Abstract

The state as a protector of the guarantee of the rights of citizens is the essence of the purpose of the establishment of a state. The guarantee of halal products for food and beverages is one form of such protection. This has been manifested in the formation of laws and regulations related to halal product guarantees in addition to Law Number 8 of 1999 concerning Consumer Protection which was promulgated earlier. Halal Product Guarantee is implemented in Halal Certification which aims to provide legal certainty and legal protection for consumers, especially Muslim consumers. Halal-certified Product Guarantee is regulated in Law Number 33 of 2014 concerning Halal Product Guarantee (JPH). The existence of this law is important in the midst of free trade that is currently happening. This policy is expected to stop the supply of food that is not clearly halal. This protection is very relevant to the purpose of the implementation of Islamic law, which is to protect religion, protect the soul, protect the mind, protect offspring and protect property. This study will examine five things that are protected in Islamic law. So it will appear that the implementation of the Halal Product Guarantee is very much needed for the sustainability of human life.Keywords: Halal Guarantee, Legal Protection

Abstract

Policy implementation is an action carried out by individuals, officials or government or private groups directed at achieving the goals outlined in policy decisions. This research examines how policy implementation is said to be good from the perspective of A Model of the Policy Implementation according to Van Metter and Van Horn (1975). This research uses qualitative research methods. Data collection methods were carried out using observation, interviews, documentation studies, and technical triguation according to Yulianto Kadji (2014). And the data analysis techniques of Miles Huberman and Saldana (2014), namely data collection, data condensation, presenting data, drawing conclusions and verification. The results of the research show that the resources, characteristics and attitudes of implementers as well as aspects of the social and political environment have been implemented well and correctly, with standards, community resources and communication between organizations that need to be studied in more depth in their implementation in Sumber Suko Village, with supporting factors such as human and material resources. , implementing characteristics, as well as the social, economic and political environment. Meanwhile, the inhibiting factors are policy standards, community resources and time which still need to be developed and communication between organizations or agencies which is still very lacking so it needs to be developed again.

Abstract

Sumber Suko Village, Kejayan District, Pasuruan Regency has extensive village assets for the village head to manage in support of government. However, the management of these assets is not yet optimal, as can be seen from the large number of village physical assets that are in disrepair. The main problem in this management is asset planning and monitoring that has not been optimal. This research aims to measure the performance of village heads in managing village physical assets using qualitative methods with observation, interviews and documentation, as well as data analysis by Miles & Huberman. George R. Terry's performance management theory approach—including planning, organization, implementation, and monitoring—is used as an analytical framework. The research results show that the performance of village heads is inadequate, as evidenced by the large number of assets that are stalled, lost or damaged due to weak planning and supervision.

Abstract

Criminal law politics, also known as national criminal law reform policy, is an integral part of social policy in general. This is because the existence of criminal law is heavily influenced by social changes in society. The state must monitor social changes to ensure that they remain within the boundaries of Pancasila ideology. Pancasila is a forum for living together for Indonesia's diverse nation so that it remains closely bound as a united nation, Bhinneka Tunggal Ika. Pancasila appears in the Preamble to the 1945 Constitution, which declares Indonesia's independence. As a result, the current Criminal Code in Indonesia must be updated to reflect the reform era. Several articles have also undergone changes, with the government making additional provisions regarding specific articles. As a result, comprehensive reform is required to ensure that criminal law can achieve its goals, which are to protect society and promote social welfare. Using normative methods, this study investigates Pancasila as a paradigm for determining the direction of criminal law policies. It also employs a policy-oriented and a value-oriented strategy. Because Pancasila is a national and state ideology.

Abstract

With the existence of a new legal regime known as cyber law or telematics law, the transaction system makes it easier for users. Cyber law or cyber law is used by utilizing information and communication technology which is a manifestation of the convergence of telecommunications law, media law and information law. The legal problems that are often faced are related to information, communication and/or transactions, especially in terms of evidence related to legal actions carried out by electronic systems. This writing aims to provide legal protection for consumers with online transactions. The research method used is normative juridical research, which involves analysis of theories, concepts, legal principles and statutory regulations relevant to this research topic. The legal problems that are often faced are related to the delivery of information, communi cation and/or transactions electronically, especially in terms of evidence and matters related to legal actions carried out through electronic systems. The results of this research can be concluded: First, in the form of legal protection for consumers who make online transactions as regulated in Law Number 11 of 2008 concerning Information and Electronic Transactions as well as provisions for legal protection for consumer users with online transactions or e-commerce. Second, in the form of responsibility for parties involved in online transactions or e-commerce as stated in Law Number Article 12 paragraph 3 concerning Information and Electronic Transactions, it is explained that every person who violates the obligation to carry out electronic transactions must be responsible for all losses and the resulting legal consequences.

Abstract

Penelitian ini membahas implementasi Peraturan Bupati Nomor 102 Tahun 2023 tentang Percepatan Penghapusan Kemiskinan Ekstrem di Kabupaten Pasuruan. Hasil penelitian menunjukkan bahwa kebijakan tersebut telah diimplementasikan dengan cukup baik oleh Bappelitbangda bersama perangkat daerah lainnya melalui tiga strategi utama: pengurangan beban pengeluaran, peningkatan pendapatan masyarakat, dan pengurangan wilayah kantong kemiskinan. Keberhasilan implementasi didukung oleh koordinasi lintas sektor, komunikasi langsung, serta penyampaian pedoman teknis melalui sosialisasi dan rapat koordinasi. Faktor pendukung mencakup komitmen pimpinan daerah, kompetensi sumber daya manusia, dan prioritas anggaran. Namun, kendala seperti keterbatasan anggaran dan kurangnya pemahaman terhadap substansi kebijakan di beberapa perangkat daerah masih menjadi tantangan. Meskipun sarana dan prasarana belum sepenuhnya memadai, perencanaan dan penganggaran yang matang serta evaluasi rutin menjadi faktor penting dalam menunjang efektivitas kebijakan ini.

Abstract

The existence of criminal law is a necessity for a nation to regulate the lives of its citizens. Indonesia is a constitutional state that has experienced a long legal history. Prior to the independence, the Indonesian people were familiar with the customary laws and religious laws of each resident. Customary Law and Islamic Law were jointly obeyed by the people at that time. As a living law, both are the solution for society in facing legal disputes. It is not surprising, then, that besides Positive Law, which is known to originate from Western/Colonial Law, Islamic Law and Customary Law have a higher bargaining position. So that in the establishment of National Law, Islamic Law and Customary Law become material sources for the establishment of a positive law. The formation of national law, therefore, including criminal law, really needs the contribution of Islamic law, in addition to customary and western law. The history of the development of criminal law in Indonesia is colored by Islamic values, because the socialization process of Islamic law is integrated with the development of customs in resolving criminal cases.

Abstract

This study aims to analyze the effectiveness of waste collection services provided by the Lekok Asri Village-Owned Enterprise (BUMDesma) in the coastal area of Wates Village, Lekok District, Pasuruan Regency. The research method used was descriptive qualitative, with data collected through in-depth interviews, direct observation, and document study. Data were analyzed using the interactive model of Miles, Huberman, and Saldana. The results indicate that waste collection services are generally well-organized and cover the entire area. However, their effectiveness is hampered by inaccurate collection times, limited manpower, road access constraints, and minimal response to public complaints. The study's conclusions emphasize that improving the effectiveness of waste collection services requires additional manpower, strengthening the monitoring system, improving coordination between relevant parties, and optimizing infrastructure to ensure more consistent and sustainable service delivery.   Keywords: Service Effectiveness, Waste Collection, Bumdesma, Waste Management

Abstract

Perselisihan hubungan industrial merupakan fenomena yang tak terhindarkan dalam dinamika ketenagakerjaan, terutama di kawasan industri seperti Kabupaten Pasuruan. Mediasi sebagai salah satu alternatif penyelesaian konflik yang diatur dalam Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial, menjadi instrumen penting dalam menyelesaikan sengketa antara pekerja dan pengusaha. Penelitian ini bertujuan untuk menganalisis implementasi kebijakan mediasi dalam penyelesaian perselisihan hubungan industrial di Dinas Ketenagakerjaan Kabupaten Pasuruan dengan menggunakan teori implementasi kebijakan George C. Edward III yang mencakup empat variabel: komunikasi, sumber daya, disposisi pelaksana, dan struktur birokrasi. Metode penelitian yang digunakan adalah pendekatan deskriptif kualitatif dengan teknik pengumpulan data melalui wawancara mendalam, observasi, dan dokumentasi. Hasil penelitian menunjukkan bahwa implementasi kebijakan mediasi masih menghadapi kendala berupa rendahnya pemahaman para pihak terhadap prosedur mediasi, keterbatasan jumlah dan kapasitas mediator, serta belum optimalnya koordinasi birokrasi. Namun demikian, mediasi tetap menjadi metode utama dalam penyelesaian kasus-kasus perselisihan dan menunjukkan potensi besar apabila didukung oleh pelaksanaan kebijakan yang lebih efektif dan berkelanjutan.

Abstract

Legal protection on religion is certainty for a state with Pancasila principle. The first principle the Divinity of the Only God has been spirit of the following points, as living guidance for Indonesian country. The believing of the Divinity of the Only God shows that the Indonesian Republic is religious based country by protecting freedom to have religion for its people. This regulation has implication in governmental circle, that the country makes Religion Ministry as one of ministries that its existence has the same position to other state institutions. The implementation of legal protection toward religion needs legitimating in the field of civil law, showed in issuing President Decree No. 1 of 1965 on the Preventing of Misuse and/or Religion Staining. The existence of this Decree in Old Order has been legitimated newly as a Law  by issuing the Law No. 5 of 1969, thus the President Decree has been added to the Criminal Code, Act 156a.
