Conflict of land ownership used to happened between community versus the government and company, related to land release where there is an investation, almost all over the country. All sorts of conflict reason is about the land ownership and the bargain compensation of land released. So many methods and approaches have been conducted to, but still far from expected, and tend to become worst and victimize the community. State as the government is expected to facilitate each party to solve the problem or at least to avoid the conflict happen, but unfortunately, it still happen. It is because in one hand the government need more investation as the income generating, and on the other side the community claim the land as their own. It is needed to reconceptualized of the land owner for the business in the investation for the release of land ownership. One of the alternative suggested is based on the rental MOU in certain period with certain compensation. By this model, the community keep own their land even the the company is ended.Keywords: land rights, land disputes, dispute resolution

Permasalahan lahan akibat usaha pertambangan nikel di Provinsi Maluku Utara, merupakanpermasalahan yang tidak kunjung selesai. Ini disebabkan oleh hubungan erat antarapertambangan dan lahan sebagai dua hal yang tidak terpisahkan. Tuntutan ganti rugi lahanoleh masyarakat kepada perusahaan yang tidak dapat terpenuhi mengakibatkan munculnyasengketa lahan. Pihak-pihak yang terlibat dalam sengketa tersebut adalah pelaku usahapertambangan dengan masyarakat, masyarakat dengan masyarakat dan masyarakat denganpemerintah. Metode pengumpulan data yang digunakan adalah observasi, wawancara.Selanjutnya, data yang diperoleh akan diinterpretasikan dan dianalisis secara deskriptifanalisitis. Hasil penelitian menunjukkan berbagai macam tanggapan responden, yangmenyebabkan terjadinya sengketa lahan dapat diidentifikasi meliputi: besaran ganti rugilahan yang tidak sesuai menduduki peringkat pertama. Permasalahan tumpang tindihkepemilikan lahan menduduki peringkat kedua. Jumlah ganti rugi tanaman yang tidak sesuaimenduduki peringkat ketiga. Adanya pihak ketiga yang memanfaatkan situasi, mendudukiperingkat keempat. Terakhir, masalah sengketa antar batas wilayah dan kurangnyakomunikasi merupakan masalah yang menduduki peringkat kelima.

Perlindungan hak prioritas masyarakat hukum adat merupakan perwujudan hak asasi manusia dari eksploitasi sumber daya wisata yang tidak menguntungkan. Adanya vaqueness of norm dalam UU Nomor 10 Tahun 2009 mempengaruhi perlindungan masyarakat hukum adat yang berada di kawasan obyek wisata pantai di Kota Ternate. Hasil penelitian menunjukan bahwa hak prioritas masyarakat hukum adat Ternate belum memperoleh perlindungan efektif meskipun telah memperoleh pengakuan melalui Peraturan Daerah, yang disebabkan tidak adanya afirmatif terhadap masyarakat hukum adat atas kewajiban pemenuhan standar kompetensi sebagai tenaga kerja pada usaha pariwisata. Dengan demikian, diperlukan revisi terhadap UU Nomor 10 Tahun 2009 serta dukungan pemerintah daerah dalam menjamin hak prioritas melalui penataan kawasan dan pengembangan community based tourism

Indonesia is the highest producer of coconut in the world. One of the cities in Indonesia which is the central producer of coconut is Tidore Islands, North Maluku. Tidore Islands is a city in the east part of Indonesia located in the province of North Maluku. Tidore Islands has many products made of coconut tree parts as raw materials. The products are varied from food products to non-food products. This research was a descriptive study to discover the variety of coconut products produced in the Tidore Islands as basic data to develop an integrated coconut industry in the Tidore Islands. The research was conducted in 4 sub-districts that had >40 ton/year production of coconut. The result showed that black copra was the main product of coconut widely produced by people in the Tidore Islands. Other food products were white copra, coconut oil, and VCO. Non-food products widely produced by people in Tidore Island were coconut shell charcoal, coconut fiber, broomstick, and liquid smoke.

The objective of land registration is to obtain law warranty and law protection for the holder of land right. Since UUPA and its regulations are written, the objective is not actually realized. It is evident when it is seen from the technical aspect of land registration. Some procedures and data used by the official may not be well elaborated. The government which is given responsibility for land registration has not certified the land. IN other hand, the land owners with limited economic capability do not have ability to register their land. Many lands are without certification, and as consequence, the law fails to cover the law warranty and law protection to the citizen.

This study aims to analyze the legal position of the broker (broker) as an intermediary trader in the binding agreement for the sale and purchase of land in Indonesia, as well as the legal implications of the actions of the land broker in the binding sale and purchase agreement (PPJB) which resulted in the occurrence of defect of will(wilsgebreken/ defect of consent). This type of research uses the normative type, normative legal research is a process to find the rule of law, legal principles, and legal doctrines in order to answer the legal issues faced. The results of this study indicate that legal position of a broker (broker) as an intermediary trader in a binding agreement for the sale and purchase of land in Indonesia in the KUHD arrangement is classified based on an official broker and an unofficial broker. Related official brokers have been regulated in the provision of Article 62 of the KUHD that he must obtain an official appointment fromrequired state officials. Meanwhile, unofficial brokers through the provisions of Article 63 of the KUHD do not grant a monopoly position to brokers, in fact there is an article that allows the existence of unofficial brokers, namely without an appointment from the Minister of Justice and without an oath, namely Article 63 of the KUHD bsd 1792 of the KUHPER. In this case, this unofficial broker is seen as a normal power holder

Effectiveness of cooperative institutions (LKS) bipartite in an effort to prevent industrial relations disputes in companies in Ternate City,The purpose of this research is to examineThe role of bipartite cooperation institutions (LKS) in the prevention of industrial relations disputes in companies, as well as the effectiveness of the establishment of bipartite cooperation institutions (LKS) in companies in Ternate City.The research method used is qualitative with a case study approach and data is collected through in-depth interviews with employers, workers/labourers, trade unions/labor unions and Industrial Relations Mediator Employees both in the regions and at the Ministry of Manpower. Some of the findings obtained from this study indicate thatIn the provisions of labor legislation, a bipartite work forum will refer to a communication and consultation forum to make careful considerations on matters relating to industrial relations in a company, where the members consist of employers/entrepreneurs and workers/laborers. or representatives of Workers/Labourers' organizations.

Children are a mandate in the hands of their parents and a clean heart is a very valuable gem. The presence of children in a family is a complement to the happiness of a marriage. Among the legal consequences of breaking up a marriage is the issue of children, because after the divorce of both parents, their rights will not be reduced to get all their needs. Formulation of the Problem What are the legal consequences for a father who does not carry out the judge's decision on the obligation to support children after divorce, How is the problem with submitting the decision of the Religious Court judge regarding the obligation to support the child after the divorce and What is the ideal concept of completing the execution of the decision of the Religious Court which is not carried out by the parents? (father) regarding his obligation to support children after divorce. The approach method used in this study is normative, with primary and secondary data approaches. The impact of the father's obligation not to carry out the court's decision Article 16 PP No. 53 of 2010. The obligation to give part of the salary to the ex. Decree of the Head of BKN No: K.26-30/V.99-6/99 Regarding the explanation of the obligation to give part of the salary to ex-wife and children. The problem of delivering the decision of the judge of the religious court regarding the obligation to support children in divorce includes the problem of the execution of the obligation to provide for the father for the maintenance of the child after the divorce. The petitioner for execution does not know what property the respondent owns. The father is unable to carry out the decision regarding the obligation to support the child on the grounds that he does not have property. The ideal concept of settlement includes Efforts in carrying out the execution of child support, guaranteeing husband's property, execution costs charged to the respondent.

Setiap tahunnya Bupati Kabupaten Pulau Morotai selalu membuat laporan pertanggungjawaban yang dituangkan melalui LKPJ, laporan tersebut didapat dari berbagai bentuk kegiatan tiap organisasi perangkat daerah (OPD) yang telah dilaksanakan, akan tetapi dalam pembuatan laporan di tiap-tiap OPD masih menggunakan system yang belum terkomputerisasi. Tidak semua instansi pemerintah menggunakan komputerisasi dalam pengolahan data, melainkan masih banyak instansi pemerintah menerapkan sistem manual, hal ini tentunya menjadi penghambat jalannya aktivitas yang mestinya dapat terselesaikan dengan cepat menjadi lambat dan tidak akurat. Tujuan dari penelitian ini adalah merancang sistem dashboard statistik untuk membantu proses penyajian laporan yang lebih dinamis dan relevan sehingga informasi yang diperoleh lebih informatif. Metode pengembangan perangkat lunak yang digunakan adalah metode SDLC dengan metode SDLC (Software Development Life Cycle), yang dimulai dengan tahapan analisa kebutuhan data, perancangan dan desain perangkat lunak, pembuatan aplikasi (programming) dan uji coba aplikasi sebelum diimplementasikan kepada pemerintah daerah. Hasil yang diperoleh dalam penelitian ini adalah sebuah aplikasi dashboard statistik yang dapat membantu menunjang proses penyampaian laporan kepala daerah kepada pemerintah pusat, DPRD dan masyarakat.

Penelitian ini bertujuan untuk mengetahui akibat hukum pengembalian tanah dan bangunan rumah obyek yang telah dihibahkan terhadap pembatalan hibah tanah. Studi kasus Putusan Nomor 472/Pdt.G/2019/PA.Tte. Penelitian ini menggunakan jenis penelitian hukum empiris yaitu penelitian tentang bekerjanya hukum (law in action) di masyarakat. Penelitian dilakukan di Kelurahan Mangga Dua Utara, Kota Ternate Selatan, Provinsi Maluku Utara. Data penelitian dianalisis secara deskriktif kualitatif. Hasil penelitian menunjukkan bahwa akibat hukum pengembalian tanah dan bangunan rumah objek yang telah dihibahkan dinyatakan sebagai kebatalan relatif. Perbuatan hukum yang dapat dibatalkan, dimana keadaannya disahkan dalam perbuatan hukum yang digantungkan pada kemauan salah satu pihak. Artinya, akibat hukum dapat timbul kepada penerima hibah jika dimohonkan batalnya pada pengadilan untuk memperoleh putusan yang berketetapan hukum tetap, dimana seluruh harta hibah yang telah diberikan terhadap setiap penerima hibah akan kembali menjadi milik sendiri pemberi hibah secara keseluruhan. Pembatalan hibah tanah sebagaimana Putusan Nomor 472/Pdt.G/2019/Pa.Tte pemberi hibah memiliki beberapa hak. Pemberi hibah juga dapat menarik kembali pemberiannya, jika penerima hibah tidak memenuhi kewajiban yang ditentukan dalam akta hibah atau hal-hal lain.
