Abstract

The guarantor agreement/individual guarantor or personal guarantor often requires the guarantor to relinquish his rights as a personal guarantor so that the consequences of the personal guarantee result in bankruptcy. Various decisions on bankruptcy petitions state that the personal guarantor can be made bankrupt, so that the guarantor as referred to in article 1 paragraph 1 of the Bankruptcy Law must release all his assets into general confiscation to pay off creditor payments. The main problem that will be studied is the position of the guarantor, in this case the personal guarantee, which is used as a bankruptcy debtor. The purpose of writing this journal is to analyze the capacity of personal guarantees made by bankrupt debtors the same as the main debtor because at the time of making the guarantee deed the guarantor was willing to voluntarily relinquish all his privileges without waiting for the main debtor to default and his assets to be sold. This journal is normative juridical research, with a statutory approach and a case approach. In this journal, it was found that making a guarantee deed means that the position of a guarantor who can be made bankrupt is a weak position in an agreement, so the role of the notary must be to be able to provide legal counseling before the personal guarantor signs the guarantee deed. The result of this study is that Personal Guarantee as a guarantor of bankruptcy has an equivalent status with the main debtor because in making the deed of guarantee, the guarantor has agreed to release his privileges without waiting for the default of the main debtor. If the main debtor's debt is not met, the creditor can file bankruptcy against the guarantor (Personal Guarantee or Corporate Guarantee) in accordance with the bankruptcy law. In the agreement, it is important for all parties (creditor, notary and debtor) to understand the risks that may arise when the guarantor signs the deed of guarantee

Abstract

The increasing demand for land due to population growth gave rise to a focus on agrarian law. The pre-1960 dualism of land law (Western land and customary law) ended with the agrarian Basic Law (UUPA) of 1960, which unified land regulation. The UUPA aims to simplify land law for the benefit of the people. The conversion of eigendom rights is regulated by the UUPA, but the settlement of land disputes, although it can be done through non-litigation channels, often leads to litigation, especially in complex cases such as eigendom rights, conversion, and land ownership. This study raises two problems, namely the legal consequences of the former Eigendom land that has not been registered but has been controlled by other parties and the legal construction of Land Dispute Resolution on the Land of the former Eigendom that has not been registered but has been controlled by other parties.This research is normative legal research, with legislation and case approach. The technique of collecting legal materials used by the authors in this study is to collect data by reading and reviewing some literature. The result of this study is that Article 24 of Government Regulation No. 24 of 1997 on land registration provides legal consequences for owners of eigendom deeds who have not registered their land, triggering disputes with communities who have controlled the land. To minimize disputes, it is necessary to establish an alternative institution for resolving land disputes in Indonesia, such as the ex-Eigendom land examination Institute

Abstract

Marriage combines the husband-wife relationship and unifies two families of different ethnicities, cultures, and backgrounds. The consent of the wali is a significant function of the family, particularly the prospective bride's family. Marriage requires the permission of the wali because it is null and void without it. In actuality, the wali of the prospective bride may be hesitant to marry off the woman under his supervision for various reasons, both Shar'i and non-Shar'i. As a result, the prospective bride must apply to the Religious Court for wali adhal for the marriage to occur. This qualitative research employs a normative legal approach, which examines legal norms found in laws and regulations, judge judgments, and other legal sources. According to the findings of this study, wali adhal cases are currently evaluated by voluntary trials or unilaterally. However, because it is unilaterally assessed and there is no opponent, fulfilling the legal purpose of building integrative justice in this examination requires considerable effort. Therefore, wali adhal cases must be examined using a contentious trial.

Abstract

Youth has a very important position in the history of the struggle for Indonesian independence. Youth development is Indonesia's strategic agenda in order to prepare future generations who are strong and able to play a role in the development of the nation as a whole. In the present, youth are expected to continue to be able to fulfill independence in order to support national development. Seeing the very high potential of youth, the Government then saw the need to formulate special policies related to youth development. The research method in this writing is qualitative. The type of research in this research is using normative juridical law research. The purpose of the establishment of the Youth Law which provides specificity for the implementation of affairs in the field of youth cannot be carried out optimally so that it also has an impact on the Government's efforts in implementing youth development which is expected to support national development.Keywords: Authority; Youth; National development AbstrakPemuda memiliki kedudukan yang sangat penting dalam sejarah perjuangan kemerdekaan Indonesia. Pembangunan pemuda merupakan agenda strategis Indonesia dalam rangka mempersiapkan generasi masa depan yang tangguh dan mampu berperan dalam pembangunan bangsa secara keseluruhan. Di masa sekarang, pemuda diharapkan terus dapat mengisi kemerdekaan guna mendukung pembangunan nasional. Melihat potensi kaum muda yang sangat tinggi, Pemerintah kemudian memandang perlu menyusun kebijakan khusus terkait dengan pembangunan kepemudaan. Metode penelitian dalam penulisan ini adalah kualitatif, jenis Penelitian dalam penelitian ini yaitu menggunakan penelitian hukum yuridis normative. Tujuan pembentukan Undang-Undang Kepemudaan yang memberikan kekhususan penyelenggaraan urusan dibidang kepemudaan tidak dapat dilaksanakan dengan maksimal sehingga berdampak pula terhadap upaya Pemerintah dalam melaksanakan pembangunan kepemudaan yang diharapkan dapat mendukung pembangunan nasional.Kata Kunci: Kewenangan; Kepemudaan; Pembangunan Nasional

Abstract

Penelitian ini bertujuan untuk mengkaji akibat hukum dari wanprestasi debitur dalam perjanjian pengakuan utang yang tidak disertai hak tanggungan serta perlindungan hukum bagi kreditur dalam situasi tersebut. Dengan menggunakan pendekatan yuridis normatif, penelitian ini menemukan bahwa ketiadaan hak tanggungan dalam perjanjian utang-piutang membuat kreditur berada pada posisi yang rentan dan sulit untuk mengeksekusi jaminan. Kreditur harus melalui proses hukum yang panjang dan tidak pasti, yang sering kali berujung pada kerugian finansial. Penelitian ini menegaskan pentingnya hak tanggungan sebagai instrumen hukum untuk memberikan kepastian dan kemanfaatan bagi kreditur dalam menghadapi wanprestasi debitur. Rekomendasi penelitian ini adalah agar pemasangan hak tanggungan di setiap perjanjian utang diperkuat, dan sosialisasi mengenai pentingnya hak tanggungan bagi kreditur harus ditingkatkan.

Abstract

Introduction to the Problem: Women and children are frequently mistreated, particularly when they face legal issues. In divorce situations, for example, they often do not receive the entitlements to which they are entitled, such as mut'ah, iddah, and child support. This situation is due to the existing legal system and policies that do not reflect equality and justice for women and children, particularly in the execution of court orders carrying ex-husbands' obligations to their ex-wives. One of the legal advances in this part is using information and technology (IT) to develop a decision execution system. E-MOSI CAPER is one of the IT-based decision execution instruments that ex-wives can employ to demand that their ex-husbands voluntarily carry out the decision's obligations.Purpose/Objective of the Study: This article attempts to describe and analyze how the E-MOSI CAPER App could assure the preservation of women's and children's rights after divorce.Design/Methodology/Approach: This work adopts a qualitative research technique through normative and empirical juridical approaches, with statutory and conceptual approaches.Findings: According to this study, the E-MOSI CAPER application, one of the IT-based services released by the Bengkulu Religious High Court, is an innovation that could be used as a tool in organizing guarantees for the protection of women's and children's rights. This App can increase the compliance of ex-husbands to perform court decisions, which makes this App part of the legal instrument of the Integrated Execution System.Paper Type: Research Article
