Abstract

Hukum itu untuk manusia, bukan sebaliknya. Paradigma ini harus digunakan saat mempelajari ilmu hukum. Dengan paradigma tersebut maka akan menimbulkan pengaruh ketika belajar ilmu hukum. Seseorang yang mempelajari beragam pendekatan dalam ilmu hukum akan menimbulkan hasil yang berbeda pula. Pengakuan terhadap manusia sebagai subjek utama dalam ilmu hukum akan menimbulkan regulasi yang baik.

Abstract

Laws are for humans, not vice versa, thus paradigms should be used in studying law. This is the entrance and the point of view (point of view) which will affect all aspects of our learning about progressive law. People who use a different point of view will also generate learning about the law differently. Acknowledging the presence of humans as a major stakeholder in the law would place them in line with legal regulations, if not, even on higher ground.Admittedly, that it is not easy to be realized or implemented. Abstract

Indonesia berada di puncak bonus demografi, maka kualitas sumber daya manusia menjadi tantangan besar. Berdasarkan World Population Review Oktober 2022, mengemukakan bahwa tingkat Intelegence Quotient orang Indonesia rata-rata 78,49% dan berada di peringkat 130 dari 199 negara di dunia serta urutan terakhir dari 10 negara ASEAN. Sejak tahun 2000–2010, lebih dari 30% anak balita Indoesia mengalami tengkes. Permasalahan tersebut ditemukan di Kecamatan Mangkubumi Kota Tasikmalaya. Secara umum, yang saling berkaitan dan mempengaruhi yaitu; Kemiskinan, Kebersihan, dan Stunting. PKM ini bertujuan membangun persepsi, pemahaman dan keterampilan para pemangku kepentingan dalam mencegah stunting dan cara-cara mengantisipasinya melalui strategi komunikasi kesehatan dalam bentuk digital media campaign. Maka, dibutuhkan content sehat dan manfaat bagi para content creator dan kecerdasan informasi bagi penerimannya, untuk menangkal hoaxs/propaganda, informasi menyesatkan tentang kesehatan. Hasil PKM menunjukkan diantaranya; terdapat peningkatan pengetahuan, pemahaman dan kesadaran dari para pemangku kepentingan yang relevan tentang perlunya koordinasi yang intens untuk pencegahan stunting.

Abstract

Abstract. This research addresses the fulfillment of the right to health for prisoners at the Klas IIA Banceuy Correctional Institution in the context of law enforcement and human rights protection. The Law on Corrections provides the legal basis for prisoners' rights, including access to adequate healthcare services. However, its implementation in the field often faces challenges. This study aims to analyze the extent to which the right to health of prisoners at Klas IIA Banceuy Correctional Institution is fulfilled in accordance with the provisions of the Law on Corrections. The methods used include legal document analysis, interviews with correctional officers and prisoners, and direct field observations. The results indicate that although the Law on Corrections emphasizes the importance of fulfilling prisoners' right to health, several obstacles persist in practice, such as limited resources, inadequate infrastructure, and restricted access to healthcare services. The study implies the need for improvements in the correctional system, including enhancing human resources and healthcare infrastructure within correctional institutions. Additionally, cooperation between correctional institutions, the government, and other related parties is necessary to ensure the fulfillment of prisoners' health rights in line with the standards set by the Law on Corrections. Recommendations include improving healthcare facilities, human resources, and collaboration with external parties to support the fulfillment of prisoners' health rights at Klas IIA Banceuy Correctional Institution. Abstrak. Penelitian ini membahas pemenuhan hak kesehatan bagi narapidana di Lembaga Pemasyarakatan Klas IIA Banceuy dalam konteks penegakan hukum dan perlindungan hak asasi manusia. Undang-Undang Pemasyarakatan menetapkan dasar hukum untuk hak-hak narapidana, termasuk akses terhadap layanan kesehatan yang layak. Namun, implementasinya di lapangan seringkali menghadapi tantangan. Studi ini bertujuan untuk menganalisis sejauh mana pemenuhan hak kesehatan narapidana di Lapas Klas IIA Banceuy sesuai dengan ketentuan Undang-Undang Pemasyarakatan. Metode yang digunakan meliputi analisis dokumen hukum, wawancara dengan petugas lapas dan narapidana, serta observasi langsung di lapangan. Hasil penelitian menunjukkan bahwa meskipun Undang-Undang Pemasyarakatan menekankan pentingnya pemenuhan hak kesehatan bagi narapidana, terdapat sejumlah hambatan di lapangan seperti keterbatasan sumber daya, infrastruktur yang kurang memadai, dan akses terbatas ke layanan kesehatan. Implikasi penelitian ini adalah perlunya perbaikan dalam sistem pemasyarakatan, termasuk peningkatan sumber daya manusia dan infrastruktur kesehatan di lembaga pemasyarakatan. Selain itu, diperlukan kerjasama antara lembaga pemasyarakatan, pemerintah, dan pihak terkait lainnya untuk memastikan pemenuhan hak kesehatan narapidana sesuai standar yang ditetapkan dalam Undang-Undang Pemasyarakatan. Rekomendasi yang diberikan meliputi peningkatan fasilitas kesehatan, sumber daya manusia, dan kerjasama dengan pihak eksternal untuk mendukung pemenuhan hak kesehatan narapidana di Lapas Klas IIA Banceuy.

Abstract

Law enforcement against service users and traditional commercial sex workers in Indonesia in handling the increasingly rampant practice of prostitution. Despite government efforts to reduce involvement in prostitution, the lack of specific regulations in Indonesian law has allowed service users of prostitution to avoid appropriate legal consequences. The purpose of this research is to understand the urgency to criminalize traditional commercial sex workers and service users. The majority of the problem lies in economic factors influenced by someone's income or needs, especially the difficulty for women to meet their needs, especially women who lack skills, thus their competitiveness in the job market is very low, and also related to the legal framework which still lacks regulation. This research uses a normative juridical method by employing legislative approach, conceptual approach, and comparative approach. Researchers examined secondary legal materials, including local regulations such as the DKI Jakarta Regional Regulation, the Indramayu District Regulation, the Tangerang City Regulation, the Denpasar City Regulation, the Badung Regency in Bali, Batam City, and Bandung Regency, as well as the Dutch regulation on brothels, known as the "Wet Regulering Prostitutie en Bestrijding Misstanden Seksbranche" (Regulation on Prostitution and Combating Abuses in the Sex Industry). The research findings indicate the need to promptly incorporate these regulations into the NATIONAL CRIMINAL CODE to prosecute users of traditional sex services and also the workers themselves, or at least to follow the policy of the Dutch government by legalizing brothels, where brothel owners are required to prove consistent tax payments and not being involved in any crimes, aiming to prevent HIV/AIDS and human trafficking.

Abstract

In the context of a medical audit, the medical committee functions to prevent possible negligence in specific medical procedures. This function is generally performed when a case is considered difficult, an unnatural death or other exciting cases are found. This study aims to explain the role of medical committees and medical audits and the part of medical audits in resolving medical crimes. The method used in this study is a normative juridical method with a statutory and conceptual approach. This study shows that the medical committee is tasked with monitoring and evaluating the quality of medical services by implementing medical audits. Meanwhile, the role of medical audit in resolving medical crimes is as a guide to ensure that every action, procedure, mechanism and decision taken in medical treatment is by established standards and quality. In conclusion, the findings highlight the critical role of medical audits in ensuring the quality of medical services, preventing medical crimes, promoting accountability, and supporting due process. Emphasizing the importance of medical audits can lead to better patient care, increased trust in the healthcare system, and continuous improvement in the medical field.

Abstract

The high crime rate and overcapacity in correctional institutions underscore the necessity of examining the effectiveness of prison sentences and exploring fairer alternative sanctions. This research aims to analyze the effectiveness of prison sentences within the criminal justice system and identify ideal criminal sanctions to achieve justice. The study employs a normative juridical method with a descriptive approach. The findings reveal that prison sentences carry negative consequences, including stigmatization and challenges in social reintegration. To enhance the effectiveness of law enforcement and realize justice, the study recommends adopting restorative justice approaches, strengthening preventive measures, and integrating non-legal considerations into law enforcement. Thus, this research contributes to shaping criminal law policies that are not solely repressive but also preventive and rehabilitative. It advocates for the development of a legal system adaptable to the challenges of overcapacity in correctional institutions, promoting a balance between repression, prevention, and rehabilitation for a more equitable and sustainable justice framework.

Abstract

This study investigates Islamic jurisprudence principles concerning workers’ protection regarding wage determination and payment in Indonesia. Employing a juridical-normative approach, the research analyzes labor regulations, Islamic jurisprudential rules, and the concept of labor law. Data were collected through legal document analysis, Islamic literature review, and comparative studies and were analyzed qualitatively using descriptive-analytical methods. The findings indicate that Islamic jurisprudence principles, prioritizing justice, equality, and workers’ welfare, have been incorporated into Indonesian labor law through Law Number 13 of 2003 on Manpower and Government Regulation Number 51 of 2023 on Wages. Islam regards workers as equals to employers and prohibits the imposition of excessive workloads, delays in wage payments, and unjust treatment of workers. Similarly, Indonesian legislation prohibits employers from delaying wages and ensures workers receive fair compensation. The study underscores the significance of integrating Islamic principles with positive law to establish a more humane and equitable wage system that safeguards workers’ rights and promotes their welfare in Indonesia, particularly within the context of Subang Regency as an industrial area. This research contributes to a comprehensive understanding of legal protection for workers within the wage system by synthesizing the principles of Indonesian positive law and Islamic jurisprudence.

Abstract

Penelitian ini mengkaji perlindungan hak asasi manusia dalam proses peradilan pidana terhadap orang dengan gangguan jiwa. Meskipun berbagai peraturan hukum di Indonesia, seperti Kitab Undang-Undang Hukum Pidana (KUHP), Undang-Undang Nomor 18 Tahun 2014 tentang Kesehatan Jiwa, dan prinsip-prinsip HAM internasional telah mengatur hak individu dengan gangguan jiwa, penerapannya di lapangan masih belum optimal. Dalam praktiknya, individu dengan gangguan jiwa yang tersangkut kasus pidana sering mengalami pengabaian hak, seperti tidak mendapatkan pemeriksaan psikologis yang layak, tidak didampingi oleh ahli kesehatan mental, hingga perlakuan diskriminatif selama proses penyidikan, penahanan, dan persidangan. Dengan pendekatan kualitatif melalui studi literatur dan analisis kasus, penelitian ini menemukan bahwa stigma sosial terhadap gangguan jiwa turut memengaruhi penegakan hukum, dan berpotensi menyebabkan pelanggaran hak asasi manusia. Temuan ini menegaskan pentingnya integrasi antara pendekatan psikologis, hukum progresif, dan prinsip HAM dalam sistem peradilan pidana Indonesia. Penelitian ini merekomendasikan adanya reformasi hukum berbasis keadilan inklusif, pelatihan khusus bagi aparat penegak hukum dalam menangani pelaku dengan gangguan jiwa, serta penguatan akses terhadap layanan kesehatan jiwa yang layak. Tujuannya adalah agar proses peradilan tidak hanya menekankan aspek legalistik, tetapi juga menjunjung tinggi martabat dan kondisi psikologis pelaku.

Abstract

Introduction: Professional standards for medical personnel define the competencies that medical personnel can be held accountable for when practicing medicine. The purpose of these professional standards is to ensure that medical personnel possess a minimum standard of knowledge, skills, and professional behavior, which is also used by relevant parties as a guideline, reference, basis, and guidance in regulating and fostering the medical and dental professions. However, in the cases of Supreme Court Decisions Number 1145K/Pdt/2017 and Number 365K//Pid/2012, medical personnel were faced with an emergency that forced them to perform medical procedures deemed to violate these professional standards. Method: This study uses a descriptive analytical juridical method to analyze the criminal law liability of medical personnel. Data were collected from laws, related regulations, and court decisions. Data analysis was carried out using a qualitative juridical approach. Discussion: The professional standards for doctors are regulated by the Decree of the Indonesian Medical Council Number 193/KKI/KEP/VIII/2024, and the professional standards for dentists are regulated by the Decree of the Indonesian Medical Council Number 126/KKI/KEP/III/2024. These professional standards govern medical personnel in providing healthcare services, including emergency measures. While emergencies are not explicitly stated in Article 48 of the Indonesian Criminal Code and Law Number 1 of 2023 concerning the Indonesian Criminal Code (KUHP), Article 33, is not explicitly stated. However, through doctrine and jurisprudence, the view has developed that emergencies are part of relative coercive power, but not psychological coercive power. Therefore, legal subjects may be faced with three conflicting options. Emergencies can be linked to Article 48 of the Indonesian Criminal Code concerning coercive power and forced circumstances, which can serve as justification and excuse. Conclusion: The liability of medical personnel for performing emergency actions and errors, if carried out in an emergency to protect the patient's life, can be grounds for eliminating criminal penalties for medical personnel and cannot be accounted for.
