Abstract

Indonesia's economic landscape has been significantly impacted by the COVID-19 pandemic, both at micro and macro levels. To address these challenges, it is imperative to implement optimal and sustainable financial management strategies. Given Indonesia's predominantly Muslim population, the development of an Islamic financial system, including the use of Zakat as a distribution instrument, holds great potential. As an obligation for Muslims, Zakat can be a highly productive means of addressing the country's economic challenges.     This study proposes a model for economic empowerment through productive Zakat to effectively address the impact of the COVID-19 pandemic on the Indonesian economy. The research methodology utilized a library research approach with descriptive qualitative methods. Data was meticulously collected from various sources including books, articles, journals, news, homepages, and other scientific references. The management of productive Zakat has great potential for contributing to the economic recovery of Indonesia after the COVID-19 pandemic. Productive Zakat involves an economic empowerment model that has personal and spiritual dimensions, and its impact on social life is significant. The management of productive Zakat is a support system for the better and sustainable development of Indonesia's economy.

Abstract

Abstrak: Pada dasarnya perkawinan beda agama dapat menjadi konflik sosial yang disebabkan akibat perbedaan keyakinan, nilai-nilai, serta praktik agama antara pasangan. Konflik semacam ini dapat terjadi dalam berbagai bentuk, mulai dari tingkat individu hingga tingkat sosial yang lebih luas. Tujuan penelitian ini ialah untuk mengetahui implementasi hukum perkawinan beda agama di Indonesia, pengaruh perkawinan beda agama dalam keluarga, serta perkawinan beda agama yang ditinjau dalam perspektif hukum Islam. Mengenai metode yang digunakan dalam penelitian ini adalah library research yakni melakukan analisis terhadap undang-undang dan regulasi terkait perkawinan beda agama di Indonesia. Hasil dari penelitian ini menunjukan bahwa perkawinan berbeda agama membawa akibat hukum terhadap agama yang dianut kedua pasangan. Oleh karena itu, setiap agama tidak dapat membenarkan perkawinan yang berlangsung jika tidak seagama. Sementara itu, dampak yang timbul dari perkawinan beda agama memiliki implikasi yang signifikan dan jangka panjang. Dampak ini mencakup aspek keagamaan dan psikologis, baik terhadap pasangan dengan keyakinan yang berbeda, maupun dampak terhadap anak-anak dalam aspek tumbuh kembang serta perkara administratif. Sementara itu, dalam hukum Islam perkawinan beda agama dinyatakan tidak sah, karena dikhawatirkan menghilangkan tujuan pernikahan itu sendiri, yakni membentuk keluarga yang harmonis, damai dan saling menguatkan keimanan. Selain itu, perkawikan berbeda agama juga menimbulkan risiko mengorbankan atau mengubah keyakikannya untuk mempertahankan keharmonisan dalam berumah tangga.

Abstract

This study aims to analyze the fulfillment of the rights of children with special needs (ABK) from the perspectives of positive law and Islamic law, as well as to identify the challenges encountered in its implementation. The research uses a normative juridical approach with a descriptive-analytical method, combining the analysis of laws and regulations, legal theory, and the concept of Sharia. Data collection techniques include literature study, observation, and interviews with relevant parties. The results show that both positive law and Islamic law emphasize the importance of protection and fulfillment of ABK rights, including rights to education, health, and non-discriminatory treatment. However, significant challenges are found in implementation, such as social stigma, lack of facilities, and low public awareness. Other obstacles include limited government budget allocation and inadequate infrastructure in various regions. This study recommends improving public education, fostering synergy among stakeholders, and providing inclusive facilities to ensure the optimal fulfillment of ABK rights.

Abstract

Artikel ini bertujuan untuk menganalisis Pasal 80 Undang-Undang Nomor 8 Tahun 1995 tentang Pasar Modal sebagai dasar penentuan standar pertanggungjawaban Konsultan Hukum Pasar Modal dalam hal terjadinya kerugian investor yang disebabkan oleh informasi yang menyesatkan atau tidak akurat dalam prospektus pada proses penawaran umum perdana (Initial Public Offering/IPO). Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif. Teknik analisis yang digunakan meliputi interpretasi sistematis dan sinkronisasi horizontal norma. Hasil penelitian menunjukkan bahwa standar pertanggungjawaban Konsultan Hukum Pasar Modal di Indonesia berdasarkan Pasal 80 Undang-Undang Pasar Modal bersifat fault-based liability, yang bergantung pada pengungkapan fakta material dalam prospektus serta mengandung prinsip tanggung jawab renteng. Selain itu, rezim ini masih menempatkan beban pembuktian yang lebih berat pada investor dibandingkan dengan mekanisme pembalikan beban pembuktian ganda (double reversal burden of proof) di Belanda maupun kewajiban asuransi tanggung jawab profesional di Singapura. Oleh karena itu, Indonesia dapat mempertimbangkan penerapan prinsip strict liability, khususnya pada tahap awal pemeriksaan perkara. Pendekatan ini berpotensi memperkuat akses terhadap keadilan serta meningkatkan efektivitas perlindungan investor dalam sengketa pasar modal. Namun demikian, implementasinya harus didukung oleh pengaturan yang tegas dalam peraturan perundang-undangan guna menjamin kepastian hukum dan menyediakan landasan normatif yang jelas.

Abstract

This study aims to analyze the effectiveness of restorative justice in reducing case accumulation within the Indonesian National Police (POLRI), identify challenges in its implementation, and propose solutions for its integration into the legal system. Restorative justice, as regulated in National Police Chief Regulation Number 8 of 2021, seeks to resolve conflicts between violators, victims, and the community while alleviating the burden on courts and correctional institutions. This research employs an analytical descriptive method with an empirical juridical approach, collecting data through observations, interviews, and document studies. The findings indicate that while restorative justice offers a potential solution to case backlog issues, its implementation remains hindered by procedural complexity, limited expertise among police personnel, and the absence of a dedicated legal framework regulating its execution. Additionally, the misalignment between restorative justice within the police force and other law enforcement agencies further complicates its effectiveness. The study concludes that overcoming these challenges requires enhancing human resource capacity within the police, fostering public awareness of restorative justice principles, providing specialized training for investigators, and advocating for the establishment of a Criminal Procedure Code that formally regulates restorative justice mechanisms to ensure consistency and alignment across all legal institutions.

Abstract

This study aims to examine Indonesia’s Suspension of Debt Payment Obligations (PKPU) through the Islamic legal concept of taʿassur (financial distress), focusing on the operation of the current framework as a genuine distress-based restructuring mechanism or creditor-driven outcomes. Even though existing studies have analyzed PKPU from doctrinal and procedural perspectives, limited attention has been given to the evaluation through an integrated Islamic insolvency framework, particularly in relation to debtor capacity and proportionality. A normative juridical method is adopted with statutory, conceptual, and comparative approaches. Furthermore, legislation, selected commercial court decisions, and classical Islamic jurisprudence are analyzed using qualitative doctrinal reasoning. The results show that the absence of a substantive financial-distress test and limited judicial scrutiny permit creditor-initiated PKPU proceedings to contribute to inefficient liquidation, even though Article 222(1) sets out basic eligibility requirements. Insolvency mechanisms should incorporate proportionality, feasibility, and debtor-capacity assessment by applying taʿassur as a normative evaluative framework. This study contributes to insolvency law theory by operationalizing Islamic jurisprudential principles into modern restructuring standards and offers policy implications, including the need for distress-based entry criteria, enhanced judicial oversight, and proportionality-based evaluation of creditor decisions, to support a more balanced and sustainable regime in Indonesia.
