Abstract

Penulisan sitasi merupakan salah satu elemen yang penting dalam penyusunan karya ilmiah. Mahasiswa Sekolah Tinggi Teknik Malang sering kali menghadapi kesulitan dalam mengelola sitasi secara sistematis serta sesuai dengan format yang ditentukan. Untuk menghindari plagiarisme penelitian ini bertujuan untuk memberikan panduan praktis mengenai penggunaan Mendeley, sebuah perangkat lunak manajemen referensi, dalam proses penulisan sitasi. Penelitian ini menggunakan metode deskriptif dengan pendekatan kuantitatif. Data dikumpulkan melalui observasi, kuesioner, dan wawancara terhadap mahasiswa yang telah mengikuti pelatihan penggunaan Mendeley. Selain itu, dilakukan analisis terhadap karya tulis mahasiswa sebelum dan sesudah penggunaan Mendeley untuk mengukur tingkat peningkatan kualitas sitasi. Hasil penelitian memberikan gambaran tentang efektivitas pelatihan dan dampaknya terhadap kemampuan mahasiswa dalam mengelola referensi secara profesional. Serta menunjukkan bahwa penggunaan Mendeley secara signifikan meningkatkan efisiensi dan akurasi dalam pengelolaan referensi serta mempermudah mahasiswa untuk mengikuti format sitasi yang standar. Dengan demikian, penggunaan Mendeley dapat menjadi solusi efektif bagi mahasiswa Sekolah Tinggi Teknik Malang untuk meningkatkan kualitas karya ilmiah mereka.

Abstract

Corporate crime lately has been seen by the public as the most serious and dangerous crimes than conventional crimes such as robbery or theft by force because the consequences of corporate crime is much more devastating than those caused by conventional crime, the purpose of this study describe and analyze criminal liability against corporations that commit crimes of environmental destruction,the formulation of the the second is how criminal liability against corporations that commit crimes of environmental destruction,the research method used is normative legal research.The first research results in UUPPLH in 2009 regulate the formulation of offenses, namely material offenses and formal offenses. Material offenses are found in Article 98, Article 99 and Article 112, while formal offenses are found in Article 100 to Article 111 and Article 113 to Article 115 of Law Number 32 of 2009 on Environmental Protection and management. While related to corporate regulation in environmental crimes stated in Article 116 paragraph (1) and Paragraph (2) and Article 118 UUPPLH. Abstract

Based on the applicable legislation, the Defendant Timothy Tandiokusuma should have been sentenced for the crime of fraud and deceit. The identification of the problem in this research is how the conformity of evidence proves the existence of fraud (Case Study Number: 278/Pid.B/2021/PN.Tng) and how the legal considerations of the Tangerang District Court judge in acquitting Timothy Tandiokusuma (Case Study Number: 278/Pid.B/2021/PN.Tng). The conformity of evidence has met the principles of Article 185 paragraph (6) of the Criminal Code, which is the method used by a judge in sentencing the Defendant. Data analysis was conducted descriptively and conclusions were drawn using deductive methods. Based on the research results and conclusions, it is concluded that there was an error by the Panel of Judges in sentencing the defendant due to not paying attention to the conformity of the evidence. In this case, the Panel of Judges only referred to evidence such as witness statements, bank statements, checks, and contract letters, and considered the act as not a criminal offense but rather a civil matter. The victim witness who suffered losses due to the Defendant's actions should have filed a fraud claim to obtain compensation.

Abstract

Law No. 8 of 1981 on Criminal Procedure regulates the implementation of arrests, but there are cases of arrests that are contrary to the Criminal Procedure Code, and this is reinforced by the Pre-Trial Decision of Kayuagung District Court No. 02/Pid.Pra/2018/PN.Kag. The formulation of the problem to be discussed, namely: Was the arrest by Ogan Komering Ilir (OKI) police officers of Yogie Singa Negara in accordance with KUHAP and Regulation of the Chief of the Indonesian National Police (Perkap) No. 14/2012 on the Management of Criminal Investigation? And whether the judge's decision to reject all of the applicant's requests in Kayuagung District Court Pretrial Decision No. 02/Pid.Pra/2018/PN.Kag is in accordance with KUHAP and Perkap No. 14/2012. This research uses normative legal methods, descriptive in nature, using secondary data. The result and conclution that the OKI police officers in carrying out the arrest of Yogie Singa Negara did not comply with the procedures in Article 18 paragraph (1) of KUHAP jo. Article 37 of Perkap No. 14/2012. The decision of the pre-trial judge of Kayuagung District Court No. 02/Pid.Pra/2018/PN.Kag was also deemed inappropriate, because it rejected entirely the petition of the applicant in the case.

Abstract

The indictment is a legal document submitted by the public prosecutor in criminal proceedings, serving to explain the criminal offense charged against the defendant. The issue examined in this paper focuses on a juridical review of the inaccurate use of an indictment in the North Jakarta District Court Decision Number 43/PID.B/2021/PN JKT.UTR concerning an online gambling offense. This study employs a normative legal research method with a descriptive approach, supported by both primary and secondary legal materials. Data will be collected through literature study and analyzed qualitatively.The discussion and conclusion reveal that although the indictment formally meets the requirements under the Criminal Procedure Code (KUHAP), there is inaccuracy in the selection of the legal basis, which is a material requirement. The public prosecutor charged the defendant under Article 303 of the Indonesian Criminal Code (KUHP), which is more suitable for conventional gambling, whereas the offense committed would be more appropriately charged under Law Number 11 of 2008 on Electronic Information and Transactions (ITE Law). This inaccuracy potentially leads to legal uncertainty in law enforcement and creates juridical consequences for the indictment. This study emphasizes the importance of precision in formulating indictments.

Abstract

Penelitian ini bertujuan untuk mengembangkan strategi integrasi antara ternak sapi dan kebun kelapa sawit dengan pola pemeliharaan system SISKA di Kecamatan Batang Cenaku, Kabupaten Indragiri Hulu. Penelitian ini mengidentifikasi faktor internal dan eksternal yang mempengaruhi pengembangan integrasi ternak sapi dengan kebun kelapa sawit, serta merumuskan strategi yang tepat untuk pengembangan tersebut. Data dikumpulkan melalui wawancara, observasi, dokumentasi, dan kuisioner kepada peternak di Kecamatan Batang Cenaku. Hasil analisis matriks IFE dan EFE menunjukkan bahwa faktor internal dan eksternal yang ada memberikan peluang yang cukup besar untuk pengembangan sistem integrasi tersebut. Berdasarkan analisis SWOT dan matriks IE, strategi yang disarankan adalah strategi intensif yang memanfaatkan kekuatan internal dan peluang eksternal, seperti pengurangan biaya pemupukan dan peningkatan permintaan daging sapi. Selain itu, kerjasama dengan pihak terkait dan peningkatan keterampilan peternak juga dianggap penting untuk mengatasi ancaman dan kelemahan yang ada. Penelitian ini memberikan rekomendasi untuk memanfaatkan limbah kebun kelapa sawit sebagai pakan ternak untuk mendukung keberlanjutan usaha peternakan di daerah tersebut.

Abstract

Corruption offenses are not exclusively committed by civilians; disciplined military personnel can also be involved. A notable instance of this was disclosed by the Corruption Eradication Commission (KPK) through a sting operation (OTT) on July 27, 2023. During this operation, KPK apprehended several private individuals and the Coordinator of Administration (Koorsmin) of Basarnas RI, Lieutenant Colonel Adm Afri Budi Cahyanto. The identification problem of this analysis is the authority and legal basis for KPK RI to charge the Head of Basarnas RI and the Coordinator of Administration (Koorsmin) of Basarnas RI in the context of the procurement project for disaster victim search equipment. Additionally, it examines the legal foundation for KPK RI to designate an active military officer as a suspect in a corruption case within a non-military institution. The result and conclusion; reveals that KPK possesses the authority to handle corruption cases involving active-duty personnel who are employed in non-military institutions or organizations, even if the perpetrators are active military officers. The primary legal foundation for the Corruption Eradication Commission of the Republic of Indonesia (KPK RI) to designate a suspect in the disaster victim search equipment procurement project is Law Number 19 of 2019, which is the second amendment to Law Number 30 of 2002 on the Corruption Eradication Commission.

Abstract

In the development of the judiciary, crown witness testimony often becomes a subject of debate as it contradicts the principle of non-self-incrimination. This study identification problem the evidentiary strength of testimony given by defendants sworn in as crown witnesses in the North Jakarta District Court Decision Number 286/Pid.B/2024/PN Jkt Utr. The research employs a normative juridical method with a descriptive approach, the data type uses secondary data with primary legal materials and secondary legal materials, and conclusions are drawn using deductive reasoning. The analysis results and conclusion show that the crown witness testimony provided in this case lacks valid evidentiary strength, violates the principles of the Indonesian Criminal Procedure Code (KUHAP), and contravenes the ICCPR, which has been ratified through Law Number 12 of 2005. This underscores the importance of adhering to the principle of due process of law in Indonesia's criminal justice proceedings.

Abstract

Coffee (Coffea sp.) is a plantation crop that is widely cultivated and an export commodity that has an important role for the economy in Indo-nesia. The productivity of coffee cultivation in Indonesia is still not optimal due to several factors, one of which is the lack of innovative tech-nology that can increase the production of coffee plants. An important phase in the cultivation of coffee plants is in the phase of young plants or immature plants in year 1. In this phase, proper maintenance treatment is needed for the purpose of preparing the plant for optimal growth. The application of technology to increase the production of coffee plants can be done through the application of Bacillus sp. which can func-tion as bacteria that can stimulate plant growth and by using superior clones. The purpose of this study was to determine the effect of Bacillus sp. on the growth of immature plants in year 1 on several robusta coffee clones. The method of this research was using split plot design which was arranged in a randomized complete block design (RCBD) with 2 factors and 3 replications. Factor I as the main plot consisted of several clones with 4 levels, namely the Cabutan clone, BP 409, BP 936, and BP 939. Factor II as the subplot was the concentration of Bacillus sp. consisted of 3 levels, namely 0 gr/l, 30 gr/l and 60 gr/l. The results of this study indicate that there is no interaction between the application of Microbial Bacillus sp. with some of robusta coffee. While the application of Bacillus sp. significantly increase stem diameter and there were differences in the growth characteristics of several coffee clones on all observed variables.

Abstract

Pretrial is a legal mechanism that serves as a means of control over the actions of law enforcement officials, especially in the process of investigation and detention. In Indonesia, pretrial authority is regulated in the Criminal Procedure Code (KUHAP) and Constitutional Court Decision No. 21/PUU-XII/2014, which focuses on procedural testing, such as the legality of arrest, detention, confiscation, termination of investigation, termination of prosecution, and determination of suspects. On the other hand, Italian pretrial is regulated in the Codice di Procedura Penale, which grants broader authority to the Giudice per le Indagini Preliminari to oversee both of the procedural aspects and the substance of investigations and prosecutions. The results show that the Italian pretrial institution provides relatively responsive protection to the human rights of suspects or defendants, because structurally the investigative judge has the authority to examine procedural aspects from the beginning of the investigation. Indonesia's pretrial institutions have relatively limited authority to examine the formal procedural aspects of actions taken by investigators and public prosecutors. This comparison suggests that there is an opportunity for Indonesia to improve pretrial effectiveness by adopting the checks and balances principles applied in Italy.
