Abstract

This study aims to analyze the urgency of implementing the victimology paradigm in the Indonesian correctional system, particularly in the context of protecting the rights of victims of crime. To date, the correctional system has focused more on the development of prisoners as perpetrators, while the role and position of victims tend to be neglected. This is despite the fact that Law Number 22 of 2022 concerning Corrections mandates the principle of protecting victims' rights. Using normative legal research methods and a legislative approach, this study examines legal doctrine, theory, and regulations related to victimology and correctional services. The results show that integrating victimology into the correctional system not only fulfills formal legal aspects but is also crucial for achieving substantive justice goals. The concept of restorative justice serves as an important bridge to integrate the interests of victims, perpetrators, and society. Therefore, this study recommends the need for philosophical and legal reconstruction of the correctional system to be more responsive to the needs of victims, making corrections not merely a place of development but also a forum for recovery and justice for all parties.

Abstract

This legal research aims to determine the juridical analysis of polyandry marriages in terms of Law Number 1 of 1974 concerning Marriage. This research is a juridical-normative legal research. The research approach used is a statutory approach. The types of legal materials used are primary legal materials and secondary legal materials. The data collection technique used is a literature study technique. Furthermore, using data processing techniques that are deductive and analyzed using content analysis. The results showed that polyandry marriages are part of polygamy just like polygyny, but polyandry marriages are prohibited in Indonesia, while polygynous marriages are permitted under certain conditions. However, even so, polyandry marriages also still occur, although very rarely, which is caused by several factors, namely economic factors, distance factors and the unfulfilled inner living, age factors, lack of family harmony, lack of faith and weak understanding of religion as social control. and cultural factors. Based on a juridical analysis of Law Number 1 of 1974 concerning Marriage, it is not found any article that regulates permission for women or wives to have more than one husband or permission to do polyandry. The practice of polyandry is prohibited in Indonesia because it can have several impacts, namely the impact on offspring and the impact on the parties.

Abstract

This study examines the legal accountability and consumer protection frameworks in Indonesia concerning the widespread health crisis caused by the consumption of contaminated paracetamol syrup, which led to cases of Atypical Progressive Acute Kidney Injury (AKI) in children. Using a normative juridical method, the research analyzes relevant statutory regulations, such as Law No. 8 of 1999 on Consumer Protection and Law No. 36 of 2009 on Health, alongside Islamic legal principles, particularly maslahah (public interest). The discussion focuses on the obligations of pharmaceutical companies and the regulatory role of the Indonesian Food and Drug Authority (BPOM) in ensuring the safety and quality of pharmaceutical products. Findings reveal that both the manufacturers and BPOM failed to fulfill their legal duties, leading to significant material and immaterial losses for affected consumers. From an Islamic legal perspective, the concept of maslahah underscores the moral and legal imperative to protect life and public welfare, supporting the need for stricter enforcement and accountability. The study concludes that a more robust legal and ethical framework is essential to protect children as vulnerable consumers, and it advocates for an integration of national law and Islamic principles to ensure justice, transparency, and the prevention of similar incidents in the future.

Abstract

Civil trials on the principle of ius curia novit and rechtsvinding become a breath of fresh air for justice seekers seeking their laws that fulfill the ideè des rechts (rechtssicherheit: legal certainty, zweckmässigkeit: expediency, and gerechtigkeit: justice). The principle of ius curia novit which means that the judge is considered to know the law becomes a space for judges in making legal discoveries (rechtsvinding). The implementation of laws by judges is not merely a matter of logic and proper use of the mind, but rather the provision of juridical forms rather than basing on juridical experience and judgment rather than basing on abstracts, because the law cannot be complete, only one stage in the process of forming a law that is forced to seek its completeness in the legal practice of the judge. The judge's wiggle room in fulfilling the sense of justice for justice seekers in the environment as the decision No. 374 / Pdt.G / LH / 2019 / PN.Jkt.Pst which granted the lawsuit of the plaintiffs (Advocacy Team of the Capital Movement (Initiative to Clean the Air of the Universe Coalition) based the findings of the judge's law, basing on Decision Number: 36 / KMA / SK / II / 2013 concerning the Enactment of guidelines for handling environmental cases. Keyword: ius curia novit, rechtsvinding, onrectmatigedaad, lawsuit, environment.

Abstract

This article aims to analyze legal protection for children as victims of moral crimes. This research uses a normative juridical research method with a type of approach, namely a statutory approach and a conceptual approach. The legal materials used are primary, secondary and tertiary legal materials, obtained by conducting literature studies. The research results show that the implementation of protection for children who are victims of violence is still not optimal. This is because victims' rights, such as the right to receive rehabilitation, compensation and restitution, make it difficult to manage the release of funds, because there is confusion from law enforcement officials regarding where the funds should be used from. A very fundamental obstacle to implementing the protection of children as witnesses and victims is that there are no funds provided to maximize the implementation of this protection. And in general, protection for child victims of immoral crimes can be carried out in 3 (three) ways, namely: (1) Punishing perpetrators of immoral crimes against children with heavy criminal sanctions so that the objectives of the punishment can be achieved based on the provisions of the Law (2) By provide compensation to child victims of immoral crimes by providing restitution charged to the perpetrator of the immoral crime. (3) By carrying out rehabilitation for child victims of immoral crimes.

Abstract

This study aims to determine how the implementing legal provisions and utilization of forest land conversion into plantations are oriented towards capitalism. This study uses a normative legal research method with the types of approaches, namely the legislative approach and the conceptual approach. The legal materials used are primary, secondary, and tertiary legal materials, obtained by conducting a literature study. The results of the study indicate that law enforcement against violations related to B3 waste still faces various significant obstacles. One of the main obstacles is the weak supervision by the responsible authorities, such as the Ministry of Environment and Forestry and related agencies at the regional level. Suboptimal supervision is often caused by limited human resources and technology that supports the monitoring process of companies or industries that produce B3 waste. This causes some violations to go undetected or not followed up properly. In addition, limited law enforcement facilities and infrastructure are also inhibiting factors. The lack of adequate laboratories to test waste samples, obsolete environmental quality monitoring equipment, and minimal budget to support supervision and investigation operations causes the effectiveness of law enforcement to be low. Law enforcers such as police, prosecutors, and judges who handle environmental cases often do not have sufficient knowledge or technical expertise about the impacts and characteristics of B3 waste, so that the case handling process does not run optimally.The sanctions given to perpetrators of pollution have also not provided a sufficient deterrent effect.

Abstract

Eigendom, derived from Dutch, means "ownership" and refers to the right to control and manage both tangible and intangible assets. In Western legal systems, eigendom is regulated by civil law, granting absolute ownership. In Indonesia, the Civil Code recognizes eigendom as the highest form of ownership, giving owners full freedom to enjoy and manage their assets while adhering to regulations. A clear understanding of eigendom is crucial for legal certainty in property transactions and maintaining economic and social stability. This study employs a normative legal approach to analyze eigendom regulations in Indonesia and compare them with ownership concepts in other countries. An empirical approach is also used through literature studies and interviews with legal practitioners, notaries, and land officials. The data were analyzed using content analysis and presented in comparative tables and diagrams. The study found that eigendom rights in the Civil Code provide strong ownership guarantees but face challenges, particularly in verifying and validating ownership documents, influenced by colonial-era legacies. Comparisons with legal systems in other countries highlight interpretative differences, indicating the need for stricter verification to prevent misuse of rights and illegitimate claims. Although eigendom ensures strong legal protection for property ownership, the study concludes that regulatory improvements are necessary to promote fairness and transparency. The combination of normative and empirical approaches offers a comprehensive view of eigendom rights and emphasizes the urgency of legal reforms for justice in modern property law in Indonesia

Abstract

Perjanjian perkawinan dapat menjadi strategi efektif dalam mengurangi potensi konflik harta benda dalam perkawinan. Dalam artikel ini, kita akan membahas pentingnya perjanjian perkawinan sebagai upaya meminimalisir konflik harta benda. Perjanjian perkawinan dapat memisahkan harta suami dan istri, mengatur bagaimana harta kekayaan akan dibagi jika terjadi perceraian, serta mengurangi konflik perebutan harta bersama. Dengan demikian, perjanjian perkawinan dapat membantu meminimalisir konflik harta benda dalam perkawinan dan memudahkan pengurusan utang dan harta masing-masing. Artikel ini juga akan membahas perlindungan hukum terhadap harta perkawinan dan putusan-putusan mahkamah yang relevan. Dengan demikian, artikel ini diharapkan dapat memberikan kontribusi pada upaya mengurangi konflik harta benda dalam perkawinan melalui perjanjian perkawinan.

Abstract

Perkawinan anak merupakan masalah serius di Indonesia dengan tingginya angka pernikahan di bawah umur, meskipun telah ada undang-undang yang mengatur batas usia perkawinan. Fenomena ini dipengaruhi oleh faktor-faktor seperti tradisi lokal, kemiskinan, dan kurangnya akses pendidikan. Penelitian ini bertujuan untuk mengidentifikasi faktor-faktor yang mendorong praktik perkawinan anak di Indonesia, mengeksplorasi dampak dari praktik tersebut terhadap hak-hak asasi manusia anak, dan merumuskan langkah-langkah strategis untuk mengurangi prevalensi perkawinan anak. Penelitian ini menggunakan pendekatan kualitatif dengan teknik analisis konten dan analisis tematik. Data diperoleh dari berbagai sumber, termasuk dokumen-dokumen hukum, wawancara dengan ahli, dan data statistik terkait. Praktik perkawinan anak di Indonesia didorong oleh tradisi lokal yang menganggap perkawinan dini sebagai cara untuk melindungi kehormatan keluarga dan mengatasi kemiskinan. Namun, praktik ini memiliki dampak negatif yang signifikan terhadap hak-hak anak, termasuk akses terhadap pendidikan dan kesehatan, risiko tinggi terhadap komplikasi kehamilan, kekerasan dalam rumah tangga, dan pembatasan dalam partisipasi pengambilan keputusan. Perkawinan anak merupakan pelanggaran terhadap hak-hak asasi manusia anak yang diatur baik dalam hukum internasional maupun nasional. Untuk mengatasi permasalahan ini, diperlukan pendekatan yang komprehensif melalui edukasi masyarakat, pemberdayaan ekonomi anak perempuan, peningkatan akses terhadap layanan kesehatan, penegakan hukum yang tegas, dan kolaborasi internasional. Langkah-langkah ini diharapkan dapat mengurangi prevalensi perkawinan anak di Indonesia dan melindungi anak-anak untuk tumbuh dan berkembang dalam lingkungan yang aman dan mendukung.

Abstract

Money laundering in the Indonesian banking sector has become a major issue affecting economic stability and national security. This article analyzes the implementation of Law No. 8 of 2010 concerning the Prevention and Eradication of Money Laundering, focusing on the challenges in identifying and handling illegal transactions amidst the complexity of the financial system. Through a qualitative method with a normative legal approach, this study reveals various weaknesses in the implementation of existing regulations. The results of the study indicate the need to update the legal framework to be more responsive and effective in dealing with the dynamics of money laundering. Recommendations put forward include strengthening cross-agency cooperation, utilizing advanced technology to detect suspicious transactions, and increasing education and training for stakeholders in the banking sector. This strategy is expected to not only strengthen domestic supervision but also encourage international collaboration to combat money laundering more broadly. The findings of this study emphasize the importance of adaptive regulatory updates and the use of technological innovation to create a more transparent and secure financial system. With these steps, it is hoped that Indonesia will be able to strengthen economic stability, increase public trust in the banking sector, and contribute to global efforts to eradicate financial crime.
