Abstract

The growth of Fintech Peer-to-Peer (P2P) lending in Indonesia is one of the supports for national economic development. The positive growth of this financial sector is not supported by proportional rules, resulting in the practices of business ethics violation which is detrimental to society. To overcome these problems, the spirit of Islam can be the basis for determining ethical and business measures into a better legal framework for Fintech P2P Lending. This article applies a normative legal research method using a conceptual approach and legislation relevant to the theme of the study. The research results indicate that Fintech P2P Lending in Indonesia needs to be regulated in a qualified legal framework because the existing rules have not been able to solve unethical actions of businessmen. The business concept in Islam also accommodates ethical issues that must be applied in business activities as a harmless commerce spirit. This Islamic spirit can be used as a source of material law in determining a clear legal framework to uphold Fintech P2P Lending business ethics so as not to harm the Indonesian people.Pertumbuhan fintech peer-to-peer (P2P) lending di Indonesia merupakan salah satu penunjang pembangunan ekonomi nasional. Pertumbuhan positif sektor keuangan ini tidak diikuti dengan aturan yang proporsional sehingga menimbulkan praktik-praktik yang melanggar etika bisnis dan sangat merugikan masyarakat. Untuk mengatasi permasalahan tersebut, semangat Islam dapat menjadi landasan untuk menentukan langkah-langkah etis dan bisnis ke dalam kerangka hukum fintech P2P lending yang lebih baik. Artikel ini menggunakan metode penelitian hukum normatif dengan menggunakan pendekatan konseptual dan peraturan perundang-undangan yang relevan dengan tema penelitian. Hasil penelitian dalam artikel ini menunjukkan bahwa fintech P2P Lending di Indonesia perlu diatur dalam kerangka hukum yang mumpuni karena aturan yang ada belum mampu mengatasi tindakan tidak etis dari para pelaku bisnis. Konsep bisnis dalam Islam juga mengakomodir persoalan etika yang harus diterapkan dalam kegiatan bisnis sebagai spirit perdagangan yang tidak merugikan. Semangat keislaman ini dapat dijadikan sebagai sumber hukum materil dalam menentukan kerangka hukum yang jelas untuk menegakkan etika bisnis fintech P2P lending agar tidak merugikan masyarakat Indonesia.

Abstract

Illegal fintech is one of the main issues not fully addressed in the digital finance sector in Indonesia despite various legal regulations. This condition shows that the fintech legal framework in Indonesia still needs to be entirely relevant to the concept of Regulatory Technology (regtech). This study aims to analyze the position of the fintech legal framework in Indonesia in overcoming illegal fintech with a regtech approach chosen as an analytical instrument—a basic concept that combines law and digital financial technology to create an orderly platform and comply with all applicable laws. This article uses normative-legal research methods and a conceptual approach, indicating that the legal framework governing fintech in Indonesia fragments, with rules spreading across the civil, administrative, and criminal sectors. This legal framework still needs to be reinforced as a legal tool to overcome the problem. Based on the regtech approach, increased transparency and accountability in fintech implementation are essential as legal support for dynamic supervision and law enforcement and to allow for wider access to cooperation between stakeholders in handling illegal fintech. Such measures will help create a more effective legal environment and align with the regtech paradigm in addressing illegal fintech practices in Indonesia. Fintech ilegal merupakan salah satu isu utama yang belum sepenuhnya tertangani di sektor keuangan digital di Indonesia, meskipun telah diterbitkan berbagai peraturan hukum. Kondisi ini menunjukkan bahwa kerangka hukum fintech di Indonesia memerlukan evaluasi berdasarkan paradigma Regulatory Technology (RegTech). Penelitian ini bertujuan untuk menganalisis posisi kerangka hukum fintech di Indonesia dalam mengatasi permasalahan fintech ilegal dengan pendekatan RegTech. RegTech dipilih sebagai instrumen analisis karena merupakan konsep dasar yang menggabungkan hukum dan teknologi keuangan digital untuk menciptakan platform yang tertib dan mematuhi semua hukum yang berlaku. Penulisan artikel ini menggunakan metode penelitian hukum normatif dengan pendekatan konseptual. Hasil penelitian menunjukkan bahwa kerangka hukum yang mengatur fintech di Indonesia masih terfragmentasi dengan aturan yang tersebar di sektor perdata, administrasi, dan pidana. Kerangka hukum ini masih perlu diperkuat sebagai alat hukum untuk mengatasi masalah fintech ilegal. Berdasarkan pendekatan RegTech, diperlukan peningkatan transparansi dan akuntabilitas dalam implementasi fintech, sebagai dukungan hukum atas pengawasan dan penegakan hukum yang dinamis serta dukungan hukum untuk membuka saluran kerja sama antar pemangku kepentingan dalam penanganan fintech ilegal. Langkah-langkah tersebut akan membantu menciptakan lingkungan hukum yang lebih efektif dan selaras dengan paradigma RegTech dalam menangani praktik fintech ilegal di Indonesia.

Abstract

Green sukuk is a contemporary-era sharia investment revolution that accommodates environmental aspects. Integrating Sustainable Financing in green sukuk can be an alternative investment platform contributing to sustainable development. The concept paradigm is relevant for strengthening the proportional construction of green sukuk law in Indonesia. The study aimed to analyze the concept of sustainable financing as the legal basis for implementing green sukuk in supporting sustainable development programs in Indonesia. The study used normative legal research methods. This research approach used a conceptual approach through reasoning the concepts of sustainable financing, green sukuk, and other concepts relevant to the topic of study to strengthen the discussion argument. The study showed that there are 2 (two) components of the relevance of the Sustainable Financing paradigm as the basis for implementing green sukuk in Indonesia. First, the implementation of green sukuk in various countries has rules that accommodate sustainable financing in response to climate change problems. Second, the sustainable financing Paradigm is relevant as a source of green sukuk legal construction to strengthen the policy basis for implementing environmentally sound investment in Indonesia. The urgency of the regulation is to increase investment commitments that can increase environmental resilience, alleviation of social problems and business transparency in contributing to sustainable development in Indonesia.

Abstract

The green constitution concept in the Indonesian Constitution is the legal fundamental basis for environmental protection in implementing the national economy through public participation. The rationale for "public participation" as part of the rights of the International Covenant on Civil and Political Rights needs to be examined in Government Regulation instead of Law No. 2 of 2023 concerning Job Creation, passed into a legal act. This writing aims to analyze the components of public participation rights that the job creation act can potentially reduce, especially the provisions on the Environmental Impact Assessment (EIA) in enforcing the green constitution. This research is conducted based on normative legal research methods with statutory and conceptual approaches. The results of this research show that the rules for involving the community in preparing the EIA in the Job Creation Act differ from the green constitution principles in 2 (two) aspects. First, the limitation on community involvement in the Job Creation Act is potentially unconstitutional with the essence of the green constitution and the 1945 Constitution, which guarantees the right of public participation in the environmental field. Second, in the green constitution, the urgency of aspirations for public participation can become a consideration for making more transparent decisions in implementing an economy based on sustainable development. Restrictions on community involvement reduce the concept of a green constitution and potentially reduce the transparency in the granting of business permits in Indonesia which cannot mitigate the risk of environmental losses due to economic exploitation.

Abstract

Social commerce (S-Commerce) comes from the disruption of business digitalizationthat explores social media. When s-commerce was developing, Indonesia bannedthe platform because it was considered to kill local businesses and capitalize onthe market. The decision can potentially contradict economic democracy in oneof the provisions of Article 33, paragraph (4) of the 1945 Constitution, whichopens up technological space for developing the national economy. The purposeof writing this article is to deconstruct economic democracy on commercial lawon social media as a Government policy that prohibits S-Commerce. The writingarticle uses normative legal research methods with statutory, legal comparison, andconceptual approaches. There are two research results in this article. First, at a timewhen significant nations are embracing technology at a rapid pace to boost theirbusinesses, the government’s decision to outlaw s-commerce has negatively impactedthe nation. Based on the doctrine of digitalization, economic law is not appropriate ifit has to ban S-Commerce. The business paradigm of the contemporary era must beintegrated with technology to compete with the development of the digital economy inthe global realm. Second, based on economic democracy in Article 33, paragraph (4)of the 1945 Constitution, S-Commerce manifests a national economy balanced withtechnological progress by the constitution’s mandate. S-Commerce law provisionsneed to be deconstructed using the principles of economic democracy. So, reasonablelegislative parameters may promote the growth of the digital economy while notjeopardizing the local economy.

Abstract

The Constitutional Court's Decision Number 84/PUU-XXI/2023 against Law No. 28 of 2014 emphasizes that Social Media platforms based on User Generated Content are prohibited from being apathetic to copyright infringement on their platforms. However, the Constitutional Court's decision still leaves a legal void in efforts to crack down on social media copyright infringement that is relevant to the copyright protection paradigm. This legal vacuum can cause social media only to act repressively and contradict the copyright protection paradigm, which should include moral and economic aspects to fulfill creators' rights. The article's purpose is to analyze the strengthening of copyright licensing policies. The normative law research method is used as a medium for analyzing issues. The writing approach in this article uses conceptual,  comparative, and statute approaches. The study results show that there needs to be a legal construction as the basis for platform licensing policies that are useful for creating proportional interpolation of copyright protection on social media. The platform's active participation greatly protects creators' natural rights from the threat of piracy. According to Personality Theory, creators have moral rights that must be protected to obtain channels of economic rights that can be fulfilled. Implementing this policy is expected to create a more responsible digital ecosystem, provide legal certainty for copyright owners, and ensure fair rewards for their creativity.

Abstract

Abstract: This project aims to enhance the promotion and branding of Candi Badut through artificial intelligence (AI) within the framework of religious moderation. As a cultural heritage site rich in history and religious significance, Candi Badut holds great potential as a prime tourist destination. By integrating AI, the program develops digital strategies to broaden promotional reach and enrich visitor experiences. The initiative also includes digital literacy training for the local community and collaboration with the Malang Regency Tourism Office. Results show that effective use of digital technology supports religious moderation and cultural preservation. Recommendations include digital platforms for tourist information, community training, and collaboration with religious groups to foster sustainable, culture-based tourism. AI integration ultimately strengthens Candi Badut’s image as a harmonious, heritage-preserving destination.Keywords: Artificial intelligence, Candi Badut, religious moderation, digital promotion, digital literacy, cultural preservation.Abstrak: Pengabdian Kepada Masyarakat ini bertujuan untuk meningkatkan promosi dan branding Candi Badut melalui teknologi kecerdasan buatan (AI) dalam kerangka moderasi beragama. Sebagai situs warisan budaya yang kaya akan sejarah dan nilai keagamaan, Candi Badut memiliki potensi besar sebagai destinasi wisata utama. Dengan mengintegrasikan AI, program ini mengembangkan strategi digital untuk memperluas jangkauan promosi dan memperkaya pengalaman pengunjung. Inisiatif ini juga mencakup pelatihan literasi digital bagi masyarakat lokal serta kolaborasi dengan Dinas Pariwisata Kabupaten Malang. Hasil menunjukkan bahwa pemanfaatan teknologi digital yang efektif mendukung moderasi beragama dan pelestarian budaya. Rekomendasi meliputi pengembangan platform digital untuk informasi wisata, pelatihan masyarakat, dan kolaborasi dengan kelompok keagamaan guna mendorong pariwisata berbasis budaya yang berkelanjutan. Integrasi AI pada akhirnya memperkuat citra Candi Badut sebagai destinasi yang mendukung keharmonisan dan pelestarian warisan budaya. Abstract

Penelitian ini bertujuan untuk mengkaji tingkat kesadaran hukum pelaku usaha sound horeg di Kecamatan Gondanglegi dalam konteks penerapan Peraturan Daerah Kabupaten Malang Nomor 11 Tahun 2019 tentang Pengendalian Kebisingan Lingkungan. Sound horeg merupakan usaha penyewaan sound system dengan volume tinggi yang sering digunakan dalam acara karnaval, namun penggunaannya menimbulkan kebisingan berlebihan yang berdampak negatif pada masyarakat dan lingkungan sekitar. Hasil penelitian menunjukkan bahwa mayoritas pelaku usaha sound horeg memiliki kesadaran hukum yang rendah, ditandai dengan penolakan terhadap batas maksimal kebisingan 60 desibel dan kurangnya pemahaman mengenai perizinan serta sanksi yang berlaku. Faktor penyebab rendahnya kesadaran hukum antara lain adalah keterbatasan sosialisasi dan edukasi dari pemerintah, tingkat pendidikan yang rendah, budaya usaha yang sudah terbentuk, faktor ekonomi yang mendorong pelaku usaha mengabaikan aturan demi kelangsungan bisnis, serta pengawasan dan penegakan hukum yang belum optimal. Dampak dari rendahnya kesadaran hukum ini meliputi gangguan ketertiban umum, masalah kesehatan masyarakat, dan potensi konflik sosial antara pelaku usaha dan warga sekitar. Penelitian merekomendasikan peningkatan sosialisasi dan edukasi hukum, penguatan pengawasan dan penegakan hukum secara konsisten, serta kolaborasi antara pemerintah aparat kepolisian, pelaku usaha, dan masyarakat. Pendekatan yang menggabungkan penegakan hukum dengan pembinaan dan pemberian insentif diharapkan dapat meningkatkan kesadaran dan kepatuhan hukum pelaku usaha sound horeg secara berkelanjutan, sehingga tercipta lingkungan usaha yang tertib dan harmonis di Kecamatan Gondanglegi

Abstract

Problematika mahasiswa yang mengalami banyak penolakan judul skripsi perlu direspon melalui kebijakan yang transformatif. Pendekatan Total Quality Management dapat menjadi ukuran untuk menciptakan kebijakan untuk mengatasi problematika mahasiswa yang telah diidentifikasi tersebut. Penelitian ini bertujuan untuk menjelajahi dan menganalisis transformasi kebijakan pengesahan judul skripsi berbasis (TQM) di Program Studi Hukum Ekonomi Syariah, Fakultas Syariah, UIN Maulana Malik Ibrahim Malang. Metode penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan studi konseptual. Hasil penelitian menunjukkan bahwa implementasi TQM dalam kebijakan pengesahan judul skripsi dapat memberikan kontribusi positif terhadap peningkatan kualitas akademis. Agar kebijakan pengesahan skema skripsi Prodi HES dapat menjadi kebijakan yang transformatif, dapat memperhatikan 4 (empat) indikator TQM yang terdiri dari (1) fokus pada pelanggan, (2) keterlibatan para pihak, (3) pengukuran komitmen, dan (4) Perbaikan berkelanjutan yang dapat diintegrasikan kedalam kebijakan. Penerapan TQM dalam kebijakan diharapkan dapat menciptakan kebijakan yang dapat mengatasi problematika mahasiswa yang mengalami banyak penolakan skripsi. Implikasi dari penelitian ini dapat memberikan panduan kebijakan untuk membimbing mahasiswa dalam menyiapkan rencana penelitian yang layak sebagai tugas akhir dalam masa akhir perkuliahan.

Abstract

Sharia Financial Technology in Indonesia is regulated in OJK Regulation No. 10/POJK.05/2022 Concerning Information Technology-Based Joint Funding Services. According to researchers, enacting these regulations still needs improvement because they are disproportionate to the basic rules for implementing Sharia Fintech in Indonesia. A Fiqh Muamalah study needs to be conducted to reconstruct these rules into proportional rules. This research uses normative legal research methods. This research uses a statutory regulatory approach related to Fintech and DSN MUI Fatwa, as well as the Fiqh Muamalah conceptual approach. The results show that based on the Fiqh Muamalah indicator, OJK Regulation No. 10/POJK.05/2022 still needs to be in harmony with Fiqh Muamalah. The OJK Regulations have no concrete rules regarding what contracts can be used for Sharia Fintech schemes.  Abstrak:Financial Technology Syariah di Indonesia saat ini diatur dalam Peraturan OJK No. 10/POJK.05/2022 Tentang Layanan Pendanaan Bersama Berbasis Teknologi Informasi. Keberlakuan Peraturan tersebut masih perlu di perbaiki karena tidak proporsional sebagai aturan dasar penyelenggaraan. Perlu ada kajian Fikih Muamalah untuk Merekonstruksi aturan tersebut menjadi aturan yang proporsional. Penelitian ini menggunakan metode penelitian hukum normatif. Pendekatan penelitian menggunakan Pendekatan Peraturan Perundang-undangan yang terkait dengan Fintech dan Fatwa DSN MUI, serta pendekatan Konseptual Fikih Muamalah. Hasil Penelitian menunjukkan, berdasarkan indikator Fikih Muamalah, Peraturan OJK No. 10/POJK.05/2022 masih tidak harmonis dengan Fikih Muamalah. Dalam Peraturan OJK tidak ada aturan konkret mengenai akad apa yang dapat digunakan untuk skema Fintech Syariah.
