Abstract

The Law of the Republic of Indonesia authorizes Aceh to implement shari’a law in various sectors, including jināyāt (Islamic criminal law). This additional authority is different from the authority of the Religious Courts (Pengadilan Agama) in other provinces in Indonesia. This article analyzes the process of handling children in criminal cases in the Aceh’s Shari’a Courts in Aceh using the lex specialis derogate legi generalis and the systematic lex specialis principles. The data in this study comes from legal documents and interviews with Shari’a Court judges. The results show that the handling of Islamic criminal offenses involving children has been carried out by referring to existing laws and regulations according to the principle of specificity. However, some issues arise related to human resources and appropriate facilities. Most of the judges have not obtained special training in handling children’s cases, which influenced their knowledge on the issue. Moreover, children involving in legal cases are still treated using similar facilities as adults. These weaknesses, however, can be appropriately resolved by the Shari’a Courts and the Aceh Government. Abstrak:Undang-Undang Republik Indonesia memberikan kewenangan kepada Aceh untuk menerapkan syariat Islam di berbagai bidang, termasuk jināyāt (hukum pidana Islam). Pemerintah Aceh mengeluarkan qanun (Peraturan Daerah) yang mencakup beberapa jarīmah (perbuatan pidana) dan pelaksanaannya menjadi kewenangan Pengadilan Syariah (Mahkamah Syar’iyyah) di Aceh. Kewenangan tambahan ini berbeda dengan kewenangan Peradilan Agama di provinsi lain di Indonesia. Hakim-hakim di pengadilan-pengadilan tersebut tidak mendapatkan pendidikan khusus dalam hukum pidana, terutama kasus-kasus yang melibatkan anak-anak yang telah diatur dalam undang-undang khusus. Kewenangan tambahan dalam memeriksa dan mengadili perkara pidana di Mahkamah Syariah menimbulkan persoalan Sumber Daya Manusia (SDM) baru. Artikel ini menganalisis proses penanganan anak di Pengadilan Syariah di Aceh dengan menggunakan prinsip lex specialis derogate legi generalis dan systematic lex specialis. Hasil penelitian menunjukkan bahwa penanganan tindak pidana Islam yang melibatkan anak telah dilakukan dengan mengacu pada peraturan perundang-undangan yang ada sesuai dengan asas kekhususan. Beberapa kelemahan sumber daya manusia dan infrastruktur dapat diselesaikan dengan baik oleh Pengadilan Syariah dan Pemerintah Aceh.

Abstract

This study aims to assess and elucidate the influence of polygamy on domestic violence as reflected in the Sharia Court rulings in Aceh, as well as the viability of polygamy as a justification for granting divorce petitions. The study of this topic is significant since Islam essentially allows polygamy, provided that men can behave justly. The divorce ruling at the Sharia Court in Aceh revealed that polygamy led to the neglect of women and other forms of domestic violence. Unfortunately, Indonesian laws and regulations do not acknowledge polygamy as a valid ground for women to petition for divorce. The study is normative juridical review in nature. The data source is a judicial ruling. The data is examined under a women's protection framework. The findings indicate that the wife initiated divorce proceedings against her husband for practicing polygamy, which contravened Indonesian marital law and the Compilation of the Islamic Law, namely polygamy conducted without the wife's consent. Furthermore, polygamy often leads to domestic abuse against the wife. Polygamy can be categorized as irresponsible when practiced by a husband lacking steady economic resources, resulting in the neglect of women and their children. This polygamy is likewise deemed a contravention of the rules of marriage in the Islamic jurisprudence. At the present time, polygamy is not recognized as the reason for divorce in the Indonesian law. This study advocates for the inclusion of polygamy without consent as a legal ground for divorce, as the current legislation recognizes only physical domestic violence as a valid justification for divorce.

Abstract

Setelah menikah, isteri diperintahkan untuk patuh kepada perintah suaminya. Isteri yang tidak mau patuh kepada perintah suami dianggap berbuat “nusyuz” (durhaka kepada suami). Dalam kitab fikih makna ini dianggap tunggal. Namun, karena dinamika sosial yang terjadi di tengah-tengah masyarakat Aceh, makna tersebut turut mengalami perubahan, yaitu perbuatan nusyuz dapat pula dilakukan oleh suami terhadap isterinya. Atas dasar ini, yang menjadi tujuan pembahasan dalam tulisan ini adalah penjelasan makna nusyuz dalam masyarakat Aceh dan dampaknya terhadap pelakuan KDRT dalam keluarga. Penelitian ini merupakan penelitian kualitatif, sumber data diperoleh dari tokoh agama, tokoh masyarakat, dan masyarakat umum. Teknik pengumpulan data dilakukan dengan wawancara mendalam. Selanjutnya, data dianalisis dengan teori perubahan hukum karena perubahan waktu dan tempat. Hasil penelitian menunjukkan bahwa di kalangan masyarakat terdapat tiga kategori makna nusyuz. Pertama, nusyuz adalah durhaka yang dilakukan oleh suami atau isteri kepada pasangannya. Kedua, nusyuz adalah sikap tidak patuh yang dilakukan oleh isteri terhadap suaminya. Ketiga, tidak mengetahui istilah nusyuz, namun hanya mengetahui bahwa isteri wajib mematuhi semua perintah isteri. Terbentuknya pemaknaan nusyuz dalam masyarakat bersumber dari pendidikan yang didapatkan. Selanjutnya, pemaknaan konsep ini memberikan dampak yang besar terhadap munculnya sikap sewenang-wenang atau kekerasan dalam rumah tangga yang menjadikan isteri sebagai korban.

Abstract

Fisheries zakat is zakat imposed on the results of the fishery business, both obtained through cultivation and fishing, and paid at harvest time. This zakat must be paid if the harvest reaches nisab equivalent to 85 grams of gold. Most of the medium-to-upper scale fishery entrepreneurs have the potential to achieve nisab zakat. However, there are still fishery entrepreneurs who do not pay zakat. This study aims to analyze the ability of fishery entrepreneurs in Banda Aceh City to pay zakat based on income from fish catches. And analyze aspects of fulfilling indicators of legal compliance of fisheries entrepreneurs in paying zakat. This research is an empirical legal research using a qualitative approach. The research data was analyzed by descriptive-analysis method. The results of the study show that fishery entrepreneurs in the city of Banda Aceh have fulfilled the nisab of income zakat. Indicators of legal compliance in paying zakat fulfilled by fishery entrepreneurs are indicators of trust and acceptance. Where fish entrepreneurs believe and accept the existence of zakat obligations. In general, fisheries entrepreneurs in Banda Aceh City are categorized as non-compliant with the law in fulfilling their zakat obligations. The contribution of this research is that it can be a reference for the formulation of strategic policies in increasing zakat compliance through more effective educational, regulatory, and institutional approaches.

Abstract

The formulation of oil and gas Production Sharing Contracts (PSCs) in Aceh differs greatly from those in other regions of Indonesia. This process shall adhere to the Government Regulation No. 23 of 2015 on the Joint Management of Oil and Gas Natural Resources in Aceh, as the legal foundation for the Aceh Government’s authority in managing these resources. Accordingly, the Aceh Government shall be involved in the drafting, amendment, and termination of the PSCs, which also includes issues related to data management, payment of signature and production bonuses, audits, transfer of participating interests, involvement of Aceh-owned enterprises, and determination of CSR funds. However, there is only one oil and gas PSC in the Pase Block, signed between the Aceh Regional Development Company and Triangle Pase Inc. on May 22, 2015. This study explored the implementation of the PSC in the context of foreign investment in the upstream oil and gas sector in Aceh. Employing a normative juridical method, the study collected data by means of interviews and literature reviews, and analyzed the data based on oil and gas regulatory frameworks. The findings revealed that the implementation of the PSC indicated several contractual obligations that were not fulfilled or were violated by Triangle Pase Inc., causing financial losses to the Aceh Regional Development Company. As a result of these violations, the Aceh Regional Development Company filed a legal claim through the Indonesian National Arbitration Board, whose decision was to reject all of the Company’s claims and to require it to pay arbitration costs. Therefore, the Aceh Regional Development Company promptly filed for the annulment of the decision issued by the Indonesian National Arbitration Board.

Abstract

Every child has the fundamental right to protection, which includes having a guardian. If the child's parents are still alive, they are automatically considered the guardians. But in certain cases where this is not possible, a court will assign another person or a governmental institution to act as the child's guardian. The laws and regulations surrounding guardianship in Indonesia are often inconsistent. This study aims to clarify the age requirements for children in need of a guardian, the procedures for appointing a guardian, as well as the duties and responsibilities of guardians according to Indonesian laws. The research also highlights areas for improvement. To achieve this, a statutory approach is adopted, with legal regulations in Indonesia on children and guardianship as the primary source of data. The findings reveal that the age requirements for children to have a guardian range from 16 to 19 years. Additionally, a court order is required for the appointment of a guardian to ensure legal validity. Additionally, the selection of a guardian needs to go through a court ruling in order to ensure legal clarity. The regulations differ from one to another, and in the process, there have been no affirmative efforts taken to expedite the process of appointing a guardian, which has the impact of children not being protected from the start. Affirmation efforts can be carried out through the involvement of village government officials and the subdistrict Religious Affairs Office for those who are Muslim. Then, regarding the duties and responsibilities of guardians, there are still differences either the guardian’s obligation to fulfil a child’s physical and spiritual needs or maintain the child’s assets. These provisions need to be combined to provide comprehensive protection for children from various aspects

Abstract

The practice of inheritance distribution in the Gayo community should align with the Fiqh Mawārit, but in reality, it has not fully adhered to it. There are still deviations found in the practice of inheritance distribution, such as the belief among some community members that juelen and angkap marriages can obstruct or reduce a person's share. Given these issues, the author is interested in examining the legality of Gayo customary inheritance from the perspective of Islamic law. To address this issue, a qualitative research approach is needed, with data obtained through interviews, observations, and documentation, analyzed using social interaction theory, cultural theory, Fiqh Mawārit theory, and Maqāshid al-Syari’ah. The research results indicate that the distribution of customary inheritance in Gayo is based on the type of marriage practiced in the community. Some aspects of Gayo customary inheritance are relevant to Islamic law, while others are practiced in a deviant manner.
