Abstract

Abstract

Abstract. One of the roles of the Capital Market in Indonesia is as a vehicle for investment for the community. The public, which in this case are investors, can channel their funds to securities traded in the Capital Market, one of which is bonds with the type of medium-term bonds or MediumTerm Notes (MTN). In fact, investing in bonds in the Capital Market is not only profitable for investors, but is also faced with the risk of loss, including because of the PKPU decision filed by a third party against the issuer, which then results in the non-fulfillment of investors' rights. This study examines the fulfillment of investors' rights in investing in bonds in the Capital Market, where the fulfillment of these rights is constrained because the issuer of bonds received a PKPU decision requested by a third party. This study uses a normative juridical approach with qualitative descriptive-analytical specifications. The results show that the rights of investors in investing in MTN bonds according to the trusteeship contract as outlined in the bond issuance prospectus are to get payment of principal and bonds payable, but in fact investors do not get the right to payment of principal and interest of the 6 bonds because of the PKPU decision to issuers.

Abstract

Indonesia has issued a fisheries subsidy policy to encourage the development of the fishing industry because this sector contributes to national development, but the subsidies applied must be in accordance with the provisions stipulated in the WTO. Indonesia is a member of the WTO and in the last few meetings held by the WTO in which the WTO prohibits subsidies, besides that fisheries subsidies can cause depletion of fish stocks and damage to marine biota. This is not in line with the UN program, namely Sustainable Development related to sustainable fisheries, so the implementation of fisheries subsidy policies can cause problems. the 12th WTO ministerial conference, a draft was drafted, but until now the draft has not been ratified, the draft fisheries subsidies at the WTO specifically regulate fisheries subsidies that are prohibited and exceptions in general. the 13th Ministerial Conference 2024 has not yet concluded negotiations on agricultural and fisheries subsidy issues, which remain key concerns for the conference organizers. Trade or Economic Ministers of the WTO engaged in negotiations are aware of the significant differences in positions among member states, necessitating further time for additional negotiations to be continued by permanent delegations in Geneva. The impact of the draft WTO fisheries subsidy, if successfully ratified, will have a negative impact on Indonesia in terms of the fishery market, fishery resources and employment.

Abstract. Music plays an important role in modern society, especially for young people as a medium of expression and entertainment. Music concerts are one form of entertainment that is in demand because it provides a direct experience. Health is one of the constitutional rights protected by law. The importance of health in everyday life makes many people hope to get a cure when they see a doctor. Patient expectations that differ from the results obtained sometimes lead to medical disputes. Conflicts that occur between doctors and patients if they cannot be resolved by mediation usually the patient or the patient's family will report to the authorities. Some law enforcers, in this case the police, still use the Criminal Code or Civil Code as the basis for charges without looking at other more specialised laws such as the Medical Practices Act (UUPK). The purpose of this thesis is to find out the procedures for legal protection for doctors in medical disputes and also to find out the application of the Lex Specialist principle of Article 79 letter (C) of the GCPL in relation to the lex generalis principle of the Civil Code in resolving medical disputes for doctors. Abstract

Purpose: This study examines the implementation of Gross Split Production Sharing Contracts (PSCs) in Indonesia’s upstream oil and gas sector, with particular attention to whether the allocation of rights, obligations, and risks reflects the principles of balance and fairness in contract law. Research/methodology: The research adopts a normative juridical approach using qualitative analysis. Secondary legal materials are analyzed, including oil and gas legislation, government and ministerial regulations, and the contractual provisions of Gross Split PSCs. The analysis focuses on contractors’ obligations related to signature bonuses, firm commitments, and operating costs. Results: The findings indicate that Gross Split PSCs place excessive financial, operational, and technological burdens on contractors, while the government bears minimal risk. Contractors are fully responsible for signature bonuses, firm commitments, and operating costs without cost recovery mechanisms. This contractual structure creates an imbalance of rights and obligations and contributes to contractors’ difficulties in fulfilling firm commitments and achieving agreed production targets. Conclusions: Gross Split PSCs, as currently regulated, do not adequately uphold the principles of balance and fairness. The unequal distribution of risks and obligations undermines contractual justice and the sustainability of upstream oil and gas operations. Limitations: This study is limited to normative legal analysis and does not include empirical field data. Contribution: This research provides theoretical insight into the application of balance and fairness principles in energy contracts and offers practical considerations for improving the Gross Split PSC framework.
