Abstract

Abstract: The Economic development in Indonesia shows significant results, yet it has a negative impact towards the environment. The trouble  is that if the bank has provided credit or financing to customers, it turns out that the credit recipient company discharges waste into the river or other actions that undermine the environment. Do banks have helped in financing environmental damage? Then how was the bank's responsibility for credit channeled to polling debtors? Economic development cannot be separated from bank institutions as an intermediary institution which has become one of the drivers of the economy and business so that it has a strategic role that can be used to achieve certain goals. One of the objectives of development is environmental sustainability. In order to espouse environmental preservation, the pattern of green banking can be applied, but only a small number of conventional banks and Islamic banks implement it in credit assessment terms. The pattern of green banking practice that can be realized in each credit agreement and financing at the bank, among others: administrative patterns, associative patterns, incentive patterns and evaluative patterns. Those patterns can be implemented with great awareness and responsibility from all banks in Indonesia.Keywords: law, bank, green banking Abstrak: Pembangunan ekonomi di Indonesia menunjukkan hasil yang cukup signifikan, akan tetapi menghasilkan dampak buruk terhadap lingkungan hidup. Permasalahannya yaitu apabila bank sudah menyalurkan kredit atau pembiayaan kepada nasabah yang ternyata perusahaan penerima kredit melakukan pembuangan limbah ke sungai atau kegiatan lainnya yang merusak lingkungan. Apakah bank dapat dikatakan turut membiayai terjadinya kerusakan lingkungan? Lalu bagaimana tanggungjawab bank terhadap kredit yang disalurkan pada debitur pencemar? Pembangunan ekonomi tidak dapat dilepaskan dari lembaga bank sebagai intermediary institution yang merupakan salah satu penggerak ekonomi dan bisnis sehingga memiliki peran strategis yang dapat digunakan untuk mencapai tujuan tertentu. Salah satu tujuan pembangunan adalah kelestarian lingkungan hidup. Dalam rangka menunjang pelestarian lingkungan hidup, pola green banking dapat diterapkan, akan tetapi hanya sebagian kecil bank konvensional dan bank syariah yang melaksanakannya dalam syarat penilaian kredit. Pola pelaksanaan green banking yang dapat direalisasikan dalam setiap perjanjian kredit dan pembiayaan pada bank, antara lain: pola administrative, pola asosiatif, pola pola insentif dan pola evaluative. Pola demikian dapat dilaksanakan dengan kesadaran dan tanggungjawab yang besar dari semua bank di Indonesia. Kata Kunci: Hukum, Bank, green banking

Abstract

Kuota ekspor merupakan salah satu mekanisme perlindungan ekosistem laut. Banyaknya perburuan Ikan Hiu Tikus (Alopias Ssp.) di Indonesia saat ini karena permintaan pasar yang tinggi, khususnya dari luar negeri. Tingginya permintaan menyebabkan ikan jenis ini masuk ke dalam daftar Convention on International Trade in Endanger Species of Wild Fauna and Flora (CITES)  Appendiks II pada tahun 2016. Jika Ikan Hiu Tikus yang merupakan predator puncak pada rantai makanan di laut ini sampai terancam punah, maka ekosistem laut akan mengalami kerusakan parah. Hasil penelitian menunjukkan bahwa Indonesia belum memiliki perangkat hukum yang memadai terkait dengan penentuan komponen-komponen kuota ekspor Ikan Hiu, khususnya Ikan Hiu Tikus sebagaimana ketentuan yang diatur di dalam CITES. Keadaan ini menimbulkan dampak terhadap kelestarian Ikan Hiu Tikus itu sendiri, kepentingan masyarakat Indonesia, keberlangsungan lingkungan laut dan generasi yang memanfaatkannya, serta berdampak terhadap perdagangan internasional.The Consequencies of an Inexistence of Alopias Ssp Export Quota Regulation In Indonesia AbstractExport quota is one of mechanical ways to protect marine ecosystem. The huge number of Alopias Ssp. hunts has recently been caused by its international trade worldwide. Highly demands of Alopias Ssp. get this species to be listed on Convention on International Trade in Endanger Species of Wild Fauna and Flora (CITES)  Appendix II in 2016. When Alopias Ssp. as the top predator have been endangered, the marine ecosystem will come to a serious damage. Research shows that Indonesia does not have yet the regulation on components of export quota of Alopias Ssp. as it is regulated on CITES. This condition has affected the preservation of Alopias Ssp. itself, Indonesians’ interest, marine ecosystem sustainability and the generation taking the benefit of it, also international trade as well.DOI: https://doi.org/10.22304/pjih.v4n3.a9

Abstract

Abstrak Penawaran barang dengan media daring dilakukan oleh penjual dengan mengandalkan deskripsi barang dalam bentuk video atau foto sehingga konsumen tidak dapat melakukan pengecekan secara langsung atas barang yang akan dibelinya. Disamping kewajiban konsumen untuk berhati-hati, konsumen juga perlu mendapatkan perlindungan. Artikel ini menganalisis tanggung jawab penjual akibat produk cacat tersembunyi dalam transaksi jual beli secara daring. Penulis berpendapat bahwa produk cacat tersembunyi yang dijual oleh penjual dalam transaksi daring menjadi tanggung jawab mutlak penjual sebagaimana diatur pada Pasal 19 UUPK, serta ketentuan Pasal 1365 dan 1865 KUH Perdata, yaitu penjual bertanggung jawab atas barang yang dijual. Namun tanggung jawab tersebut harus dibuktikan bahwa penjual memang berbuat kesalahan, dan akibat kesalahan tersebut telah merugikan konsumennya.

Abstract

ABSTRACTCombating corruption is also characterized by one unique decision in the District Court of Surakarta, particularly associated with the element against the law as stipulated in Article 2 paragraph (1) UUPTPK. Judges examine the material of the regulations, although not in the sense of Judicial Review, which is the authority of the Supreme Court. Material regulations testing were intended to bear out that the acts of the defendant was a nature against the law formally or deemed to be contradictive to the positive law. This study was primarily intended to explain the teachings of nature against the law, which is used by judges in legal considerations. In that context, the judges resolve a violation of Article 2 paragraph (1) Corruption Eridiction Act (UUPTPK), therefore it is different from the demands of the public prosecutor, who claimed that the defendants did not violate that article.Keywords: corruption, nature against the law, local regulations. ABSTRAKPemberantasan korupsi menjadi karakteristik yang unik dalam putusan Pengadilan Negeri Surakarta, khususnya terkait dengan unsur-unsur melawan hukum sebagaimana tertuang dalam pasal 2 paragraf (1) UUPTPK dalam konteks kewenangan hakim pidana untuk menguji kesesuaian atau ketidaksesuaian suatu peraturan daerah terhadap undang-undang. Hakim telah memeriksa materi undang-undang meskipun tidak menyingung materi dalam judicial review yang merupakan kewenangan Mahkamah Agung. Materi undang-undang menguatkan kejahatan terdakwa dengan dakwaan sifat melawan hukum sesungguhnya kontradiktif dengan hukum positif. Dalam kajian ini, hakim dalam pertimbangan hukumnya menentukan adanya perbuatan melawan hukum dari para terdakwa. Dan, menetapkan pelanggaran Pasal 2 paragraph UUPTPK, meski terdapat perbedaan sebagaimana permintaan jaksa penuntut umum yang mengklaim terdakwa tidak melanggar pasal iniKata kunci: korupsi, sifat melawan hukum, peraturan daerah

Abstract

Communication is a necessity in education. This study aimed at investigating howeffectiveness of communication in education world, especially in Islamic education.This study was literature study, meanwhile, data of this study was collected indocumentation by using descriptive approach as data analysis. Furthermore,communication has a role that cannot be separated in Islamic education. The exchangeof information from a teacher to a student must be occurred effectively. Teacher’sabilities and skills in communicating and conveying a message (science) are veryinfluential in learning process and lead to the results which are achieved by a studentor students. The better the teacher gives clear inputs and messages in education, thebetter the message received by student or students.

Abstract

The technology of smart contract is a new technology applied in online trading. This technology has the possibility of errors and its arrangement that results in losses to buyers. This study was aimed to examine the legal certainty for the users smart contract in e-commerce transactions in Indonesia. The method used was the normative juridical method. The results of the study indicate that the privacy policy on smart contracts in e-commerce transactions based on national and international laws still has a legal vacuum in which the aspect of national law is guided by the ITE Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 and the Regulation of the Minister of Communication and Information Number 20 of 2016 concerning Personal Data Protection in Electronic Systems. Then, in the aspect of international law referring to the UNCITRAL Model Law on Electronic Commerce (MLEC), it also establishes the rules for the formation and validity of contracts made electronically and for attribution.

Abstract

The purpose of this study is to find out that strengthening resilience can be useful to help psychologically recover for students who are victims of criminal acts of sexual harassment. Of course, it is supported by good relations from family, school and social environment as well as a strong will on the victim to try to rise from adversity due to the occurrence of the crime of sexual harassment that happened to her. The type of research used by the author is normative or doctrinal legal research that is prescriptive and applied. This research approach is carried out with a statute approach . The results of this study indicate that efforts to strengthen resilience in the context of psychologically rehabilitating victims of sexual harassment crimes are useful for helping to forget the sadness and fear and despair due to the suffering received by the victims due to the criminal acts of sexual violence committed by the perpetrators. As well as support from families, schools and the environment will greatly help victims to be enthusiastic about returning to school to achieve the goals that victims hope for in the future

Abstract

The purpose of this article is to identify some issues arising from the revival of the SG/PAG after the enactment of the Yogyakarta Speciality Law (YSL). This article seeks to identify three issues arising from re-emerging the SG/PAG after the enactment of the YSL. First, the strengthening of patrimonial culture in Yogyakarta. Second, the SG/PAG impact on the common people in Yogyakarta. We will answer two research questions: (1) How relation between SG/PAG revival and the strengthening of Patrimonial Culture and (2) What is the impact of the revival of SG on the prosperity of the People? The results of the research. The results showed that the patrimonial culture in Yogyakarta strengthened after the YSL was enacted and also land grabbing informal land and village land, on the other hand, patrimonialism cloaked as a 'Speciality of Yogyakarta' actually weakened state control over land in Yogyakarta.

Abstract

This study aims to analyze the implications of the principle of opportunity for implementing depowering in the Attorney General's Office. This is normative legal research, with secondary data in primary, secondary, and tertiary legal materials. The results showed that implementing depowering as part of the principle of opportunity was not optimal and practical. The causative factors were. First, the legal material was still ambiguous regarding the definition of public interest as the basis for implementing depowering. Secondly, the understanding of the prosecutor's office on the principle of opportunity was not coherent with the principle of equality before the law by the apparatus. Third, the factor of the legal culture of the community whose trust is still deficient in the implementation of the principle of opportunity by the Prosecutor's Office.

Abstract

Background: In the context of limited liability companies in Indonesia, minority shareholders often encounter structural disadvantages due to the dominance of majority shareholders. Despite having derivative rights as a legal safeguard, exercising these rights in practice remains a complex challenge. Aims: This research explores the alignment between legal norms and actual practices related to derivative actions initiated by minority shareholders. It focuses on uncovering the systemic barriers they face and proposing pathways for improving legal implementation. Method: The study uses an empirical legal research approach. Data were obtained through interviews with minority shareholders in three companies, supported by doctrinal analysis of statutory provisions and legal theories on protection and effectiveness. Result: The findings indicate three main obstacles: limited financial capacity to initiate lawsuits, political dynamics within shareholder meetings, and insufficient understanding of legal procedures. These issues hinder access to justice and weaken the intended function of minority protection under company law. Conclusion: Although the legal framework in Indonesia recognizes derivative rights, its application remains far from effective. Achieving fairness requires procedural reform, stronger institutional support, and better legal literacy among minority shareholders
