Abstract

This study analyses the interrelationship between alleged medical malpractice, patient safety, and legal accountability through a case study of a suspected malpractice incident during a cesarean section at Bekasi Regional Public Hospital (RSUD Bekasi) in 2025. Using a juridical-normative approach combined with empirical case analysis, the research applies Donabedian’s quality of care framework and examines Indonesian legal instruments, particularly Law No. 17 of 2023 on Healthcare. Data were collected from statutory provisions, court archives, national media reports, and scholarly literature, and analysed qualitatively through normative interpretation and triangulation of legal norms, theory, and factual findings. The results indicate three key deficiencies: (1) limited implementation of standard operating procedures and informed consent; (2) weak institutional oversight and patient safety culture; and (3) slow, costly, and opaque dispute resolution mechanisms that hinder access to justice. Comparative analysis with international practices shows that Indonesia’s legal governance remains fragmented, with insufficient integration between healthcare regulation and professional accountability. The study concludes that comprehensive reform is required to strengthen patient protection through clear regulatory mechanisms, independent medical audits, and the development of a no-fault compensation system that ensures both patient rights and medical professionalism.

Abstract

The reform of Indonesia’s criminal law through the enactment of the National Criminal Code (Law Number 1 of 2023) signifies a fundamental transformation in the orientation of sentencing objectives. This shift reflects a transition from a retributive approach, which primarily emphasizes punishment of offenders, toward a more humanistic and restorative justice–oriented paradigm. This article aims to critically examine the reorientation of sentencing purposes within the National Criminal Code and its implications for the criminal justice system in Indonesia. This study employs a normative juridical method, utilizing both statutory and conceptual approaches, by analyzing relevant legal regulations and scholarly literature. The findings reveal that the objectives of sentencing under the National Criminal Code are no longer confined to the imposition of penalties, but also encompass crime prevention, offender rehabilitation, victim restoration, and social reintegration. This humanistic approach positions individuals as the central focus of criminal law, striving to balance the interests of offenders, victims, and society. Therefore, this reform is expected to foster a more equitable, responsive, and humane criminal justice system.

Abstract

The rate of post-inpatient control visits remains relatively low due to various factors, including accessibility. At Hospital X, 220 of non-Jaminan Kesehatan Nasional (JKN) participants scheduled for post-inpatient control visits between January and March 2025, 71.82% attended, and 28.18% did not. Patients who did not attend control visits were twice as likely to be readmitted. This study aimed to determine the relationship between accessibility and post-inpatient control visits for non-JKN participants at Hospital X. This quantitative study employed an analytical cross-sectional design, with a population of 220 patients and a sample of 142 patients selected using probability sampling. Bivariate and multivariate analyses were performed using the chi-square test and binary logistic regression analysis. The results showed a significant relationship between distance to the hospital (p = 0.000), availability of transportation (p = 0.000), and the condition of service infrastructure (p = 0.000) with post-inpatient control visits among non-JKN participants at Hospital X. The results also showed that the factor with the highest probability of increasing post-inpatient control visits was walking as a mode of transportation, which increased the likelihood by 11.759 times. In conclusion, distance accessibility, transportation availability, and the condition of service infrastructure were significantly associated with post-inpatient control visits among non-JKN participants at Hospital X. The hospital should consider providing telemedicine services for patients who live at a considerable distance. In addition, the hospital could provide free pick-up and drop-off services within a certain radius.

Abstract

BPJS Kesehatan can be used to access promotive and preventive services at primary health care facilities, but its utilization is still not optimal. A situation analysis conducted in Sirnagalih Village, RT 01/RW 01, Megamendung Village, Bogor Regency, shows that residents who already have BPJS Kesehatan have not utilized promotive and preventive services at the community health center optimally. This condition has the potential to cause low utilization of primary health care services as an effort to prevent disease. The implementation of the Real Work Lecture (KKN) aims to increase the knowledge of the community of Sirnagalih Village, regarding the utilization of Community Health Center Health Services, especially preventive efforts. The activity method is in the form of observation and analysis of the field situation as a basis for compiling the KKN work program. Based on the results of the problem identification that has been done, a Health education program entitled "Healthy Friend Community Health Center: Preventing Diseases is Easier with BPJS Kesehatan" was implemented, using lectures and interactive discussions. The results of the activity showed that there was an increase in participant knowledge from an average pretest score of 70 to 78.69 in the posttests. It can be concluded that the health education program was able to increase public knowledge about how BPJS Kesehatan can be used to support disease prevention efforts. It is recommended that educational activities be carried out continuously by community health centers to increase the utilization of promotive and preventive services in the community.
