Abstract

- Provision of Legal Assistance provided by the Legal Division of the Police of the Republic of Indonesia to Police officers who have committed Serious Abuse in Decision No: 372/pid.B/2020/PN.Jkt.Utr. The main problem of this thesis is whether the provision of legal assistance by the Legal Division of the Indonesian Police to members of the Police who committed criminal acts of serious abuse in Decision No. 372/Pid.B/2020/PN.Jkt.Utr. and whether the consequences of using the Advocate Attributes provided by the Legal Division of the Indonesian Police are in accordance with existing laws and regulations. The type of research used is normative juridical using secondary data, qualitative data analysis, and drawing conclusions using deductive methods. Based on the analysis, it is known that the provision of legal assistance by the National Police Legal Division to Police Officers in the Crime of Serious Persecution is in accordance with National Police Chief Regulation no. 2 of 2017 which is in conflict with article 13 paragraph (2) of PP No. 3 of 2003 concerning the Implementation of Institutional Technical General Courts for Members of the Indonesian Police and the use of advocate attributes by the police in trials is contrary to Constitutional Court decision No.: 89/PUU-XV/2017 and Article 25 paragraph (1) Law no. 18 of 2003 concerning Advocates.

Abstract

Mustard greens (Brassica juncea L.) are one type of favorable vegetable. However, mustard greens production and productivity still fluctuate. Also, society expects quality, healthy and safe vegetable products for consumption. So, it is necessary to increase the use of organic fertilizers to produce high productivity and good products. LOF of rabbit urine contains high nutrients, and PGPR contains microorganisms that act as bioactivators that decompose organic matter. This study aimed to determine the effect of giving LOF of rabbit urine and concentration of PGPR of bamboo roots on the growth and yield of mustard greens. The experiment was carried out factorially using Random Design Complete with three replications. The first factor was the LOF dose of rabbit urine, and the second was the PGPR concentration which consisted of 4 levels. The results showed that (1) the interaction of LOF of rabbit urine and concentrations of PGPR of bamboo root had no significantly different effect on all variables; (2) LOF of rabbit urine had no significantly different effect on all variables and (3) PGPR concentration of bamboo roots had a significant different effect on all variables except root volume and number of leaves, where treatment of 15 ml/L (B3) gave the best results on the yield of mustard greens.

Abstract

The right of review is the right of the perpetrator, in contrast to ordinary legal remedies whose application is enshrined in Article 268 paragraph (3) of the Criminal Code. However, in SEMA Number 7 of 2014, a review can be submitted on the grounds that there is a conflict between the decisions. Through Decision 467 Pk/Pid.Sus/2021, the panel of judges decided that the application was unacceptable. From the description above, the author intends to analyze two main issues to be examined, namely whether the decision is in accordance with the Criminal Procedure Code, and whether the reason for the decision is not acceptable to the application. In this paper, the author conducts a descriptive analysis method. Based on the discussion presented in this paper, it is concluded that the decision is not in line with Article 79 of Law Number 14 of 1985 concerning the Supreme Court, using the reason that there is no contradiction submitted as evidences as required in SEMA Number 7 of 2014

Abstract

Corruption is an ongoing issue in Indonesia, with hundreds of cases occurring every year. The Corruption Eradication Commission (KPK) has special authority to conduct wiretapping as part of the investigation efforts into corruption cases. One of the frequently used pieces of evidence in wiretapping is voice recordings. In this research, a normative legal approach with a descriptive-analytical method is employed. The research aims to understand and analyze the evidential strength of voice recordings in  cases of corruption. Data is gathered through a literature review, utilizing primary sources like the 1945 Constitution of the Republic of Indonesia, the Criminal Procedure Code (KUHAP), and the Law on the Eradication of Criminal Acts of Corruption, as well as secondary sources such as legal books, legal journals, papers, and relevant articles. Qualitative analysis is the chosen data analysis method. The research findings affirm that the KPK has legitimate authority to conduct wiretapping and use voice recordings as evidence in the prosecution of corruption cases. Voice recordings are recognized as valid evidence with strong probative value, supported by decisions from the Constitutional Court and the expansion of evidentiary provisions in the KUHAP. The research's conclusion reinforces that the KPK can lawfully conduct wiretapping and employ voice recordings as evidence in accordance with applicable laws, playing a crucial role in the fight against corruption in Indonesia. Abstract

Restorative justice is a new concept that may justify the suspension of criminal investigations throughout the criminal justice system. The West Jakarta District Attorney's Office investigated a theft case using this strategy. The problem studied was how the West Jakarta District Attorney's Office applied restorative justice to a theft case involving suspect Hendra Yohanes and how it was evaluated in a non-criminal case involving the same suspect. This descriptive research uses normative legal studies to show how restorative justice can resolve criminal cases. This research uses primary and secondary sources to obtain information. The West Jakarta District Attorney's Office abandoned the restorative justice prosecution of a theft case after going through procedural steps conducted by the facilitating prosecutor, according to the results of the research. The West Jakarta District Attorney's Office issued a Decree to Discontinue Prosecution to resolve Hendra Yohanes' theft case after reconciling with the victim, the suspect's apology, and a statement that he would not reoffend.

Abstract

The development of digital technology has transformed the landscape of the construction industry, and one of the most important innovations in recent years is the implementation of Building Information Modeling (BIM). BIM provides solutions to enhance efficiency in the design, construction, and management of construction projects. This research explores the impact of integrating BIM into the civil engineering curriculum on students' readiness to face the challenges of an increasingly digitized construction industry. Through a quantitative and qualitative approach, this research uses pre-test and post-test to measure changes in students' competencies in using BIM after participating in the training. Three groups of civil engineering students were tested to measure their level of understanding before and after the BIM training. The research results show a significantincrease in post-test scores compared to pre-test scores in all three groups, with an average improvement of 24.7%. These results indicate that the integration of BIM in education can be effective in enhancing students' professional readiness and bridgingthe gap between academic theory and the practical demands of the modern construction industry. This study suggests that BIM should be more widely integrated into the civil engineering curriculum to prepare graduates who are ready to compete in the era of construction industry digitalization.

Abstract

This research explores the application of restorative justice for juvenile offenders in Indonesia and Germany, focusing on two cases: the AQJ case in Indonesia and a rape case in Germany involving minors. Restorative justice is applied with the aim of protecting the rights of both the children and the victims within the legal process. The study adopts a normative comparative legal approach. There are two main research questions: first, the differences and similarities in the concept of restorative justice for juveniles in Indonesia and Germany; second, the advantages and disadvantages of applying this concept. The result and conclusion is findings indicate that although Indonesia and Germany share the same goal of restoring the situation for both victims and offenders, as well as mitigating the negative impact on children through mediation, there are differences in the implementation mechanisms. In Indonesia, the approach involves family discussions and focuses on the moral recovery of the child. In contrast, in Germany, juvenile judges play a significant role in educating and rehabilitating the offender through formal and structured mechanisms. Additionally, mediation facilities are more widely available in Germany compared to Indonesia, where the understanding and implementation of restorative justice remain limited.

Abstract

Banjir merupakan masalah serius yang dihadapi oleh Kabupaten Sampang, khususnya di sekitar Kali Kemoning. Salah satu upaya yang dilakukan untuk mengendalikan banjir adalah dengan membangun sistem pengendalian banjir yang melibatkan penggunaan tiang pancang dalam normalisasi Kali Kemoning. Penelitian ini bertujuan untuk menganalisis dampak ambruknya tiang pancang terhadap kinerja pompa pengendalian banjir. Metode Penelitian yang digunakan yaitu jenis penelitian analisis deskritif kualitatif. Penelitian ini melibatkan survei lapangan, pengumpulan data sekunder, serta analisis terhadap data yang diperoleh. Data yang dikumpulkan meliputi kondisi tiang pancang, kapasitas pompa, gangguan operasional, dan biaya perbaikan. Analisis dilakukan dengan membandingkan kinerja pompa sebelum dan setelah ambruknya tiang pancang. Hasil Penelitian didapatkan bahwa bahwa robohnya tiang pancang mengakibatkan reduksi kapasitas pompa dalam menangani volume air yang tinggi, sehingga menghambat aliran air dan mengurangi kinerja pompa dalam mengendalikan banjir sehingga disarankan untuk melakukan perbaikan infrastruktur dengan memulihkan tiang pancang yang ambruk, memperbaiki atau mengganti peralatan dan sistem pompa yang rusak, serta meningkatkan pemeliharaan rutin.

Abstract

The criminal justice system is often considered ineffective and can have negative impacts on children, such as stigmatization and dehumanization. Diversion aims to protect children from the adverse effects of criminal justice and support their development. The problem is about, the use of diversion efforts in cases of drug crimes committed by children, with a case study of Sibuhuan District Court Decision Number 2/Pid. Sus-Anak/2022/Pn.Sbh. The result and conclusion; still not maximized in its application, in this case the child who committed a narcotics crime has met the requirements for diversion efforts but this was not pursued during the process, this study also examines the legal consequences of not applying diversion efforts in the examination process in court, where there are no legal consequences for law enforcement officials, the research method used is a normative approach with analysis of applicable laws and regulations and literature studies.

Abstract

Based on sufficient preliminary evidence, Fahrul Roji as the applicant has been named a suspect by the BNN as the respondent. However, the applicant is dissatisfied with the determination because the evidence held by the respondent is considered insufficient. This study discusses the problem is the determination of preliminary evidence in determining a suspect in a narcotics case, with a case study of the pretrial decision No. 14 / PID.PRA / 2023 / PN JKT.TIM. The focus of the study is to analyze the types of valid evidence that can be used as the basis for sufficient preliminary evidence and the appropriateness of the judge's considerations in determining the suspect. The method used is normative study using secondary data and a descriptive approach analyzed qualitatively. Based on the discussion, it can be concluded and result that the preliminary evidence to determine the applicant as a suspect is insufficient, because the existing evidence is not accurate and only one can be accepted as valid evidence. Therefore, the applicant's request should be granted by the judge because there is no sufficient evidence for a narcotics crime.
