Abstract

This study aims to analyze the existence of customary land law of the sultanate of Ternate before and after the Supreme Court Decision Number 57K/PDT/2017. Meanwhile, legal efforts to resolve customary land disputes of the Sultanate of Ternate after the enactment of Supreme Court Decision Number 57K/PDT/2017 provide benefits to the Regional Government or customary law communities. This type of research uses Empirical Juridical research, that is, this research in addition to using scientific methods also sees the reality in the field. Especially regarding the Legal Existence of Customary Land of the Sultanate of Ternate After the Supreme Court Decision Number 57k/Pdt/2017. Empirical Legal Research or field research is a method to obtain data directly from the Sultanate of Ternate as well as from the family of the Sultanate of Ternate and related Regional Governments. The results showed that the existence of customary land law of the sultanate of Ternate before and after the Supreme Court Decision Number 57K/PDT/2017. Prior to the enactment of Law Number 5 of 1960 concerning Land Principal (UUPA) and the Supreme Court Decision Number 57K/PDT/2017. Permanent rights consist of; Aha Kolano (sultan's right), Aha Soa (clan right), Aha Cocatu (individual right). Meanwhile, temporary rights consist of; Tolagumi Rights (Right to Avoid Bala), Safa Rights, Ruba Banga Rights (Demolishing Forests), and Jurame Rights, or one's right to a piece of land that has been cultivated. The polemic over land ownership at the location of the Jiko Malamo beach tourist attraction, West Ternate District emerged after the Supreme Court Decision Number 57K / PDT / 2017 over the Jiko Malamo land dispute lawsuit between Hamiru Haruna (Plaintiff) and Hamzah Kalepa (Defendant) has now become state-owned land. Settlement of Customary Land Disputes of the Sultanate of Ternate After the enactment of Supreme Court Decision Number 57K/PDT/2017 provides benefits to local governments, which should be on lands in the territory of the Sultanate of Ternate must first pay attention to the subject of these lands. Subjects who control the land according to swaparaja land law can be divided into 3 (three), namely the Sultan (Kolano), soa, and Individuals / legal entities. Lands controlled by individuals give civil authority to those who control them.

Abstract

Penilitian ini bertujuan untuk mengetahui ratio legis pembentukan bank tanah dalam system hukum tanah di Indonesia dan untuk mengetahui kedudukan bank tanah di Indonesia dalam pelaksanaan Retribusi tanah. Penelitian ini menggunakan metode penelitian hukum normatif. Pendekatan yag digunakan dalam penelitian ini adalah pendekatan perundang-undangan, pendekatan sejarah, dan pendekatan konseptual. Hasil penilitian ini menjunjukan bahwa kedudukan bank tanah dalam rangka retribusi tanah tidak menjamin kesejahteraan masyarakat secara umum, sebaliknya, hanya menguntungkan kepentingan para investor sebagai pemilik modal. Terjadi tumpang tindih aturan dan kewenangan, membuka peluang investasi, memperparah monopoli tanah. Selain itu, hadirnya bank tanah, secara tidak langsung pemerintah mengulang kembali atau mangadopsi asas domein verklaring dan menyelewengkan hak menguasai negara. Semangat dan cara kerja bank tanah ini melegalkan praktik-praktik tanah negara dipersempit jadi milik pemerintah.

Abstract

Permasalahan pengelolaan sampah menjadi tantangan serius di berbagai daerah, termasuk di Kota Tidore Kepulauan. Salah satu indikasinya adalah keterbatasan armada pengangkut sampah yang hanya melayani wilayah perkotaan, sementara desa-desa terabaikan. Penelitian ini adalah penelitian hukum empirik. Penelitian ini dilakukan di Kota Tidore Kepulauan, Provinsi Maluku Utara. Hasil penelitian menunjukkan bahwa pemenuhan hak konstitusional masyarakat Kota Tidore Kepulauan atas lingkungan yang baik dan sehat belum terpenuhi secara memadai. Hal ini disebabkan oleh pencemaran sampah yang tersebar di berbagai lingkungan. Lemahnya kesadaran masyarakat dalam pengelolaan sampah juga disebabkan oleh keterbatasan fasilitas, seperti tempat penampungan dan pengangkutan sampah. Akibatnya, masyarakat sering membuang sampah tidak sesuai dengan Standar Operasional Prosedur yang berlaku. Pemerintah telah melakukan upaya untuk mengatasi permasalahan sampah, termasuk melalui program Bank Sampah. Namun, implementasi program ini belum berjalan efektif karena keterbatasan fasilitas dan kurangnya penyadaran masyarakat. Selain itu, penerapan Peraturan Daerah tentang pengelolaan sampah belum dilakukan secara konsisten, sehingga target pengelolaan dan penanganan sampah yang direncanakan tidak berjalan optimal.

Abstract

This study examines the role and position of crime victims within Indonesia's criminal justice system, highlighting their marginalization and the limitations of the current framework. Victims are often relegated to the role of evidence providers, sidelining their rights and needs while exposing them to risks such as retaliatory actions and psychological trauma. The system's emphasis on punitive measures for offenders fails to adequately address the suffering of victims, perpetuating their exclusion from meaningful participation in justice processes. The research employs a normative legal method, drawing on statutory and conceptual approaches alongside legislative analyses and secondary data, to explore restorative justice as a viable solution. Restorative justice offers a balanced, inclusive model that involves victims, offenders, and their families in collaborative decision-making. This approach not only addresses victims’ needs and aspirations but also reflects Indonesia’s cultural values of kinship and social harmony. It emphasizes fairness by holding offenders accountable in a manner proportionate to their capacity, while promoting victim rehabilitation and community reconciliation. Findings demonstrate the potential of restorative justice to mitigate systemic challenges, enhance victim involvement, and create outcomes aligned with societal values. The novelty lies in advocating for restorative justice as a culturally congruent and legally viable alternative to the prevailing adversarial system. By prioritizing victim-centered justice, this approach fosters a more humane and effective criminal justice process, ensuring that justice serves all stakeholders equitably.Keywords: Criminal Justice System; Restorative Justice; Victims.

Abstract

This study explores legal issues surrounding the protection of customary land ownership through the implementation of agrarian reform in Ternate City. Existing legal frameworks, particularly the Basic Agrarian Law, remain insufficient in providing explicit recognition and legal protection for customary land that continues to exist without formal documentation. This research identifies areas of customary land in Ternate that have not been registered or recognized with formal ownership rights and examines the position of customary land ownership from the perspective of legal protection theory. The findings reveal that agrarian reform has had limited impact in securing customary land rights due to the absence of legal clarity and institutional support. Moreover, the National Land Agency's current policy strategies have not effectively integrated mechanisms to acknowledge and register customary land claims. The lack of harmonized regulations contributes to legal uncertainty and hinders the realization of equitable land rights. Therefore, this paper emphasizes the urgent need for a more comprehensive regulatory framework that ensures the legal recognition and protection of customary land within the agrarian reform agenda. This will contribute to stronger legal certainty, social justice, and the preservation of indigenous communities' land rights in Ternate City.

Abstract

This research explores the sustainable legal control and protection of Angus Stone (Batu Angus) utilization in Ternate City. Angus Stone is a unique geological formation with significant historical, cultural, and scientific value, recognized as part of the Geopark Protected Area and categorized as a national strategic asset. The study aims to analyze the legal mechanisms governing its management, covering planning, implementation, supervision, and monitoring, within the framework of sustainable development. Employing an empirical legal research method, this study focuses on Ternate City through purposive sampling interviews, field observations, documentation, and review of relevant legislation, supported by secondary data from scholarly sources. The findings indicate that current management is regulated by national legal provisions but lacks systematic implementation aligned with sustainable principles. Drawing from Gustav Radbruch’s theory of legal objectives, the research emphasizes the necessity for regulatory structures that are just, orderly, and transparent. These structures must prevent exploitative practices while respecting local wisdom and maximizing community benefits. The study recommends that a successful legal protection framework must incorporate sustainable planning, enforce management practices that align with sustainability standards, and ensure ongoing and effective supervision. Such a framework would not only preserve Angus Stone as a natural heritage but also contribute to the economic, social, and cultural development of Ternate City .

Abstract

The article attempts to look at the location and role of victims of crime in the criminal justice system and how the system is manipulated to corner the victims and offer solutions to the victims' problems. The Indonesian criminal justice system places the position of criminal victims as no more than those who assist law enforcement in uncovering crimes. The obstacle that the victim encounters in the criminal justice system is that the victim is only used as an object of evidence alone, not to mention if there is a blacklash from the perpetrator to the perpetrator who goes to jail only for penance. The application of restorative justice is one of the best solutions to how the criminal justice system is run. Involving victims and perpetrators and their families in a balanced and fair way as well as meeting the needs of the victims adapted to the perpetrators' ability to be responsible reflects the kinship character of the kinship culture of the Indonesian people.

Abstract

The Constitutional Court and the Supreme Court of the Republic of Indonesia are the two high state institutions that possess judicial authority; they are both independent of other bodies of government. The Supreme Court, in particular, has two main types of human resources—judge (hakim) and Registrar (Panitera). Despite the fact that registrar and judge job descriptions are clearly different according to regulations, career paths indicate otherwise—while a judge can serve as a registrar at the Supreme Court level, a registrar cannot. This study examines career development inconsistencies in Indonesia’s judicial system, focusing on the dual roles of judges and registrars. Using a literature review approach, this paper highlights regulatory ambiguities and the urgent need for policy reform to address career progression challenges within the Supreme Court. This highlights the formation of a case that needs to be further explored by using a case study approach to unveil factors leading to this situation.

Abstract

Land acquisation by the community of adat law tends to leave out. This condition caused by the government policy before which has no attention to the development of land acquisition of the adat community. According that policy, all land are owned by the State, especially when its issue is about the government and bussiness interest. Reformation has changed the State system related to land acquisition, where the position of adat law community is diclared explicitly in the State constitution. The position of adat law community is agreed as long as not contradicted wiht public interest. The tale of seeking the existency of adat law community and the right of adat land acquisition shows that acquisition, mechanism and the area of adat law community still exist and have different characteristic between one and another. So that, State and the government should give protection and agreement to the right of adat law community as well as local wisdom as stated in its constitution. Key words: Land acquisation, right of adat community, adat law
