Abstract

This study aims to determine the relationship between contextual based learning with the formation of morals in the maintenance of the environment of the State Senior High School in Tasikmalaya City. The study used descriptive method, with the number of samples as much as 240. Data analysis using correlation test resulted in correlation coefficient of 0.680 and significant at the level of trust 0.05. Thus, contextual based learning is positively related to morality in the maintenance of the school environment

Abstract

This paper aims to describe findings of the study in pesantren-based SMA Amanah covering: 1) the principal policy in developing character education, 2) the methods used in developing character education, 3) students’ characteristics as the result of the character education process, 4) the problems encountered in the implementation of character education and the efforts made in addressing the implementation of character education at the school. This study applied qualitative method using descriptive technique. The data were collected through observation, interviews, and documentation. The findings of study showed that: 1) the principal’s policy in developing character education was carried out by implementing government policies in line with the school’s vision, mission, and programs; 2) the methods used in the process of character education were through role-modelling, assignments and nurturing, habituation, training programs, and  students’ participation in various types of activities, as well as the application of rewards and punishments; 3) the student's characteristics resulted from the character  education process were piousness and devotion as well as being able to apply their knowledge and piety in everyday life; 4) problems encountered in the implementation of character education  were different values and norms students brought from home; imbalance of facilities compared to the number of students; as well as teachers’ readiness to actually implement the new program, which  was character education. Meanwhile the efforts made to overcome those problems were namely developing personal, family, neighborhood or community characters, and making commitment of all related parties/stakeholdres of SMA Amanah.

Abstract

This article discusses the implementation of the concept of hybrid contracts in the product of ijarah al muntahiya bit tamlik (IMBT) and leasing at Indonesia Islamic Financial Institutions. This article aimed to find out the implementation of hybrid contract concept in IMBT and leasing products at Indonesia Islamic Financial Institutions. This article was conducted using qualitative research method. The data in this study were obtained from library materials such as books, journals, articles, etc. Data analysis techniques used were data condensation, data presentation, and drawing conclusions. The analysis results showed that the development of contracts in Islamic financial institutions was inevitable due to the implementation of multi-contracts. The merging of two contracts is also known as (hybrid contract or al-'uqudal-murakkabah) such as ijarah al mutahiya bit tamlik (IMBT). IMBT is a combination of two inter-ijarah contracts (lease) and the sale and purchase or grant is made at the end of the lease term. The implementation and merging of two contracts (hybrid contracts) in IMBT may use several contracts, including ijarah contract, ba'i contract, wakalah contract, and hibah contract.

Abstract

This article discusses applying the hybrid contract concept in multiservice ijarah financing as an alternative to financing health services. This is important to study because health services are one of the most urgent things in the current Covid-19 pandemic. This article aims to determine the form of contracts contained in multiservice ijarah financing as an alternative to financing health services in the Covid-19 pandemic. This type of research is normative legal research. The data were obtained from library materials such as books, journals, etc. The analysis results show that health financing can be carried out in two ways: the ijarah contract, which begins with the bank through investors doing the health institution after making the contract, and the wakalah contract through the customer himself. People who have financial problems paying for health costs with multiservice ijarah transactions can apply for health financing to Islamic Financial Institutions for their families to minimize deaths before treatment in the Covid-19 pandemic.

Abstract

From the standpoint of Islamic Economic Law, this article seeks to describe and examine the syndicated financing of Islamic Banks in Indonesia. With the kind of library research used to examine the formulation of the problem in this study, a qualitative research methodology was used to conduct this study. The findings of this study suggest that a hybrid contract or multi-contract approach can be used to implement Islamic banking product innovation. Sharia syndicated finance products exist in banking as a result of the requirement for huge quantities of funding, which means that Islamic banks must work with other banks since they will not be able to support it alone. In accordance with the Fatwa DSN No: 91/DSN-MUI/IV/2014, syndicate financing is permitted. Musyarakah Mutanaqishah contracts are typically used for syndicated financing in Islamic banks. The Sharia Banking Law, KHES, Fatwa DSN, and other relevant rules have both been accommodated by syndicated financing in Islamic banks. The Sharia Supervisory Board will continue to oversee the implementation of syndicated financing products at Indonesian Islamic Banks so that it is, in theory, consistent with Sharia Economic Law and no restrictions are broken.

Abstract

Rapid product development is carried out by Islamic Financial Institutions (LKS) in providing alternative services to the needs of the community which are carried out based on sharia principles. The development of these services is provided both in the form of banks and non-banks as well as in the form of storage or other types of services as well as in the form of financing. However, due to more complex customer needs, LKS requires innovation in order to get convenience in its operational activities. So, in innovating with hybrid contracts, it becomes an important thing. This research uses a literature study with a normative juridical approach, which is carried out by collecting, studying and reviewing books, scientific magazines and documents related to this research such as theses and scientific articles. The results of the study state that in the application of hybrid contracts in multi-service financing products at Islamic Financial Institutions (LKS) generally use ijarah contracts according to the DSN-MUI fatwa. In this case, if the LKS uses the ijarah contract, it must comply with the provisions of the fatwa as the service provider or the benefits obtained from the LKS. Meanwhile, if in a hybrid contract one or more contracts are added, in this case it is added with a wakalah contract, then the customer has the power to carry out his own costs. However, if there are customers who still have to pay ujrah for the ijarah contract, it is called usury. Because this is not justified in sharia principles and is not in accordance with the ijarah fatwa concerning the multiservice, the bank does not fulfill its service obligations as the fatwa regarding multiservice as well as the kafalah contract. Thus, there is an alternative in this multi-service financing, namely by using hawalah bil ujrah and wakalah contracts which are more flexible and their implementation as an innovation, namely combining these contracts with the aim of making banking operations easier, reaching wider and able to meet the needs of more customers.

Abstract

An agreement is a form of agreement between parties to do something. An agreement always gives birth to an agreement, where the agreement is a concrete form and the agreement is an abstract and binding form. The concept of contract product innovation has emerged by combining several existing contracts and is called a hybrid contract. A hybrid contract is a combination of two or more contracts into one contract for a specific purpose. This research was conducted to determine the application of hybrid contracts in sharia financial institution products, especially Giro. This research also analyzes whether the application of Giro products in sharia banking is in accordance with Islamic law. The type of research used is library research by describing qualitative data obtained from research documents. This research uses qualitative methods combined with analytical methods. The research results show that the implementation of hybrid contracts in Giro products in sharia banking is in accordance with the provisions of Islamic law. Combination contract products are permitted in accordance with religious texts so that Giro products can be claimed to be included in the contract category which applies to several contracts, especially wadiah and mudharabah contracts. In the Sharia Bank Giro product, there is a basic contract, namely a deposit and includes additional fees. contracts, especially benefits. From this agreement there will be an agreement to determine profits with the mudharabah giro.

Abstract

The concept of "Hybrid Contract" in Islamic financial institutions refers to the combination or combination of two or more types of contracts or sharia agreements to achieve certain goals in accordance with sharia principles. In the context of Islamic banking, this refers to the use of more than one type of contract or financing mechanism in a single transaction to meet complex needs and requirements. Hybrid Contract in trade finance and Letter of Credit (L/C) multipurpose financing in sharia financial institutions refers to the combination or combination of two or more different types of sharia contracts or agreements to meet the needs of complex trade finance and multipurpose financing in the sharia context. This is a flexible approach that allows Islamic financial institutions to design financing solutions that comply with Sharia principles and the needs of their customers.

Abstract

The purpose of this article is to describe and analyze syndicated financing of Islamic banks in Indonesia from the point of view of sharia economic law. This research uses qualitative research methods with the type of literature research used to analyze the formulation of this research problem. The results of this study show that Islamic banking product innovation can be achieved through the introduction of hybrid contracts or multiple contracts. Syndicated financing products emerged in the banking world due to the need for large amounts of financing, which Islamic banks could not support alone. Therefore, it must cooperate with other banks. Syndicated financing is allowed based on Fatwa DSN Number 91/DSN-MUI/IV/2014. Sharia syndicated financing at Islamic banks usually uses the Musharakah Mutanakisha contract.

Abstract

Changes and the growth of shari'ah financial problems have faced widespread challenges. Among the important pillars for creating shari'ah financial products in serving the demands of modern society is the development of hybrid conctract (multi-contract). This paper analyzes rahn products that are widely practiced in shari'ah financial institutions, especially shari'ah pawnshops, from the point of hybrid contract. This research uses a qualitative approach with a type of case study research at Pegadaian Syariah Jombang. One of the data collection techniques is in the form of documentation, namely a rahn transaction agreement document between pawn customers and the Jombang Regency shari'ah pawnshop. Data analysis of this study in addition to using the fiqh approach also uses a substantive-normative approach in Islamic legal thinking. The results showed that rahn products in shari'ah pawnshops are still questionable shari'ah practices. If examined more deeply based on the criteria of permissible hybrid contracts, then this product can be included in the prohibited hybrid contract, because it is included in the combination of buying and selling with debts prohibited by hadith and scholars, because it combines two contracts that contradict its character and nature.
