Abstract

Permasalahan dalam penelitian ini adalah bagaimana kebijakan hukum bisnis mengatur jaminan dalam transaksi online dan bagaimana efektivitas penerapannya dalam memberikan kepastian hukum bagi para pelaku usaha. Penelitian ini bertujuan untuk menganalisis regulasi hukum bisnis yang mengatur jaminan dalam transaksi online serta mengkaji kendala dan solusi penerapannya di era digital. Metode penelitian yang digunakan adalah metode yuridis normatif dengan pendekatan kualitatif. Teknik pengumpulan data dilakukan melalui studi kepustakaan, dokumentasi terhadap peraturan perundang-undangan, serta analisis terhadap kasus-kasus relevan. Teknik analisis data dilakukan secara deskriptif analitis terhadap norma hukum yang berlaku. Hasil penelitian menunjukkan bahwa kebijakan hukum bisnis di Indonesia belum sepenuhnya adaptif terhadap dinamika transaksi online, khususnya dalam hal pembuktian jaminan, validitas dokumen digital, dan mekanisme penyelesaian sengketa.

Abstract

Di era digital yang ditandai dengan kemajuan teknologi informasi dan komunikasi, kewirausahaan digital telah menjadi pendorong utama pertumbuhan ekonomi global. Penelitian ini bertujuan untuk menganalisis peran hukum bisnis dalam mendorong kewirausahaan di era digital, serta mengidentifikasi tantangan yang dihadapi oleh wirausahawan dalam mematuhi regulasi hukum. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan studi literatur, yang mencakup analisis berbagai sumber, termasuk buku, artikel jurnal, dan dokumen hukum. Hasil penelitian menunjukkan bahwa hukum bisnis memberikan kepastian hukum, perlindungan hak kekayaan intelektual, dan regulasi yang jelas mengenai transaksi online, yang semuanya penting untuk menciptakan lingkungan yang kondusif bagi inovasi. Namun, tantangan seperti kompleksitas regulasi, perubahan regulasi yang cepat, dan kurangnya pengetahuan hukum masih menjadi hambatan bagi wirausahawan. Penelitian ini merekomendasikan peningkatan edukasi dan pelatihan hukum, simplifikasi regulasi, dukungan hukum yang terjangkau, pengembangan kebijakan yang responsif, dan perlindungan data yang efektif sebagai langkah-langkah untuk mendukung kewirausahaan di era digital. Dengan demikian, hukum bisnis tidak hanya berfungsi sebagai pengatur, tetapi juga sebagai pendorong pertumbuhan ekonomi yang berkelanjutan.

Abstract

Team innovation in microfinance institutions lies in the quality of human resources. The rapidly changing times that occur must be able to be anticipated with quality innovation. The quality of human resources can be seen from the ability of employees to share knowledge and behave innovatively and can be assessed from the team innovation that occurs in the institution or organization. The population of this research is employees who work in the microfinance industry with a population of 2100. A sample of 300 employees was taken using the proportional stratified random sampling method. The data collection technique is by distributing questionnaires to all respondents. The data analysis method used is SEM (Structural Equation Modeling), with the Smart PLS program. This team's innovation concept will provide insight and guidance for employees to be able to increase the competitiveness and existence of Microfinance Institutions now and in the future.

Abstract

The literature on 360-degree feedback performance appraisal systems has attracted considerable attention by showing a link between behavior change and individual performance. This study aimed to analyze the strengths, weaknesses, opportunities, and threats to the 360-degree feedback performance appraisal system for Civil Servants in the City Government of Medan. To determine the participants in this study, it was calculated using the formula, Slovin. The data was collected through observations, interviews, and literature studies. Data analysis used qualitative descriptive analysis. The data results would be used to determine the strengths, weaknesses, opportunities, and threats to the implementation of the Civil Servants' 360-degree feedback performance assessment system in the City Government of Medan. The strategy of implementing a 360-degree feedback performance appraisal system as a performance assessment system for Civil Servants in the City Government of Medan was creating a joint commitment to support a fair and objective performance appraisal system, implement a 360-degree feedback performance appraisal system as an effective performance appraisal system for Civil Servants in the City Government of Medan, involving the participation of many parties to formulate assessment instruments, involving the participation of several parties at each interconnected level to act as an assessment team, improving the competence of human resources in conducting the appraisal process, establishing performance appraisal instruments that reflect aspects of actual attitudes, behaviors, morals, skills, and work outcomes, creating stages and performance appraisal standards, and using information and communication technology (ICT) in the delivery of appraisal instruments.
