholic beverages themselves. The phenomenon of alcoholic beverages is faced with cultural connotations and local wisdom. From this view, this study will look at the influence of local wisdom and Islamic legal views so that they can influence local regulatory policies. Furthermore, the other hand, it will also discuss law enforcement from alcoholic beverages that have a terrible impact on the community. The research method used is a normative legal research method. The study uses a statutory approach and the analysis of legislation theory. The study results indicate that the traditions strongly influence the North Toraja area's formation of regional regulations in its community. One view can be drawn that the link between the traditions of a region will follow the existing regulations in that area. This is in line with the basis for the formation of regional regulations. There are three principal foundations: the philosophical, the juridical, and the sociological. The majority of the population in every Indonesian region is Muslim, which also affects the norm value of local government regulation. This can be seen in the Province of Aceh, which strongly opposes the existence of alcoholic beverages in the area. For the Province of South-Sulawesi alone in Takalar Regency, the same thing applies by strictly prohibiting the drinking, producing, and trading of alcoholic beverages, even though these include traditional drinks. Therefore, this research shows that strong Islamic values greatly influence the local community. Law enforcement is closely related to the implementation of sanctions from existing regulations. Penalty application is so religious in every area. Some impose sanctions regarding production and trade permits, and some apply criminal sanctions, and so on.

Abstract

Teori Ta'lil dalam filsafat hukum Islam merupakan pendekatan yang menitikberatkan pada pencarian rasionalitas dan hikmah di balik setiap ketentuan syariat. Teori ini bertujuan untuk memahami esensi hukum, bukan semata-mata teks literal, tetapi juga tujuan-tujuan mendasar (maqashid syariah) yang ingin dicapai. Penelitian ini membahas konsep dasar teori Ta'lil, landasan filosofis, serta aplikasinya dalam konteks penemuan hukum Islam. Dengan menggunakan metode deskriptif-analitis, penelitian ini menguraikan hubungan antara 'illah (sebab hukum) dan hikmah sebagai dasar penetapan hukum yang relevan dalam menghadapi dinamika sosial masyarakat. Teori Ta'lil memberikan fleksibilitas dalam penerapan hukum Islam agar tetap relevan, tanpa mengesampingkan otoritas wahyu. Studi ini menyimpulkan bahwa teori Ta'lil berperan penting dalam menyeimbangkan aspek normatif dan realitas praktis, sehingga memungkinkan hukum Islam menjawab kebutuhan zaman dengan tetap berpegang pada prinsip-prinsip universal syariah.

Abstract

Maslahat dalam perkembangannya dipahami sebagai kebaikan atau manfaat yang membawa nilai-nilai positif bagi berbagai aspek kehidupan manusia. maslahat menjadi bagian penting dalam hukum Islam, meskipun sering kali memicu perbedaan pendapat dan perselisihan di kalangan akademisi, baik pada masa Sahabat, para Imam Mazhab, maupun para peneliti modern. Tujuan untuk mencapai maslahat dapat terpenuhi, dan segala bentuk kemudaratan yang dapat mengakibatkan kerusakan dapat dihindari. Maslahat juga meliputi upaya menjaga tujuan syariat, termasuk perlindungan agama, jiwa, akal, keturunan, dan harta. Dengan demikian, apa pun yang memelihara kelima prinsip dasar ini adalah maslahat, sementara yang bertentangan dengan tujuan ini dianggap mafsadat atau kemudaratan.

Abstract

Islamic law has an important position as a legal system that is not only derived from divine revelation, but also reflects the moral and spiritual values ​​of Muslims. This study aims to describe the characteristics of Islamic law by examining in depth the conceptual differences between Islamic law, sharia, and fiqh, and tracing its main sources, namely the Qur'an and hadith. In addition, this paper also discusses the characteristics of Islamic law which are flexible, justice-oriented, and able to adapt to the social dynamics of society. The implementation of Islamic law in Indonesia is an additional focus in this article, considering the diversity of legal systems in Indonesia that allow Islamic law to coexist with national law, especially in aspects of family law and sharia economics. Through a descriptive-analytical approach, this article concludes that Islamic law has great potential to become an inclusive and contextual legal solution, as long as it is understood proportionally in accordance with its normative and historical foundations. Thus, a comprehensive understanding of the characteristics of Islamic law is needed to strengthen its role in the national legal system and the lives of contemporary Muslim society.

Abstract

Premarital pregnancy continues to drive adolescent marriage in Indonesia where religious, customary, and state norms intersect. This study examines how marriages following premarital pregnancy are governed in North Halmahera and identifies the conditions under which negotiated compromises protect or harm young families. Using a qualitative case study, we conducted in-depth interviews with clerics, customary leaders, officials, adolescents, and parents, observed community proceedings, and analyzed local documents; thematic and cross-case analysis with triangulation and reflexivity ensured credibility and ethical safeguards. Cases cluster among adolescents aged fifteen to nineteen with incomplete schooling and financial strain, and decision windows compress rapidly once pregnancy becomes known. Proximal and structural drivers include gaps in sexuality education, limited parent–child communication, peer and media influence, low practical religious literacy, and poverty. Three honor-restoring mechanisms recur: swift marriage, customary acknowledgment through penebusan, and judicial dispensation. Outcomes diverge: when safeguards for consent, psychosocial readiness, maternal and child health, continued education, and civil documentation are embedded, reintegration improves; when compromises focus on ritual display alone, risks accumulate and legal identity gaps persist. The analysis refines legal pluralism in practice by showing how maqasid- and maslaha-oriented reasoning legitimates harm-reduction pathways and explains subdistrict variation by leader networks and administrative capacity. The study offers a micro-process model and recommends locally coherent sexuality education, culturally anchored premarital counseling, integrated referral systems, clear documentation routes, and measured use of dispensation.
