Abstract

Franchise agreements play an important role in providing legal protection for franchise business actors in Indonesia, both for franchisors and franchisees. This study aims to analyze the effectiveness of franchise agreements in protecting the rights and obligations of the parties and identify potential legal problems that arise in their implementation. The approach used is normative juridical, with an analysis of related laws and regulations, such as Government Regulation No. 42 of 2007 concerning Franchises, as well as franchise agreement documents from various business sectors. The results of the study show that franchise agreements that are drafted by fulfilling the legal principles of the agreement, such as legal certainty, fairness, and balance, are able to provide adequate legal protection for both parties. However, there are still challenges in implementation, including inconsistencies in the content of the agreement with regulations, lack of understanding of legal aspects by business actors, and weak supervision of the implementation of the agreement. This research recommends strengthening regulations and education for franchise business actors to create a fairer and more sustainable business ecosystem.

Abstract

In Land Law in Indonesia, valid evidence for someone to prove himself as the holder of land rights is the existence of a land certificate in which the name of the right holder is written. With the land certificate, the holder of land rights already has juridical power over the land. Through land certificates that provide juridical control, land rights holders are also entitled to physical control of the land. The position of the landholder whose name and land has been registered is strong which is guaranteed certainty and legal protection. In the event that land becomes the object of sale and purchase, there are conditions and characteristics of buying and selling land that must be met in order for the legal act to be valid. To prove that there has been a sale and purchase of land, it is necessary to prove the existence of a Sale and Purchase Deed made by the Land Deed Making Officer. With the deed, the sale and purchase of land can be registered with the Land Office to provide legal certainty and protect the buyer as the holder of new land rights. The problem is when the process of buying and selling land stops at the process of paying prices only. Meanwhile, the buyer has mastered the land based on the receipt of payment of the sale and purchase price. For this reason, it is necessary to examine the good faith of buyers in buying and selling land in cases based on Supreme Court Decision Number 801 K / PDT / 2022. This research used normative legal research, which was carried out through literature studies. Research methods in analyzing and processing data are carried out qualitatively and are descriptive analytical with deductive logic conclusions.

Abstract

This writing was motivated by the Surabaya District Court Decision Number 1270/Pdt.G/2021/PN.Sby whose case was regarding the Deed of Sale and Purchase which the object of sale and purchase had been made as an object of a testamentary grant and had been included in the Testament Grant Deed Number 119. The implementation of the sale and purchase is carried out using a Power of Attorney to Sell where the Seller is an elderly woman who is 78 years old and suffers from memory impairment that also known as dementia, so the Seller does not remember that she had made a transaction buying and selling of land that has been given as a testamentary grant. The seller signs the Power of Attorney to Sell without the consent of hes heirs and the sale and purchase was carried out without the knowledge of the seller's family. This writing was written using normative research methods by collecting legal materials regarding testamentary grants and linking Decision Number 1270/Pdt.G/2021/PN.Sby with applicable laws and regulations, and with literature studies in the form of articles that relating to testamentary grants. The conclusion that can be drawn from this research is that the panel of judges has been unwise in carrying out legal considerations in Decision Number 1270/Pdt.G/2021/PN.Sby and the Notary who made the Power of Attorney to Sell must apply the precautionary principle so there will be no dispute over the object of sale and purchase in the future

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan iktikad baik dalam perjanjian kredit, khususnya dalam konteks kredit macet, serta implikasinya terhadap perlindungan hukum bagi kreditur. Iktikad baik merupakan prinsip dasar dalam hukum kontrak yang menuntut setiap pihak untuk bertindak dengan itikad yang jujur dan adil, baik dalam pelaksanaan kewajiban maupun dalam menyelesaikan perselisihan. Namun, dalam praktiknya, sering kali terjadi penyalahgunaan prinsip ini, terutama dalam kasus kredit macet, yang dapat merugikan pihak kreditur. Penelitian ini mengangkat dua rumusan masalah utama: pertama, bagaimana pengertian dan penerapan iktikad baik dalam perjanjian kredit yang melibatkan kredit macet, dan kedua, bagaimana prinsip iktikad baik mempengaruhi perlindungan hukum terhadap kreditur dalam kasus tersebut. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan peraturan perundang-undangan. Data yang dikumpulkan berupa bahan hukum primer, sekunder, dan tersier yang dikaji secara mendalam untuk memperoleh pemahaman yang komprehensif mengenai implementasi iktikad baik dalam kasus kredit macet. Kesimpulan dari penelitian ini adalah bahwa penerapan iktikad baik sangat penting untuk melindungi hak-hak kreditur, terutama dalam menghindari terjadinya penundaan yang merugikan dalam eksekusi hak tanggungan, dan bahwa tindakan hukum yang tidak berdasarkan iktikad baik dapat menambah kompleksitas penyelesaian sengketa dalam kredit macet.

Abstract

Business people show great interest in the development of the property industry. With promising market prospects, developers have significant legal responsibilities to potential buyers. To ensure legal certainty and avoid future conflicts, consumers must understand and comply with the legal rules contained in the agreement. The Sales and Purchase Agreement functions as a contract between the seller and the buyer at the initial stage of the home buying and selling process. This research examines the developer's responsibility towards consumers in house sale and purchase agreements through the Agreement of Sale and Purchase Binding mechanism, because a lack of consumer awareness and knowledge can increase risks to their rights. The method used in this research is based on normative juridical. The aim of this research is to determine the developer's legal responsibility towards buyers as consumers, so that there is legal certainty for buyers using the Agreement of Sale and Purchase Binding system. Developers must bear the losses experienced by consumers in accordance with Article 19 of Law Number 8 of 1999 concerning Consumer Protection. In accordance with Article 19 of Law Number 8 of 1999 concerning Consumer Protection, this research aims to determine the developer's legal responsibility towards buyers as consumers, so that buyers can obtain legal certainty through the Agreement of Sale and Purchase Binding system. In addition, the developer is responsible for providing accurate information and guaranteeing the quality of construction, which includes the construction period to the maintenance period, until all sales and purchase agreements are completed.

Abstract

Disparities in financial capabilities in society have resulted in many credit agreements being entered into between consumers as debtors and banks as creditors or lenders, which are also accompanied by collateral in the form of mortgage rights which are used as collateral for payment of receivables by the debtor if he is unable to pay his debts to the creditor. The scope related to credit agreements is increasingly expanding when the model develops that credit agreements can be transferred to third parties through a cessie or receivable transfer agreement which of course poses risks for both creditors and debtors because in principle, when receivables are transferred to the cessie buyer, then the mortgage rights as collateral are also also transferred, including in terms of claim rights by new creditors. Therefore, this issue is interesting to discuss from the perspective of debtor protection as consumers of banking institutions, especially regarding the procedures and requirements that need to be understood regarding the transfer of mortgage collateral through a cessie or receivable transfer agreement. Apart from that, debtors also need to know what legal remedies can be submitted if the credit agreement or receivable transfer procedure causes losses for the debtor. In this research, the author uses a normative juridical research method using literature study and a legal approach. The results of the research show that based on the Consumer Protection Law and Financial Services Authority regulation, the Debtor as a consumer has the right to know clear and accurate information regarding the procedures and requirements of credit agreements including receivable transfer or cessie agreements and the legal consequences for the mortgage rights which he uses as collateral, including filing a complaint and/or legal remedies in litigation and non-litigation as long as he feels disadvantaged. The government needs to aggressively carry out outreach regarding all applicable regulations regarding credit agreements.

Abstract

Penelitian Ini Membahas Pokok Permasalahan Pengaturan Tentang Pembatalan Jadwal Penerbangan Pesawat Pada Badan Usaha Niaga Berjadwal di Indonesia menurut Undang-Undang Perlindungan Konsumen, bentuk perlindungan hukum bagi konsumen sebagai penumpang pesawat yang mengalami kerugian materiil dan immateriil dikarenakan pihak maskapai penerbangan membatalkan jadwal penerbangan, dan upaya hukum yang dapat ditempuh konsumen sebagai penumpang pesawat yang mengalami kerugian materiil dan immateriil dikarenakan pihak maskapai penerbangan membatalkan jadwal penerbangan. Tujuan dari Penelitian ini adalah untuk menganalisis bentuk Perlindungan Hukum Terhadap Konsumen Sebagai Penumpang Yang Mengalami Kerugian Materiil Dan Immateriil Dikarenakan Maskapai Yang Membatalkan Jadwal Penerbangan. Penyusunan makalah ini menggunakan penelitian yuridis normatif dengan pendekatan teoritis terhadap fenomena bentuk Perlindungan Hukum Terhadap Konsumen Sebagai Penumpang Yang Mengalami Kerugian Materiil Dan Immateriil Dikarenakan Maskapai Yang Membatalkan Jadwal Penerbangan. Pengaturan Tentang Pembatalan Jadwal Penerbangan Pesawat Pada Badan Usaha Niaga Berjadwal di Indonesia menurut Undang-Undang Perlindungan Konsumen. Pasal 2, menyatakan Perlindungan konsumen berasaskan manfaat, keadilan, keseimbangan, keamanan dan keselamatan konsumen, serta kepastian hukum. Hak untuk mendapatkan kompensasi atau ganti rugi atau penggantian, juga diatur dalam Undang-undang perlindungan konsumen, ketika barang dan atau jasa yang diterima tidak sesuai dengan perjanjian atau apabila tidak sebagaimana mestinya. Dalam Undang-undang perlindungan konsumen terdapat 3 (tiga) pasal yang mengatur mengenai tanggung jawab produk, yaitu Pasal 19, Pasal 23 dan Pasal 28. Upaya hukum yang dapat ditempuh konsumen yang mengalami kerugian materiil dan immateriil dikarenakan pihak maskapai penerbangan membatalkan jadwal penerbangan, dapat dilakukan peradilan maupun diluar peradilan.

Abstract

The legal consequences of the adoption event are regarding the status of the adopted child as the heir of his adoptive parents, such a status often causes problems in the family. The issues that often arise in the event of a lawsuit are usually related to the legality of the adoption of the child, as well as the position of the adopted child as the heir of his adoptive parents. Adopted children also have the right to guarantee the protection of their rights so that they can live their lives, participate optimally, and get protection from violence and/or different treatments. As for the reality, sometimes adopted children are still considered not part of the family and in the end, the rights of adopted children are ignored. This does not rule out the possibility of problems such as in terms of the distribution of inheritance, because it considers that the adopted child is not the heir of the parent who adopted him. In this study, the author also used Decision Study Number: 113/K/Pdt/2019. The theories used in the research are the theory of legal certainty, the theory of legal justice and the theory of legal protection. The research method used by the author is a normative research method. SW is not entitled to LTJ's inheritance because of his position as only a foster child based on the Deed of Child Handover Number 2. Foster children in terms of inheritance are not entitled to inheritance because their position is different from the position of the adopted child. A foster child is considered a third person who is not included in the class of heirs who are entitled to inheritance according to the law. An adopted child can get property from his adoptive parents through a will. The amount of this will is determined not to exceed 1/3 of the inheritance.

Abstract

Auction is a method of offering goods by verbally mentioning the price from the highest to the lowest. This writing aims to find out the material law that should be stipulated in this case and to find out the basis for the judge's considerations in deciding case Number 2893 K/Pdt/2021. This research approach is a normative juridical approach by discussing the doctrine or legal principles contained in statutory regulations. The results of this study are that the court can cancel the cancellation of auction for the execution of the Mortgage. Cancellations can only be canceled before the auction is held, this is by the provisions in Article 24 of the Minister of Finance Regulation No.106/PMK.06/2013 which states that the auction can be canceled by a court decision before the auction is held. Cancellations of auctions submitted after the auction has occurred cannot be carried out, this is in accordance with the provisions in Article 3 of Minister of Finance Regulation No.106/PMK.06/2013 which reads that auctions that have been carried out in accordance with applicable regulations cannot be cancelled.

Abstract

In essence, Indonesia is a state based on law as stated in the Constitution of the Republic of Indonesia Article 1 paragraph 3, so that every community activity is regulated by using law as a tool to carry out order, justice, security and development. One form of guarantee provided by law in its products is the legal relationship between legal subjects and other legal subjects in the economic field which cannot be separated from everyday human activities with the existence of arrangements regarding agreements. One that relates to agreements is online-based arisan which is based on written or oral agreements, thus providing protection to legal subjects to avoid unwanted things such as not having good faith in carrying out online arisan activities, especially those that can be a default form. Therefore the researcher uses a type of normative research method with a statutory approach. The results of this study are that the legal consequences arising from non-payment of online arisan funds can cause losses and are included in the category of default in the agreement so that they are required to compensate for losses and the conclusion in this study is that repayment can be carried out by means of litigation and non-litigation.
