Abstract

Penelitian ini mengkaji maraknya kasus pengoplosan BBM Pertamax di Indonesia, di mana Pertamax dicampur dengan bahan bakar kualitas rendah demi keuntungan ilegal. Dengan metode kualitatif studi pustaka, penelitian ini menelaah buku, jurnal, regulasi, dan berita untuk menganalisis fenomena ini dari sudut pandang hukum Indonesia dan hukum ekonomi syariah. Hasil penelitian menunjukkan bahwa pengoplosan Pertamax tidak hanya melanggar hukum nasional seperti UU No. 22/2001 tentang Migas dan UU No. 8/1999 tentang Perlindungan Konsumen, tapi juga bertentangan dengan prinsip syariah. Praktik ini merugikan konsumen, merusak mesin kendaraan, dan menyebabkan kerugian besar bagi negara. Studi ini juga menemukan bahwa sanksi hukum saja belum cukup untuk menghentikan praktik ini. Oleh karena itu, penelitian ini merekomendasikan penguatan pengawasan, peningkatan edukasi masyarakat, dan integrasi nilai-nilai Islam dalam etika bisnis untuk mencegah kecurangan serupa di masa depan. Penelitian ini diharapkan bisa memberi solusi praktis demi sistem distribusi BBM yang lebih adil dan transparan di Indonesia.

Abstract

Go Fun Bojonegoro Theme Park is one of the biggest family playgrounds in Bojonegoro. Most tourist attractions must have a variety of products that are traded to visitors who come. The rental of the heavy food stands at Go Fun Bojonegoro has a different contract agreement with the other stands because there are additional contracts, namely profit sharing cooperation by increasing the selling price. The results of the study indicate that the practice of profit sharing between the food stand tenants and the Go Fun Bojonegoro manager has a different agreement with other booths, because the rental of food stands at Go Fun Bojonegoro has the most number of payment details. Go Fun Bojonegoro managers waive booth rental fees and replace it with a profit sharing system, namely by increasing the selling price of food by 20% of the selling price set by the tenant at a ratio of 80:20. In addition, there are three theories in the perspective of sharia economic law, namely the contract, ijarah and musyarakah. Of the three contracts, it is considered valid according to sharia economic law because they have met the requirements and harmonious agreements, ijarah and musharaka.

Abstract

Currently, deposits in a Sharia Financial Institution are increasingly diverse, including at BMT NU Ngasem. There is one excellent product called education savings. There are four different practices, one of which is to use the ?savings box? program. This practice is highly recommended by means of cash waqf, this savings is known as ?Si Galis?. The results of the study indicate that the first practice is between BMT and students, the second practice is between BMT and schools where the MoU and bonuses are fully owned by the school, the third practice is between BMT and schools with MoU and the bonus is divided by 50% for schools and 50 % for students while the fourth practice is between BMT and students using the ?savings box? program and it is recommended that cash waqf be used. In addition, the first, second and third practices are in accordance with the wadi>'ah yad al-d}ama>nah theory and the concept of guardianship, both terms and conditions. The fourth practice, apart from using that theory, also uses the concept of productive waqf. In terms of fiqh, the fourth practice is also in accordance with the terms and conditions of wadi>'ah and waqaf istithma>ry.

Abstract

Abstract: The practice of the bai' al-tawarruq contract has existed since the era of the four mujtahids, it's just that the term bai' al-tawarruq only appeared in the Middle Ages, the first person to mention the term bai' al-tawarruq was a Hanbali scholar, Ibn Taimiyah. In the modern era, this term has been divided by the practice carried out in Islamic banks called bai' al-tawarruq al-masrafy and those carried out outside Islamic banks called bai' al-tawarruq al-fiqhi. These two types of bai' al-tawarruq contracts look the same in practice as bai' al-'inah but have differences with the involvement of third parties in the practice of bai' al-tawarruq, which is not present in bai' al-'inah. The pros and cons of Ulama against the law of bai' al-tawarruq have existed since the classical era, the majority of Ulama of the three madhhabs (Hanafi, Maliki, and Shafi'i) prohibit the practice of bai' al-tawarruq on the grounds of hailah and leads to usury, only the Hanbali madhhab is driven by Ibn Taimiyah and Ibn al-Qayyim who allowed the contract with the argument that bai' al-tawarruq was different from the forbidden bai' al-'inah contract. Meanwhile, contemporary scholars have different opinions in punishing bai' al-tawarruq al-masrafy. Referring to the results of the congress and conference decisions in Sharjah, United Arab Emirates, Bahrain, and Saudi Arabia in 1423 H. There were two opposing camps in formulating the law of bai' al-tawarruq al-masrafy. The first camp, the majority madhhabs forbids financial transactions using this contract in Islamic banks because it contains elements of usury, hailah and includes the form of bai' al-'inah. While the second camp, minority madhhabs tend to allow it for reasons of emergency and urgent need as well as to fulfill liquidity.

Abstract

“This paper deals with Islamic studies and the future of Islam. Firstly, Fazlur Rahman considers that neo-modernists have acknowledged that Western civilization is the only alternative for the future of the world. He revealed a fact that modernity in the West, ethics, and law is able to develop as an independent discipline with secularism method. On the contrary, Islamic ethics was never developed as an independent discipline based on the systematic interpretation methodology of the Qur'an. Secondly, Rahman mentions the orthodoxy of Islamic thought on the obsolete methodology, such as qiya>s, must be reconstructed with a new methodological approach, such as mas}lah}at, so that, the elasticity of Islamic law is able to provide solutions to all contemporary problems. In addition, Rahman highlighted the impact of the hegemony of Western civilization on the mindset and lifestyle of Muslim communities that can be seen in a variety of new situations that are full of complexity. Actually, he wants to create synergy between Muslim and non-Muslim intellectuals and can work together between them. In discussing the development of Islamic intellectualism, he said that something that was desired primarily was to understand the Qur'an with the historical background and new interpretations.”

Abstract

The purpose of this study is to examine the implementation of sukuk related to cash waqf at BSI Bojonegoro Branch. The main focus is to understand how waqf is integrated with CWLS, see the supporting and inhibiting factors, and assess its potential and impact on regional economic and social development. The qualitative descriptive method, and using primary data with interviews and secondary data from literature reviews. The results obtained indicate that the CWLS mechanism at BSI Bojonegoro has followed national guidelines, supported by regulations, BSI's commitment, and public awareness of waqf. However, there are several obstacles such as low community literacy, low minimum wages, and the need to increase trust in local communities. Although the real impact of CWLS in Bojonegoro has not been widely felt, there is significant potential to raise funds for social and economic programs. The contribution of this study provides a specific case study of CWLS at the local level, which is expected to be a reference for BSI and other stakeholders in developing adaptive strategies. This aims to ensure that the benefits of productive waqf can be felt more widely and more clearly in empowering the community's economy.

Abstract

Desa Klempun, Kecamatan Ngraho, Kabupaten Bojonegoro, memiliki potensi besar dalam sektor peternakan, namun masih menghadapi kendala dalam penyediaan pakan ternak berkualitas, terutama pada musim kemarau. Ketergantungan terhadap pakan hijauan segar yang terbatas menyebabkan produktivitas ternak menurun. Kegiatan pengabdian masyarakat ini bertujuan untuk meningkatkan ketahanan pangan ternak melalui pembuatan silase sebagai alternatif pakan yang tahan lama dan bernutrisi tinggi. Metode yang digunakan dalam program ini meliputi sosialisasi, pelatihan pembuatan silase, serta pendampingan bagi peternak dalam implementasinya. Bahan baku utama yang digunakan adalah limbah pertanian lokal seperti jerami padi dan batang jagung yang difermentasi menggunakan inokulan bakteri asam laktat. Evaluasi program dilakukan dengan mengukur tingkat adopsi teknologi oleh peternak serta kualitas silase yang dihasilkan berdasarkan uji pH dan kadar nutrisi. Hasil kegiatan menunjukkan bahwa 85% peserta mampu membuat silase dengan kadar pH optimal (3,8–4,2) dan tingkat daya cerna meningkat sebesar 25% dibandingkan pakan hijauan segar. Selain itu, peternak melaporkan peningkatan bobot ternak rata-rata sebesar 12% dalam kurun waktu dua bulan setelah penerapan silase. Dengan demikian, pembuatan silase terbukti menjadi solusi inovatif dalam menjaga ketersediaan pakan ternak sepanjang tahun dan meningkatkan produktivitas peternakan di Desa Klempun. Program ini diharapkan dapat direplikasi di daerah lain untuk meningkatkan kemandirian pangan ternak.

Abstract

Abstrak Penelitian ini bertujuan untuk mengkaji hubungan antara implementasi fintech syariah dengan prinsip keuangan etis dalam pembiayaan UMKM di BMT MEKAH (Mekar Barokah) Bojonegoro. Fintech syariah sebagai inovasi teknologi keuangan yang berlandaskan nilai-nilai Islam dinilai mampu menjadi solusi pembiayaan yang adil, transparan, dan inklusif bagi pelaku usaha mikro. Pendekatan kualitatif deskriptif digunakan dalam penelitian ini melalui observasi dan wawancara langsung dengan pengurus BMT MEKAH. Hasil penelitian menunjukkan bahwa penerapan fintech syariah pada BMT MEKAH tidak hanya meningkatkan efisiensi layanan dan aksesibilitas pembiayaan, tetapi juga mencerminkan prinsip keuangan etis seperti keadilan, transparansi, dan tanggung jawab sosial. Melalui skema pembiayaan syariah, terutama akad murabahah, BMT MEKAH berhasil meningkatkan profitabilitas, likuiditas, dan efisiensi operasional pada pelaku UMKM yang telah menjadi anggota. Sinergi antara nilai-nilai syariah dan prinsip keuangan etis menunjukkan bahwa pemanfaatan teknologi finansial dapat diarahkan untuk membangun sistem keuangan yang tidak hanya efisien, tetapi juga berlandaskan nilai kemanusiaan dan keberlanjutan. Penelitian ini merekomendasikan pengembangan lebih lanjut terhadap sistem fintech syariah serta peningkatan dukungan kelembagaan guna mendorong pemberdayaan UMKM yang lebih efektif dan berkeadilan. Kata Kunci: Fintech syariah, Keuangan etis, Pembiayaan syariah, UMKM, BMT MEKAH   Abstract This study aims to examine the relationship between the implementation of Islamic fintech and ethical finance principles in the financing of micro, small, and medium-sized enterprises (MSMEs) at BMT MEKAH (Mekar Barokah), Bojonegoro. Islamic fintech, as a financial technology innovation rooted in Islamic values, is considered a viable solution for providing fair, transparent, and inclusive financing to micro-entrepreneurs. A descriptive qualitative approach was employed through field observation and interviews with BMT MEKAH management. The findings reveal that the application of Islamic fintech at BMT MEKAH not only enhances service efficiency and accessibility but also reflects ethical finance principles such as justice, transparency, and social responsibility. Through Sharia-based financing schemes—particularly murabahah contracts—BMT MEKAH has successfully enhanced the profitability, liquidity, and operational efficiency of its financing partner MSMEs. The synergy between Sharia values and ethical finance principles demonstrates that financial technology can be harnessed to build a system that is not only efficient but also grounded in humanistic and sustainable values. This study recommends further development of Sharia-compliant fintech systems and greater institutional support to promote more effective and equitable empowerment of MSMEs. Abstract

Waqf is a concept in Islam that refers to the gift of property that is eternally useful for benevolent purposes. The history of waqf dates back to the time of Prophet Muhammad SAW, where he and his companions practised waqf as a means to fulfil the social and religious needs of the community. Initially, waqf was used to build mosques, madrasas, and provide public facilities such as wells and roads. The development of waqf continued during the Islamic Caliphate, with the establishment of various waqf institutions that supported education, health, and public infrastructure. In the modern era, the concept of waqf underwent a transformation with applications in broader economic and social fields, including the professional management of waqf assets to ensure the sustainability of its benefits. The history of waqf demonstrates its important role in the development of Islamic civilisation and its contribution to the welfare of society as a whole.

Abstract

This research aimed to examine the former Egyptian mufti Ali Gomaa's argument that the absence of banks is the essence of riba. He theorized that the lack of banks was to blame for the inflation, just as riba can. In contrast, as we all know, the prohibition on riba is due to increased debt repayments. He went on to say that the mistake made by Muslim scholars in understanding bank interest as a form of riba was their dogmatic way of thinking, which equated money invested in bank financing with money owed. This study uses the arguments of former Egyptian mufti Ali Gomaa as primary and secondary sources to conduct critical research. In this case, the explanation is provided by a qualitative descriptive research design. Its purpose is to demonstrate the validity of former Egyptian mufti Ali Gomaa's argument for justifying that destroying the banks is equivalent to breeding riba. The study discovered that the statement by Egypt's Mufti Ali Gomaa was based on the bank's overall performance, specifically as an intermediary institution, where the bank's function is as a financing institution rather than a lending institution. Also, unlike debts and credits, where profit-taking is forbidden, it is perfectly legal to do so in any funding. Ali Gomaa's statement is a unilateral claim because banks channel money to customers for various reasons, including financing, investment, and debt purposes. Research-based recommendations are offered for adjustments required by stakeholders. Optimistically, the submission of this study will trigger a positive response from stakeholders.
