Abstract

The law of Islamic inheritance has been largely abandoned by the Indonesian Islamic community either directly or indirectly. This phenomenon illustrates that there has been a refraction of the sense of justice in settling inheritances in accordance with Islamic inheritance law. This shows that the values contained in the Qur'an regarding inheritance verses require a clear understanding according to the conditions and sense of justice while still paying attention to the purpose of the shari'a of Islamic law. In the distribution of inheritance, there are often problems when dividing the shares, so there are several  alternatives in dividing the inheritance. The division of inheritance often causes disputes in the family, this journal examines alternative distribution that can be done if there are still problems in the distribution of inheritance for heirs based on positive law and Islamic law. A balance between rights and obligations will always be present from every wise and wise decision, including in the matter of property distribution. Every right of a male or female heir in obtaining property must be directly proportional to the needs and responsibilities needed for a more peaceful balance in life.

Abstract

A Limited Liability Company (Perseroan Terbatas) is a legal entity with a legal personality separate from its shareholders and corporate organs; therefore, it is generally governed by the principle of limited liability. However, under certain circumstances, this principle may be set aside through the piercing the corporate veil doctrine when the corporate entity is used to evade legal obligations or to commit abuses that cause harm to other parties. This study aims to analyze the application of the piercing the corporate veil doctrine in corporate breach of contract disputes through the alter ego doctrine, as well as to examine the construction of personal liability and the juridical parameters for imposing joint and several liability on corporate organs. This research employs a prescriptive doctrinal legal method using statutory, conceptual, and case approaches. The case approach examines Indonesian court decisions, namely Decision Number 96/Pdt.G/2017/PN.Jkt.Sel. and Decision Number 47/Pdt.G/2021/PN.Mtr. Legal materials were collected through library and document research, encompassing primary, secondary, and tertiary legal sources, and were analyzed qualitatively. The findings indicate that The alter ego doctrine may serve as an indicator in identifying the control and relationship between corporate organs and the company in determining personal liability. However, control over a company alone does not constitute sufficient grounds for applying the piercing the corporate veil doctrine.

Abstract

This research aims to analyze and find the obligation of rehabilitation for drug addicts and abusers from the Islamic perspective and Sufism healing as an alternative rehabilitation for drug addicts. Sufism examines the spiritual aspects of Islam, while healing is the process of recovering from mental illness. This program plan becomes a hypothesis that is worth testing in prison for terrorism prisoners based on qualitative research methods with a phenomenological approach. Sufism healing has long been used to rehabilitate drug users in Islamic Boarding House (pesantren). The research approach in this research is a sociological juridical approach. The findings indicate that, according to an Islamic standpoint, rehabilitating those struggling with drug addiction is deemed obligatory due to the principle of al-Maqashid al-Syariah, which emphasizes the preservation of the mind (al-hifdzu al-aql) as an imperative need. The sufism healing, as a potential alternative approach to rehabilitating those struggling with drug addiction and substance misuse, centers on the objective of cultivating a greater connection with Allah the Almighty through the principles of takhalli, tahalli, and tajalli.
