Abstract

Kegiatan pengabdian kepada masyarakat ini dilaksanakan di Desa Way Hui, sebuah desa yang berada di Kecamatan Jati Agung, Kabupaten Lampung Selatan, dengan tujuan meningkatkan pemahaman dan kemampuan masyarakat kurang mampu dalam mengakses layanan bantuan hukum melalui Pos Bantuan Hukum (Posbakum) di Pengadilan. Minimnya informasi mengenai prosedur, persyaratan administratif, serta mekanisme pelayanan menyebabkan banyak warga desa kesulitan memperoleh pendampingan hukum yang merupakan hak konstitusional mereka. Melalui program penyuluhan hukum, konsultasi, dan pendampingan teknis, kegiatan ini memberikan edukasi yang komprehensif terkait tata cara pengajuan permohonan bantuan hukum, dokumen yang harus dipersiapkan, serta peran organisasi bantuan hukum terakreditasi dalam penanganan perkara litigasi maupun nonlitigasi. Metode pelaksanaan meliputi ceramah, diskusi kelompok, simulasi penyusunan dokumen hukum, dan layanan konsultasi individual. Hasil kegiatan menunjukkan peningkatan signifikan dalam pemahaman peserta mengenai alur permohonan bantuan hukum, fungsi Posbakum, serta mekanisme pembebasan biaya perkara (prodeo). Selain itu, kegiatan ini memperkuat koordinasi antara perangkat desa, masyarakat, dan lembaga bantuan hukum sehingga pemenuhan persyaratan administratif dapat dilakukan secara lebih efektif. Secara keseluruhan, program pengabdian ini berkontribusi nyata dalam memperluas akses keadilan, mengurangi hambatan hukum struktural, dan mendorong terselenggaranya layanan hukum yang inklusif bagi masyarakat kurang mampu di Desa Way Hui. Kegiatan serupa perlu dilanjutkan untuk memastikan pemerataan layanan bantuan hukum di wilayah pedesaan.

Abstract

Divorce among parents often leads to the failure of a marriage to achieve its primary goals, which are sakinah, mawaddah, warahmah (peace, love, and compassion). In family law courts, the number of divorces continues to rise every year, reflecting a growing trend of broken marriages. This situation undermines the intended harmony and stability that marriage is supposed to bring, leaving a significant impact on the family unit as a whole. This study aims to determine the psychological impact on children after their parents' divorce. This study uses a descriptive qualitative method. The qualitative approach taken is a qualitative case study approach. Parental divorce can have a significant psychological impact on children. Children may experience stress, anxiety, and feelings of insecurity. They can also feel guilty, lose self-confidence, and have difficulty building healthy relationships in the future. Some children even exhibit aggressive, quiet, or withdrawn behavior in response to their parents' divorce.

Abstract

The Nyongkolan tradition is a distinctive marriage procession within the Sasak community in Lombok, West Nusa Tenggara, which combines elements of customary law with Islamic law. This study aims to examine how the integration of Islamic law and Sasak customary law occurs in the implementation of Nyongkolan, as well as the challenges faced in harmonizing the two. Using a descriptive qualitative approach, data was obtained through in-depth interviews, participatory observation, and documentation involving religious leaders, customary figures, and members of the Sasak community involved in the marriage procession. The findings of the study show that although there is potential conflict between the principle of simplicity in Islam and some customary elements considered excessive, both Islamic law and customary law play important roles in strengthening the relationship between the two families of the bride and groom, as well as preserving local cultural values. Dialogue and mutual understanding between religious leaders and customary figures are necessary to achieve harmonious integration between the two. This study reveals the importance of maintaining a balance between tradition and religious teachings to preserve the essence of a marriage that is legitimate both in terms of religion and culture, as well as enriching the identity of the Sasak community.

Abstract

This study examines the institutional legal reasoning of the Indonesian National Sharia Council (DSN-MUI) in developing the normative framework for dispute resolution and risk management in Sharia finance. Through a qualitative corpus analysis of fatwas on taʿwīḍ (compensation for loss), debt restructuring, and debt transfer, the research argues that these fatwas do not function as isolated case-by-case rulings. Instead, they form a coherent body of evolving institutional reasoning that shifts Islamic financial law from a rigid, contract-validity-focused paradigm toward a dynamic risk governance paradigm. The findings reveal that DSN-MUI consistently distinguishes between involuntary and willful default, designs restorative rather than punitive compensatory mechanisms, and systematically integrates principles of maqāṣid al-sharīʿah and maṣlaḥah with modern financial governance needs. The analysis further contrasts DSN-MUI's contextualized legal reasoning with the standardized approach of AAOIFI, highlighting how DSN-MUI adapts Islamic legal principles to Indonesia's socio-economic and regulatory context. The study concludes that DSN-MUI fatwas collectively construct a distinct model of Fiqh al-Mukhāṭarah wa al-Nizāʿ (Fiqh of Risk and Dispute Resolution), positioning Islamic law as an integral instrument for systemic risk management, contractual sustainability, and equitable dispute resolution within a modern financial ecosystem.
