Abstract

The public’s freedom to access information is increasingly guaranteed by law. However, when accessing copies of court decisions, the court must still protect the personal rights of all parties involved. The application of secure technology, supported by regulatory protection, is essential to prevent privacy-related data breaches and maintain public trust in the judiciary. In this context, the Personal Data Protection Law application should be expanded to include guidelines for accessing court decision copies. This research analyzes the importance of maintaining the parties’ confidentiality when accessing copies of court decisions and the need for legal certainty regarding sanctions for disseminating personal data in these decisions. This study uses normative juridical methods with statutory and conceptual approaches. The study results indicate that this is appropriate if court decisions are accessed for the benefit of the litigating parties. However, certain aspects, particularly personal data, must remain confidential when accessed by the general public. It is also explained in the Qur’an that, in general, privacy within the home is highly protected and respected. AbstrakKebebasan masyarakat untuk mengakses informasi semakin dijamin oleh undang- undang, namun dalam hal mengakses salinan putusan suatu perkara yang telah diputuskan, pengadilan harus tetap melindungi hak-hak pribadi masing-masing pihak yang terlibat dalam perkara tersebut. Penerapan teknologi yang aman dan didukung dengan perlindungan regulasi diperlukan untuk mencegah pelanggaran data terkait privasi dan menjaga kepercayaan publik terhadap lembaga peradilan. Dalam hal ini, penerapan Undang-Undang Perlindungan Data Pribadi perlu diperluas hingga mencakup pedoman dalam mengakses salinan putusan pengadilan. Penelitian ini bertujuan untuk menganalisis pentingnya menjaga kerahasiaan para pihak dalam mengakses salinan putusan pengadilan, serta pentingnya kepastian hukum terkait sanksi atas penyebarluasan data pribadi para pihak dalam putusan pengadilan. Penelitian ini menggunakan metode yuridis normatif, dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa jika putusan tersebut diakses untuk kepentingan para pihak yang berperkara, maka hal ini sesuai dengan ketentuan. Namun demikian, ada hal-hal yang harus dirahasiakan terkait data pribadi para pihak apabila putusan tersebut diakses oleh publik. Dalam Al-Qur’an dijelaskan bahwa secara umum, privasi di dalam rumah sangat dilindungi dan dihormati.

Abstract

Within the pesantren tradition, kitab kuning serves as a foundational and authoritative reference for Islamic scholarship. This study focuses on the regular recitation of kitab kuning texts—Tafsīr al-Munīr by Imam al-Nawawī and Iḥyā’ ʿUlūm al-Dīn by Imam al-Ghazālī, as conducted by K.H. Ahmad Hasan, the head of Pesantren As-Sa‘īdiyyah 2 Bahrul Ulum Tambak Beras, Jombang. Employing a field-based, qualitative research approach, this study applies the lens of digital da'wah to examine how traditional pedagogical practices are being transformed through modern technology. This study's findings indicate that since 2014, the pesantren has initiated the digital broadcasting of kitab kuning recitations via YouTube. Despite limitations in audiovisual quality, which often affect sound clarity, the integration of digital media has substantially widened the reach and accessibility of these religious teachings. This transformation yields three significant impacts: (1) spatial boundaries are reduced through the enabling power of information technology; (2) audience participation is no longer limited by physical space; and (3) the availability of recitation content transcends time, allowing asynchronous access for learners. These developments mark an important step toward preserving classical Islamic scholarship while adapting to contemporary modes of knowledge transmission.

Abstract

The issue of "application fatigue" among government agencies has led to a reluctance among user to download or engage with existing applications. The intent behind these applications is to digitalize government functions, particularly in enhancing public services. This article explores the application of cost-benefit analysis (CBA) regarding the development of smart city policies in Indonesia. Historically, smart city initiatives have often translated into the creation of new applications by both central and regional government entities. This study employs normative legal research, utilizing both a statutory and cost-benefit analysis approach to investigate smart city implementation. The findings that the current conditions for smart city development in Indonesia are regressing, primarily due to lack of central government regulations that serve as guidelines for these initiatives. The involvement of stakeholders is examined based on their authority and interests, which significantly influence the implementation of the single smart city platform. Furthermore, the cost-benefit analysis demonstrates the importance of establishing and implementing this single smart city platform as a means to enhance decision-making efficiency within government agencies. It is hoped that this article will serve as a recommendation for policymakers to conduct through analysis prior to program development to ensure feasibility and effectiveness.

Abstract

This study aims to analyze the effectiveness of derden verzet as a legal protection mechanism for third parties in civil execution disputes in Indonesia and to assess its relevance to the achievement of Sustainable Development Goals (SDGs), particularly Goal 16 on peace, justice, and strong institutions. Employing normative legal research with a case approach, this article examines Decision No. 372/Pdt/2020/PT.Bdg and relevant procedural norms under the HIR/RBg framework, supported by doctrinal and human-rights-based justice literature. The findings show that derden verzet is conceptually designed to safeguard third-party property rights affected by final court judgments; however, its implementation remains constrained by procedural formalism, a heavy burden of proof, limited public awareness, and inadequate procedural safeguards in summons and evidentiary examination. In the analyzed case, the third party’s attempt to reclaim property rights was impeded despite indications that the transfer of rights occurred in the absence of good faith, demonstrating a gap between procedural compliance and substantive justice. This condition undermines legal certainty and weakens access to justice, contradicting the institutional objectives promoted by SDG Goal 16. The novelty of this study lies in repositioning derden verzet not merely as an extraordinary procedural remedy but as a substantive rights-protection instrument within a human-rights-oriented civil justice reform agenda, while identifying key normative deficiencies such as unclear standing requirements and undefined criteria of “harmed interests.” Accordingly, the study recommends clearer judicial guidelines and standardized procedural rules to strengthen third-party standing assessment, improve structured evidentiary review, and reduce excessive formalism to ensure more effective protection and a more accountable civil justice system.

Abstract

Infrastructure development constitutes a fundamental driver of economic growth in developing countries; however, persistent fiscal constraints have compelled ASEAN states such as Indonesia and the Philippines to adopt Public–Private Partnership (PPP) schemes as alternative financing mechanisms. Despite the long-standing implementation of PPP in both jurisdictions, significant disparities in legal frameworks and institutional arrangements raise critical issues concerning regulatory efficiency, bureaucratic coordination, and legal certainty in infrastructure delivery. This study aims to comparatively examine the legal frameworks governing PPP implementation in Indonesia and the Philippines by applying the analytical standards set out in the World Bank’s Public–Private Partnership Legal Framework Reference Guide. Employing normative legal research, this study utilises statutory, conceptual, and comparative approaches to analyse PPP-related legislation, institutional governance structures, contractual arrangements, and dispute resolution mechanisms in both countries. The findings reveal that Indonesia operates under a fragmented and multi-layered regulatory regime involving numerous institutions, offering stronger legal certainty through tiered dispute resolution mechanisms, whereas the Philippines adopts a unified PPP legal code supported by a centralised PPP Center, resulting in greater procedural efficiency and investment facilitation. This article contributes to the optimal implementation of PPP through regulatory simplification and institutional centralisation for countries in the ASEAN region. Pembangunan infrastruktur merupakan prasyarat utama pertumbuhan ekonomi di negara berkembang, namun keterbatasan fiskal mendorong Indonesia dan Filipina sebagai negara ASEAN untuk mengandalkan skema Public–Private Partnership (PPP) sebagai alternatif pembiayaan yang berkelanjutan. Meskipun kedua negara telah lama menerapkan PPP, perbedaan kerangka hukum dan kelembagaan menimbulkan persoalan efektivitas, efisiensi birokrasi, serta kepastian hukum yang berdampak langsung pada keberhasilan proyek infrastruktur. Penelitian ini bertujuan membandingkan kerangka hukum PPP di Indonesia dan Filipina dengan menggunakan World Bank Public–Private Partnership Legal Framework Reference Guide untuk menilai efektivitas regulasi, struktur kelembagaan, dan mekanisme penyelesaian sengketa. Metode penelitian menggunakan pendekatan hukum normatif dengan teknik perundang-undangan dan komparatif, menganalisis peraturan PPP, struktur institusi terkait, serta pengaturan kontraktual dan penyelesaian sengketa di kedua negara. Hasil penelitian menunjukkan bahwa Indonesia memiliki kerangka regulasi yang kompleks dengan banyak institusi dan mekanisme penyelesaian sengketa berjenjang yang memberikan kepastian hukum lebih kuat, sedangkan Filipina menerapkan satu undang-undang terpadu dan satu lembaga khusus PPP Center yang menciptakan proses lebih efisien dan ramah investasi. Artikel ini berkontribusi pada bentuk optimalisasi implementasi PPP melalui penyerderhanaan regulasi dan sentralisasi kelembagaan untuk negara di kawasan ASEAN.

Abstract

Background: The talaqqī system in Qur’anic education traditionally emphasizes direct interaction between teacher and student to ensure authenticity of recitation and the transmission of spiritual values. However, the advancement of digital technology—particularly the use of artificial intelligence (AI)—has introduced new models in Qur’anic pedagogy. One example is the Qara’a application, which offers a self-directed learning method without the physical presence of a teacher. Purpose: This study aims to analyze the transformation of the talaqqī system into a digital format through the Qara’a application and to evaluate the accuracy of its Qur’anic recitation assessment system. Methodology: This study employs a descriptive qualitative approach with structured digital observation of the Qara’a application. The researcher directly engaged with the app to document its navigation flow, AI features, and learning system. Data were collected through screenshots and field notes, and analyzed thematically through the stages of data reduction, categorization, interpretation, and conclusion drawing. Findings: The results show that in the Qara’a system, the teacher’s role is replaced by a machine that provides sample recitations, which are then imitated by the learner through voice recordings. The learning materials are structured in stages—covering writing, recitation, and a combination of both—and users cannot proceed to the next level without completing the current one. While the app offers flexibility in terms of time and place, its AI-based assessment focuses solely on makhraj (articulation point) per letter and does not account for technical issues (such as voice clarity and network stability) or the psychological state of the learner. Research Implication: These findings reveal a shift in the value system of talaqqī, from one rooted in spiritual relationships to an automated evaluative system, affecting both the meaning of authority and the quality of assessment in Qur’anic learning. Contribution: This study offers a new contribution to the field of digital Qur’anic education by presenting a critical analysis of AI integration in Islamic pedagogy. Its focus on the transformation of talaqqī and the evaluation mechanism of the Qara’a application represents a dimension that has not been widely explored in previous studies.
