Abstract

The Indonesian legal system comprises three main components: customary law, Islamic law, and European law. These three systems serve as foundational elements in the construction of a holistic and comprehensive national legal framework through national legal politics. This study aims to examine the position and role of Islamic law in Indonesia, focusing on Ijtihad in the context of social change and the positivization of Islamic law. Employing a normative juridical method, this research relies on secondary data sources, including primary and secondary legal materials. The findings reveal that the adaptive and dynamic character of Islamic law allows it to grow and develop in the Indonesian legal system, which is transforming codification and official and binding legal enforcement. This development cannot be separated from the direction and policy of legal politics that influence the process of Islamic legal legislation. Although its application is not yet comprehensive and is still limited to certain fields, Islamic law has gained recognition in the form of independence, legitimacy, and authority as part of national law

Abstract

Human rights are fundamental freedoms that are eternally guaranteed to all people as they are the creations of the Almighty God. As a result, it must be protected, supported, and respected. It also must not be disregarded, as neglect and human rights abuses result in human rights violations. Political rights are one of the fundamental rights that must be upheld and safeguarded by the State, the law, and the government. The Criminal Code's provision of criminal penalties for the elimination of political rights in Article 35 (1) (3), where the electoral process and electoral laws are founded, proves to conflict with the State's mission for the preservation and maintenance of political rights. This article's analysis of criminal sanctions that impact citizens' political rights in terms of punishment philosophy is urgently needed.

Abstract

The politicization of religion in general elections has been a global issue in both religious and secular countries. Since 1955 to 2019, Indonesia experienced political contests laden with religious attributes, which sparked conflicts. This research aims to analyze the relevant issues and motives associated with using religious elements in the presidential election campaign 2019. This study  is  empirical  research  and  involves  interviews  with  high-level  officials of  political  parties.  Furthermore,  the  online  mass  media,  official  blogs  of candidate  pairs  for  president  and  vice  president,  and  social  media  were employed  as  secondary  data.  Following  the  analysis,  the  result  implies  that the politicization of religion in the 2019 presidential election campaign firmly appears  amidst  the  decline  of  presidential  and  vice  presidential  candidates' religious  polarization.  The  use  of  religious  issues  in  the  campaign  yielded public  sympathy  and  antipathy,  affecting  the  electability  of  presidential and  vice  presidential  candidates.  Meanwhile,  counter-elements  contradict negative images that discredit presidential and vice presidential candidates. The motives for politicizing religion were identified as "political pragmatism" and "culturalism politics". Ideological interest was also identified as a motive but  did  not  arise  in  the  2019  presidential  election.  From  siyāsah  shar'iyyah perspective, the politicization of religion could threaten the sharia objective of  creating  social  advantage  (maṣlaḥah).  Politicization  using  religious  issues amounts  to  religious  commodification,  which  is  irrelevant  to  the  sharia objective.Keywords: politization of religion; campaign; presidential election; siyāsah shar'iyyah AbstrakPolitisasi agama dalam pemilihan umum telah menjadi isu global di banyak negara, baik negara-negara berbasis agama maupun sekuler. Indonesia telah  melaksanakan  pemilihan  umum  sejak  tahun  1955  hingga  2019  dalam prosesnya  banyak  sekali  muncul  isu-isu  keagamaan  yang  menyebabkan terjadinya konflik dan perpecahan. Penelitian ini bertujuan untuk memetakan dan menganalisis isu-isu terbaru dan motif penggunaan isu keagamaan dalam kampanye  Pilpres  2019.  Penelitian  ini  merupakan  penelitian  fenomenologis empiris. Data diperoleh dari pengurus dan anggota partai politik. Selain itu diperoleh dari media cetak, media elektronik, media online/internet seperti blok resmi  pasangan  calon  presiden-calon  wakil  presiden  dan  media  sosial.  Hasil penelitian menemukan bahwa politisasi agama dalam kampanye Pilpres 2019 semakin menguat di tengah melemahnya polarisasi agama. Isu-isu keagamaan dalam  kampanye  telah  menimbulkan  simpati  dan  antipati  publik  sehingga mempengaruhi elektabilitas pasangan calon presiden-calon wakil presiden. Di sisi  lain  isu-isu  yang  mengkonter  berusaha  menormalisasi  citra  negatif  yang dialamatkan  pada  pasangan  calon  presiden-calon  wakil  presiden.  Isu-isu  ini muncul untuk kepentingan sesaat sebagai wujud politik pragmatis, di samping politik kultural. Kepentingan ideologis tetap terbaca walaupun tidak mengemuka secara  transparan,  karena  hambatan  konstitusional.  Dalam  pandangan  siyāsah shar'iyyah, politisasi agama dapat mengancam tujuan syariat untuk mewujudkan kemashlahatan. Politisasi dengan menggunakan isu-isu keagamaan merupakan komodifikasi agama yang tidak sejalan dengan cita-cita syariat itu sendiri.Kata Kunci: politisasi agama; kampanye; pemilihan presiden; siyāsah shar'iyyah

Abstract

 The promulgation of the Marriage Law is as a tool of social engineering or an instrument to regulate the community and as a guideline for the community to carry out a marriage. So those friendships that are carried out are not based on or violate religious law contained in the Marriage Law deemed invalid, one of which is interfaith marriages. The diversity of Indonesian society has been regulated by several provisions and diverse institutions, moreover related to the requirements of marriage. The occurrence of social facts in the form of violation of the regulations of marriage in the way of interfaith marriages according to the Sociological jurisprudence school is the result of proper gradation, morals which have been the basis for the formation of law. If ethics or morals become evil, it will result in bad behavior, both the behavior of individuals, groups and state officials.

Abstract

The goal of this paper is to demonstrate how corruption is being prevented, starting with the smallest component, the Pusar village administration. Contributing with a community-based research strategy is one way that empowered people can express their concern about national concerns where crime statistics show that corruption, including grant fraud, has increased from 2004 to 2022 and that a solution to eliminate it is therefore being examined. The community must be involved in the prevention and elimination of corruption offenses; it cannot be left to components of the integrated criminal justice system alone. Therefore, the empower thinks that by engaging in this mentoring activity, the central village government would better comprehend and be able to prevent the crime of satisfaction. Tulisan ini bertujuan untuk menunjukkan bagaimana pencegahan korupsi dimulai dari komponen terkecil yaitu Pemerintah Desa Pusar. Berkontribusi dengan strategi penelitian berbasis komunitas adalah salah satu cara yang dapat dilakukan oleh orang-orang yang diberdayakan untuk mengungkapkan keprihatinan mereka tentang keprihatinan nasional dimana statistik kejahatan menunjukkan bahwa korupsi, termasuk penipuan hibah, telah meningkat dari tahun 2004 hingga 2022 dan oleh karena itu solusi untuk menghilangkannya sedang diperiksa. Masyarakat harus dilibatkan dalam pencegahan dan pemberantasan tindak pidana korupsi; tidak dapat diserahkan kepada komponen sistem peradilan pidana terpadu saja. Oleh karena itu, Pemberdaya berpendapat bahwa dengan mengikuti kegiatan pendampingan ini, pemerintah pusat desa akan lebih memahami dan mampu mencegah terjadinya kejahatan untuk memenuhi kepuasan hati itu.

Abstract

Kecerdasan Buatan (Artificial Intelligence/AI) kini menjadi elemen penting dalam pendidikan modern, termasuk dalam studi Islam dan pendidikan hukum. Meskipun AI menawarkan efisiensi dan akses informasi yang luas, penggunaannya yang cepat memerlukan refleksi filosofis agar tidak menggeser nilai dasar pendidikan. Penelitian ini menggunakan metode studi kepustakaan atau yuridis normatif yang dipadukan dengan pendekatan komparatif dan analisis kualitatif untuk menelaah perubahan yang ditimbulkan AI terhadap proses pembelajaran. Secara ontologis, ketergantungan pada AI mengubah pola interaksi belajar dari hubungan langsung antarpendidik dan peserta didik menjadi proses yang lebih dimediasi teknologi. Dari sisi epistemologis, tantangan utama ialah menjaga keaslian produksi dan penyampaian pengetahuan ketika alat AI dapat memengaruhi cara berpikir yang sebelumnya dibangun melalui upaya manusia. Secara aksiologis, pemanfaatan AI harus berada dalam batas etika, moral, dan integritas akademik agar tidak mengurangi nilai-nilai dasar pembelajaran. Penelitian ini menekankan pentingnya kebijakan pendidikan Agma Islam yang seimbang antara penggunaan AI dan penguatan kompetensi manusia. Rekomendasi utama mencakup penyusunan pedoman literasi AI yang sesuai dengan kebutuhan pendidikan Agama Islam dan hukum, serta pengembangan sistem evaluasi yang menekankan orisinalitas dan proses. Dengan demikian, AI dapat berfungsi sebagai alat pendukung tanpa menghilangkan nilai kemanusiaan dalam pendidikan.

Abstract

This article was the result of community service in Nagari Tuo Pariangan, Pariangan District, Tanah DatarRegency related to technical assistance in the drafting of the Nagari regulations. The Nagari Regulations are the statutedrafted by the village level legislature (BPRN/BAMUS) and Wali Nagari. Therefore, Nagari Regulations usually haveto be made in accordance with the provisions of laws and regulations. In order to be able to create good NagariRegulation, those who create nagari regulations must have to a holistic and comprehensive understanding of theprocedures for designing nagari regulations since planning untill clarification. The difference from other articles waswrited of this article endowed with a method of devotion participatory action research (PAR) and a shift in legislativefunction at the Nagari level to go to a traditional village.

Abstract

In order to advance knowledge, higher education has a duty to educate all facets of society, including the local population. Additionally, as advancing general welfare is a duty of higher education, these efforts can be carried out through fulfilling duties related to the tri-dharma of higher education, all of which are interconnected and cannot be separated from one another. One of these dharmas is community service, which is why LP2M UIN Mahmud Yunus followed this approach when performing research-based service. Prior study must be done to ensure that the service is modeled, structured, and evaluated in accordance with the needs of the aided community.

Abstract

The State Civil Apparatus (ASN) is an occupation for civil servants and government employes with employment contracts who work for government agencies and play a very fundamental role in maintaining the unitary state of the Republic of Indonesia. ASN urgencies include the implementation of public policies, civil servants and the connected the nation must be able to act as organizers of government and developmental missions through the implementation of policies and professional public services. In fulfilling its function as a link and unification of the nation, ASN must strive to protect the integrity of the unitary state of the Republic of Indonesia from terrorism crimes that can break the sovereignty anchored in Bineka Tunggal Ika. Dirrect speak and written expressions of opinions on social media donÔÇÖt contain elements of hate speech against to Pancasila, the Constitution, Bhineka Tunggal Ika, the Unified State of the Republic of Indonesia and the government. DonÔÇÖt convey information that shows the nuances of hate speech against ethnicity, race, religion, and between groups. ASN doesnÔÇÖt participate in activities that lead to insult, incitement, provocation or hatred of Pancasila, the Constitution, Bhineka Tunggal Ika, the Unified State of the Republic of Indonesia and the government.

Abstract

The criminal justice system, which was previously focused on the criminal aspect or retributive perspective, is now confronted with the reality that there are only a few legal structures, ranging from judges, prosecutors, and police to a small number of prison institutions that serve as execution venues. The author is concerned with this legal fact, so he uses primary data sources and sociological juridical studies to try and find a remedy. According to the author's findings, to prevent the issues mentioned above, criminal cases in Minangkabau can be resolved through the Nagari Traditional Meeting Institution using the restorative justice idea, which aims to repair the social discord caused by criminal acts. When applying restorative justice, the Nagari Customary Association makes use of the relevant legal source of the Nan Salapan Law, while the formal legal procedures can use the Nan Duo Puluah Law.
