Abstract

Perkawinan masuk ke dalam kategori peristiwa hukum dan suatu jalan bagi manusia untuk meneruskan keturunannya. Ikatan dua subjek hukum tersebut terjalin dapat berdampak luas pada harta kekayaan dan anak yang lahir dalam Perkawinan tersebut. Salah satunya merupakan hak waris bagi anak yang menjadi bagian keturunan antara suami dan istri tersebut. Perkawinan menurunkan harta kekayaannya kepada ahli waris khususnya kepada anak, namun terdapat beberapa kasus terdapat perceraian yang menyebabkan akibat hukum terhadap ahli warisnya terkait harta kekayaan. Selain perceraian yang berdampak terhadap harta kekayaan pada ahli warisnya adalah meninggalnya orang tua sang anak, sehingga menyebabkan anak menjadi yatim piatu. Anak yang menjadi yatim piatu mendapatkan asuhan dari wali yang ditunjuk oleh orang tua anak sebelum ia meninggal ataupun dari pihak keluarga ayah atau ibunya yang ingin menjadi wali bagi anak tersebut. Metode yang digunakan pada penelitian ini ialah yuridis normatif dengan mengkaji peraturan perundang-undangan. Pendekatan yang dilakukan ialah dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil pembahasan pada penelitian ini ialah seorang anak yang ditinggal wafat oleh kedua orang tuanya akan tetap mendapatkan asuhan dari wali apabila ia belum mencapai umur 18 tahun. Bagi wali yang ingin mendapatkan hak asuh anak dapat meminta penetapan kepada Pengadilan Agama atau Pengadilan Negeri setempat.

Abstract

Business people show great interest in the development of the property industry. With promising market prospects, developers have significant legal responsibilities to potential buyers. To ensure legal certainty and avoid future conflicts, consumers must understand and comply with the legal rules contained in the agreement. The Sales and Purchase Agreement functions as a contract between the seller and the buyer at the initial stage of the home buying and selling process. This research examines the developer's responsibility towards consumers in house sale and purchase agreements through the Agreement of Sale and Purchase Binding mechanism, because a lack of consumer awareness and knowledge can increase risks to their rights. The method used in this research is based on normative juridical. The aim of this research is to determine the developer's legal responsibility towards buyers as consumers, so that there is legal certainty for buyers using the Agreement of Sale and Purchase Binding system. Developers must bear the losses experienced by consumers in accordance with Article 19 of Law Number 8 of 1999 concerning Consumer Protection. In accordance with Article 19 of Law Number 8 of 1999 concerning Consumer Protection, this research aims to determine the developer's legal responsibility towards buyers as consumers, so that buyers can obtain legal certainty through the Agreement of Sale and Purchase Binding system. In addition, the developer is responsible for providing accurate information and guaranteeing the quality of construction, which includes the construction period to the maintenance period, until all sales and purchase agreements are completed.

Abstract

Disparities in financial capabilities in society have resulted in many credit agreements being entered into between consumers as debtors and banks as creditors or lenders, which are also accompanied by collateral in the form of mortgage rights which are used as collateral for payment of receivables by the debtor if he is unable to pay his debts to the creditor. The scope related to credit agreements is increasingly expanding when the model develops that credit agreements can be transferred to third parties through a cessie or receivable transfer agreement which of course poses risks for both creditors and debtors because in principle, when receivables are transferred to the cessie buyer, then the mortgage rights as collateral are also also transferred, including in terms of claim rights by new creditors. Therefore, this issue is interesting to discuss from the perspective of debtor protection as consumers of banking institutions, especially regarding the procedures and requirements that need to be understood regarding the transfer of mortgage collateral through a cessie or receivable transfer agreement. Apart from that, debtors also need to know what legal remedies can be submitted if the credit agreement or receivable transfer procedure causes losses for the debtor. In this research, the author uses a normative juridical research method using literature study and a legal approach. The results of the research show that based on the Consumer Protection Law and Financial Services Authority regulation, the Debtor as a consumer has the right to know clear and accurate information regarding the procedures and requirements of credit agreements including receivable transfer or cessie agreements and the legal consequences for the mortgage rights which he uses as collateral, including filing a complaint and/or legal remedies in litigation and non-litigation as long as he feels disadvantaged. The government needs to aggressively carry out outreach regarding all applicable regulations regarding credit agreements.

Abstract

This research discusses the legal consequences of default in a sale and purchase agreement. Using a normative approach, this research analyzes the legal regulations governing the issue of default in sales and purchase agreements. The research results concluded that default resulted in a violation of agreed obligations, which could result in a lawsuit for breach of contract or an unlawful act. Dispute resolution can be done through negotiation, mediation or arbitration. Negotiation, both of interests and rights, is an important process in forming contracts, with the aim of reaching an agreement that is profitable for all parties. In conclusion, success in business and dispute resolution often depends on the ability to negotiate well and adhere to promises that have been made.

Abstract

Debitur yang sudah membuat dan juga menyepakati sebuah perjanjian yang dibuat bersama dengan kreditur dalam hal debitur membutuhkan sebuah dana tertuang didalam sebuah perjanjian kredit, debitur seringkali melakukan sebuah tindakan wanprestasi berupa tidak membayar hutang serta tidak dipenuhinya itikad baik, seperti jaminan yang diperjanjikan ternyata telah dijadikan jaminan kepada pihak lain dan telah disita, dimana perjanjian harus tetap berjalan, diperlukan perlindungan hukum bagi kreditur yang tidak memiliki pengikatan jaminan. Perlindungan hukum kreditur diatur dalam Kitab Undang-Undang Hukum Perdata. Penelitian ini bertujuan untuk memberikan pemahaman kepada kreditur bagaimana bentuk perlindungan hukum terkait dengan jaminan yang disita pihak lain baik sebelum ataupun sesudah perjanjian dibuat. Jenis penelitian yang digunakan adalah penelitian normatif, seperti penggunaan buku, pembahasan teori dan hukum yang berlaku. Dengan kesimpulan, penelitian ini dirasa sangat penting untuk memberikan keadilan bagi orang-orang yang membutuhkannya.

Abstract

Perjanjian kerjasama dibuat bagi para pihak yang berkepentingan dalam suatu pekerjaan, dimana membutuhkan bantuan pihak lain, dengan adanya perjanjian kerjasama yang dibuat sah dalam hukum, lahirlah prestasi yang harus dipenuhi oleh para pihak, tiap perjanjian kerjasama diharapkan berjalan lancar, sering kali perjanjian kerjasama tidak selalu berjalan dengan lancar, dimana salah satu pihak tidak melaksanakan prestasinya, sehingga merugikan pihak lain, terlebih lagi jika perjanjian kerjasama tersebut berhubungan dengan uang, sehingga pihak yang merugikan harus bertanggung jawab sesuai Kitab Undang-Undang Hukum Perdata. Penelitian ini bertujuan untuk menjelaskan tentang tanggung jawab apa saja yang harus dilakukan oleh pihak yang merugikan. Jenis penelitian hukum yang digunakan penelitian normatif, berupa buku hukum, teori serta undang-undang yang berlaku. Penelitian ini diharapkan memberikan pemahaman bagi pihak yang dirugikan dalam perjanjian kerjasama berkaitan dengan bentuk tanggung jawab yang harus dipenuhi oleh pihak yang merugikan.

Abstract

An authentic deed is known as the strongest and most legally binding evidence in legal proceedings. However, its integrity can be compromised when fraudulent data is incorporated, leading to the degradation of its evidentiary value. This research aims to analyze the legal implications of authentic deeds that have been degraded due to data falsification and to explore the notary’s responsibility in such cases. This research used normative juridical approach, this study examined statutory regulations, court decisions, and legal doctrines related to document authenticity. The findings indicate that an authentic deed containing falsified data may lose its status as a perfect piece of evidence and be downgraded to an underhand deed, depending on the extent of the forgery. Additionally, notaries may be held accountable if negligence is proven in verifying the validity of the data. This research contributes to a better understanding of the legal protection mechanisms for parties involved in notarial transactions and highlights the importance of strict verification procedures to uphold the authenticity of legal documents.

Abstract

Notaries such as Public Officials who make authentic deeds are prohibited from reading deeds outside their work area. The problem is that there are still many Notaries who read deeds outside their work area which results in changes in the status of the deeds they make. The method used in this research is normative juridical by conducting research through the literature on secondary data, especially primary legal materials in the form of statutory regulations and secondary legal materials in the form of books and articles or journals, using the theory of responsibility and Law Enforcement. The results of the research show that to date Notaries who read deeds outside their area of office have violated the law and the Notary's code of ethics, therefore Notaries can be held accountable by parties who have been harmed by reading deeds carried out outside their area. position of Notary, it can be concluded that law enforcement against Notaries who read deeds outside their area of office is not optimal. Therefore, in terms of proof, the deed he made is no longer authentic, but a private deed.

Abstract

Uncertainty in human life gives rise to the need for legal and economic protection instruments, one of which is through the insurance mechanism. As a form of risk transfer, insurance provides compensation guarantees for losses due to uncertain events, such as accidents, fires, or death. In the legal framework in Indonesia, the relationship between the insurer and the insured is formed through an agreement (policy) or normative provisions in laws and regulations. However, in practice, this relationship is inseparable from the problem of moral hazard, especially the misuse of claims by the insured who act dishonestly. This phenomenon not only causes economic losses for insurance companies, but also threatens the integrity of the insurance system itself. Therefore, an effective legal protection mechanism is needed for insurance companies to deal with these manipulative practices. This paper examines the forms of legal protection available, both through contractual instruments (internal) and external regulations such as Law Number 40 of 2014 concerning Insurance. With a normative legal approach, this paper aims to provide a deeper understanding of the importance of maintaining a balance of rights and obligations in insurance contracts and the need to strengthen legal aspects in anticipating misuse of claims.

Abstract

In Indonesia, a marriage agreement is regulated in Article 119 of the Civil Code and Article 29 of Law Number 1 Year 1974 concerning marriage. The marriage agreement is made by a notary as an authorized party and legalized by the marriage registrar. However, there are often problems related to marriage agreements, especially when they are not recorded by the marriage registrar. Meanwhile, the recording of a marriage agreement has an important urgency for each party, which provides justice, certainty, and legal benefits. The non-recording of a marriage agreement by a marriage registration officer will have legal consequences, one of which is the potential for legal problems that lead to disputes over joint property after divorce. This research analyzes how the importance of recording a marriage agreement and its legal consequences through Supreme Court Decision Number 598 PK/Pdt/2016 with a normative juridical approach. The results show that the marriage agreement can still be canceled because it does not meet the formal requirements of the provisions of Article 29 paragraph (1) of the Marriage Law, namely the element of being legalized by a marriage registration officer. The legal effect is that the assets obtained during the marriage must be separated and divided equally.
