Abstract

Tujuan penelitian ini adalah untuk menganalisis bentuk perlindungan hukum terhadap masyarakat terkait kegiatan pertambangan batubara yang merugikan masyarakat di sekitar lokasi pertambangan, serta untuk menemukan penyelesaian sengketa tuntutan ganti rugi masyarakat di sekitar lokasi pertambangan. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan menggunakan data sekunder berupa bahan hukum primer, sekunder, dan tersier. Analisis bahan hukum dilakukan secara kualitatif. Hasil penelitian ditemukan bentuk-bentuk perlindungan hukum terhadap masyarakat atas kegiatan pertambangan batubara serta tanggung jawab perusahaan pertambangan batubara yang merugikan masyarakat sekitar lokasi pertambangan dikaitkan dengan putusan Pengadilan Negeri Sarolangun dalam penyelesaian sengketa terkait kegiatan pertambangan.

Abstract

Halal certificati for food and beverage products is highly important, especially for Muslim consumers, in order to provide convenience options. Law No.33 of 2014 Concerning Halal Product Guarantees (UUJPH) has clearly regulated that every imported, distributed, and available products in the Indonesian market are required to be halal-certified. This study specifically aims to: 1) Analyze consumer protection toward packaged food products of Micro, Small and Medium Enterprises (MSMEs) that are not halal-certified in Jambi City, 2) Analyze the limitations toward the halal- certified packaged food products of MSME players in Jambi City, 3) Analyze government supervision toward the packaged food products of MSME players in Jambi City. This study is using a Juridical Empirical method, and the specifications are descriptive. The result shows: Consumer protection for packaged food products of MSMEs that are not halal certified in Jambi City has not been optimally provided. This is due to many enterprise hasn't register the product yet to get halal certification on Halal Office of Jambi Province. 2. Limitations to the MSME players of packaged food products that are not halal-certified in Jambi City includes: 1) lack of understanding among business players regarding halal certification, 2) incomplete documents, 3) business products are not fully developed/unstable, 4) expensive costs, 5) yet to renew the halal certification and 6) do not have time to register halal certification. 3. Government supervision on the packaged food products that are not halal-certified in Jambi City is in fact the duty of BPJPH. In fact, the supervision is not in accordance with the current regulation, therefore, it is necessary to partner with other institutions, such as Indonesian Ulema Council (MUI), Indonesian Food and Drug Authority (BPOM), Health Department, Animal Husbandry Service and the whole population.

Abstract

Itsbat Nikah (Legalization of Marriage) is a determination of the marriage of husband and wife which has been carried out in accordance with the provisions of the Islamic religion with the fulfillment of the conditions and pillars of marriage, but the marriage has not been or has not been registered with the authorized official, namely the Religious Affairs Office official, in this case the Marriage Registrar Officer. The marriage regulations determined by the Religious Courts have a very big role and contribution in efforts to provide a sense of justice and legal certainty for married couples who do not yet have a marriage book as authentic proof or married couples who carry out unregistered marriages. By stipulating the marriage law, husband and wife will receive their rights as full citizens, including recognition of their children. Community service activities in Sekernan Subdistrict, Muaro Jambi Regency with the theme of increasing understanding of the importance of the Itsbat Nikah in unregistered marriages to increase public insight into the procedures for applying for the Itsbat Nikah related to unregistered marriages which are still found in society for various reasons so that husband and wife are not have a marriage certificate or marriage book. This Community Service Activity was carried out on August 15 2023 at the Office of the Head of Bukit Baling Village, Sekernan District, Muaro Jambi Regency and was attended by the community and local village officials. This service is carried out using lecture, discussion and question and answer sessions.

Abstract

Halal Certification is a form of protection provided by the Halal Product Guarantee Organizing Agency (BPJPH) and the Indonesian Ulama Council (MUI) to provide security and comfort in consuming food for Muslim consumers regarding labels on food products. Halal certification for food products is very necessary, especially for Muslim consumers, in order to create consumer comfort in choosing the products they want to consume. The community service program in Bukit Baling Village, Sekernan District, Muaro Jambi Regency with the theme Socialization of Halal Certification Registration for food products for Micro, Small and Medium Enterprises (MSMEs) is to motivate the MSME community to register for halal certification for their food products, in order to provide comfort for Muslim consumers who consume these products. This Community Service Activity was carried out on August 15 2023, attended by The community and officials of Bukit Baling Village, Sekernan District Muaro Jambi Regency. This service is carried out using lecture, discussion and question and answer sessions.

Abstract

Alms is an order as narrated by Allah swt. For Muslims, certain assets are issued and given to those who are entitled. In regulating the implementation of zakat in society, the Indonesian government establishes special institutions, namely BAZNAS and LAZ as outlined in Law Number 23 of 2011 concerning Zakat Management. Based on these regulations, the task of BAZNAS is to assist in the management of zakat by establishing UPZ, one of which is at the sub-district, village, or other names. The duties of UPZ are regulated in PERBAZNAS Number 2 of 2016 concerning the Establishment and Work Procedure of UPZ, which explains how the mechanism for the formation of UPZ and the working mechanism of UPZ in each sector. The results of this study can be concluded that the existence of UPZ from every mosque and mushalla in several sub-districts in Jambi City is still not visible. Like several mosque and mushalla administrators, it was stated that UPZ had not yet been formed and also did not know specifically about UPZ itself. The problems faced by BAZNAS Jambi City are the lack of personnel from Jambi City BAZNAS employees in an effort to reach mosques and prayer rooms in Jambi City, lack of operational costs in socializing, the higher volume of work faced by BAZNAS. So that the Jambi City BAZNAS is expected to focus more on the work pattern mandated by PERBAZNAS Number 2 of 2016, so that there are no more mosques or mushalla whose UPZ has not been formed.

Abstract

The aims of this study are to find out and analyze the effectiveness of Mediation in minimizing divorce rates in the Jambi City Religious Court; and to find out and analyze the factors of the failure of Mediation in minimizing the divorce rate in the Jambi City Religious Court. The method used in this research is empirical juridical. The results of the research are based on what has been carried out as follows: that the effectiveness of mediation in minimizing the number of divorce in the Jambi Religious Court is still not effective, seeing from the results of the research conducted the number of divorce cases from 2020 to 2022 has increased, empowerment of mediation institutions in resolving civil cases, especially regarding the matter of divorce at the Jambi City Religious Court as evidenced by the small number of successful cases in Mediation. Based on the factors of the unsuccessful Mediation in the Jambi City Religious Court, the absence of the parties themselves, as well as the parties who are selfish and do not apply principles to resolve their problems peacefully, the absence of the parties will make it difficult for the Mediator to resolve the problem by reconciling the parties and the Mediator does not understand the problems faced by the parties so that the Mediation process is still not effective in reconciling the litigants, especially divorce cases.

Abstract

The aims of this research are to find out and analyze whether (1) What are the elements of informed consent that are implemented at the Sungai Jambat Village Health Center. (2) What are the exceptions to the absence of informed consent in a therapeutic agreement at the Sungai Jambat Village Health Center. The methodology had been used was an empirical juridical legal research regarding the application or implementation of legal provisions directly to every legal event that occurs in society. The results of this research indicate that the implementation of informed consent at the Sungai Jambat Village Health Center has been legally enforced as law because it implements and fulfills the four elements of the agreement in Article 1320 of the Civil Code, agreed after receiving the information, competent because they are 21 years old. and guardianship if under age, a certain thing related with the medical action/treatment, and the object of the agreement is fulfilled, and the last requirement related with the legally reason has been eligible because the object of the agreement were the medical treatment that accordance and do not deviate from the law. Regarding the exception to the absence of informed consent, the Sungai Jambat Village Health Center stipulates the rule that in an emergency situation, as an effort to save the patient and requires immediate action, informed consent is not required and can be requested after medical action has been given.

Abstract

Food is a basic human need that cannot be neglected in everyday life. Without eating and drinking sufficient quantity and quality, humans will not be productive in carrying out their activities. Food issues also concern security, safety, and health, both physical and spiritual. Food safety is one of the important factors that must be considered in daily consumption. Thus, food must be available in sufficient quantities, at affordable prices, and must also meet other requirements, namely healthy, safe, and halal. So before the food is distributed it must meet the requirements of being truly safe for consumption. This means that food must not contain dangerous ingredients such as pesticide contamination, heavy metals, pathogen microbes, or be contaminated by ingredients that could disturb people's trust or confidence, for example being contaminated with dangerous ingredients. Food security in Indonesia is still far from safe, which can be seen from the food poisoning incidents that have occurred recently. In such conditions, consumers generally do not care or do not have awareness about the safety of the food they consume, so they do not demand much from producers to produce safe food products. This also causes food producers to increasingly ignore consumer safety in order to gain as much profit as possible. For example, there are still many food manufacturers who like to use textile dyes for various food and beverage products because of economic considerations.

Abstract

Indonesia is currently experiencing rapid development in the creative economy sector. Various industries such as design, fashion, art, music, film, and others have become the backbone of creative economic growth in this country. One of the most valuable assets in the creative economy is a brand. Brand protection is very important to ensure the continued growth of Indonesia's creative economy. This research aims to determine and analyze the importance of trademark registration in the development of small and medium enterprises in the creative economy of Indonesia and trademark protection in the development of small and medium enterprises in the creative economy. The research results show the importance of registering a trademark, including: To obtain legal protection, exclusive rights to use the trademark, as a publicity tool (promotion), and also as a business opportunity. Brand protection in the development of micro, small, and medium enterprises in the creative economy sector in Indonesia can be done in two ways, namely preventive protection and repressive protection.

Abstract

The implementation of trademark digitalization in Tirta Kencana Village, Rimbo Bujang District, Tebo Regency, aims to enhance the competitiveness of SMEs by integrating technology and Islamic economic values such as transparency, justice, and sustainability. This program includes digital training, the development of management and marketing platforms, and strengthening internet access. As a result, there was a 40% increase in revenue, a growth in the number of customers, and an improved understanding of digitalization and Islamic economics among business owners. Support from the community and digital infrastructure is expected to drive inclusive and sustainable economic growth in the village, while strengthening the competitiveness of SMEs in the local and regional digital markets.
