Abstract

Perlindungan data pribadi merupakan aspek krusial dalam era digital yang ditandai oleh pesatnya pertukaran informasi melalui teknologi. Pemerintah indonesia telah mengesahkan regulasi yang mengatur perlindungan data pribadi, seperti undang-undang no. 27 tahun 2022, namun dalam implementasinya masih ditemukan berbagai kendala yang menghambat efektivitas perlindungan tersebut. Penelitian ini bertujuan untuk mengidentifikasi dan menganalisis kendala-kendala yang dihadapi dalam pelaksanaan perlindungan data pribadi, baik dari sisi regulasi, kelembagaan, teknis, maupun kesadaran masyarakat. Metode yang digunakan adalah pendekatan kualitatif dengan studi pustaka dan kajian liteartur sebagai teknik pengumpulan data. Hasil penelitian menunjukkan bahwa masih lemahnya infrastruktur pengawasan, ketidaksiapan pelaku usaha, serta minimnya literasi digital masyarakat menjadi hambatan utama dalam mewujudkan sistem perlindungan data pribadi yang efektif. Temuan ini diharapkan dapat menjadi masukan bagi para pemangku kebijakan, sektor swasta, dan masyarakat untuk meningkatkan komitmen dan koordinasi dalam penerapan perlindungan data pribadi. Diperlukan sinergi antara penegakan hukum, edukasi publik, dan penguatan kelembagaan agar pelaksanaan perlindungan data pribadi dapat berjalan optimal dan mampu menjamin hak privasi warga negara.

Abstract

Hugo, one of the trademarks under Hugo Boss, is often the target of violations in the form of registering trademarks that are essentially similar to the Directorate General of Intellectual Property Rights, which is considered unfair business competition, because it can harm the owner of the original trademark, mislead consumers, and damage the reputation of the brand that has been built. This study examines the analysis of the famous Hugo trademark dispute from the perspective of legal protection in Indonesia, which is the object of the dispute in decision Number 10 PK / Pdt.Sus-HKI / 2023.The focus of the research is an analysis of the legal basis underlying the protection of famous trademarks in Indonesia and a review of legal considerations by the panel of judges in the trial process in 3 (three) stages, namely the first decision, cassation, and judicial review. The research method used in this study is the normative legal research method by examining court decisions and laws and regulations as primary legal materials. Books, documents, journals, and scientific works as secondary legal materials. As well as official and trusted publications as tertiary legal materials. The analysis technique applied in this study is a qualitative method through literature studies. The results of the research and analysis obtained are that the Plaintiff as the owner of the HUGO BOSS brand is the first registrant and user of the HUGO BOSS brand and variations of HUGO and/or BOSS based on the first to file system, so that the Plaintiff is the legal owner of the HUGO BOSS brand and is also a well-known brand according to the evidence of its registration in various countries. The registration of the HUGO brand owned by the Defendant is considered to be in bad faith because its brand is essentially similar to the Plaintiff's brand.

Abstract

Kegiatan Pengabdian kepada Masyarakat sangat bermanfaat bagi masyarakat, dalam hal ini masyarakat Desa Betimus Mbaru, Kecamatan Sibolangit, Kabupaten Deli Serdang Propinsi Sumatera Utara. Penyuluhan hukum mengenai sertifikat tanah dan penyelesaian sengketa tanah yang dilakukan di Sibolangit, memberi motivasi dan menambah wawasan tentang Hukum Tanah/Agraria yaitu hak-hak atas tanah penting dibuktikan dengan surat tanah/sertifikat sebagai bukti yang memiliki kekuatan hukum. Tanah mempunyai nilai ekonomis, semakin banyak kebutuhan akan tanah maka semakin tinggi nilai tanah, tidak terhindar akibatnya semakin bertambah konflik tanah. Disamping permasalahan hukum atas hak-hak warga Desa Betimus Mbaru berkaitan dengan hak atas tanah. Upaya penyelesaian masalah hukum mengenai hak milik atas tanah dapat dilakukan di luar pengadilan yaitu musyawarah adat, atau diselesaikan di pengadilan dengan mengajukan gugatan. Metode penelitian yang diterapkan untuk memecahkan masalah sertifikat tanah sebagai alas hak dan bukti kepemilikan tanah melalui penelitian yuridis normatif empiris, dengan data pustaka dan didukung dengan tanya jawab dalam penyuluhan hukum yang disampaikan di Sibolangit kepada Masyarakat Desa Betimus Mbaru. Pentingnya bukti kepemilikan hak atas tanah sebagai alas hak warga masyarakat Desa Betimus Mbaru, sehingga dapat ditindaklanjuti melalui kegiatan penyuluhan hukum selanjutnya akan membahas pengurusan sertifikat tanah pada Badan Pertanahan Nasional (BPN).

Abstract

Child exploitation within Child Social Welfare Institutions (Lembaga Kesejahteraan Sosial Anak or LKSA) remains a significant concern that undermines the fulfillment of children's fundamental rights, particularly in relation to access to education, health care, proper care, and protection. This study aims to examine the role of legal frameworks in preventing and addressing exploitative practices within LKSAs, focusing on the extent to which these institutions ensure the fulfillment of children's basic needs in accordance with national welfare standards. Employing a qualitative research design with a case study approach, the study was conducted in several LKSAs in Medan, North Sumatra. Data collection methods included in-depth interviews with key stakeholders, analysis of relevant legal and institutional documents, and direct field observations. The results show that there are still practices of child exploitation in several LKSA, including forced labor and misuse of foster child status for economic interests. Other important findings include weak supervision by government agencies, limited coordination between agencies, and a lack of understanding by LKSA managers of children's rights. On the other hand, the role of the police as law enforcers is considered reactive and not optimal in preventing and prosecuting cases of child exploitation in LKSA. The main obstacles faced by POLRI include limited resources, lack of specialized training, and the absence of strong synergy between the police and other child protection agencies. Hence, the research emphasizes that although the legal framework is in place through various laws and regulations, its implementation is still not effective.

Abstract

Hukum dan penegakan hukum yang baik, adil, dan bermanfaat merupakan impian dan harapan suatu bangsa. Keresahan masyarakat terhadap kondisi penegakan hukum di Indonesia semakin merendahkan dan menjatuhkan wibawa aparat penegak hukum. Sistem peradilan pidana diciptakan dalam rangka untuk mewujudkan hukum dan penegakan hukum yang baik, adil dan bermanfaat, bukan untuk sarana pelanggaran dan kejahatan baru. Jenis penelitian normatif ini menyimpulkan bahwa elemen-elemen dalam kerangka sistem peradilan pidana yakni subtansi hukum, struktur hukum, dan budaya hukum, saling mempengaruhi satu sama lain untuk mencapai keberhasilan penegakan hukum sekaligus menjadi faktor penting dan utama. Aparatur penegak hukum tanpa memiliki pandangan yang sama dalam mencapai tujuan hukum, niscaya penegakan hukum tidak membawa arti yang bermanfaat dan adil. Regulasi yang mendukung proses terselenggaranya penegakan hukum tidak berarti apa-apa, jika tidak didukung dengan aparat penegeak hukum yang baik dan profesional, serta budaya hukum yang positif. Diharapkan agar ketiga elemen ini dapat dijalankan dengan konsisten, komitmen dan motivasi yang kuat oleh aparat penegak hukum dan semua stakeholder untuk mencapai tujuan hukum dan keberhasilan penegakan hukum di Indonesia

Abstract

The purpose of this study is to analyze the effectiveness of legal norms in Law No. 28 of 2014 concerning Copyright and Government Regulation No. 56 of 2021 concerning the Management of Song and/or Music Royalties in guaranteeing the protection of the economic and moral rights of songwriters in the context of live performances, through a case study of Decision No. 92/Pdt.Sus-HKI/Cipta/2024/PN Niaga Jkt.Pst. The method used is normative juridical with a statutory approach, case approach, and conceptual approach which are analyzed qualitatively. The novelty of this study lies in the reconstruction of dual legal liability between performers (singers) and event organizers, as well as the application of Hans Kelsen's theory regarding the separation between legal norms (the should) and reality (being) in music copyright disputes. The results of the study show that there is still an imbalance between regulation and practice; industry players often ignore licensing mechanisms and royalty payments through the National Collective Management Agency (LMKN), and do not include the names of creators or make changes to works without permission. Although the judge in the case granted part of the lawsuit, the recognition of direct licensing practices outside the collective mechanism indicates a regulatory loophole and potential legal uncertainty. In conclusion, the effectiveness of positive law in copyright protection in Indonesia has not yet been fully achieved. Therefore, policy reforms are needed to integrate direct licensing mechanisms into the official legal framework, strengthen the role of the LMKN, and enforce stricter sanctions against moral rights violations, so that legal norms truly become a substantive protection instrument for creators.

Abstract

Unemployment is one of the serious and complex economic problems, which affects the welfare of individuals and the social stability of a country. To overcome this challenge, governments often implement various policies aimed at reducing unemployment rates. These policies can be divided into three main categories: macroeconomic policies, labor market policies, and training and education policies. Based on these things, this paper is conducted to determine the impacts arising from the effects of unemployment, and to determine government policies in overcoming unemployment. This paper is carried out by collecting materials using library research methods and tracing various sources of literature on policies taken by the government. While the results obtained in this paper are the impacts arising from the effects of unemployment on individuals, namely financial difficulties, stress and mental health problems, decreased self-confidence and decreased skills; on society, namely increased inequality, decreased quality of life; on the economy, namely decreased consumption, decreased tax revenues, increased social and health costs, and government policies in overcoming unemployment in various fields including fiscal and monetary policies, increasing foreign investment, investment promotion, trade and industrial policies, developing SMEs, developing the tourism sector and indigenous Indonesian culture, providing guarantees for workers whose employment is terminated (PHK), employment policies.

Abstract

This research aims to determine the responsibility of banking institutions and the government in terms of legal protection for customers who use mobile banking services. Empirical normative research methods were used by the author in this research. This means evaluating the implementation of normative legal provisions (legislation) and is linked to field data obtained from interviews with subjects relevant to the research problem. The research data collection method is carried out through field studies (field research) and library research, namely conducting research by studying in the library through reading references in the form of books, articles and legal journals as well as through the results of interviews which are then used as material to produce conclusions that answer research problems. However, the data analysis used is qualitative data analysis, which means collecting, analyzing and interpreting primary and secondary data that is arranged systematically, clearly and in detail. Next, legal thinking logic is used to analyze this data. The research results show that the responsibility of banks and government institutions for losses experienced by customers should ideally be linked to proof that the losses originate from errors or negligence by the customer or the bank.

Abstract

The purpose of this writing is to find out the legal consequences carried out by Notaries who are signing the deeds virtually in the Covid-19 pandemic situation and to find out the urgency of changes that occur regarding authentic deeds that virtually will obtain certainty, benefit and legal protection not only for notaries but also for the community. The results of the research and analysis in this writing are that electronic signatures have actually been regulated in Indonesia in Law Number 19 of 2016 concerning Information and Electronic Transactions. It's just that virtual signing of deeds using electronics has not yet obtained a strong legal basis in Indonesia. Legal certainty also cannot be achieved because there are still conflicting provisions in Law Number 2 of 2014 concerning the Office of a Notary. During the Covid-19 pandemic, many professions were able to carry out their duties by utilizing electronics but notaries were excluded because there were no specific rules that clearly regulated it and there were various legal consequences which resulted in uncertainty, injustice and no legal protection for notaries. Therefore, changes to laws and regulations or legal products are needed in order to achieve legal synchronization and harmonization. The government needs to increase the role of the notary in accordance with the times and regulate the legal force and data authenticity as well as the power of electronic deeds in proof which have been an obstacle so far.

Abstract

Sustainable development has become a significant global agenda in an effort to maintain a balance between economic growth, environmental protection and social welfare. Indonesia, as a country with a large population and natural and cultural diversity, faces complex challenges in achieving sustainable development goals. This research aims to analyze sustainable development goals in Indonesia, identify the challenges faced, and formulate policy recommendations to advance the implementation of sustainable development. The government's steps for efficiency and effectiveness, the formation of regulations and support for strengthening state institutions in government governance, are presented in this research using descriptive analysis methods with a qualitative approach. Data was obtained through literature reviews, analysis of government policies and laws and regulations regarding sustainable development in Indonesia. It is hoped that the results of this research will reveal that sustainable development goals in Indonesia include aspects such as: (1) inclusive and sustainable economic growth; (2) sustainable management of natural resources; (3) social empowerment and community welfare; (4) environmental protection and climate change mitigation; and (5) strengthening governance and community participation. However, the implementation of these goals is faced with challenges such as socio-economic disparities, environmental degradation, lack of coordination between sectors, and climate change, so that government steps or policies as part of implementing sustainable development are in line with the SDGs.
