Abstract

Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisa tentang restorative justice sebagai solusi mengatasi overkapasitas lapas di Indonesia. Penelitian tentang Restorative Justice Sebagai Solusi Mengatasi Overkapasitas Lapas Di Indonesia terdapat Penelitian hukum yang relevan dengan masalah hukum yang diteliti dan mendasarkan analisisnya pada peraturan perundang-undangan yang relevan disebut yuridis normatif. Berdasarkan penelitian yang dilakukan, didapatkan hasil tingkatan restorative justice di Indonesia secara tegas diatur dalam berbagai peraturan perundang-undangan misalnya Undang-Undang Dasar Republik Indonesia Tahun 1945; Undang-Undang Nomor 48 Tahun 2009 Tentang Kekuasaan Kehakiman, Undang-Undang Nomor 14 Tahun 1985 sebagaimana telah diubah oleh UndangUndang Nomor 5 Tahun 2004 sebagaimana telah diubah terakhir dengan Undang-Undang Nomor 3 Tahun 2009 Tentang Mahkamah Agung. Sasaran akhir dari adanya teori peradilan restorative yakni agar lebih sedikit orang yang dipenjara; menghapus stigma atau cap dan merehabilitasi pelaku kejahatan menjadi manusia biasa; penjahat lebih mungkin untuk belajar dari kesalahan mereka dan menghindari membuat kesalahan yang sama lagi, mengurangi beban kerja polisi, jaksa, pusat penahanan, pengadilan dan penjara; Karena korban telah memaafkan pelaku dan segera diberi ganti rugi, menyimpan uang negara tidak menimbulkan keinginan untuk balas dendam; membantu masyarakat memerangi kejahatan dan mengintegrasikan kembali pelaku ke dalam masyarakat.

Abstract

This community service aims to provide knowledge and prevent the rise of online prostitution in Indonesia. Online prostitution is a problem that really threatens the younger generation and changes the culture of Indonesian society. Apart from having a bad effect on changing a good legal culture, online prostitution can become addictive for users. It takes good legal awareness to understand the damages caused by online prostitution. There are similarities between prostitution and drug cases. Both of these cases provide legal action for both drug dealers and their pimps. What makes the difference is that in narcotics cases, the user can be free from criminal law action with the condition that they are required to carry out the rehabilitation process until they recover from their addiction to the drug. As for prostitution cases, prostitutes and their service users are exempt from criminal acts with the condition that they "only" have to report to the police. In this case, there is a possibility that prostitution perpetrators will repeat their actions because they feel protected, as long as there are no regulations governing them.

Abstract

This article aims to analyze legal protection for children as victims of moral crimes. This research uses a normative juridical research method with a type of approach, namely a statutory approach and a conceptual approach. The legal materials used are primary, secondary and tertiary legal materials, obtained by conducting literature studies. The research results show that the implementation of protection for children who are victims of violence is still not optimal. This is because victims' rights, such as the right to receive rehabilitation, compensation and restitution, make it difficult to manage the release of funds, because there is confusion from law enforcement officials regarding where the funds should be used from. A very fundamental obstacle to implementing the protection of children as witnesses and victims is that there are no funds provided to maximize the implementation of this protection. And in general, protection for child victims of immoral crimes can be carried out in 3 (three) ways, namely: (1) Punishing perpetrators of immoral crimes against children with heavy criminal sanctions so that the objectives of the punishment can be achieved based on the provisions of the Law (2) By provide compensation to child victims of immoral crimes by providing restitution charged to the perpetrator of the immoral crime. (3) By carrying out rehabilitation for child victims of immoral crimes.

Abstract

This study aimed to determine ecological and social justice as the basis for protecting and preserving the marine environment in the Indonesian legal system. This research was empirical normative legal research. The subject of the study was the implementation of favourable legal provisions in every particular legal event that occurred in society to achieve the predetermined goals. If not careful in its application (still characterized by anthropocentrism), this political economy policy could conflict with the social ecology currently developing in Indonesia through the concept of a green economy and a blue economy. The characteristics of the socialism system in the political economy related to environmental justice after the amendment to the 45th Constitution began to shift in the era of globalization so that it began to respond to ecological modernization. However, due to colliding with the concept of socialism, the ecological justice system in the Indonesian legal system had the nuances of social-ecological justice. This concept would significantly affect the fairness of compensation for oil pollution by tanker accidents in Indonesia.

Abstract

Tujuan dilaksanakannya riset ini guna menganalisis cara hakim menjaga keseimbangan kepentingan antara pihak utama dan pihak ketiga dalam putusan perdata, khususnya dalam konteks perjanjian kawin. Metode penelitian yang diterapkan yakni pendekatan kualitatif. Data utama diperoleh dari dokumen putusan pengadilan dan analisis kasus serupa. Temuan penelitian menampikan bahwasanya hakim dalam putusan nomor 1371/Pdt.P/2023/PN Jkt.Brt mempertimbangkan dengan cermat ketentuan hukum yang berlaku, bukti-bukti yang diajukan, argument hukum, dan dampak social-ekonomi dari Keputusan tersebut.

Abstract

This study aims to determine how the implementing legal provisions and utilization of forest land conversion into plantations are oriented towards capitalism. This study uses a normative legal research method with the types of approaches, namely the legislative approach and the conceptual approach. The legal materials used are primary, secondary, and tertiary legal materials, obtained by conducting a literature study. The results of the study indicate that law enforcement against violations related to B3 waste still faces various significant obstacles. One of the main obstacles is the weak supervision by the responsible authorities, such as the Ministry of Environment and Forestry and related agencies at the regional level. Suboptimal supervision is often caused by limited human resources and technology that supports the monitoring process of companies or industries that produce B3 waste. This causes some violations to go undetected or not followed up properly. In addition, limited law enforcement facilities and infrastructure are also inhibiting factors. The lack of adequate laboratories to test waste samples, obsolete environmental quality monitoring equipment, and minimal budget to support supervision and investigation operations causes the effectiveness of law enforcement to be low. Law enforcers such as police, prosecutors, and judges who handle environmental cases often do not have sufficient knowledge or technical expertise about the impacts and characteristics of B3 waste, so that the case handling process does not run optimally.The sanctions given to perpetrators of pollution have also not provided a sufficient deterrent effect.

Abstract

Civil trials on the principle of ius curia novit and rechtsvinding become a breath of fresh air for justice seekers seeking their laws that fulfill the ideè des rechts (rechtssicherheit: legal certainty, zweckmässigkeit: expediency, and gerechtigkeit: justice). The principle of ius curia novit which means that the judge is considered to know the law becomes a space for judges in making legal discoveries (rechtsvinding). The implementation of laws by judges is not merely a matter of logic and proper use of the mind, but rather the provision of juridical forms rather than basing on juridical experience and judgment rather than basing on abstracts, because the law cannot be complete, only one stage in the process of forming a law that is forced to seek its completeness in the legal practice of the judge. The judge's wiggle room in fulfilling the sense of justice for justice seekers in the environment as the decision No. 374 / Pdt.G / LH / 2019 / PN.Jkt.Pst which granted the lawsuit of the plaintiffs (Advocacy Team of the Capital Movement (Initiative to Clean the Air of the Universe Coalition) based the findings of the judge's law, basing on Decision Number: 36 / KMA / SK / II / 2013 concerning the Enactment of guidelines for handling environmental cases. Keyword: ius curia novit, rechtsvinding, onrectmatigedaad, lawsuit, environment.

Abstract

Perkawinan merupakan ikatan lahir dan batin antara seorang pria dan seorang wanita sebagai suami istri dengan tujuan membentuk keluarga atau rumah tangga yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Tujuan perkawinan amatlah mulia karena itu suami dan istri perlu saling membantu dan melengkapi agar masing-masing dapat mengembangkan kepribadiannya membantu dan mencapai kesejateraan spirituil dan materiil. Dalam penelitian ini menitikberatkan pada hak hadlanah terhadap anak yang belum mumayyiz atau belum cukup umur, biasanya hak tersebut jatuh kepada ibunya tetapi dalam penelitian ini hak tersebut jatuh pada ayahnya. Tentu saja ada beberapa alasan yang menjadikan hak tersebut jatuh kepada ayahnya dengan syarat si ayah mampu membuktikan bahwa si ibu tidak bertanggung jawab sehingga diberikan kepada ayahnya. Tujuan penelitian ini adalah untuk mengetahui alasan hak hadlanah diberikan kepada ayahnya bukan kepada ibunya. Penulis menggunakan pendekatan yuridis normatif; Spesifikasi penelitian bersifat deskriptif. Data yang digunakan dalam penelitian ini meliputi data primer dan data sekunder. Data primer diperoleh melalui wawancara kepada ayah dan ibu dari anak tersebut. Data sekunder berupa KUHPerdata; buku karya para ahli, makalah penelitian, jurnal ilmiah, internet, kamus hukum. Penyajian data dalam bentuk deskripsi disusun secara sistematis. Data dianalisis secara kualitatif.

Abstract

Pawn is one of the property rights obtained by a person who receives the goods—who provides credit—on a movable and tangible item that is handed over to him by a person who is in debt or by another person on his behalf. Pawning is a common phenomenon in many countries, especially in Indonesia. The regulations related to pawn are determined in the Civil Code, especially in Article 1150 of the Civil Code, and are further regulated in various additional articles in the Civil Code. Pawn requires the existence of two or more parties who are related to each other and agree to make a binding agreement with a certain period of time to receive and provide guarantees to an entity in return for a certain amount of money or other goods, which must then be returned in accordance with the agreement that has been made along with the surplus value that may arise as a result of added value or interest. This is an obligation that must be fulfilled by the party who owes, but the party who provides the credit also has a handful of obligations that must be fulfilled as a form of accountability for the pawned goods that are received and maintained for a certain period of time, for example, maintaining the pawned goods from potential damage or carrying out maintenance so that the pawned goods function properly. However, the party who provides the credit has the right to receive compensation or a refund of the maintenance costs incurred to maintain the pawned goods; this is regulated in Article 1157, Paragraph 2, of the Civil Code, which is a guarantee for every entity that provides credit to obtain its rights or compensation from efforts to "rescue" the pawned goods.

Abstract

The Covid-19 pandemic had a significant impact on the decline in the national and global economy. The third quarter of 2020 is an important and challenging momentum to restore the national economy. This legal counseling aims to provide understanding to students, parents, teachers, the elderly, people with disabilities and all other levels of society who act as implementers of Micro, Small and Medium Enterprises in the Alian District, Kebumen Regency, so as to gain an understanding of strengthening Micro, Small and Medium Enterprises as a driver of economic recovery. It is hoped that the community can participate in developing and maintaining what is good and realize that goodness in daily life wholeheartedly, becoming a habit that is continuously practiced and carried out every day. Hopefully people can get ease of understanding Micro, Small and Medium Enterprises implementers in Alian District, Kebumen Regency.
