Abstract

Some literature suggests that Islamic banking, particularly in terms of financing agreement, always employs standard contracts. The contracts are agreement to the clauses that have already been established unilaterally by one party possessing a stronger position; the party is the bank. Consequently, customers basically cannot negotiate for the content of the contracts. It is worth mentioning that the unilateral decision is contrary to the Surah An-Nisa Verse 29 asserting that trade should be based on a consensus between two parties. The research findings reveal that the standard contracts can be justified in the view of Islam since it is a ‘mubah’ case that is not prohibited by the Qur’an in relation to ‘qath’y’, especially the ‘maqasid’ (purposes) of the standard contracts for the sake of ease and acceleration in the contracts. For instance, the contract No. 007/WKL/UMS/0117/9310/IV/2013 BRI Syariah is actually in accordance with sharia principles. This contract discusses the time for purchasing goods dealing with ‘murabahah’ (cost plus profit) financing, but the implementation of the contract is deemed inappropriate according to the sharia principles.

Abstract

Education is ideally a space for shaping character, promoting equality, critical awareness, and freedom of thought. However, in practice, there is a growing tendency toward militaristic approaches, particularly within institutions that adopt semi-military systems. This model emphasizes strict discipline, hierarchy, and absolute obedience, which ultimately suppresses learners' autonomy, creativity, and critical thinking. Such an approach contradicts the principles of critical pedagogy, which prioritize dialogue, participation, and liberation within the learning process. This study employs a qualitative approach with a critical case study design to explore and analyze the phenomenon of militaristic education within formal educational institutions in Indonesia. Data were collected through a literature review involving academic journals, policy reports, and institutional documentation. The data were analyzed descriptively and critically to examine the tension between authoritarian educational practices and the ideals of critical pedagogy. The findings highlight the urgent need to shift from repressive and hierarchical educational models to more humanistic, participatory, and emancipatory approaches. An education system that upholds human values is expected to foster democratic learning environments and empower students to become reflective individuals and active agents of social transformation.

Abstract

Based on the phenomenon of human life, many people experience complex life problems, from top to bottom. In essence, all humans have their own life problems depending on their level. Such as economics, politics, family, children, both internal and external. It all depends on the individual concerned. Such problems are as follows: increasing life needs, individualistic and selfish feelings, competition in life, unstable conditions. Of all these problems, the author focuses on research on household life problems, because the author sees that in household life there are many affairs, it turns out that these stories are not only in soap operas or films, but also occur in real life. Why can this happen? This study uses a qualitative literature research approach. The data used uses primary and secondary data, the analysis used uses content analysis. This is all due to several factors including; 1. Economic factors, 2). Sexuality, 3). Miscommunication, 4). Lack of mutual trust and openness in the family, 5). Children, 6). Shallow faith. With a psychological approach, families can better understand and communicate harmoniously and intelligently, and with an Islamic approach, the family atmosphere can better understand each other's duties according to Islamic teachings/Islamic law.

Abstract

Sosialisasi dan pola asuh  untuk meningkatkan kesadaran akan pentingnya bahwa orang tua berpartisipasi dalam PAUD desa Galih merupakan salah satu inisiatif utama dalam program Kuliah Kerja Nyata (KKN) yang bertujuan untuk meningkatkan kesadaran orang tuadi desa galih. Setiap orang tua yang mempunyai anak usia dini di desa Galih harus menyadari betapa pentingnya partisipasi dan kolaborasi orang tua dengan lembaga PAUD desa galih. Program kesamaan dan kesinambungan PAUD di sekolah dan di rumah akan membantu anak usia dini melewati tugas perkembangan mereka dengan lebih baik. Orang tua dapat mengikuti pendidikan anak yang disediakan oleh lembaga PAUD desa galih untuk mendapatkan pemahaman dan cara merawat anak usia dini. Dari  kegiatan sosialisasi yang telah dilakukan menunjukkan hasil yang cukup signifikan dimana orang tua didesa Galih yang mempunyai balita mulai faham bagaimana cara merawat anak usia dini dengan benar dan lebih memperhatikan perekmbangan mereka salah satunya dengan cara menyekolahkan anak mereka di PAUD Desa Galih.

Abstract

This study aims to analyze the legal factors that influence the decision of victims of domestic violence (DV) to choose divorce rather than criminal law. In addition, this study evaluates the implementation of Law Number 23 of 2004 concerning the Elimination of Domestic Violence (UU PKDRT) in providing protection to victims. The method used in this study is field research with a normative legal and normative theological approach. Data collection techniques are carried out through in-depth interviews, observation, and document analysis, while data analysis techniques use qualitative descriptive methods to understand how the law is implemented in cases of divorce due to DV. The results of the study indicate that victims of DV prefer divorce because of the long criminal law process, minimal legal support for victims, and social pressure that considers DV as a family matter. The main obstacles in accessing justice include bias from law enforcement officers, limited evidence of non-physical violence, and lack of protection facilities such as safe houses. The novelty of this study lies in the analysis of the role of judges in deciding cases of DV divorce and identifying the need for legal reform to be more in favor of victims. Recommendations for future research include increasing the capacity of legal officers, educating the public about victims' rights, and integrating legal and psychosocial services to support victims in obtaining justice.
