Abstract

The potential of fisheries in the waters of Maluku is so large that it is often used by other affiliated companies both local and foreign fish for fishing illegally. Illegal fishing practices, and brought most of the catch to foreign countries without going through the formal examination procedure proved to be the impact of revenue losses for local or central government. The core issue in this study is whether the practice of illegal fishing in the waters of Maluku can categorize as economic crimes. Writing method used in this paper is a type of juridical normative deskritif analytical writing. The study concluded that the effect caused by the existence of this criminal act, then the state and the Government of the Republic of Indonesia suffered losses and has led to delays in national development. Therefore, it kriminologi, illegal fishing, the type of crime can be classified into economic crimes.

Abstract

Hunting for birds in the Aru Islands as one of the Wallacea regions is a crime that must be overcome to prevent the destruction of Wallacea bird species in Indonesia. This study aims to analyze how the criminal policy of hunting Wallacea birds in the Aru Islands. The research method used is normative jurudic, i.e. analyzing library materials or searching documents related to the problem under study. The approach used is the statutory approach and conceptual approach. Source of data used are secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials. Data collection methods are the study of literature and analyzed qualitatively. The results showed that hunting birds on the Aru Islands if left unchecked would threaten Wallacea bird species. Efforts to control the crime of bird hunting can be done by using means of punishment and non-punishment. Non-penal means that can be applied through the application of Sasi Cenderawasi and Sasi Walet as a form of local wisdom of the Aru people in maintaining the balance of nature in which they live. While the means of punishment through the application of legislation relating to hunting animals (birds). It is hoped that the Government can add forest police personnel or Nature Conservation Center officers, improve facilities / infrastructure as support activities for the protection and supervision of the nature reserve area. In addition, community participation must be increased through awareness to obey the Sasi rules as local wisdom.

Abstract

Introduction: Fulfillment of economic, social and cultural rights is a reflection of guaranteeing human rights. However, the economic, social and cultural rights of every citizen must be supported by their status as a citizen. Because a person's citizenship status has the effect of giving them a number of rights as a citizen. This problem occurs for Sangir Filipino residents whose citizenship status is unclear.Purposes of the Research: Is to examine and analyze the ideal policies taken by the government, especially the regional government of Bitung City, North Sulawesi Province, in addressing issues that provide economic, social and cultural rights for Sangir Filipino residents who have unclear citizenship status, so that this has an impact. on Providing their rights as part of providing human rights.Methods of the Research: In this research is normative juridical research using statutory regulations and a contextual approach. The sources of legal materials used in this research are primary legal materials, secondary legal materials and tertiary legal materials. This legal material was obtained through literature review and then explained qualitatively.Results of the Research: Show that the citizenship status of Sangir Filipino residents does not clearly have an impact on the provision of economic, social and cultural rights. There is a need for policies by the Regional Government and the Central Government, such as updating national laws that simplify the citizenship registration process, providing outreach to Sangir Filipino residents about the importance of a clear citizenship status, and the need for participation from all elements of society in order to overcome this problem.

Abstract

Introduction: The criminal policy of natural resource corruption in the fisheries sector can be carried out using two approaches, namely the penal approach and the non-penal approach.Purposes of the Research: .Methods of the Research: This research method is normative juridical while still involving the role of other social sciences in legal social studies. The approach used in this research is a statutory approach and a conceptual approach. Data collection was carried out by literature study and then analyzed qualitatively.Results of the Research: IUU Fishing practices such as transshipment, fraudulent acts of marking down ship sizes, using unreported foreign crew members or using falsified documents, bribing bribes in permit processing and various actions that lead to corrupt practices in the fisheries sector cause the country to suffer huge losses and have a bad impact on the country. people's welfare and exploitation of natural resources that can damage the ecosystem. For this reason, there is a need for criminal policy or efforts to overcome corruption by using two approaches, namely a repressive penal approach and a preventive non-penal approach.
