Abstract

This article aims at conducting washiyyah institution as an alternative for distribution of inheritance as the verses of inheritance in Qur’an using the word washiyyah. It means that  washiyyah  has  important  position  in  the  distribution  of  inheritance  beside  wârits institution. It is important for Muslim to use washiyyah institution replacing wârits one in the distribution of inheritance when he sees that the shares the Islamic law of inheritance system issues defy aginst principle of justice, the ultimate principle of Islamic teachings. Washiyyah institution consisting of specific justice for specific family is to be preferred than wârits institution consisting general one for general Muslim ummah. Artikel  ini  bertujuan  untuk  mengkaji  lembaga  washiyyah  sebagai  alternatif  pembagian kewarisan sebagaimana terminologi washiyyah dalam ayat-ayat Qur’an. Ini berarti bahwa washiyyah mempunyai posisi penting dalam pembagian warisan disamping lembaga wârits itu  sendiri.   Adalah  penting  untuk  seorang  Muslim  menggunakan  lembaga  washiyyah menggantikan  wârits  dalam  pembagian  kewarisan  ketika  dia  melihat  bahwa  persoalan system  pembagian  wârits  hukum  Islam  bertentangan  dengan  prinsip  keadilan,  sebagai prinsip  pokok  dalam  ajaran  Islam.  Lembaga  washiyyah  memuat  keadilan  khusus  bagi keluarga tertentu yang perlu diprioritaskan dari pada lembaga wârits yang berlaku secara umum bagi umat muslim.

Abstract

Islamic principles regarding zakat in general are closely related to the issue of wealth which must be distributed to the needy and poor as well as groups that have been determined by Islamic law. This article aims to discuss the principles of charity in the distribution of inheritance by analyzing the views of ulama and intellectuals in Malang City, East Java. This study is socio-legal research using the theory of maqāṣid al-sharī'ah and social construction. Data was obtained from document study sources in the form of opinions of tafsir and fiqh scholars, journal articles and books related to the discussion. The informants interviewed were NU member, Muhammadiyah, MUI, and academics. The results of this study revealed that: first, based on the principles of justice and benefit, as the general elements of maqāṣid, in the inheritance verses, there is a command to set aside inherited property for the needy from the group of distant relatives, orphans, and the poor (al-Nisa: 8) and to help the heirs who are less able (al-Nisa: 9) as maqāṣid al-kulli. Second, based on social construction, at the externalization stage, the ulema and Muslim community in the city of Malang practice the Islamic charity by setting aside inherited property for the poor, the needy, and orphans in various forms such as slametanfor the deceased, endowments for orphanages, and donations to educational institutions, as well as giving some of the inherited property to their less fortunate relatives. Muslim community simultaneously objectifies the Islamic charity so that the Islamic charity becomes an objective reality in the city of Malang, although the Muhammadiyah community does not observe slametan. The internalization of the construction of Islamic charity as a final stage is understood by internalizing the verses of Islamic charity as the beliefs and teachings that must be implemented in society.

Abstract

Abdul Malik Karim Amrullah (Hamka) is widely recognized as a leading Muslim intellectual of 20th-century Indonesia, renowned for his extensive body of work, including both novels and Qur'anic exegesis. His tafsir has been the subject of considerable scholarly interest across Asia. The Qur'an contains numerous verses concerning the Jews, and as an exegete of the entire 30 juz of the Qur'an, Hamka offers a distinct interpretation of these verses. The 20th century was a period marked by significant global political upheaval, notably the establishment of Israel in 1948. The creation of the Israeli state had profound consequences for Muslims worldwide, intensifying anti-Jewish, anti-Zionist, and anti-Israel sentiments, which also permeated discourse in the United States and the United Kingdom. Within this context, several Islamic scholars began to integrate European concepts found in the "Protocols of the Elders of Zion," a document that portrays Jews as malevolent and conspiratorial figures. These ideas gradually infiltrated the field of Qur'anic exegesis, including Indonesian works, most prominently Hamka's Tafsir Al-Azhar, first published in 1965. Before this period, the "Protocols of the Elders of Zion" had not influenced Qur'anic interpretation. This paper seeks to critically analyze the theme of Jewish conspiracy in Hamka's tafsir by tracing the origins of his arguments, identifying the presence of conspiratorial elements in his exegesis, and examining the extent to which Hamka's views converge with those of Sayyid Qutb. The study employs a library-based literature review utilizing a descriptive-analytical and critical approach. The findings reveal that Hamka strongly adheres to the conspiracy theory espoused in the "Protocols of the Elders of Zion," depicting Jews as aiming to establish a new world order, dominate the global economy, and control Hollywood and the media. Moreover, Hamka's interpretations are significantly shaped by Sayyid Qutb's concepts of Jahiliyyah (ignorance) and Hakimiyyah (sovereignty).

Abstract

Abstract: The constitutional court's decision No. 46/PUU-VIII/2010 was passed in response to the judicial review submissions of Mochicha Mochtar and Iqbal Ramdan who felt that their constitutional rights were hindered by the law, namely article 43 paragraph (1) of the Law. No. 1 of 1974 on Marriage. Under the article, every children born out of wedlock does not have a civil law relationship with his father. The condition of children born out of wedlock can be analogous like a person who is exposed to sap without eating the fruit, meaning that the children born out of wedlock is not the actor of violations of legal action, but he is exposed to the burden of law for violations committed by both parents. Though every child is born without carrying the burden of sins committed by both parents and remains in a fitrah. The constitutional court's decision aims to uphold justice for the inheritance rights of children born out of wedlock who are considered hindered by one of marriage law articles in Indonesia. The purpose of this study is to analyze the principle of justice related to the civil rights of children born out of wedlock in Constitutional Court Decision No. 46 / PUU-VIII / 2010 perspective of legal justice Hans Kelsen and coherence with Sunni inheritance law. This research is normative-descriptive research with library research methods. The constitutional court's ruling has a coherence with the opinion of Abu Hasan Al-Mawardi who said an illegitimate child can be descended of a man as his father after a blood relationship can be proven. After being analyzed with the legal justice of Hans Kelsen, the Constitutional Court's verdict has contained the value of justice. So that parties who have interests related to the civil rights of children born out of wedlock must be obedient to the content of the ruling.Keywords: Inheritance of Children Born Out of Wedlock; Sunni Inheritance Law; Hans Kelsen's Legal Justice.       Abstrak: Putusan MK No. 46/PUU-VIII/2010 disahkan sebagai respon atas pengajuan judicial review Mochicha Mochtar dan Iqbal Ramdan yang merasa hak konstitusionalnya dihalangi oleh undang-undang yaitu Pasal 43 ayat (1) Undang-undang No. 1 Tahun 1974 tentang Perkawinan. Berdasarkan pasal tersebut setiap anak luar nikah tidak mempunyai hubungan keperdataan dengan ayahnya. Posisi anak dapat dianalogikan seperti orang yang terkena getah tanpa memakan buahnya, artinya anak yang terlahir di luar nikah bukan pelaku pelanggaran tindakan hukum, namun ia terkena beban hukum atas pelanggaran yang dilakukan kedua orang tuanya. Padahal setiap anak terlahir tanpa membawa beban dosa yang diperbuat oleh kedua orang tuanya dan tetap dalam keadaan fitrah. Putusan MK tersebut bertujuan menegakkan keadilan atas hak-hak keperdataan anak luar nikah yang dinilai terhalangi oleh salah satu pasal dalam undang-undang perkawinan di Indonesia. Adapun tujuan dari penelitian ini adalah menganalisi prinsip keadilan terkait hak waris anak luar nikah dalam Putusan MK No. 46/PUU-VIII/2010 perspektif keadilan hukum Hans Kelsen. Penelitian ini merupakan penelitian normatif-deskriptif dengan metode library research. Putusan MK tersebut mempunyai koherensi dengan pendapat Abu Hasan Al-Mawardi yang mengutarakan anak luar nikah dapat nasab dengan laki-laki sebagai ayahnya setelah hubungan darah dapat dibuktikan. Setelah dianalisis dengan keadilan hukum Hans Kelsen, Putusan MK tersebut telah memuat nilai keadilan. Sehingga pihak yang mempunyai kepentingan terkait hak keperdataan anak luar nikah harus bersikap patuh terhadap isi putusan tersebut.Kata Kunci: Waris Anak Luar Nikah; Hukum Waris Sunni; Keadilan Hukum Hans Kelsen.

Abstract

The Supreme Court has ruled that in contested divorce cases, women are entitled to receive nafkah iddah, mut'ah, and nafkah madhiyah, provided they do not act nusyuz. However, this provision is not being effectively implemented. This study examines the fulfilment of women's rights post-contested divorce in the Malang Regency Religious Court. The goal is to identify shortcomings in implementing these regulations and propose solutions for more effective enforcement. The research employs an empirical-juridical method, using secondary data from interviews and documentation with key personnel at the Malang District Religious Court. The qualitative analysis refers to Soekanto's theory. The Findings indicate that the fulfilment of women's rights in contested divorces at the Malang Regency Religious Court is ineffective. The law is clear and understandable, and officers, judges, and staff are accountable. Furthermore, the Malang District Religious Court provides sufficient infrastructure and support. However, the unmet factors—community awareness and cultural attitudes—pose significant barriers. Low legal awareness and compliance, coupled with cultural tendencies in Malang District to avoid legal processes and seek quick resolutions, hinder effective implementation. Addressing these issues is crucial for the regulations to achieve their intended impact on women's rights post-divorce.

Abstract

The distribution of joint property regulated under the Compilation of Islamic Law is considered very effective due to the legal certainty guaranteeing that ex-husbands and wives receive a half share. However, these provisions cannot be fully applied to estranged husbands and wives because family background conditions vary. There are certain conditions where husbands and wives have multiple roles, and this occurrence needs to be more profoundly studied. Therefore, this study is presented to analyze the distribution of joint assets according to the roles assigned in the household. This research employed a normative-legal method and statutory and conceptual approaches. The primary data in this study is the Compilation of Islamic Law (KHI). The researcher analyzed activity profiles, access and control between husband and wife as specified in KHI norms by using a gender equity analysis tool. The results show that the fair value of the distribution of joint assets which refers to the division of roles between husband and wife contained in the KHI has set different roles between the two, in which the husband works outside the house while the wife serves as a housewife. Meanwhile, currently, all roles performed by husbands can also be performed by wives and the other way around, while unchangeable roles remain in the biological or reproductive role. So the division of roles cannot be interpreted literally because the husband or wife has flexible and fair access and control. Keywords: joint property; gender equality; spouses rights.

Abstract

Anti-Semitism in M. Quraish Shihab's Interpretation of verses about Jews in Tafsir al-MisbahThis article aims to analyze more deeply the issue of anti-Semitism in the interpretation of the Qur'an Quraish Shibah. Seeing the growing movement of adherents of the Jewish religion in Indonesia and the emergence of a survey from the Wahid Foundation that Indonesian Muslims do not like Judaism, it is necessary to have an in-depth study regarding the interpretation of Indonesian figures towards Jewish verses in the Koran. Quraish Shihab apart from being an intellectual figure in Indonesia who has a complete commentary of 30 chapters, he is also one of Indonesia's political figures. Quraish Shihab's interpretation of Judaism needs to be explored to track and analyze more deeply whether there are elements of anti-Semitism in his interpretation, seeing that he is one of the intellectual and political figures of Indonesian Muslims. To reveal the interpretation of Quraish Shihab, the descriptive-analytical method is the guideline in this article. After carrying out the analysis, it was found that Tafsir al-Misbah still has a strong impression of anti-Semitism, although it does not apply equally to all adherents of the Jewish religion. Regarding the characteristics revealed by Quraish in describing the Jews, namely: often playing against each other, jealous, and often committing lies, and aspiring for Muslims to embrace Judaism

Abstract

Praktik pembagian waris “Bagi Rusa” di Desa Kemuja menuai perbedaan pendapat karena dianggap menggunakan praktik pemabagian waris yang blum ada legitimasi hukumnya. Penelitian ini bertujuan untuk mengetahui bagaimana tinjauan teori keadilan distributif Aristoteles terkait pembagian waris bagi rusa. Penelitian ini bersifat yuridis empiris dengan pendekatan kualitatif. Data primer diperoleh dalam penelitian ini diperoleh dari hasil wawancara dengan tokoh masyarakat dan juga masyarakat yang ada di Desa tersebut. Sedangkan data sekunder bersumber dari jurnal, buku, skripsi, dan karya ilmiah yang berkaitan dengan penelitian ini. Hasil penelitian menunjukkan bahwa praktik bagi rusa merupakan praktik pembagian hewan buruan yang dikonversi ke dalam praktik pembagian waris. Praktik pembagian waris "Bagi Rusa" diterapkan berdasarkan persetujuan dan dibagi berdasarkan strata, dari anak pertama, anak kedua dan seterusnya. praktik pembagian waris model ini berdasarkan terori keadilan Aristoteles dinilai sudah memenuhi unsur-unsur keadilan yang ada. Beberapa unsur tersebut meliputi prinsip proporsionalitas, kesetaraan dan keseimbangan. Lebih dari itu, praktik pembagian waris bagi rusa dinilai tidak bertentangan dengan Kompilasi Hukum Islam pasal 183 yang memuat aturan perdamaian dalam pembagian waris.

Abstract

There is a need for an aqidah akhlak education curriculum that can shape the character of istiqamah students at the elementary school level as a basic foundation for good character building. Thus, this research seeks to explore: (1) How is the concept of aqidah akhlak education curriculum in shaping the istiqamah character of elementary school students at the stage of learning planning, learning implementation, and learning evaluation? (2) How is implementing the aqidah akhlak education curriculum in shaping the istiqamah character of elementary school students at the stage of learning planning, learning implementation, and learning evaluation? This research uses a qualitative approach. This type of multi-site study research is chosen to provide a search for the proposed research problem. Data collection techniques were carried out by 1) in-depth interviews, 2) participant observation, and 3) documentation. The data were analyzed with an interactive model consisting of data condensation, data display, conclusion, and verification. Data validity checking is based on four criteria: degree of trust (credibility), degree of transferability, degree of dependability, and degree of certainty (confirmability). The results of this study were found (1) the concept of the aqidah akhlak education curriculum in shaping the istiqamah character of elementary school students at the learning planning, learning implementation, and learning evaluation stages in two Islamic elementary schools in Situbondo and (2) implementation of the aqidah akhlak education curriculum in shaping the istiqamah character of elementary school students at the stage of learning planning, learning implementation, and learning evaluation in two Islamic elementary schools in Situbondo.

Abstract

This study aims to discuss the prevention of child marriage by the Religious Affairs Office (KUA) of Kraksaan District through partnerships in the review of Lawrence Meir Friedman's legal system theory. This is due to the high number of child marriage applications recorded at the KUA of Kraksaan District from 2022 to 2023. Then, the effectiveness of preventing child marriage will be measured through Lawrence Meir Friedman's legal system theory. Qualitative methods are used in this research. Qualitative methods are research methods based on philosophy and are useful for studying scientific conditions (experiments). In this partnership strategy, the KUA works with several partners, including Village Officials, Village Heads, Non-Civil Servant Employees/Counselors, Community Health Centers (PUSKESMAS), Kraksaan District Government, NU, Muhammadiyah and al-Irsyad. As a result, 50 applications were prevented, and five were postponed out of 55 applications in 2022. In 2023, 13 applications were successfully rejected, and nine were accepted out of 22 applications in 2023. In the review of Lawrence Meir Friedman's legal system theory, the substance of the law is Law No.16 of 2019. This law is not effective because Article 7 still provides an opportunity for people to marry children. Meanwhile, the legal structure comprises the structural officials of the KUA. The KUA, assisted by its partners, is said to be effective in preventing child marriage, as seen from the data on the success rate of preventing child marriage mentioned above. The legal culture is the people of Kraksaan Subdistrict who still strongly hold the tradition of arranged marriage, maintain the good name of the family, parents want to escape their responsibilities, and the belief that many families will provide a lot of sustenance.
