Abstract

This activity is “Socialization and Increasing Comprehension of Consumer Protection Law during Covid Pandemic in Dandangan Village, Kediri City”. This program is carried out by universities, especially the Law Faculty of Kadiri Islamic University, to carry out the Tri Dharma of Higher Education, community service to build mutually beneficial relationships. This community service program is run by Higher Education in collaboration with Dandangan Village, Kota, Kediri City. The participants are 17 peoples from Dandangan village, consisting of religious leaders (Toga), community leaders (Tomas), village activists, youth organizations, PKK ladies, and recitation groups. The results of this activity resulted in the following recommendations and evaluations: from the discussion, presentation and questionnaire, we know that the majoritypeoples from Dandangandoesn’t know and understand the meaning of consumer protecting from law perspective.

Abstract

This research aims to investigate the influence of press law regulations on political reporting in online media and to conduct a comparative study of press law regulations in countries that have experienced the development of online media in the political context. The research employs content analysis of political news in online media during the 2024 regional election campaign period to understand the extent of online media's influence in shaping public opinion and election outcomes. This research is expected to provide a clear vision of the role of online media in the political process and contribute new understanding to the legal regulations of the press needed to maintain the continuity of democracy.

Abstract

Makalah berjudul  Quo Vadis Kebijakan Penyusunan Kabinet  Koalisi  Dimasa Yang Akan Datang Tinjauan Filosofis, Historis, Teoritis Dan Yuridis ini bertujuan untuk menjawab dua permasalahan yaitu: 1. Bagaimana bentuk kabinet yang sudah dilakasanakan pemerintahan Jokowi saat ini? 2. Bagaiamana formulasi kedepan  kabinet yang seharusnya  dibentuk oleh Pemerintah Presiden Jokowi? Metode penelitian  menggunakan metode yuridis normatif dengan pendekatan koseptual, historis dan perundang-undangan. Hasilnya adalah bahwa bentuk kabinet yang sudah dilakasanakan pemerintahan Jokowi saat ini, masih tetap mengakomodir kepentingan partai politik pengusung pada saat Pemilu Presiden tahun 2009, serta masih belum mandiri dan profesional dalam menyusun para mentri, sehingga masih ditemukan  kelemahan dan adanya menteri yang tidak berperan dan menjalankan tugas secara profesioanal. Kedua bahwa penyusunan  kabinet yang seharusnya  dibentuk oleh Pemerintahan Presiden Jokowi jilid kedua adalah mengabaikan tekanan partai pengusung yang tergabung dalam partai koalisi, sehingga formulasi kabinet yang terbentuk kedepan adalah profesional dan hanya presiden saja yang berhak menyusun.

Abstract

Expiration in law criminal is a restrictive instrument that states the authority of the state to demand the perpetrator's action after a certain term, which is justified on the basis of certainty and the efficiency of law enforcement. However, its implementation of premeditated murder causes problematic Issues in perspective, justice, and protection of the victim's rights. Under the system law, Indonesian criminal law remains in effect, with a maximum penalty of 20 years, as provided in Constitution Number 1 of 2023. In contrast, German criminal law has been deleted and is no longer applicable to murder premeditated with a confirmed characteristic crime, as it cannot fall by time (imprescriptible). Research: This use method is juridical-normative, employing a conceptual, regulatory-legislative, and comparative approach to analyze differences. The results of the study show that arrangements in Indonesia are more certainty-oriented than formal law. At the same time, Germany emphasizes substantive justice and the protection of fundamental rights, including the right to life. Implementation fell short of its crime-prevention potential, hindering access to justice and openness, leading to impunity. Moreover, in the context of development, modern forensic technology can reveal crimes over time. Therefore, it is necessary to reorient the policy and law of Indonesian criminal law towards the deletion of the expired murder premeditated.

Abstract

The development of social media provides benefits for children in obtaining information, communicating, and developing themselves, but it also poses various risks, such as cyberbullying, digital exploitation, exposure to negative content, misuse of personal data, and disruption of psychological and social development. This study aims to analyze the urgency of restricting the use of social media for sixteen-year-olds from the perspective of legal protection and examine the form and implementation of regulations that can be applied. The research method used is normative legal research with a statutory and conceptual approach, using primary, secondary, and tertiary legal materials that are analyzed qualitatively. The results of the study show that restrictions on the use of social media for 16-year-olds have a strong urgency from juridical, psychological, and sociological aspects. Juridically, the protection is based on Article 28B paragraph (2) of the 1945 Constitution of the Republic of Indonesia, the Child Protection Law, the Electronic Information and Transaction Law, the Personal Data Protection Law, and the Convention on the Rights of the Child, which prioritizes the principle of the best interests of children. The findings of the study show that legal protection can be realized through minimum age restrictions, age verification, supervision of use, protection of personal data, improvement of digital literacy, and strengthening the responsibility of digital platforms. The implementation of these policies requires synergy between the government, families, communities, and digital service providers to ensure child protection in the digital era.

Abstract

This study aims to analyze the legal implications of the use of generative artificial intelligence (generative AI) in journalistic practice against three forms of press violations, namely defamation, the spread of misinformation/disinformation, and privacy violations, as well as to assess the extent of the readiness of the applicable legal framework in overcoming these problems. The development of generative AI in journalism presents new challenges in criminal law, especially regarding accountability for news content generated automatically without direct human intervention. This study uses a normative-doctrinal approach combined with a comparative analysis of the Indonesian criminal law framework and the latest international regulatory developments. The results of the study show that conventional criminal accountability principles, especially the elements of mens rea and actus reus, are not fully compatible with the characteristics of AI which is autonomous, thus causing legal gaps and regulatory uncertainty. To overcome these problems, this study offers three strategic solutions, namely: (1) modification of the corporate accountability model by expanding the definition of criminal offenders, (2) the application of limited strict liability (limited strict responsibility) for digital platforms, and (3) the establishment of a risk-based algorithmic supervision mechanism involving various stakeholders. This research makes a theoretical contribution to the development of criminal law in the digital era while offering practical recommendations for policymakers in formulating an AI accountability system that is adaptive, balanced, and supports modern journalism innovation.

Abstract

Studi ini mengeksplorasi penerapan diversi dalam menangani kasus pidana anak yang menjadi korban eksploitasi dalam tindak pidana narkotika, dengan membandingkan sistem hukum di Indonesia dan Thailand. Anak-anak yang terlibat dalam pelanggaran narkotika seringkali adalah korban dari eksploitasi oleh jaringan kejahatan terorganisir, sehingga dibutuhkan pendekatan keadilan restoratif melalui mekanisme diversi. Penelitian ini menggunakan metode normatif-komparatif dengan pendekatan hukum dan perbandingan. Data sekunder diperoleh melalui penelitian pustaka terhadap undang-undang, keputusan pengadilan, dan literatur hukum dari kedua negara. Temuan penelitian menunjukkan bahwa Indonesia melaksanakan diversi berdasarkan Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, yang menetapkan syarat ancaman hukuman di bawah 7 tahun dan bukan residivis. Namun, pelaksanaannya masih menemukan kendala dalam pengenalan status anak sebagai korban eksploitasi, termasuk kurangnya keterlibatan lembaga seperti Badan Narkotika Nasional (BNN), Lembaga Perlindungan Anak (LPA), dan psikolog dalam proses asesmen. Sementara itu, Thailand menerapkan pendekatan yang lebih adaptif melalui Juvenile and Family Court and Procedure Act B.E. 2553 (2010), dengan penekanan pada rehabilitasi dan perlindungan bagi anak korban, termasuk mekanisme penyaringan untuk mengidentifikasi anak yang merupakan korban perdagangan manusia atau eksploitasi. Pelaksanaan diversi di Indonesia terhambat oleh kurangnya koordinasi antara penegak hukum dengan lembaga-lembaga teknis seperti BNN, Komisi Perlindungan Anak Indonesia (KPAI), psikolog forensik, dan pekerja sosial, terbatasnya fasilitas rehabilitasi, dan stigmatisasi sosial. Di sisi lain, Thailand menunjukkan keberhasilan dengan menggunakan sistem manajemen kasus terpadu yang melibatkan berbagai pihak, termasuk pekerja sosial, psikolog, dan LSM. Penelitian ini merekomendasikan perlunya revisi terhadap kriteria diversi dalam Undang-Undang Sistem Peradilan Pidana Anak di Indonesia untuk mengakomodasi status anak sebagai korban eksploitasi, peningkatan kapasitas penegak hukum dalam mengidentifikasi korban melalui kerjasama dengan BNN, KPAI, Lembaga Konsultasi dan Bantuan Hukum (LKBH), psikolog, dan pekerja sosial, serta pembentukan sistem rujukan yang terpadu antara sistem peradilan pidana dan layanan perlindungan anak.

Abstract

The issue of jurisdiction in dispute resolution within the Commercial Court arises when the contract designates an arbitration clause as the preferred mechanism for resolving disputes. In the contractual agreement between PT. Swadaya Graha and PT. Rayon Utama Makmur (RUM), the chosen forum for dispute resolution is stipulated to be the National Arbitration Board (BANI). However, concurrently, there is a proposal for dispute resolution within the Commercial Court framework concerning defaulted debt and receivable disputes in PKPU case number 45/Pdt.Sus-PKPU/2020/PN Niaga Smg. This has engendered a legal debate centring on the application of the "lex specialist derogat legi general" principle among the Arbitration Law, the Bankruptcy Law, and PKPU, with regard to the absolute jurisdiction of institutions authorized to examine, decide, and adjudicate incidents of defaulted debt and receivable disputes within the legal relationship between the PKPU Petitioner and the Respondent. The PKPU process is structured within a contract that includes an arbitration clause as the designated dispute resolution mechanism. Given the complications and hurdles posed by these issues, there is a pressing need for legal certainty in the future. Furthermore, there has been a conflict of norms between the Arbitration Law the Bankruptcy Law and PKPU, as evidenced in PKPU case number 45/Pdt.Sus-PKPU/2020/PN Niaga Smg. Hence, a reformulation of the Bankruptcy Law and PKPU regulations is essential to harmonize them with evolving norms and address emerging issues. A vital aspect of this reformulation involves the potential removal or replacement of Article 303 of the Bankruptcy Law and PKPU.

Abstract

AbstractionChild sexual exploitation and abuse represent grave violations of human rights with long-lasting consequences for victims. In Kediri City, these issues remain prevalent, raising significant concerns within the community. This paper seeks to analyze the legal enforcement measures addressing sexual exploitation and abuse in Kediri City. It explores several key aspects, including data and statistics concerning cases of sexual exploitation and abuse within the city, the law enforcement efforts undertaken by agencies such as the Kediri City Police, the Kediri City District Attorney's Office, and the Kediri City District Court. The paper also examines the challenges encountered in law enforcement, such as insufficient evidence, societal stigma against victims, and interference from particular parties. Furthermore, it discusses prevention initiatives undertaken by various stakeholders, including local government, civil society organizations, and the community. This study aims to enhance public understanding of sexual exploitation and abuse while advocating for more effective and victim-centred law enforcement practices.

Abstract

This study aims to analyze the criminal liability of the press in the use of Artificial Intelligence (AI) for news writing based on the Press Law and the Second Amendment ITE Law. The use of AI in the world of journalism poses legal challenges related to liability for the news produced, especially if the news violates the law such as spreading hoaxes or misleading information. The method used in this study is normative legal research, which examines applicable legal regulations, as well as journalistic ethical principles in relation to AI. The study identifies who is criminally responsible if news generated by AI breaks the law, as well as explores potential ethical violations that may arise due to inaccuracies in information published by AI. The results of the study show that although the Press Law provides for press freedom, criminal responsibility remains on media that use AI in news production. In addition, the Second Amendment of the ITE Law emphasizes criminal sanctions for perpetrators who disseminate harmful electronic information, including fake news produced with AI. This study also found that the implementation of the Journalistic Code of Ethics (KEJ) is a big challenge, considering that AI cannot always meet journalistic ethics standards that prioritize truth, balance, and objectivity. This study suggests that there should be clearer regulations regarding the use of AI in journalism to maintain public trust and avoid violations of the law that have the potential to harm society.
