Abstract

Perbuatan penambangan tanpa izin pada hakekatnya telah memenuhi unsur yang dapat diancam dengan hukum pidana sebagaimana diatur dalam ketentuan Pasal 158 Undang-undang Nomor 4 Tahun 2009 Tentang Pertambangan Mineral dan Batubara. Permasalahan dalam penelitian adalah bagaimana pertanggungjawaban pidana pelaku usaha yang melakukan usaha penambangan tanpa IUP, IPR, atau IUPK dalam studi kasus putusan nomor 556/Pid.Sus/2019/PN Bls. Metode penelitian yang digunakan adalah metode analisis yang dilakukan untuk mengumpulkan data dengan cara studi kepustakaan. Jenis penelitian termasuk penelitian yuridis normative. Bahan hukum penelitian diperoleh secara normative kualitatif. Berdasarkan fakta-fakta hukum yang terungkap bahwa Zekkeri Saputra yang melakukan tindak pidana penambangan tanpa izin usaha dapat dimintakan pertanggungjawaban pidana karena telah memenuhi syarat untuk dapat dimintakan pertanggungjawaban pidana. Oleh karena itu, Majelis Hakim menjatuhkan hukuman kepada terdakwa Zekkeri Saputra dengan pidana penjara selama 2 (dua) tahun dan 4 (empat) bulan dan denda sebesar Rp. 2.000.000.000 Subsidair 1 (satu) bulan kurungan.Bahwa terdakwa memenuhi syarat untuk dapat dimintakan pertanggungjawaban pidana maka Hakim dalam menjatuhkan pidana terhadap pelaku tindak pidana penambangan tanpa izin harus mempertimbangkan faktor-faktor yang meringankan dan memberatkan sehingga pidana yang dijatuhkan sesuai dengan perbuatan pidana terdakwa.

Abstract

Peran panitera pengganti dalan penyelesaian sengketa perdata pada Pengadilan Negeri Lubuk Pakam Kelas IA sangat menentukan dalam proses persidangan untuk membuat sebuah putusan yang berkualitas guna memenuhi rasa keadilan bagi para pihak yang terlibat. Peran panitera pengganti dalam penyelesaian sengketa perdata pada PN Lubuk Pakam adalah bertugas untuk melakukan persiapan sidang sebelum sidang, waktu sidang dan atau sidang sedang berlangsung dan setelah persidangan dan pasca sidang, membantu Hakim dalam persidangan, mencatat jalannya persidangan kemudian menuangkannya dalam berita acara sidang. Selain dari pada itu Panitera juga sebagai pelaksana administratif dan memiliki peran yang tak tergantikan. Namun, masih sering terjadi kebingungan mengenai kewenangan mereka, yang berpotensi menimbulkan masalah seperti tertunda dan ketidakpuasan terhadap sistem hukum. Penelitian ini bertujuan untuk menganalisis peran dan kinerja panitera pengganti dalam proses penyelesaian sengketa di Pengadilan Negeri Lubuk Pakam. Sebagai bagian dari struktur organisasi peradilan, panitera pengganti memiliki tanggung jawab penting dalam membantu hakim dalam proses administrasi peradilan, termasuk penyusunan berita acara persidangan dan pencatatan jalannya sidang. Kinerja panitera pengganti sangat berpengaruh terhadap efisiensi dan akurasi penyelesaian sengketa. Penelitian ini menggunakan metode deskriptif kualitatif dengan teknik wawancara dan observasi untuk mengumpulkan data dari panitera pengganti, hakim, dan pihak terkait lainnya. Hasil penelitian menunjukkan bahwa kinerja panitera pengganti berperan signifikan dalam mempercepat proses penyelesaian sengketa dan memastikan kelancaran administrasi peradilan.

Abstract

Di era yang semakin maju, persaingan dalam dunia bisnis semakin ketat. Dengan banyaknya platform belanja online, terbuka peluang bisnis baru seperti layanan titip beli barang secara online. Layanan ini memungkinkan seseorang untuk membeli barang di toko atau pusat perbelanjaan sesuai dengan permintaan konsumen. Layanan ini mencakup barang lokal maupun impor. Sebagai perantara antara penjual dan pembeli, penyedia layanan bertanggung jawab sebagai pembeli bagi kliennya. Pelaku usaha mempromosikan barang mereka melalui platform seperti Instagram, Facebook, WhatsApp, dan Twitter. Transaksi jual beli online sering dianggap sebagai perdagangan yang dilakukan melalui internet. Pertumbuhan transaksi online didorong oleh meningkatnya produktivitas industri yang menawarkan berbagai produk melalui media internet, memicu maraknya usaha jual beli online karena lebih mudah dijalankan, membutuhkan modal yang relatif kecil, dan tidak memerlukan sistem manajemen yang rumit. Namun, dalam praktiknya, terjadi ketidakseimbangan, seperti meningkatnya pelanggaran terhadap perlindungan konsumen. Berdasarkan Pasal 19 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, pelaku usaha wajib memberikan kompensasi atas kerugian yang diderita konsumen.

Abstract

Participation (deelneming) is a concept that includes various forms of participation from individuals or groups, both in mental and physical aspects, who are involved in carrying out certain actions that lead to the occurrence of a criminal offense. This study aims to analyze the punishment of perpetrators of participation (deelneming) in the crime of mistreatment of children, with a focus on Decision Number 4/Pid.Sus-Anak/2023/PN Jkt.Sel. The method used is a normative juridical approach, which examines the application of law and the theory of participation in the context of juvenile criminal law. The results showed that AG, as a child involved in the act, had fulfilled the elements of the crime of aggravated maltreatment that was premeditated, although he did not directly commit physical acts. The judge's consideration in handing down the verdict reflected attention to the age of the perpetrator as well as the principle of rehabilitation in the juvenile justice system. The prison sentence of 3 years and 6 months in LPKA reflects efforts to provide a deterrent effect as well as rehabilitation. This research recommends an increased understanding among law enforcers of the theory of inclusion and legal protection for children so that it can be applied fairly and effectively.

Abstract

The purpose of this research includes the regulation of citizen residence permits in Indonesia based on the Law on Immigration and how sanctions for citizens who violate residency permits in Indonesia or commonly referred to as Overstay The research used by researchers is a type of normative juridical research (legal research), namely using the source of legal materials in the form of legislation, decisions / court provisions, legal theory, approaches from books related to legal issues that are examined. Violations committed in the form of exceeding the deadline for residence permits (overstay), are subject to deportation as a special measure of immigration, legal sanctions against citizens who do not have a residence permit through administrative measures and criminal sanctions, subject to 5 years in prison, a fine of 500 million for those who fake visas / residence permits with the intention of being used in / out of Indonesia. 6 Year 2011 on Immigration, In its implementation, immigration control is a shared responsibility between immigration officials and the public, with the investigation of immigration crimes carried out by Immigration Servant Investigators (PPNS) in coordination with the Indonesian National Police.

Abstract

The application of the principle of ultimum remedy under the legal age of children who commit crimes is an effort to protect the health of children and ensure a more humane approach in the criminal system. This shows that after alternative forms of education, such as diversification and restorative justice, have been discussed, child care or education should be the last option. The purpose of this study is to analyze the mechanisms underlying the application of as ultimum remedy as well as the legal procedures applied to children who deviate and act like criminals. The method used in this study is normative juridical regarding laws, cases, and conceptual. The results of the study indicate that the implementation of as ultimum remedy still faces many challenges, such as a lack of understanding of the legal system, lack of rehabilitation facilities, and lack of attention to diversion of implementation. In addition, older children have a higher sensitivity to criminal acts, therefore a more comprehensive approach is needed in handling them. The principle of ultimum remedy can be integrated into child protection practices by complying with a set of rules that encourage cooperative conflict resolution. This study recommends training of law enforcement officers, improving rehabilitation facilities, and integrating legal education to create a more humane child protection system that focuses on child safety.

Abstract

The criminal act of livestock theft causes material losses and impacts the social and economic lives of farmers. Livestock theft is driven by environmental factors, lack of legal awareness, economic conditions, opportunities, and other social factors. This study aims to analyze the enforcement of the law applicable in handling cases of livestock theft committed by members of the Indonesian National Armed Forces (TNI) and to determine the sanctions imposed on TNI members involved in livestock theft to provide punishment and assess its implications for the image of the TNI. The research method used is a normative legal approach, which involves an in-depth examination of the issue by collecting library data and analyzing it to draw conclusions. The data analysis applied is descriptive analysis to interpret qualitative data, where the researcher uses materials such as legislation, court decisions, journals, and books. The findings of this study reveal that the criminal act of theft committed collectively by TNI members is regulated under Article 363 paragraph (1) 1 in conjunction with Article 55 paragraph (1) of the Indonesian Criminal Code (KUHP) and Article 126 of the Military Penal Code (KUHPM). The Military Court has the authority to try TNI members who commit criminal acts based on Article 9 of Law No. 31 of 1997, taking into account violations of military honor under Article 126 of the Military Penal Code, which relates to its implications for the image of the TNI.

Abstract

The application of restorative justice in resolving minor crimes is increasingly receiving attention in Indonesia as a more humane alternative to the traditional criminal justice system. Resolving minor crimes using a restorative justice approach can be carried out if the conditions are met, such as the perpetrator admitting his actions and showing deep regret, and the victim or his family is willing to forgive. Apart from that, the community also supports deliberation, especially if the act is classified as a minor crime. If these conditions are met, law enforcement officials such as the police can use a restorative justice approach through mediation during the investigation process. The research method used is qualitative with a normative approach where the purpose of this research is to create balance in society. The use of traditional institutions in various regions also greatly supports the implementation of restorative justice, because this model is considered to be in accordance with the values of justice that have long been recognized and implemented in Indonesian society. Thus, restorative justice can be a more inclusive and just solution in resolving minor crimes in Indonesia.

Abstract

Illegal cigarette smuggling is an illegal act that results in a loss of state revenue and creates unfair economic competition. Therefore, to prevent this practice, the government has imposed an excise policy. However, in reality, this effort has not been able to fully suppress the smuggling of illegal cigarettes. This is proven by the prevalence of smuggling cases, even though the perpetrators have been subject to criminal sanctions. This research examines two main problems on how the juridical review of the sanctions implementation related to the purpose of punishment for perpetrators of the illegal cigarette smuggling crime in Decision No. 213/Pid.B/2023/PN Pms, and the judge's strategy in imposing a decision in order to create legal certainty and justice. This is a normative legal research where the results indicate that the implementation of criminal sanctions of a one year and six months prison sentence for the illegal cigarette smugglers in the case is still relatively light and has not provided a deterrent effect, both for the perpetrators and the wider community. Therefore, it is necessary to impose heavier criminal sanctions as a form of legal liability for the perpetrators. In addition, judges in making decisions must consider juridical and non-juridical aspects. It does not only focus on juridical aspects, but also needs to consider non-juridical factors in order to prevent errors and manipulation in the examination of cases and the implementation of sanctions against defendants.

Abstract

Gambling, traditionally viewed as a crime, has evolved with the internet, leading to significant social issues, including addiction and financial distress among participants. This research addresses the growing concern of online gambling, particularly on the Invincible Elephant platform, which has become increasingly accessible due to technological advancements. This research focuses on the legal implications and criminal liability of individuals engaging in online gambling activities, as highlighted in Decision No. 1681/Pid.Sus/2024/PN MDN. The rise in online gambling has raised questions on the adequacy of existing laws and the effectiveness of enforcement measures against such activities. This research aims to analyze the criminal liability of online gamblers on the Invincible Elephant platform and to understand the judicial considerations in imposing sanctions on these individuals based on the aforementioned legal decision. This research employs a normative legal methodology, utilizing secondary data that includes primary legal materials, such as the relevant decision and laws, as well as secondary sources like books and journals related to online gambling. The analysis is descriptive, aiming to provide a clear depiction of the issues surrounding online gambling crimes. Findings indicate that online gambling not only poses a risk to individual players, but also contributes to broader societal problems, including increased crime rates and social disruption. It is revealed that the legal framework surrounding online gambling is still evolving, necessitating further regulatory measures to address the challenges posed by this modern form of gambling.
