Abstract

This study aims to analyze the application of the hybrid contracts concept in the Sharia export and import of L/C products in Indonesia to contribute to developing a practical or theoretical framework in Sharia banking. This article is a juridical-normative study using qualitative data from a literature study. Primary data comes from several DSN-MUI Fatwas related to L/C products, plus secondary data from a review of other reading materials relevant to the research topic. The data analysis techniques used are condensation, data presentation, and conclusion. This study found that the concept of hybrid contracts in sharia import and export L/C products has changed the status of L/C products, which were initially dominant service products with a single contract (wakālah bi al-ujrah) into various hybrid contract schemes with status as financing products. One of the hybrid contract schemes that are widely used is the murābahah bi al-wakālah contract, where the bank (issuing/advising bank) also provides funds in the form of purchasing imported goods, which are then resold to the importer or representing the sale of imported goods to the exporter.

Abstract

This article discusses a comparative analysis of mudharabah sukuk, ijarah sukuk, and wakalah bi al-istithmar sukuk. This article aims to highlight and analyse the comparison of mudharabah sukuk, ijarah sukuk, and wakalah bi al-istitsmar sukuk so as to provide answers to the effectiveness and efficiency of the sukuk concept without denying the sharia principles in it. This research is in the form of a comparative study, namely a research procedure that compares interrelated variables by determining their differences and similarities. The data sources used come from books, classical text (yellow book), scientific article, website internet, theses, and fatwas related to the theme the author is taking. The results of the research in the article are: First, there are differences in the characteristics and schemes of mudharabah sukuk, ijarah sukuk, and wakalah bi al-istithmar sukuk, these three sukuk schemes are permissible because they are by predetermined rules. The differences that exist in these three types of sukuk do not mean that they are not allowed to make each other but can be done in different ways. Second, from this comparison, the author sees that investment in sukuk with certainly contract characteristics, especially ijarah sukuk, tends to be safer because of the certainty of the predetermined ujrah. Third, of the three types of sukuk, sukuk with a wakalah bi al-istitsmar scheme tend to be more flexible and easier to understand and implement. The level of risk and profit of the three is different, sukuk with certainly contracts tend to be safer but stable profits and tend to stagnate in contrast to sukuk that use uncertain contracts whose risks tend to be greater but there is a possibility of greater profits.

Abstract

In general, in leasing, the object of the contract is the benefit of a tangible object. However, it is different from renting a Zoom Meeting Premium account whose position is as application software. So that its position will have benefits if its use has collaborated with hardware as hardware. Meanwhile, what is being rented is the software only. Therefore, this study will discuss the rental of Zoom Meeting Premium accounts according to the perspective of sharia economic law. This research uses a descriptive case study method with an empirical juridical approach. The data analysis technique was carried out through three stages namely data reduction, data presentation and conclusions. This study found that the position of Zoom Meeting is premium as a software application that is part of a computer program. At the same time, the computer program is part of the copyright in the form of intangible movable objects. So that there is the development of the object of the ijarah contract, generally in the form of benefits from tangible objects, which can also be in the form of benefits from intangible objects. However, the development of intangible objects as contract objects needs to be studied further by researchers so that they can be applied to all contract objects, such as intangible objects becoming objects of buying and selling contracts, mudharabah, musyarakah and other contracts.

Abstract

This research aims to analyze the position of virtual land buying, selling, and leasing practices using cryptocurrency in the metaverse from the perspective of Islamic economic law. This study uses a descriptive analysis method with a normative juridical approach and data analysis techniques through three stages of analysis: focusing the data, presenting the data, and drawing conclusions. The research found that the practice of buying, selling, and leasing virtual land in the metaverse is permissible because it meets the conditions and pillars of a valid contract. The transactions carried out involve intangible assets, namely virtual land and cryptocurrency. In these transactions, there is an expansion of the object of the ijarah (lease) contract, which typically involves the benefit of tangible objects or assets but can also include the benefit of intangible objects or assets, provided that the intangible asset requires another object (a tangible object) or a process that enables the asset to have utility, thus fulfilling the purpose of the contract in accordance with the principles of muamalah maliyyah (financial transactions). The development of the object of the ijarah contract is a scientific contribution to the development of Islamic economic law theory. Therefore, further research is needed on the status of intangible assets as objects of contracts to explore their benefits and legal status in accordance with Sharia principles.

Abstract

The aims of this research is to clarify the type of multi-contract used by National Sharia Council-Indonesian Ulama Council (DSN-MUI) in its product innovation, so that the multi-contract concept used is a multi-contract concept that is in accordance with sharia rules and principles. This research is sharia economic law research that uses descriptive literature research methods. This research uses a normative juridical approach. The primary data used in this research is the DSN-MUI Fatwa which is related to the concept of hybrid contracts in the innovation of sharia banking products. Meanwhile, Secondary data sources include various sources of literature such as laws, scientific articles, books, and others. The data analysis technique used was the cumulative data analysis technique of Miles et al., namely data condensation, data presentation, and drawing conclusions. This study found that so far, the DSN-MUI has used the type of multi-contract for similar contracts (a combination of muawadhat contracts) and also non-similar contracts (a combination of muawadhat contracts and tabarru’ contracts) provided that there is a separation of agreement documents to avoid usury schemes for the use of these contract combinations and income (both margins, ujrah, and profit sharing) is obtained from the use of muawadhat contracts. This non-similar contract combination scheme is confirmed in the Fatwa on the Income of Islamic Financial Institutions (LKS) During the Construction Period (Fatwa No. 142 of 2021), namely Al- Uqud al-Murakkabah al-Muta’addidah. Meanwhile, the hybrid contracts scheme for similar contracts uses the Al-Uqud al-Murakkabah al-Mutajanisah hybrid contracts scheme

Abstract

Tujuan dari artikel ini untuk membahas konsep teori legal realism serta keberadaanya dalam hukum ekonomi syariah Indonesia. Metode yang digunakan dalam artikel ini adalah metode deskriptif analisis dengan pendekatan kualitatif. Hasil dari penelitian ini adalah: pertama, bahwa legal realism adalah suatu teori yang meyakini bahwa hukum adalah sesuatu yang benar-benar nyata dilakukan, bukan hanya sekumpulan aturan yang termuat dalam undang-undang tapi tidak dilaksanakan. Legal realism memandang hukum sebagai putusan pengadilan, menjadikan realitas sebagai pijakan dalam membentuk hukum, tidak mengakui adanya konsepsi hukum yang bersifat metafisik atau dalam logika. Ada dua aliran legal realism, yakni American Legal Realism dan Skandinavian Legal Realism, keduanya menganut faham legal realism. Kedua, teori legal realism ini memiliki beberapa keselarasan dengan hukum Islam dan juga ditemukan eksistensinya dalam hukum ekonomi syariah Indonesia. Salah satunya adalah dalam penetapan fatwa-fatwa hukum ekonomi syariah yang menjadikan realitas sosial masyarakat sebagai pertimbangan dalam menentukan aturan.

Abstract

Scholars have different opinions regarding MLM business schemes, some forbid and some for conditional permissibility. As for the juhur of contemporary scholars, many of them forbid it. However, the DSN-MUI through Fatwa Number 75 of 2009 allows MLM business schemes on condition that the implementation of a contract is in accordance with sharia principles. Therefore, this study will analyze the implementation of the contract in the MLM business scheme. This research includes sharia economic law research using a descriptive method of literature with a normative juridical approach using secondary data in the form of DSN-MUI Fatwas. This type of research is qualitative research with data analysis techniques, namely data reduction, data presentation and conclusions. The results of this study reveal that based on the substance of the DSN-MUI Fatwa Number 75 of 2009, MLM business schemes can use several contracts, namely murabaha, wakalah bi al-ujrah, ju'alah, ijarah and other contracts determined by DSN-MUI according to sharia principles, one of them is the Samsarah contract. However, the contract that is widely used in MLM business schemes is the ju'alah contract. Meanwhile, if you look at the MLM business scheme, which contains elements of intermediary services, services for selling products and recruiting new members which are part of the achievements that must be completed, then the appropriate contract is a hybrid contract between a samsarah contract and a ju'alah contract.

Abstract

This study aims to analyze the implementation strategy of mosque-based Islamic financial innovations to improve the welfare of rural communities In Indonesia. The research method used is descriptive qualitative with a library research approach. Data analysis was conducted through data reduction, data presentation, and conclusion drawing, to obtain a systematic and comprehensive understanding. The results indicate that mosque-based Islamic financial innovations have significant potential as instruments for village economic empowerment. Various forms, such as mosque-based Islamic financial institutions (BMT), productive waqf, Islamic cooperatives, and the establishment of mosque-based Islamic Microfinance Institutions (LKMS), have been proven to improve community welfare by strengthening access to financing, creating jobs, and developing micro-enterprises. A key finding of this study is that program sustainability is largely determined by the existence of regular evaluation and monitoring mechanisms, active community participation, and strong regulatory support. Therefore, mosque-based Islamic financial innovations have the potential to become an alternative model for inclusive, equitable, and sharia-compliant village economic development.

Abstract

Inovasi produk Perbankan Syariah mengharuskan adanya penggunaan multi akad yang mentranspormasikan akad tabarru’ yang notabene sebagai akad tanpa komersil menjadi akad mu’awadhat yang tujuannya untuk kegiatan komersil. Sehingga menimbulkan perdebatan mengenai status hukum atas keuntungan yang dihasilkan dari akad tersebut serta bagaimana penerapannya dalam pengembangan produk di perbankan syariah. Akad tersebut adalah akad wakalah bi al- ujrah dan akad hiwalah bi al-ujrah. Penelitian ini menggunakan metode deskriptif kepustakaan yang menggunakan pendekatan yuridis normatif dengan teknik analisis data berupa reduksi data, sajian data dan menarik kesimpulan. Jenis penelitian ini adalah penelitian kualitatif. Hasil penelitian ini mengungkapkan fakta bahwa penerapan akad wakalah bi al-ujrah dan akad hiwalah bi al-ujrah dalam pengembangan produk di bank syariah, terdapat dalam mekanisme pelaksanaan fungsi bank syariah dalam melakukan pelayanan jasa. Adapun pelayanan jasa yang diberikan, hakikat norma hukumnya sama dengan akad ijarah jasa yang masuk dalam kategori akad inti (mu’awadhat) bank syariah untuk mendapatkan keuntungan.
