Abstract

Ekonomi kreatif adalah era baru dalam tren ekonomi dunia yang tumbuh dengan sangat cepat.Bidang ini membutuhkan dukungan dan perlindungan dari pemerintah dan masyarakatkhususnya untuk dukungan pendanaan. Industri kreatif didominasi oleh pengusaha kecil danmenengah yang membutuhkan bantuan pendanaan disamping perantara lembaga keuanganformal (bank) yang sulit untuk mereka capai. Salah satu cara baru pendanaan adalah melaluisistem donation based crowdfunding. Penelitian ini diarahkan untuk menemukan jawaban atasbeberapa topik utama. Pertama, untuk menemukan hakikat donation based crowdfunding.Kedua, bentuk badan usaha bagi kreator dan pengelola situs dalam sistem donation basedcrowdfunding. Ketiga, mengkaji bentuk pengawasan yang tepat dan lembaga yang berwenangmelakukan pengawasan.

Abstract

Penelitian ini bertujuan mengkaji aspek hukum penerbitan dan penyelesaian sengketa Obligasi Daerah. Rumusan masalah meliputi tiga hal yaitu: apa bentuk perlindungan hukum penerbitan Obligasi Daerah, apa bentuk perlindungan konsumen bagi investor pembeli Obligasi Daerah, dan apa bentuk penyelesaian Obligasi Daerah yang macet sesuai koridor hukum.Penelitian normatif ini memakai pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukan penerbitan Obligasi Daerahsaat ini diatur dalam tiga Peraturan Otoritas Jasa Keuangan. Investor pembeli Obligasi Daerah dilindungi Undang-Undang Perlindungan Konsumen, Peraturan Otoritas Jasa Keuangan, dan peraturan terkait lainnya. Obligasi Daerah yang macet dapat diselesaikan melalui jalur litigasi dan non-litigasi. Penyelesaian non-litigasi melalui Alternatif Penyelesaian Sengketa harus lebih diutamakan.

Abstract

Treaty on intellectual property, genetic resources and traditional knowledge 2024 approved an international agreement that is a breakthrough for the development of intellectual property. This paper aims to analyze the form of protection for indigenous peoples in the utilization of genetic resources used in patented research according to the international treaty WIPO and the urgency of the treaty for the development of patents in Indonesia. The approach used in this study is the statute approach and the analytical approach. The international treaty that began negotiations in 2001 is a strategic step for the development of intellectual property, especially indigenous peoples as holders of rights to genetic resources and traditional knowledge. Its use is often used in research to produce new inventions that are protected by patents. In such conditions, the applicant must disclose indigenous peoples as providers of traditional knowledge. The treaty is very important for the development of patents in Indonesia as well as strategic protection for traditional knowledge and genetic resources owned by Indonesia. Patented inventions containing genetic resources and traditional knowledge clearly disclose their material sources, thereby increasing the transparency of patent protection.

Abstract

This study examines the constitutional limits of delegating normative authority to non-structural religious bodies in Indonesia, focusing on the National Sharia Council of the Indonesian Ulema Council (DSN-MUI). As a private religious institution, DSN-MUI issues fatwas that are adopted by the Financial Services Authority, Bank Indonesia, and Sharia financial institutions as binding references in the regulation of Islamic finance. This delegation model raises fundamental constitutional questions regarding legality, accountability, and the distribution of power under the 1945 Constitution. Employing a normative legal method with statutory and conceptual approaches, the study finds that while DSN-MUI enjoys functional legitimacy in Sharia economic regulation, the absence of direct statutory basis and public oversight mechanisms poses risks to the principle of legality and checks and balances. The study recommends a co-regulation model where DSN-MUI fatwas must be formally adopted through state regulations and subject to transparent accountability mechanisms to ensure compliance with the rule of law and constitutional democracy.

Abstract

Kepastian hukum menjadi landasan utama dalam proses arbitrase, hal tersebut dilandaskan pada UU Nomor 30 Tahun 1999 Tentang Arbitrase dan Alternatif Penyelesaian Sengketa, yang mana di Indonesia telah mengadopsi separability principle. Dalam pembahasan ini akan menganalisis bagaiamana kewenangan pengadilan negeri dalam memeriksa dan memutuskan penyelesaian sengketa bisnis yang telah terikat pada akta kompromis, karena Bisnis tidak terlepas pada perbuatan hukum yang dibatasi pada kontrak atau perjanjian antara para pihak yang berkontrak. Rekonseptualisasi tersebut merupakan langkah dalam menghindari itikad tidak baik dalam menyelesaikan sengketa. Serta memastikan di dalam perjanjiannya menyatakan bahwa segala sengeketa (all dispute, any dispute). Metode penelitian yang digunakan pada penelitian ini adalan metode penelitian hukum normatif, Metode penelitian hukum tidak dapat dilepaskan dengan sifat keilmuan dari ilmu hukum yang preskriptif dan karakter ilmu hukum yang sui-generis.

Abstract

Penelitian ini bertujuan untuk menganalisis kontradiksi regulasi dalam penerapan kebijakan Tingkat Komponen Dalam Negeri (TKDN) sebagai prasyarat perizinan impor di Indonesia. Fokus utama penelitian ini adalah pertentangan antara kebijakan proteksi industri nasional dengan komitmen Indonesia terhadap hukum perdagangan internasional dan asas-asas dasar penanaman modal. Secara eksternal, kebijakan TKDN berpotensi melanggar prinsip National Treatment dalam Pasal III General Agreement on Tariffs and Trade (GATT) 1994 serta larangan performance requirement dalam Agreement on Trade- Related Investment Measures (TRIMs). Sementara secara internal, penerapan TKDN sebagai syarat perizinan impor menimbulkan persoalan terhadap asas kepastian hukum dan transparansi sebagaimana diatur dalam Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal. Metode penelitian yang digunakan adalah yuridis normatif, dengan dua pendekatan utama yaitu pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan adanya kontradiksi normatif yang signifikan antara kebijakan TKDN sebagai instrumen proteksi industri dengan kewajiban hukum perdagangan internasional serta prinsip penanaman modal yang menjamin kepastian hukum. Diperlukan harmonisasi regulasi agar kebijakan TKDN dapat sejalan dengan prinsip keterbukaan perdagangan dan iklim investasi yang berkeadilan. This study aims to analyze regulatory contradictions in the implementation of the Domestic Component Level (TKDN) policy as a prerequisite for import licensing in Indonesia. The primary focus of this research is the conflict between national industrial protection policies and Indonesia’s commitment to international trade law and basic investment principles. Externally, the TKDN policy has the potential to violate the principle of National Treatment in Article III of the General Agreement on Tariffs and Trade (GATT) 1994 and the prohibition on performance requirements in the Agreement on Trade-Related Investment Measures (TRIMs). Internally, the application of TKDN as a requirement for import licensing raises issues regarding the principles of legal certainty and transparency as stipulated in Law Number 25 of 2007 concerning Investment. The research method used is a normative juridical approach, with two main approaches: a statutory approach and a conceptual approach. The results indicate a significant normative contradiction between the TKDN policy as an instrument of industrial protection, and the obligations of international trade law and the investment principle that guarantees legal certainty. Regulatory harmonization is required to ensure that the TKDN policy aligns with the principles of trade openness and a just investment climate.

Abstract

Peredaran produk kosmetik di Indonesia memerlukan izin yang dikeluarkan oleh Badan Pengawasan Obat dan Makanan (BPOM) untuk menjamin keamanan, kualitas, dan manfaat bagi konsumen yang memakainya. Penelitian ini mengkaji inkonsistensi penerapan sanksi administratif pencabutan izin edar kosmetik oleh BPOM akibat promosi yang melanggar norma kesusilaan berdasarkan PerBPOM No. 18 Tahun 2024. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual dengan menganalisas aturan hukum yang berlaku terkait pengawasan dan izin edar produk kosmetik serta konsep-konsep hukum administratif dengan analisa menggunakan asas-asas hukum. Hasil penelitian menunjukkan bahwa PerBPOM No 18 Tahun 2024 tidak memberikan definisi eksplisit norma kesusilaan, sehingga menimbulkan ketidakpastian hukum. Terdapat empat inkonsistensi signifikan dalam penerapan sanksi: (1) BPOM menerapkan pencabutan izin edar langsung tanpa tahapan bertingkat; (2) tidak terpenuhinya prinsip due process; (3) ketidakseragaman penilaian tingkat keseriusan pelanggaran; dan (4) kesenjangan antara ketentuan normatif dengan praktik implementasi. Inkonsistensi tersebut melanggar asas kepastian hukum dan menimbulkan ketidakadilan bagi pelaku usaha. Diperlukan reformulasi regulasi dengan definisi operasional yang jelas dan perbaikan mekanisme penegakan hukum untuk menciptakan sistem pencabutan izin edar yang konsisten, proporsional, dan berkeadilan. The distribution of cosmetic products in Indonesia requires a permit issued by the Food and Drug Monitoring Agency (BPOM) to guarantee the safety, quality, and benefits for consumers who use them. This study examines the inconsistency in the application of administrative sanctions for the revocation of cosmetic distribution permits by BPOM due to promotions that violate moral norms based on BPOM Regulation No. 18 of 2024. The research method used is a normative juridical approach with a statutory approach and a conceptual approach by analyzing applicable legal regulations related to the supervision and distribution permits of cosmetic products as well as administrative legal concepts with analysis using legal principles. The results of the study indicate that BPOM Regulation No. 18 of 2024 does not provide an explicit definition of moral norms, thus creating legal uncertainty. There are four significant inconsistencies in the application of sanctions: (1) BPOM applies direct revocation of distribution permits without tiered stages; (2) failure to fulfill the principle of due process; (3) non-uniformity in assessing the level of seriousness of violations; and (4) the gap between normative provisions and implementation practices. This inconsistency violates the principle of legal certainty and creates injustice for business actors. Regulatory reformulation with clear operational definitions and improvements to law enforcement mechanisms are needed to create a consistent, proportional, and equitable distribution permit revocation system.

Abstract

Overcoming the climate crisis should not only be pursued from the aspect of technological invention but also from the financial aspect through issuing securities instruments that align with the green economy mission. Unfortunately, irresponsible parties such as corporations still use the green economy concept for personal gain through greenwashing and green financial crime. The presence of green bonds as green instruments shows a positive trend towards improving the quality of environmentally friendly technological innovations, building green infrastructure, and increasing income in line with increasing public participation in climate issues. However, its application in Indonesia is constrained by the complexity of issuance eligibility requirements which are detrimental to issuers and has not been accompanied by strict and transparent audit quality so that the public is disadvantaged when a default occurs so that legal protection for green bonds needs to be applied in several aspects. Therefore, the Indonesian public's interest in green bonds should be accompanied by an increase in the eligibility requirements and procedures for issuing green bonds.

Abstract

The existence of indigenous peoples as entities was born before the independence of the Republic of Indonesia. However, it is still disturbed by criminalisation by law enforcement officials for legal actions of indigenous peoples on their Adat lands whose Adat rights were transferred to other parties. Various regulations related to indigenous peoples already exist, and the Bill on Indigenous Peoples is not satisfying in preventing cases of criminalisation against indigenous peoples. It is because there is no adjustment in several crucial aspects, such as the nature of the recognition of indigenous people, protection of Adat lands and the application of criminal sanctions to achieve legal harmonisation in preventing the criminalisation of indigenous peoples. Synchronisation has not yet been realised between the substance of the legal rules related to indigenous peoples at the national level and the draft Bill on Indigenous Peoples with regional technical regulations at the sectoral level.This research uses statute and conceptual approaches to analyse legal norms, legal concepts, and legal principles related to indigenous people in Indonesia. As a result, it is believed that the protection of indigenous people's existence should be provided through a declarative system, not a constitutive system. It is also necessary to eliminate criminal sanctions against indigenous peoples in some related legal products according to the characteristics of indigenous peoples to stop the criminalisation of indigenous peoples and expand legal assistance for indigenous peoples in the context of implementing the law.

Abstract

The regulation of State Universities with Legal Entity Status (PTN-BH) through Government Regulations as university statutes raises a theoretical issue within the framework of legislative theory, particularly concerning the boundary between the function of Government Regulations as implementing legislation and their role as instruments governing fundamental institutional matters. Existing studies on PTN-BH have primarily focused on university autonomy and governance, while limited attention has been given to the legitimacy of Government Regulations serving as university statutes within the hierarchy of laws and regulations. This study aims to analyze the legal position of Government Regulations as PTN-BH statutes and their implications for academic autonomy, financial autonomy and organizational structure. Employing normative legal research with statutory, conceptual and comparative approaches, the study finds that Government Regulations on PTN-BH do not merely function as delegated legislation but also contain constitutive norms governing organizational structures, institutional authority and university governance. This condition raises concerns regarding the compatibility between the type of regulation and its substantive content within Indonesia’s legislative system. Therefore, regulatory reform is needed through a limited standardization model that establishes basic norms on academic autonomy, financial autonomy and organizational structure at the statutory level, while leaving technical arrangements to the respective PTN-BH statutes.
