Abstract

Uang panai digunakan sebagai simbol penghargaan dan kehormatan terhadap pihak perempuan dalam sistem perkawinan adat masyarakat Bugis-Makassar. Namun, nilai uang panai telah berubah dari simbol moral menjadi ukuran status sosial, yang menimbulkan tekanan ekonomi. Tujuan dari penelitian ini adalah untuk melihat bagaimana besarnya uang panai berhubungan dengan frekuensi terjadinya silariang, atau kawin lari, dan bagaimana hal itu berdampak pada keputusan yang dibuat oleh pasangan muda dan perspektif masyarakat tentang fenomena tersebut. Hasil penelitian menunjukkan hubungan signifikan antara tingginya uang panai dan meningkatnya kasus silariang, seperti yang ditunjukkan oleh studi literatur yang dilakukan dengan pendekatan kualitatif deskriptif. Sebagian pasangan muda memilih silariang sebagai bentuk perlawanan terhadap sistem adat yang tidak seimbang secara ekonomi karena tuntutan uang panai yang berlebihan. Pandangan yang berbeda dari masyarakat mencerminkan perubahan nilai budaya. Di sisi lain, dari sudut pandang Islam, meminta terlalu banyak bertentangan dengan keadilan dan kesederhanaan

Abstract

Introduction: The Complete Systematic Land Registration (PTSL) Program is a national policy aimed at providing legal certainty over land ownership. In Samarinda City, the program’s implementation is vital due to the number of unregistered land parcels and structural, social, and legal obstacles.Purposes of the Research: This study aims to evaluate the implementation of PTSL in Samarinda by assessing its achievements, identifying key challenges, and analyzing its impact on society and regional development.Methods of the Research: This research uses a qualitative descriptive method, with data collected through observation, interviews, and documentation.Results Main Findings of the Research: Findings show that PTSL has made significant progress, with 87% of land parcels registered. This success is supported by local policies such as BPHTB reduction, task force formation, and door-to-door services. However, challenges remain, including overlapping ownership, limited human resources, inheritance disputes, and low public legal literacy. Mitigation efforts include local paralegal training, adjudication mediation, and digital monitoring via the KitaBPN app. The study concludes that PTSL in Samarinda is generally effective and positively contributes to asset legalization and regional economic growth.

Abstract

The study aims to analyze the comparison of the implementation of agricultural law in different countries. The discussion of land is important in the context of the development of a country because land is a valuable asset and a source of life for the people. Nonetheless, the implementation of agricultural law often faces challenges that are obstacles to achieving agricultural governance effectively and fairly. This study employs a comparative research method. We collect the data from a variety of relevant sources, including legislation, policies, and related literature. We carried out the analysis to compare the differences and similarities in the implementation of agricultural law on land in the countries involved in the case studies. We expect the results of this research to provide a deeper understanding of the implementation of agricultural law on land in various contexts and countries. This study will also discuss the importance of adapting agricultural laws to the needs and socio-economic realities of local communities. The research aims to guide policymakers in crafting and executing more equitable and effective agricultural policies for farm management.

Abstract

This article examines the effectiveness of land redistribution implementation in Indonesia's agrarian reform program. The land redistribution program is part of the government's efforts to achieve equitable land ownership and improve farmers' welfare. This study aims to evaluate the success of the land redistribution program, identify the challenges faced in its implementation, and provide strategic recommendations to enhance the program's effectiveness. The research uses a qualitative method with a case study approach in several regions that focus on land redistribution. Data were collected through in-depth interviews with farmers, government officials, and agrarian experts, as well as field observations and document studies. The findings indicate that while there are some successes in land redistribution, numerous obstacles hinder the program's effectiveness, including complex bureaucracy, agrarian conflicts, and lack of infrastructure support. This article also offers recommendations to overcome these challenges and improve the effectiveness of the land redistribution program in the future.
