Abstract

To compare private data protection regulations in Indonesia and the Philippines and understand dispute resolution related to private data cases in the two countries. This research method uses literature review studies derived from books and journals or articles that have been published. The research findings reveal a comparison between the Private Data Protection Act in Indonesia and the Philippines. It is noted that the Philippines already has an independent supervisory body, whereas Indonesia does not, despite the establishment of such an institution being regulated by the Private Data Protection Act number 27 of 2022. Additionally, the study aims to understand the dispute resolution mechanisms in case of private data theft in both Indonesia and the Philippines. This study compares the regulations of the Private Data Protection Act in Indonesia and the Philippines, focusing particularly on the establishment of an essential independent supervisory body that needs to be formed in Indonesia. Subsequently, the case resolution mechanisms through Alternative Dispute Resolution can be considered to eliminate practices that tend to be slow, complex, and expensive, as well as to stop corrupt practices in the courts, ensuring that the Indonesian community feels secure and protected. No specific research has been found that compares the regulations on Private Data Protection in Indonesia and the Philippines. This includes the establishment of an independent supervisory body to aid law enforcement authorities in identifying perpetrators of private data theft, providing education, and addressing public inquiries about private data. Additionally, the resolution of cases involving private data theft through alternative dispute resolution is deemed superior to the judicial route due to the frequent practices of being slow, complex, expensive, and corrupt, which can erode or even eliminate the trust of the Indonesian public in law enforcement authorities.

Abstract

The implementation of court rulings on rehabilitation and compensation in the State Administrative Court has entered a new era with the issuance of execution guidelines for the supervision of rulings with permanent legal force by the Head of the State Administrative Chamber of the Supreme Court of the Republic of Indonesia. These guidelines mark the first time in the history of the Supreme Court that a compensation amount has been reassessed and determined by the Serang State Administrative Court due to the failure to implement rehabilitation in an employment dispute. The compensation awarded does not refer to Government Regulation No. 43 of 1991, which limits compensation to between one hundred thousand rupiah and two million rupiah, but instead is based on the actual losses of the petitioner. This practice has set a positive precedent for the execution of compensation or monetary payments, which is expected to be followed by other State Administrative Courts. It is hoped that the Plaintiffs/Execution Applicants will follow the legal enforcement procedures outlined in the Minister of Finance Regulation Number 80/PMK.01/2015 regarding the Implementation of Legal Decisions, enabling the realization of compensation payments, and it is recommended that the Minister of Finance execute the legal decisions, especially the Supreme Court's re-determination regarding the compensation payment amount, so that justice for the Plaintiffs/Execution Applicants can be fully realized.

Abstract

The problem of misuse of the Physical Control Statement Letter (SPPF) in the Complete Systematic Land Registration (PTSL) Program promoted by the government has caused many losses to land rights owners. The writing of this journal is intended to provide education for the public so that they can find out the causes and impacts of misuse of physical possession statement letters (SPPF) in the Complete Systematic Land Registration (PTSL) program, as well as the legal impacts that occur due to misuse of these letters. This journal adopts the Normative Juridical method with an Explorative approach and uses a qualitative analysis technique using primary legal materials, secondary legal materials and tertiary legal materials and the collection technique uses data from literature review. The findings obtained from the results of this study indicate that the misuse of the physical possession letter (SPPF) is due to the vulnerability in the PTSL Law which in this case provides relief for applicants in the Complete Systematic Land Registration (PTSL) program who do not have or do not complete their files as the basis for the right to register the land they own or control can still register their land by using a physical possession statement letter (SPPF). This can have an impact on uncertainty and legal guarantees and can create conflicts over land ownership in the future. In addition, the perpetrators of the misuse of the letter can also face penalties in terms of civil, criminal and administrative matters.

Abstract

This study explores the legal and policy dimensions influencing security, economic development, and education in the Indonesia-Malaysia border region, identifying key challenges and offering policy recommendations. Using a qualitative methodology and NVIVO 12+ software for data analysis, the research examines legislation documents, government reports, and policy frameworks to uncover significant gaps. The study reveals critical deficiencies, including underfunded educational institutions, inadequate healthcare facilities, and insufficient infrastructure, which hinder both human development and economic growth. For instance, many border villages face infrastructural deficits such as unpaved roads and unreliable electricity, limiting access to education and curbing local economic opportunities. The research also highlights the fragmentation of legal and policy frameworks, which often prioritize national security and macroeconomic goals over local needs, exacerbating socio-economic inequalities. Inadequate security measures further undermine regional stability, facilitating transnational crimes such as human trafficking and illegal trade. The study emphasizes the interconnectedness of education, infrastructure, security, and economic development, underscoring how deficiencies in one area adversely affect the others. This paper offers novel insights into border governance, proposing an integrated policy approach that aligns legal, economic, and educational objectives to foster sustainable development, enhance security, and promote regional cooperation. The findings provide valuable implications for policymakers seeking to improve governance in border regions facing similar socio-political challenges.

Abstract

Halal tourism, characterized by the provision of services and facilities that align with Islamic principles, such as halal cuisine, prayer facilities, and environments free of non-halal activities, has become a pertinent issue in business practices. This paradigm is increasingly gaining prominence in Indonesia, which is home to the world's largest Muslim population. In response to this development, the present research aims to investigate the impact of Islamic facilities, perceptions of pricing, and digital marketing strategies on tourists' travel decisions to West Bandung Regency. The collected data are subsequently synthesized into a central discussion of the potential of the halal tourism industry in this region. The findings indicate that Islamic facilities, price perception, and digital marketing efforts collectively exert a significant influence on tourists' decision-making processes in West Bandung Regency, as evidenced by an R² of 0.713. This implies that approximately 71.3% of the variance in tourist decisions can be attributed to these three variables. The results underscore the notion that tourists' choices are shaped through a complex interplay of spirituality, economic rationality, and the effectiveness of digital communication strategies. Consequently, integrating these three elements offers a comprehensive conceptual framework conducive to the development of sustainable halal tourism, representing a synthesis of Sharia-compliant values, consumer satisfaction, and responsiveness to the evolving dynamics of global tourism.
